<section id="HC4D6811A9057411CB37659513B438980" section-type="section-one"><enum>1.</enum><header>Compassionate release for public health emergencies</header> 
<subsection id="H39201179935B4B24AB8A68D053E4CF9F"><enum>(a)</enum><header>In general</header><text>Section 3622 of title 18, United States Code, is amended—</text> <paragraph id="H4719CF8A472241BF991891F12E2D1F80"><enum>(1)</enum><text>in the matter preceding subsection (a), by inserting <quote>or the sentencing court</quote> after <quote>The Bureau of Prisons</quote>; </text></paragraph> 
<paragraph id="HFECA69F8B3CB4A6098A9DACBD3B56C90"><enum>(2)</enum><text>in subsection (b), by striking <quote>or</quote> at the end; </text></paragraph> <paragraph id="HCC645046FCD8497B868C35CF4FDEBAF0"><enum>(3)</enum><text>in subsection (c), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HE85CE2190D7E4EF6878E1F73CD891F8E"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H5C3D2861E9B549478210C0D8A138E9F1"> <subsection id="HB249262419414749964A31BB9B2E9B60"><enum>(d)</enum><text display-inline="yes-display-inline">in the event of a public health emergency and if the Bureau or the sentencing court, as the case may be, determines that there exists a substantial, imminent health risk to the prisoner, other prisoners, or Bureau employees, reside in the community under the supervision of the Office of Probation and Pretrial Services for the judicial district in which the community is located. </text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBE021962797149DBB01000F20F5BE839"><enum>(b)</enum><header>Compassionate release petition</header><text>Section 3582 of title 18, United States Code, is amended—</text> <paragraph id="H03DFCDAC1BCD408584BBDB70AE8A0661"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1)(A), in the matter preceding clause (i) by inserting <quote>or, during a public health emergency (as defined in section 3627), upon motion of the defendant prior to exhaustion of all administrative appeals or the lapse of 30-days,</quote> after <quote>whichever is earlier,</quote>; and</text></paragraph> 
<paragraph id="H3D8E6797D7AC4F73B06E239CABFD856A"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="USC" id="H796E27A96FCF42C88C28A49120DCC8F1" display-inline="no-display-inline"> <subsection id="H8F4C686A79CA4700BB544935F039CEC2" commented="no"><enum>(f)</enum><header>Procedures during a public health emergency</header> <paragraph id="H03AF64C4BE3B461196358319361A64B6" commented="no"><enum>(1)</enum><header>Prompt release of medical records</header><text display-inline="yes-display-inline">If the defendant’s attorney submits a declaration to the Bureau of Prisons under penalty of perjury that counsel is seeking records to file a motion described in subsection (c)(1)(A) during a public health emergency, the Bureau of Prisons shall promptly release all medical records from the year preceding the declaration to the defendant’s attorney.</text></paragraph> 
<paragraph id="H11B2ABDED8CA456F9C2C35948DDB49E9" commented="no"><enum>(2)</enum><header>Expedited procedures</header><text>The court shall expedite, to the extent practicable, ruling on motions filed under subsection (c)(1)(A) during a public health emergency. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4362B7F2EDAB42849DD762058926CE2B"><enum>(d)</enum><header>Definition of public health emergency</header><text display-inline="yes-display-inline">Subchapter C of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">chapter 229</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H8040940BC94F452DB43BEC8C7EAC6100"> 
<section id="HBF2CF4D4A80C4285B5024F516D25A8F5"><enum>3627.</enum><header>Definition of public health emergency</header><text display-inline="no-display-inline">In this subchapter, the term <term>public health emergency</term>—</text> <paragraph id="HD610F51FF95E477BAF1BED3FCEED3261"><enum>(1)</enum><text display-inline="yes-display-inline">means—</text> 
<subparagraph id="HB712A91FCD704D4C913B7F441E6D6D4C"><enum>(A)</enum><text> a public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); or</text></subparagraph> <subparagraph id="HDC2B401404D64F2FB8D09A453276D498"><enum>(B)</enum><text>a public health emergency declared by the Governor of a State or territory in which a Bureau of Prisons facility is located; and</text></subparagraph></paragraph> 
<paragraph id="H01AEAD11315949B3AE9A087B30070584"><enum>(2)</enum><text>includes the public health emergency declared by the Secretary of Health and Human Services on January 31, 2020, in response to COVID–19.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4377505EB3A44029B0C43F66FAB34529"><enum>(e)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter C of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">chapter 229</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
