<section id="H70D7C40B4BDD4095992CDB8077DD1C56" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminate the Digital Divide Act of 2021</short-title></quote>.</text></section> <section id="HAFF9B1EBF08C489796E0744453DF64DC"><enum>2.</enum><header>Expansion of broadband access in unserved areas</header> <subsection id="H5D3D9EC870EE4E3CBA313029D65E8C86"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended— </text>
<paragraph id="H2B2CB2D68ED445E685C4248EE2583383"><enum>(1)</enum><text display-inline="yes-display-inline">in title I (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H491D20F06FCA4BB38C8B2DC0FAC4C9B5"> <section id="HB4056733220A40618EEB38C52572587B"><enum>14.</enum><header>Expansion and adoption of broadband service through State funding</header> <subsection id="H0CB6CFCC07B24ED39B4D08264A2398ED"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H724895CE67B24C57AE38C9447B9179F0"><enum>(1)</enum><header>Broadband funding partner</header><text>The term <term>broadband funding partner</term> means an eligible entity that receives funding for a project under this section.</text></paragraph> <paragraph id="HE5B95D94C47F4E8EB21C64F8A636E008"><enum>(2)</enum><header>Broadband service</header><text>The term <term>broadband service</term>—</text>
<subparagraph id="HA8DDF3A718A043288135356923792822"><enum>(A)</enum><text>means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service;</text></subparagraph> <subparagraph id="H4ED9D9E2B79D45A18E65926040F4A2B7"><enum>(B)</enum><text>includes any service that is a functional equivalent of the service described in subparagraph (A); and</text></subparagraph>
<subparagraph id="H780D5A4978A04F9C9A64948572D06C45"><enum>(C)</enum><text>does not include dial-up internet access service.</text></subparagraph></paragraph> <paragraph id="H8AAA7EC351EE41E79612C162A3F14CA8"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a private provider of broadband service, or a public-private partnership or cooperative (including a subsidiary of a cooperative) that provides broadband service, that has submitted to the Commission, in addition to any data required to be submitted under section 802, data regarding the service option described in subsection (f)(2) that the entity would offer if the entity were to receive funding under this section.</text></paragraph>
<paragraph id="HBE048F1886724BD9931A094A39C567A7"><enum>(4)</enum><header>High cost area</header><text>The term <term>high cost area</term> means an unserved area in which the cost of building out broadband service is higher, as compared with the average such cost in the United States (and as determined by the Commission), because of—</text> <subparagraph id="HAE48EFB307314A90BA065D783538B2E3"><enum>(A)</enum><text>the remote location of the area;</text></subparagraph>
<subparagraph id="H2F6150D168E441C8BCC4D1CC4E98B8C9"><enum>(B)</enum><text>the population density of the area;</text></subparagraph> <subparagraph id="HE42CF887E076489298F0D1AE5C6CED3E"><enum>(C)</enum><text>the unique topography of the area;</text></subparagraph>
<subparagraph id="H8C01F91EE257467BB9686563B9F24AE6"><enum>(D)</enum><text>a high rate of poverty in the area; or</text></subparagraph> <subparagraph id="HBF4EA9224F994B1E859B1B75DC3F60F1"><enum>(E)</enum><text>any other factor that contributes to the cost of building out that service.</text></subparagraph></paragraph>
<paragraph id="H12EEC56E32574688947EE3CCEAD7D747"><enum>(5)</enum><header>Location</header><text>The term <term>location</term> has the meaning given the term by the Commission under rules and guidance that are in effect, as of the date of enactment of this section.</text></paragraph> <paragraph id="H9DD908C4005E4E3BBC5CF7E848E9E7A2"><enum>(6)</enum><header>Project</header><text>The term <term>project</term> means an undertaking by a broadband funding partner under this section to construct and deploy infrastructure for the provision of broadband service.</text></paragraph>
<paragraph id="HC6259B3C89C3450BA9758FAEDE0EA098"><enum>(7)</enum><header>Unserved area</header><text>The term <term>unserved area</term> means an area that—</text> <subparagraph id="H043180CD18434D34B75EF682ED1D3E9F"><enum>(A)</enum><text>is of a standard size, as established by the Commission; and</text></subparagraph>
<subparagraph id="HA4E9C141DBB841DAA29BE6DEA091D8C7"><enum>(B)</enum><text>as determined in accordance with the maps created under section 802(c)(1)—</text> <clause id="H2F91F6C6E2B340E6A5C050F0ADC9CFEB"><enum>(i)</enum><text>has no access to broadband service; or</text></clause>
<clause id="H0E71EC1CD08B4AD48394621F900D669D"><enum>(ii)</enum><text>does not have access to broadband service offered—</text> <subclause id="HA13295DCE946417C91667F0FB03C894C"><enum>(I)</enum><text>with a download speed of at least 25 megabits per second and an upload speed of at least 3 megabits per second; or</text></subclause>
<subclause id="H391570B1CE464388A6E28CB914D06E29"><enum>(II)</enum><text>with download and upload speeds that are established as benchmarks by the Commission after the date of enactment of this section.</text></subclause></clause></subparagraph></paragraph></subsection> <subsection id="H10326318ACC0490C8427A7C36C92C244"><enum>(b)</enum><header>Program established</header> <paragraph id="H305F85E8792E499EB1C8F47031C35FCA"><enum>(1)</enum><header>In general</header><text>Not later than 100 days after the date of enactment of this section, or the date on which the maps created under section 802(c)(1) are made public, whichever is later, the Commission shall establish a program for States to expand access to broadband service in unserved areas. </text></paragraph>
<paragraph id="H08DE48E82FE4432FA18656F65DEE5068"><enum>(2)</enum><header>Relationship to universal service</header><text>The program established under paragraph (1) shall be separate from any universal service program established under section 254.</text></paragraph></subsection> <subsection id="HE0C6ECA8184C44B9B57BB1627D7888C7"><enum>(c)</enum><header>State program requirements</header><text>A State seeking funding under the program established under subsection (b) shall create a program that—</text>
<paragraph id="H3CDB492A64884952BE8577D7917AEA40"><enum>(1)</enum><text>implements the requirements of this section;</text></paragraph> <paragraph id="H777D4EF30C4741969E7F6761583E2660"><enum>(2)</enum><text>does not favor the use of any particular technology or any particular eligible entity;</text></paragraph>
<paragraph id="H0715CE477A3E4B0BB9C17D0AB2CF86B8"><enum>(3)</enum><text>encourages all eligible entities, including small broadband providers, to participate in the program through streamlined regulatory requirements for all broadband funding partners;</text></paragraph> <paragraph id="H416181D23A374608B546D0770F78583C"><enum>(4)</enum><text>takes into account—</text>
<subparagraph id="H42498E379DFC411EA0ACC1FF97884803"><enum>(A)</enum><text>the size and scope of each unserved area, and the number of locations, proposed to be served by each project carried out using the funds; </text></subparagraph> <subparagraph id="H8B28B9E6220C41758F2972137F80C63C"><enum>(B)</enum><text>the speed of the broadband service provided by eligible entities seeking funding for projects under the program; and</text></subparagraph>
<subparagraph id="H1119A83BFF394BE789857F22D1A10C0A"><enum>(C)</enum><text>the ability of the eligible entities that would receive funding for projects under the program to complete the proposed deployment and provision of broadband service under those projects in the areas served by the projects;</text></subparagraph></paragraph> <paragraph id="H77BA49FF5637422C81A3ED72EB3A74B3"><enum>(5)</enum><text>may take into account—</text>
<subparagraph id="H2138427EC66A4760B09EFC71109EA6D7"><enum>(A)</enum><text>the size and proportion of the matching funds proposed to be committed by the eligible entities seeking funding for projects under the program, which may not be provided from any funds derived from government grants, loans, or subsidies; </text></subparagraph> <subparagraph id="H67B39FB33DCE4DFDAFEDBF049F7E16F8"><enum>(B)</enum><text>the speed with which the eligible entities seeking funding for projects under the program can complete the proposed deployment and provision of broadband service to households under those projects, which may include a review of the topographical effects on the areas being served those projects as a result of the technology to be deployed under those projects; and</text></subparagraph>
<subparagraph id="H0F77AB8886064D4F880282C31ED8A3F5"><enum>(C)</enum><text>whether an eligible entity seeking funding for a project under the program has the ability to leverage nearby or adjacent broadband service provided by the eligible entity to facilitate the deployment and provision of broadband service proposed under that project;</text></subparagraph></paragraph> <paragraph id="H4FE5E4C0010A4BB48870E2F0E6047D94"><enum>(6)</enum><text>establishes— </text>
<subparagraph id="H94EF2D994929456182B91AC1F6CA8F54"><enum>(A)</enum><text>periodic buildout milestones, reporting requirements, and certification by broadband funding partners; and</text></subparagraph> <subparagraph id="H6AB63BF608124D84A59CCB43E3B37B32"><enum>(B)</enum><text>a maximum buildout timeframe for a broadband funding partner of 3 years, beginning on the date on which funding is provided to the broadband funding partner to undertake a project, except that the State may extend that timeframe if the broadband funding partner establishes that the failure to complete the project within that timeframe is due to—</text>
<clause id="H53EB7E42580D4935A50FC2389F3AA957"><enum>(i)</enum><text>delays by third parties, including governmental entities, in providing necessary permits, approvals, or access to (or construction of) poles; or</text></clause> <clause id="H2CAC1C2C8CD548CC8296DA81D732DBE0"><enum>(ii)</enum><text>a State or federally declared disaster;</text></clause></subparagraph></paragraph>
<paragraph id="H52A6F3B7BA334698B5A39A12069840CA"><enum>(7)</enum><text>contains sufficient notice, transparency, accountability, and oversight measures to— </text> <subparagraph id="HE583833CBFBE45FA95EE93DF8D8AD603"><enum>(A)</enum><text>provide the public and broadband funding partners with notice of the funding provided under this section; and </text></subparagraph>
<subparagraph id="HA15DCB940C4647E6B67B76FA3A648E4A"><enum>(B)</enum><text>deter waste, fraud, and abuse of program funds;</text></subparagraph></paragraph> <paragraph id="HC421678FFA8A4C48BCDC26D677830DF7" commented="no"><enum>(8)</enum><text>establishes procedures for the recovery of funds, in whole or in part, from a broadband funding partner if the broadband funding partner— </text>
<subparagraph commented="no" id="HD271773ED0DC4FF49CE4D3A8144A10D4"><enum>(A)</enum><text>defaults or fails to comply with the buildout requirements established for the project with respect to which the funding relates; and</text></subparagraph> <subparagraph commented="no" id="H675F827534C941C39468B9CA42CD6126"><enum>(B)</enum><text>has not received an extension under paragraph (6)(B);</text></subparagraph></paragraph>
<paragraph id="HF4E9A298549148F09271AF9D3D27195D" commented="no"><enum>(9)</enum><text>establishes procedures for expedited approval for all necessary access to (or construction of) poles, State and local rights-of-way permits, or other approvals in the areas of the State served by projects under the program;</text></paragraph> <paragraph id="H019F35F016E44D18888F6CCEB8C22DCB" commented="no"><enum>(10)</enum><text>provides that broadband funding partners are not required to be designated as eligible telecommunications carriers under section 214(e);</text></paragraph>
<paragraph id="H429F5087E0E44FAA902587F9D905F4BE" commented="no"><enum>(11)</enum><text>provides that an eligible entity shall grant access to poles, ducts, conduits, and rights-of-way that the eligible entity owns or controls within the State at rates, terms, and conditions regulated by the Commission under, or the State consistent with, section 224 and the rules of the Commission, without regard to whether that section otherwise applies with respect to those items; and</text></paragraph> <paragraph id="HED3D76F2F42148FDBB3DF2B20A14ECB1" commented="no"><enum>(12)</enum><text>except as otherwise explicitly provided in this section, does not require, or include consideration of, the imposition of any new or additional regulatory obligations on broadband funding partners beyond those required under applicable law.</text></paragraph></subsection>
<subsection id="HCED3636C175546698B911D6C583ED89E"><enum>(d)</enum><header>Distribution of funds to States</header>
<paragraph id="H972054C8C7F04CBE916C2C422C476839"><enum>(1)</enum><header>Commission distributions</header>
<subparagraph id="HE0752B8198844F23B9F2873FFF020B61"><enum>(A)</enum><header>In general</header><text>Not later than 200 days after the date of enactment of this section, or the date on which the maps created under section 802(c)(1) are made public, whichever is later, the Commission, under the program established under subsection (b), and in accordance with the requirements of this section, shall, with respect to the amounts made available to carry out this section— </text> <clause id="H81BA520435FF4104A50D363146C57576"><enum>(i)</enum><text>reserve 10 percent of those amounts for distributions under subparagraph (B) to States that have established programs under subsection (c); and</text></clause>
<clause id="H234185B38EF14E31A706265EC87CB3F6"><enum>(ii)</enum><text>of the amounts not reserved under clause (i), make distributions under paragraph (2) to States that have established programs under subsection (c).</text></clause></subparagraph> <subparagraph id="H76F1BE1DF99D4A458305FB96F830A65D"><enum>(B)</enum><header>Distributions for high cost areas</header><text>The amount of a distribution to a State under this subparagraph shall be calculated as follows:</text>
<clause id="HE735C78D5C7940B0AA014F2754515385"><enum>(i)</enum><text>Divide the number of high cost areas in the State by the total number of high cost areas in the United States.</text></clause> <clause id="HA869210218744ED897CC6CC52E19EEA7"><enum>(ii)</enum><text>Multiply the quotient obtained under clause (i) by the total amount reserved under subparagraph (A)(i).</text></clause></subparagraph></paragraph>
<paragraph id="H891417C9998A448B8D827B0191AB2A7C"><enum>(2)</enum><header>Amount of distributions for project awards</header><text>The amount of a distribution to a State under paragraph (1) shall be calculated as follows:</text> <subparagraph id="H41A10012B3F1404A9C61E7FCE1C77DBF"><enum>(A)</enum><text>Divide the number of locations in unserved areas in the State by the total number of locations in unserved areas in the United States, as determined in accordance with the maps created under section 802(c)(1).</text></subparagraph>
<subparagraph id="HD51BCDE4E3764B989E8A00B3330FAB9F"><enum>(B)</enum><text>Multiply the quotient obtained under subparagraph (A) of this paragraph by the amount described in paragraph (1)(A)(ii). </text></subparagraph></paragraph> <paragraph id="H7821E96DA0A2412AAFA4B44EB7F0D748"><enum>(3)</enum><header>State entitlement</header><text>With respect to a State that has established a program under subsection (c), the State shall receive a distribution under both of paragraphs (1)(B) and (2) of this subsection.</text></paragraph></subsection>
<subsection id="HBC50D7191EB74338AAD74C5FF1A2590E"><enum>(e)</enum><header>State use of program funds</header>
<paragraph id="H684FD8DB12AF4F478852B014629F3B8A"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date on which a State receives funds under subsection (d), and subject to paragraph (2), the State shall make awards to eligible entities through the program established by the State under subsection (c).</text></paragraph> <paragraph id="HF5FC1BE5DB5A4CE280FA0AFE20227E3C"><enum>(2)</enum><header>Funds used solely for unserved areas</header><text>A State to which funds are distributed under subsection (d)—</text>
<subparagraph id="HAF6394ED7ECF4A57B4E8449CB010BF40"><enum>(A)</enum><text>may not— </text> <clause id="H07D04458DC3B40A186529DB0865B6FD5"><enum>(i)</enum><text>use any portion of those funds for a project in any area that is not an unserved area; or</text></clause>
<clause id="HBB73D8AD37A348318F171B2BE4408653"><enum>(ii)</enum><text>use more than 5 percent of those funds to administer the program established by the State under subsection (c); and</text></clause></subparagraph> <subparagraph id="H52033F633D48462CA7CC548076F3D26B"><enum>(B)</enum><text>shall—</text>
<clause id="HEA25AEFD4805424B91B52C97B5FE9ED1"><enum>(i)</enum><text>before making any awards described in paragraph (1), consult the maps created under section 802(c)(1), as updated through the resolution of any challenges brought under section 802(b)(5), to create a list of areas within the State that are unserved areas, which the State shall make publicly available;</text></clause> <clause id="H477B9920D9E843C7BAFE47090796C012"><enum>(ii)</enum><text>from the list created under clause (i), remove any area in the State that—</text>
<subclause id="H95B26755CE804C4EA543D3092539CBC0"><enum>(I)</enum><text>has been awarded funding— </text> <item id="H0F38E9B81ED84726B491EF4CA7E51FB1"><enum>(aa)</enum><text>in the Rural Digital Opportunity Fund Phase I auction provided for in the Report and Order in the matter of Rural Digital Opportunity Fund and Connect America Fund adopted by the Commission on January 30, 2020 (FCC 20–5); or</text></item>
<item id="H533507D60F314647977A327A6D36FB07"><enum>(bb)</enum><text>under subpart D of part 54 of title 47, Code of Federal Regulations, or any successor regulations;</text></item></subclause> <subclause id="H53358C751E33495199C286B07417FA15"><enum>(II)</enum><text>has been awarded funding through any Rural Utilities Service broadband funding program with a minimum speed commitment of 25 megabits per second for downloads and 3 megabits per second for uploads;</text></subclause>
<subclause id="H11E23026BB464636A7E51B2B2BC976EF"><enum>(III)</enum><text>has been awarded funding through any existing program established by the State with minimum speed commitments described in subclause (II); or</text></subclause> <subclause id="H11FA2C7C24684E07B211E376D866E58A"><enum>(IV)</enum><text>is the subject of an enforceable commitment by a broadband provider to serve the area with minimum speed commitments described in subclause (II), even if, in any such areas, the service is not yet available, provided that the broadband provider is meeting any applicable build-out deadlines; </text></subclause></clause>
<clause id="H5230767ACC75490DA1187AFA2A95AB44"><enum>(iii)</enum><text>establish a streamlined process that allows a broadband service provider, the State, or a unit of local government within the State not less than 30 days after the date on which the list created under clause (i), as updated under clause (ii), is made publicly available to bring a challenge regarding whether an area on that final list is an unserved area;</text></clause> <clause id="H15D6A01E359A4FF2980742C4544E6004"><enum>(iv)</enum><text>provide a written notice regarding how each challenge brought under clause (iii) was decided, including the reasons for that decision; </text></clause>
<clause id="HC89813CBDA724B5BB2CC4564A52C43EE"><enum>(v)</enum><text>update the list created under clause (i) to reflect the results of challenges brought under clause (iii);</text></clause> <clause id="H5852ED381A504EDAB74111EDAC744516"><enum>(vi)</enum><text>not later than 10 years after the date of enactment of this section, return any unused portion of those funds to the Commission; and </text></clause>
<clause id="HF6C5C437697841789105AB293D722ACB"><enum>(vii)</enum><text>not later than 2 years after the date on which the funds are distributed to the State, and biennially thereafter, submit to the Commission a report— </text> <subclause id="H5009410740F547CE82530CACBAF6A9EB"><enum>(I)</enum><text>regarding how the State spent those funds during the period covered by the report, which shall include a description of each award made with those funds; and</text></subclause>
<subclause id="HADAE9DFFFCC0416E9BB8CD95401AEAB8"><enum>(II)</enum><text>that contains a certification that the State has complied with the requirements of this section during the period covered by the report.</text></subclause></clause></subparagraph></paragraph></subsection> <subsection id="HBE6CD1461F9243518131E159EFCF26E7"><enum>(f)</enum><header>Project requirements</header><text>Any project funded through the program established under subsection (b) shall—</text>
<paragraph id="HF3C5272500884885BA009F65B49E12DB"><enum>(1)</enum><text>adhere to the same quality-of-service standards established by the Commission with respect to the Rural Digital Opportunity Fund set forth in subpart J of part 54 of title 47, Code of Federal Regulations (or any successor regulations); and</text></paragraph> <paragraph id="H6CFBF24E21F94DCBAF3B8C46303F2B35"><enum>(2)</enum><text>offer a low-cost broadband service option for low-income subscribers with eligibility for the service option determined by the applicable broadband funding partner.</text></paragraph></subsection>
<subsection id="H8CEF70BB51D0407BB420728C1D898866"><enum>(g)</enum><header>Promoting broadband deployment</header><text>Not later than 1 year after the date on which a State receives funding under this section, the State shall publish on a publicly available website of the State a report that analyzes the following:</text> <paragraph id="HFDEBF8C48F5D4C3E98ED3ABFF1ACF5F8"><enum>(1)</enum><text>The process by which the State, or any local authority within the State, acts on a new request to access poles, ducts, conduits, or rights-of-way, which shall include an analysis of— </text>
<subparagraph id="H954B01315A234262A1B9DABB913E946C"><enum>(A)</enum><text>the speed with which the State or local authority, as applicable, responds to such a request; and</text></subparagraph> <subparagraph id="HA40F3CB857BA4A54945CA3D83CE30D41"><enum>(B)</enum><text>the impact that granting such a request not later than 30 days after the date on which the request is submitted would have on the speed at which broadband service is deployed in the State.</text></subparagraph></paragraph>
<paragraph id="H2DE8DD8CB85949F2BB4378795BB00C9C"><enum>(2)</enum><text>The process by which the State, or any local authority within the State, acts on a nonemergency request for authorization to place, construct, or modify facilities with respect to broadband service that are supported through access to poles, ducts, conduits, or rights-of-way, which shall include an analysis of—</text> <subparagraph id="H9FF1E2E0546D41C5A02993F16F8ED8FB"><enum>(A)</enum><text>the speed with which the State or local authority, as applicable, responds to such a request; and</text></subparagraph>
<subparagraph id="H1D3DB908990C4D50BFF796FEDA03A9DA"><enum>(B)</enum><text>the impact that granting such a request not later than 30 days after the date on which the request is submitted would have on the speed at which broadband service is deployed in the State.</text></subparagraph></paragraph> <paragraph id="H8D5BA9BB9E464C39895678DA14E8C77F"><enum>(3)</enum><text>The impact on the deployment of broadband service within the State of not requiring a permit or other authorization for emergency work performed in the rights-of-way if a broadband facility supported through access to poles, ducts, conduits, or rights-of-way notifies the State, or the applicable local authority within the State, regarding the emergency and the associated work.</text></paragraph>
<paragraph id="H53BCFB2424D44C3596D818425543D08D"><enum>(4)</enum><text>The impact on the deployment of broadband service within the State of requiring the State, or any instrumentality of the State, whenever the State or instrumentality intends to modify or alter a pole, duct, conduit, or right-of-way, or conduct road work in which there will be open trenches, to provide prior written notification of that action to any broadband service provider, or other entity, that has obtained an attachment to a pole, duct, or conduit, or right-of-way that may be affected, so that the applicable entity may have a reasonable opportunity to add to or modify its existing attachment or facilities.</text></paragraph></subsection> <subsection id="H892EDC064F1E4A2E866AAE156C24582C"><enum>(h)</enum><header>Guidance</header><text>The Commission may provide guidance to States with respect to service obligations, procedures, reporting requirements, and other requirements in carrying out programs established under this section.</text></subsection>
<subsection id="H71EE3DCF465A4E3E8D1C9B5FE236FFEB"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to permit the Commission to use any data submitted by a provider of broadband service under this section to issue or establish additional regulatory requirements with respect to that provider.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HD6108B2EFF88492EB01828991EFC511F"><enum>(2)</enum><text>in section 802(c) (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)</external-xref>)—</text>
<subparagraph id="HE1F3F21B3C1746E9B9F80CB9D68276FB"><enum>(A)</enum><text>in paragraph (1)(A)—</text> <clause id="H90364BBCECA84976B14BA83CBE747551"><enum>(i)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></clause>
<clause id="H0BC03C49EB294EB9A6CEF0532F0C2483"><enum>(ii)</enum><text>in clause (ii), by adding <quote>and</quote> after the semicolon at the end; and</text></clause> <clause id="H2BEAEE1EB47B4CF0BF8DB691CACCA27B"><enum>(iii)</enum><text>by adding at the end the following:</text>

<subparagraph id="HA23170E18AB04D109FBC6804D6781956"><enum>(C)</enum><text>in paragraph (6)—</text> <clause id="H66023A3107604B51A025FF954D6DEBED"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, including on a publicly available website,</quote> after <quote>make public</quote>; and </text></clause>
<clause id="H24CCD572E01D4E28AE9259F9373E5774"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause></subparagraph> <subparagraph id="H13D8E820CAF14D54B6F773F5FE0BD7DF"><enum>(D)</enum><text>by adding at the end the following:</text>

<paragraph id="H468208A4455F4071923A83FBF5B96DA5"><enum>(7)</enum><text>beginning not later than 18 months after the date of enactment of the <short-title>Eliminate the Digital Divide Act of 2021</short-title>, ensure that the publicly available website described in paragraph (6)—</text> <subparagraph id="H1183ABB117534C6E960757151C293919"><enum>(A)</enum><text>allows a consumer to determine, based on financial information entered by the consumer, whether the consumer is eligible— </text>
<clause id="H6B233E3DB0244D319AF617D221E8AFD5"><enum>(i)</enum><text>to receive a Federal or State subsidy with respect to broadband internet access service; or </text></clause> <clause id="H892F0DE3EDDE42F69F9DFF8D57A51E1A"><enum>(ii)</enum><text>to qualify for a low-income plan with respect to broadband internet access service; and</text></clause></subparagraph>
<subparagraph id="H33251A07D6F34AF8AFE88820B9AB085C"><enum>(B)</enum><text>with respect to a consumer who is eligible under clause (i) or (ii) of subparagraph (A), contains information regarding how to apply for the applicable benefit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HADF39F1840594319B76C04582344C3D3"><enum>(b)</enum><header>Direct appropriation</header><text>There is appropriated to the Federal Communications Commission, out of any money in the Treasury not otherwise appropriated, $10,000,000,000 for fiscal year 2021 to carry out section 14 of the Communications Act of 1934, as added by subsection (a)(1), which shall remain available through fiscal year 2030.</text></subsection></section>
