which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the continued and uninterrupted production of domestic minerals in the United States.</official-title></form><legis-body><section id="idB0385EE02FF64883A4B69F3899EE6211" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Access to Domestic Mineral Production Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idE11FD3A23B364541B6E8424B49E0C4C0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><subsection id="idFD6A173C7E8D46B5B7A938A3C848CEA1"><enum>(a)</enum><header>Withdrawal</header><text>The term <term>withdrawal</term> means withholding an area of Federal public land from the location of new mining claim, purchase and from mining activities such as exploration and mine development in accordance with 43 U.S.C. § 1702(j); 43 C.F.R. § 2300–0–5(h).</text></subsection><subsection id="id56BD7C316E7B48F5A93A6E5DA9477F3E"><enum>(b)</enum><header>Secretary</header><text>The term <term>Secretary</term> means either the Secretary of the Interior or the Secretary of Agriculture or their designee.</text></subsection></section><section section-type="subsequent-section" id="id66991CBB552D4570B37CE6CFE5CB5333"><enum>3.</enum><header>Congressional findings</header><subsection id="idCAE5BFCBBBBE488285220EAE9FCE7AB1"><enum>(a)</enum><header>In general</header><text>Congress finds that production of domestic minerals is essential to U.S. economic and national security and necessary to provide the essential resources needed for the U.S. economy and allied nations, including—</text><paragraph id="id4EF3EFD77A374D358656A4F0232AD6B2"><enum>(1)</enum><text>for the national defense and national security requirements;</text></paragraph><paragraph id="id5D787F996FA84A46A3C5431CE1B53BF9"><enum>(2)</enum><text>for the energy infrastructure of the United States, including—</text><subparagraph id="id14C3185ABB184F43B5D066655EE07D00"><enum>(A)</enum><text>pipelines;</text></subparagraph><subparagraph id="id56D3AF4D17D5470F87E8180AEF79D90A"><enum>(B)</enum><text>refining capacity;</text></subparagraph><subparagraph id="idAF5D57C07F90400C8AD4316462549E50"><enum>(C)</enum><text>electrical power generation and transmission; and</text></subparagraph><subparagraph id="idED5DD42E490D46BE876154DA84485A9B"><enum>(D)</enum><text>renewable energy production;</text></subparagraph></paragraph><paragraph id="id758A040949FF41789878BC614E52B8C3"><enum>(3)</enum><text>for community resiliency, coastal restoration, and ecological sustainability for the coastal United States;</text></paragraph><paragraph id="id1CC06C41FD374826BDB9F94A8D4D5BDC"><enum>(4)</enum><text>to support domestic manufacturing, agriculture, housing, telecommunications, healthcare, and transportation infrastructure; or</text></paragraph><paragraph id="idCD8EDF1A76204A97AA29B57291B6B377"><enum>(5)</enum><text>for the economic security of, and balance of trade in, the United States.</text></paragraph></subsection><subsection id="idB5F96629C373462D8B0E23552C02F712"><enum>(b)</enum><header>Withdrawals of Lands Pursuant to Section 204 of the Federal Land Policy and Management Act (FLPMA)</header><text>In enacting FLPMA to govern withdrawals of Federal lands and mineral assessment of lands prior to any withdrawal, Congress expressly intended to—</text><paragraph id="id058c5a07241d4f6fb2e8dd72211ecd6e"><enum>(1)</enum><text>limit the Secretary’s authority to withdraw more than five thousand acres; and</text></paragraph><paragraph id="id51420E263B7046F28AECCF62BE1FA323"><enum>(2)</enum><text>provide a mechanism for Congress to disapprove withdrawals that exceed five thousand acres.</text></paragraph></subsection></section><section section-type="subsequent-section" id="id0C1553E989214C4EB7345468D0E88A25"><enum>4.</enum><header>Limitations on mineral withdrawals</header><subsection id="id581F6FDFF8044B2ABA6B2F1DDD84365F"><enum>(a)</enum><text>Congress prohibits the Secretary from any mineral withdrawal until a mineral study has been completed, as required under Section 204 of FLPMA, that demonstrates that the proposed withdrawal will not result in any negative impacts to U.S. national security by limiting access to critical minerals.</text></subsection><subsection id="idA4F66A7675EE4882B281A059F89F4743"><enum>(b)</enum><text>Congress prohibits the Secretary from withdrawing Federal lands in excess of five thousand acres unless the withdrawal is expressly approved by Congress.</text></subsection><subsection id="id81C1AF4E2D4443DAA28113CD96DF45F8"><enum>(c)</enum><text>Prior to any withdrawal being initiated, the U.S. Geological Survey—in consultation with the Department of Defense, Department of State, and the U.S. Trade Representative—will conduct a mineral assessment to ensure that the minerals to be withdrawn by a proposed withdrawal does not impede the ability of the U.S. or its allies to procure a secure supply chain of mineral resources necessary for activities designated in Section 3(a), and in turn, result in negative impacts on—</text><paragraph id="id262d97e59c974953a8806adf1db15c2e"><enum>(1)</enum><text>U.S. economic or national security;</text></paragraph><paragraph id="id77675CC6C2BF4E02ACB68C78D0887809"><enum>(2)</enum><text>U.S. allies economic or national security; or</text></paragraph><paragraph id="idDC313995EBC1455E8C838144180126FC"><enum>(3)</enum><text>the ability to ensure an appropriate balance of trade.</text></paragraph></subsection></section><section section-type="subsequent-section" id="idE4C80CE257A2434D9653512669B31338"><enum>5.</enum><header>Mineral assessment</header><subsection id="id5C17F060269840A5A7E5F850BC570F08"><enum>(a)</enum><text>Any mineral assessment conducted prior to any withdrawal being initiated must—</text><paragraph id="id0f74ad9470624fd0b35dac9b3a7434b5"><enum>(1)</enum><text>include ample opportunity for input from the public including mineral and mining interests;</text></paragraph><paragraph id="id99E755117D8F4F4A858714AC80E1E49A"><enum>(2)</enum><text>include forecasted impacts to U.S. and allied nations economic and national security;</text></paragraph><paragraph id="id6C5DCC2634764B8A84C64DFEF8C4D7DA"><enum>(3)</enum><text>include forecasted impacts to U.S. mineral supply chains;</text></paragraph><paragraph id="idEC99D3D409AD4EC0B978C38D317C4B80"><enum>(4)</enum><text>be completed no more than 12 months prior to the withdrawal;</text></paragraph><paragraph id="idFFBBBA1687C549A88A4CB73DFD146272"><enum>(5)</enum><text>evaluate the impacts of continued mineral import reliance from foreign sources, including geopolitical adversaries;</text></paragraph><paragraph id="id015521178BE843609B6F478B00A10737"><enum>(6)</enum><text>include a comprehensive geological mapping and analysis by USGS of the likelihood of the presence of critical minerals within the withdrawal area; and</text></paragraph><paragraph id="id92312D348D3941739B31E73AFDCA04D7"><enum>(7)</enum><text>include an analysis, conducted by the Department of Defense, of the impacts of the withdrawal on national security, including—</text><subparagraph id="id5B3E795027ED43E289DE65F1F7DA2D5D"><enum>(A)</enum><text>vulnerabilities to national security of preventing access to domestic minerals located in the withdrawal area.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
