<section id="HF0E7994B8D7B415B9958EB1928D20EC8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Law Enforcement Consent Loophole Act of 2021</short-title></quote>.</text></section> <section id="HA189063E1A394528B3CF6BFFEAABEF46"><enum>2.</enum><header>Prohibition on engaging in sexual acts while acting under color of law</header> <subsection id="H946027EAFB2543E681C980B6436AF297"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2243 of title 18, United States Code, is amended—</text> 
<paragraph id="HCDF8D57BC9DE4259B1C0D376E484A51B"><enum>(1)</enum><text>in the section heading, by adding at the end the following: <quote><header-in-text level="section" style="USC">or by any person acting under color of law</header-in-text></quote>;</text></paragraph> <paragraph id="H5A54285546B741489ECA17F02EEFF2E1"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively;</text></paragraph> 
<paragraph id="H03C2FA5FEDC04D8F9EDEC30E23CA3637"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block display-inline="no-display-inline" id="H8C39C8825A7B42F7900262BC7B0A06D3" style="USC"> <subsection id="H794D33B8503E4C1AB31BA6F104EBC93E"><enum>(c)</enum><header>Of an individual by any person acting under color of law</header> <paragraph id="HFA9D4EBDB26A4CB69064AD6300996EBF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever, acting under color of law, knowingly engages in a sexual act with an individual who is under arrest, in detention, or otherwise in the actual custody of any Federal law enforcement officer, shall be fined under this title, imprisoned not more than 15 years, or both.</text></paragraph> 
<paragraph id="H3D95651927B04D3A9896C008EC06B6F4"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>sexual act</term> has the meaning given the term in section 2246.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph> <paragraph id="HB03AA38E7EF04791842D63F16350A85B"><enum>(4)</enum><text>in subsection (d), as so redesignated, by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB527169998AC414084D9789F67581539" style="USC"> 
<paragraph id="HD6C67F8059044AFAB449679767FB14C1" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In a prosecution under subsection (c), it is not a defense that the other individual consented to the sexual act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H19CEA859869E4AF0B3E8D2D66B66DDFB"><enum>(b)</enum><header>Definition</header><text>Section 2246 of title 18, United States Code, is amended—</text> 
<paragraph id="H6274E2D3B9604FA4B0C44B4145ECC237"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HF63B8C7CD9FF4FC18B741B07D332A813"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H8A3EBA07CF5245B6B28C53E5C6AB49C4"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text> <quoted-block display-inline="no-display-inline" id="H6D7DA26E4C1548BEB94FBD30B3F8EDE1" style="USC"> <paragraph id="HFBE18C2BAF0D42EA81DFEEDD3F98CF67"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>Federal law enforcement officer</term> has the meaning given the term in section 115.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6A047AAC0AAC48F09008F00C95FF52A2"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18, United States Code, is amended by amending the item related to section 2243 to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H98DAE4AFB96142B7BE1C049AD3911F50" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">2243. Sexual abuse of a minor or ward or by any person acting under color of law. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HBD0EBA0F04D34D84B3BA3751515FFEAB"><enum>3.</enum><header>Enactment of laws penalizing engaging in sexual acts while acting under color of law</header> <subsection id="H1DBAC02466664CD3899A8103BBCC7946"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date that is one year after the date of enactment of this Act, in the case of a State or unit of local government that does not have in effect a law described in subsection (b), if that State or unit of local government that would otherwise receive funds under the COPS grant program, that State or unit of local government shall not be eligible to receive such funds. In the case of a multi-jurisdictional or regional consortium, if any member of that consortium is a State or unit of local government that does not have in effect a law described in subsection (b), if that consortium would otherwise receive funds under the COPS grant program, that consortium shall not be eligible to receive such funds.</text></subsection> 
<subsection id="HB977FBBF8F95443CBA3FF22CCA7832E1"><enum>(b)</enum><header>Description of law</header><text>A law described in this subsection is a law that—</text> <paragraph id="HB3C5E0DB44CA4049BB5A74E5AA06F0D9"><enum>(1)</enum><text>makes it a criminal offense for any person acting under color of law of the State or unit of local government to engage in a sexual act with an individual who is under arrest, in detention, or otherwise in the actual custody of any law enforcement officer; and</text></paragraph> 
<paragraph id="HF47A8FF342C34AC789D6FABB86F31B20"><enum>(2)</enum><text>prohibits a person charged with an offense described in paragraph (1) from asserting the consent of the other individual as a defense.</text></paragraph></subsection> <subsection id="H73C9EACC773A4D178D86CAB8818CC705"><enum>(c)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">A State or unit of local government that receives a grant under the COPS grant program shall submit to the Attorney General, on an annual basis, information on—</text> 
<paragraph id="HEAC86597ED7749DEBEEEDF98067D25F5"><enum>(1)</enum><text display-inline="yes-display-inline">the number of reports made to law enforcement agencies in that State or unit of local government regarding persons engaging in a sexual act while acting under color of law during the previous year; and</text></paragraph> <paragraph id="H14633820DAF243AB866EFA4C25EC7627"><enum>(2)</enum><text display-inline="yes-display-inline">the disposition of each case in which sexual misconduct by a person acting under color of law was reported during the previous year.</text></paragraph></subsection></section> 
<section id="H89600A7A2F514EABB64BDE797B145420"><enum>4.</enum><header>Reports to Congress</header> 
<subsection id="H3917A2A301FA4C4597D6CA66DC4D34A1"><enum>(a)</enum><header>Report by Attorney General</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Attorney General shall submit to Congress a report containing—</text> <paragraph id="H22B44F2F4FA646648B742779CF0AABA7"><enum>(1)</enum><text>the information required to be reported to the Attorney General under section 403(b); and</text></paragraph> 
<paragraph id="H6C8ACD9690FA441CB09519DF703794B4"><enum>(2)</enum><text display-inline="yes-display-inline">information on—</text> <subparagraph id="H741DA4F2BB8F458BBC488E927EFEBEEE"><enum>(A)</enum><text display-inline="yes-display-inline">the number of reports made, during the previous year, to Federal law enforcement agencies regarding persons engaging in a sexual act while acting under color of law; and</text></subparagraph> 
<subparagraph id="H8D2E26D4C5A242598B2CD35C6755DF55"><enum>(B)</enum><text>the disposition of each case in which sexual misconduct by a person acting under color of law was reported.</text></subparagraph></paragraph></subsection> <subsection id="H65D59168EC1B4025965797E8424F8CB0"><enum>(b)</enum><header>Report by GAO</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Comptroller General of the United States shall submit to Congress a report on any violations of section 2243(c) of title 18, United States Code, as amended by section 402, committed during the 1-year period covered by the report. </text></subsection></section>
