R. 2162</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210323">March 23, 2021</action-date><action-desc><sponsor name-id="R000103">Mr. Rosendale</sponsor> (for himself, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="H001084">Ms. Herrell</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, <cosponsor name-id="B001274">Mr. Brooks</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="B001305">Mr. Budd</cosponsor>, <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>, and <cosponsor name-id="G000595">Mr. Good of Virginia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit fleeing law enforcement officers enforcing immigration laws, and for other purposes.</official-title></form><legis-body id="HEFD8C3A86EFE453884676F1D5FA1E953" style="OLC"><section id="H6FC1F19F890049DEA3AC356377B879B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Criminalize Fleeing from Immigration Enforcement Act of 2021</short-title></quote>.</text></section><section id="H6BAEF7A770B344DF888BA555DBC4F6F1"><enum>2.</enum><header>Fleeing enforcement of immigration laws</header><subsection id="HCC33A186A7594A20959F5B1D615F64C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 758 of title 18, United States Code, is amended to read as follows: </text><quoted-block style="USC" id="H8DDF472C64A642E2BE2399E0418D3FF9" display-inline="no-display-inline"><section id="H751C82C882BD4EAAA0F70D468989B0F1"><enum>758.</enum><header>Fleeing enforcement of immigration laws</header><text display-inline="no-display-inline">Whoever—</text><paragraph id="HA02055C5533441BC98313B32D91846D7"><enum>(1)</enum><text display-inline="yes-display-inline">flees or evades a Federal, State, or local law enforcement officer, which officer has identified himself as such an officer, enforcing section 274(a)(1)(A)(i) or (ii), section 274(a)(2), section 275, section 276, or section 277 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>, 1325, 1326, 1327); or </text></paragraph><paragraph id="H6410D5D8AA4F482687ED0833BF3B814D"><enum>(2)</enum><text display-inline="yes-display-inline">flees or evades a checkpoint operated by the Immigration and Naturalization Service, or any other Federal law enforcement agency, and flees Federal, State, or local law enforcement agents, </text></paragraph></section><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">shall be fined under this title, imprisoned not more than five years, or both, or, in the case of flight or evasion in motor vehicle in excess of the legal speed limit, shall be fined under this title, imprisoned not more than 8 years, or both.</quoted-block-continuation-text><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H05F68E7874F34C2CB4151B0B372D02A2"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/35">chapter 35</external-xref> of title 18, United States Code, is amended by striking the item related to section 758 and inserting the following: </text><quoted-block style="USC" id="H183BEB806E0B4FA5865CF6D2E3869E35" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">758. Fleeing enforcement of immigration laws. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
