<section id="H6D88C2A57D6D441492DC48E6F8E43807" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Americans from Dangerous Algorithms Act</short-title></quote>.</text></section> <section id="H978954FE5A0E40DABB3697C32793E479"><enum>2.</enum><header>Amendment to the communications decency act</header><text display-inline="no-display-inline">Section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H1D378339A2FC46B08E22FA8F77F0C170" display-inline="no-display-inline"> 
<paragraph id="H63D5779CC5694C4297A9F65E064F9A02"><enum>(3)</enum><header>Algorithmic amplification</header> 
<subparagraph id="H18D54815B3CA46B69ECFBEB4B342F1C1"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), an interactive computer service shall be considered to be an information content provider and the protection under such paragraph shall not apply for any claim described in subparagraph (B).</text></subparagraph> <subparagraph id="H1A78909ED73E441C805F4153374A959D"><enum>(B)</enum><header>Conditions for claim</header> <clause id="H590EDC7B1AAF4952B91B4431D229A01B"><enum>(i)</enum><header>In general</header><text>A claim in this subparagraph requires the following:</text> 
<subclause id="HB8AECD4958564B59B2401B71AC5DF672"><enum>(I)</enum><text>A claim in a civil action is brought under—</text> <item id="H3856A88C8CA94BCB83C30E1D2A693BC7"><enum>(aa)</enum><text>section 1980 or 1981 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1985">42 U.S.C. 1985</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/1986">42 U.S.C. 1986</external-xref>); or</text></item> 
<item id="H05C1AAECB10241C7B52159C79F90364D"><enum>(bb)</enum><text>section 2333 of title 18, United States Code.</text></item></subclause> <subclause id="H96533C7BEC9443CE918F007E6F5BE39B"><enum>(II)</enum><text>Except as provided in clause (ii), the claim involves a case in which the interactive computer service used an algorithm, model, or other computational process to rank, order, promote, recommend, amplify, or similarly alter the delivery or display of information (including any text, image, audio, or video post, page, group, account, channel, or affiliation) provided to a user of the service if the information is directly relevant to the claim.</text></subclause></clause> 
<clause id="H7E959E33CC7741F8A1DF6E2D13C90C3C"><enum>(ii)</enum><header>Exception</header><text>Notwithstanding clause (i)(II), the requirement is not met if—</text> <subclause id="H7365BF23D6704FAEA474FDBE19EC629E"><enum>(I)</enum><text>the information delivery or display is ranked, ordered, promoted, recommended, amplified, or similarly altered in a way that is obvious, understandable, and transparent to a reasonable user based only on the delivery or display of the information (without the need to reference the terms of service or any other agreement), including sorting information—</text> 
<item id="H0F05B949023C491D9875F1CC1C55F522"><enum>(aa)</enum><text>chronologically or reverse chronologically;</text></item> <item id="HACDCB67A964647669A633ABC02F5F358"><enum>(bb)</enum><text>by average user rating or number of user reviews;</text></item> 
<item id="HE04EFC59D0BD444CBB8528AF0304EE0C"><enum>(cc)</enum><text>alphabetically;</text></item> <item id="H96AC7847BBF940F8A41BF6817B570729"><enum>(dd)</enum><text>randomly; and</text></item> 
<item id="HEE67CB9B8A8D46E59A27E2DD747971CD"><enum>(ee)</enum><text>by views, downloads, or a similar usage metric; or</text></item></subclause> <subclause id="H3D088FA855B348A5A69F8F10D4F94A19"><enum>(II)</enum><text>the algorithm, model, or other computational process is used for information a user specifically searches for.</text></subclause></clause></subparagraph> 
<subparagraph id="HC57990D64E9D41B68059448B9CFC441A"><enum>(C)</enum><header>Exemptions</header> 
<clause id="H534BA1AF93B54C6AA3FCB77D2E5A7D38"><enum>(i)</enum><header>Small businesses</header><text>This paragraph shall not apply to an interactive computer service that (in combination with each subsidiary and affiliate of the service) has 10,000,000 or fewer unique monthly visitors or users for not fewer than three of the preceding 12 months.</text></clause> <clause id="HA382543FEF4D4E21A1291868BF650585"><enum>(ii)</enum><header>Internet infrastructure</header><text>This paragraph shall not apply to a provider of an interactive computer service, when that service is used by another interactive computer service for the management, control, or operation of that other interactive computer service, including for—</text> 
<subclause id="H68B4873E7BB84EFFB8A035979DB3220E"><enum>(I)</enum><text>web hosting;</text></subclause> <subclause id="HB1F77CF3D13949008C2FCCB93199ECB0"><enum>(II)</enum><text>domain registration;</text></subclause> 
<subclause id="H188ABDB59A514F489D58D24FE3C64A07"><enum>(III)</enum><text>content delivery networks;</text></subclause> <subclause id="HAC8354F8903043408F04EF34AE3FA8E9"><enum>(IV)</enum><text>caching;</text></subclause> 
<subclause id="H5C6ED34A399E4C8982E081FBAF57CF6D"><enum>(V)</enum><text>data storage; and</text></subclause> <subclause id="HF4F5E28A867240F08D7691C4B480D47D"><enum>(VI)</enum><text>cybersecurity.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
