which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for expanded coverage of services furnished by genetic counselors under part B of the Medicare program, and for other purposes.</official-title></form><legis-body id="H30F076B3FBF741C99C3A2C30A1A3D150"><section id="id5A0C5F55FACC4F3EB98EA9BB7AC24854" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to Genetic Counselor Services Act of 2021</short-title></quote>. </text></section><section section-type="subsequent-section" id="idB1A6538D3B744CCCB0E103F11E91375C"><enum>2.</enum><header>Medicare coverage of genetic counseling services</header><subsection id="id3720232A4AF843D1A62670EBD74E2764"><enum>(a)</enum><header>In general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="idB70CF9391AE847878A966ECB53485332"><enum>(1)</enum><text>in subsection (s)(2)—</text><subparagraph id="id8FC69E0CEBBD4AC7A0D814495B43C356"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (GG);</text></subparagraph><subparagraph id="id400A010A860448BD8B6B824A4459816A"><enum>(B)</enum><text>by adding <quote>and</quote> at the end of subparagraph (HH); and</text></subparagraph><subparagraph id="id71F743CE8C96490EAF6F2D6C355686DB"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBABFDEB22EB24195B9829490F1D072DE"><subclause id="id284A0AB9365F4C12AEFDA362740736C3"><enum>(II)</enum><text>covered genetic counseling services (as defined in subsection (kkk)(1));</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idDA4296ABD9964CBB971F26EA8447C813"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="other" display-inline="no-display-inline" id="id290DCE1CB8D44E1EA1322DC144EA301B" other-style="archaic"><subsection id="id36127AB841C9498494B115F5E7ACF0CD"><enum>(kkk)</enum><header>Covered Genetic Counseling Services</header><paragraph commented="no" display-inline="yes-display-inline" id="idfcc3d1d67ea14cbcbeae4dc0e30bab11"><enum>(1)</enum><text>The term ‘<term>covered genetic counseling services</term>’ means genetic counseling services furnished by a genetic counselor (as defined in paragraph (2)) (and such services and supplies furnished as an incident to the provision of such services) as would otherwise be covered under this title if furnished by a physician (or as incident to a physician’s service).</text></paragraph><paragraph id="id029D58F5C17344DEA430D89DA0F4223D" indent="up1"><enum>(2)</enum><text>The term <term>genetic counselor</term> means an individual who—</text><subparagraph id="idC263A2933B0B4F35841D9CFA662E059A"><enum>(A)</enum><text>is licensed as a genetic counselor by the State in which the individual furnishes genetic counseling services; or</text></subparagraph><subparagraph id="id570A15994C174756A9D29E8E6DEDC214"><enum>(B)</enum><text>in the case of an individual practicing in a State that does not license genetic counselors, meets such other criteria as the Secretary establishes.</text></subparagraph></paragraph></subsection><quoted-block-continuation-text quoted-block-continuation-text-level="section">The provisions of this paragraph shall not be construed as preventing other practitioners, including those providing telehealth services, from providing covered genetic counseling services within the scope of their practice. </quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id03722F1A03CC48DD94278B6965BBABAB"><enum>(b)</enum><header>Physicians’ services</header><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by inserting <quote>(2)(II),</quote> after ‘‘(2)(FF) (including administration of the health risk assessment),’’.</text></subsection><subsection id="id9471F658DD9A463FB7F9D951A1A0F93C"><enum>(c)</enum><header>Payment</header><paragraph id="id63DF24FC94D2442CA2B5289E19D6FE0F"><enum>(1)</enum><header>In general</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="id42486742532B4C38A6D253C28C6D7014"><enum>(A)</enum><text>by striking <quote>and (CC)</quote> and inserting <quote>(CC)</quote>; and</text></subparagraph><subparagraph id="id896D7E06C250470D92201A2180133523"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: ‘‘, and (DD) with respect to covered genetic counseling services under section 1861(s)(2)(II), furnished by a genetic counselor, the amount of payment for such service shall be an amount equal to 85 percent of the lesser of the actual charge for the services or the amount determined under the fee schedule established under section 1848(b) for the same services if furnished by a physician’’.</text></subparagraph></paragraph><paragraph id="id456A3AF544CA433084693EA6BADE3ADB"><enum>(2)</enum><header>Modifier</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC5887DA6AA174838A661AA8F962A4352"><subsection id="id9EF7D99D5B1E46A38548E41F23F4542B"><enum>(x)</enum><header>Use of modifier with respect to genetic counseling services</header><paragraph id="idD6514A70281641EC86636BDE320AFF7F"><enum>(1)</enum><header>Establishment</header><text>Not later than January 1, 2022, the Secretary shall establish a modifier to be utilized with evaluation and management CPT codes to indicate (in a form and manner specified by the Secretary), in the case of covered genetic counseling services under section 1861(s)(2)(II), if such services were furnished by a genetic counselor.</text></paragraph><paragraph id="idC270D4D98CDE449A98DE8B0CD51E3BD6"><enum>(2)</enum><header>Required use</header><text>Each request for payment, or bill submitted using evaluation and management CPT codes, for covered genetic counseling services (as defined in section 1861(kkk)(1)) furnished by a genetic counselor (as defined in section 1861(kkk)(2)) on or after January 1, 2022, shall include the modifier established under subparagraph (A) for each such service.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id65185DA0F2E54A47B7411D8D56C34239"><enum>(d)</enum><header>Assignment of payment</header><text>Section 1833(r) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(r)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE3ABFBF5CDAB453BB89037496022BA40"><paragraph id="id82B50C780BFD40FA8A1E66A4E96851F8"><enum>(3)</enum><header>Application to genetic counselors</header><text>The provisions of paragraphs (1) and (2) shall apply with respect to covered genetic counseling services described in section 1861(s)(2)(II) and genetic counselors (as defined in section 1861(kkk)(2)) in the same manner as such provisions apply with respect to services described in section 1861(s)(2)(K)(ii) and nurse practitioners.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCA2164B4FF3549F1ADC74A4F67A08182"><enum>(e)</enum><header>Conforming amendment</header><text>Section 1862(a)(14) of the Social Security Act (42 U.S.C. 1395(y)(a)(14)) is amended by inserting ‘‘covered genetic counseling services,’’ after ‘‘qualified psychologist services,’’.</text></subsection><subsection id="id104EC18B6B894ADB87E1ABCE0B46B7FB"><enum>(f)</enum><header>Effective date</header><paragraph id="id0832B00A71704551AEA133B2DA6D8BBB"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2022.</text></paragraph><paragraph id="id42D0FA5C6F9E46BD91BA1244C91ADBF5"><enum>(2)</enum><header>Implementation</header><text>The Secretary of Health and Human Services may implement the amendments made by this section by interim final rule with comment period.</text></paragraph></subsection></section></legis-body></bill>
