R. 213</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210105">January 5, 2021</action-date><action-desc><sponsor name-id="S001165">Mr. Sires</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the minimum allocation requirement for the emergency solutions grants program.</official-title></form><legis-body id="H84DF6C56F6044531A5CF86BCA2530037" style="OLC"><section id="H69E9E0B55E5E4364BB34918E7272D3DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Solutions to End Homelessness Act of 2021</short-title></quote>.</text></section><section id="HE10E01D709304840BCB60F45950CB758"><enum>2.</enum><header>Minimum allocation requirement for emergency solutions grants program</header><text display-inline="no-display-inline">Section 414(b) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11373">42 U.S.C. 11373(b)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6749992444FF4468AC2475FABF13E094" style="OLC"><subsection id="H156766EEE825491497C1F202EF0590D6"><enum>(b)</enum><header>Minimum allocation requirement</header><paragraph id="HD3A4D1B1E96E4A75B65E76A5A281947F"><enum>(1)</enum><header>In general</header><text>If, under the allocation provisions applicable under this subtitle, a metropolitan city or an urban county would receive a grant of less than .05 percent of the amounts appropriated under section 408 and made available to carry out this subtitle for any fiscal year, such amount shall be reallocated to the State in which the metropolitan city or urban county, as applicable, is located, except that—</text><subparagraph id="H874FF340D09B4F3D9403228B98D8A53A"><enum>(A)</enum><text>in the case of the metropolitan city, such amount shall be reallocated to the urban county in which the metropolitan city is located, if the urban county—</text><clause id="HDC75C23AB255449FAAE8A66899ABFE74"><enum>(i)</enum><text>has previously received and administered assistance under this section; and</text></clause><clause id="H2A06F1CB524D4F07B85D35CCDD40EB12"><enum>(ii)</enum><text>agrees to receive such amount; and</text></clause></subparagraph><subparagraph id="HD39709543F584C8D8EE4018AB2974AFD"><enum>(B)</enum><text>in the case of the urban county, such amount shall be provided to the urban county if the urban county has previously received and administered assistance under this section.</text></subparagraph></paragraph><paragraph id="H78225906179145FB8B64DFEA8F1B4D8E"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), a metropolitan city shall receive the grant amount described such paragraph if the metropolitan city—</text><subparagraph id="H720C2AEB6B614CD79F77DDE07C8B8D75"><enum>(A)</enum><text>is located in a State that does not have counties as local governments;</text></subparagraph><subparagraph id="HE9A99715B059468B9361709BBB54CD86"><enum>(B)</enum><text>has a population greater than 40,000 but less than 50,000 as used in determining the fiscal year 1987 community development block grant program allocation; and</text></subparagraph><subparagraph id="HA43D4A3D2A744362B733348D68069B83"><enum>(C)</enum><text>was allocated in excess of $1,000,000 in community development block grant funds in fiscal year 1987.</text></subparagraph></paragraph><paragraph id="HC31D19B49E324E04BE73D50FA8969441"><enum>(3)</enum><header>Amounts reallocated to urban counties</header><text>An urban county that receives amounts reallocated under paragraph (1)(A) shall expend those amounts for the benefit of metropolitan cities located in the urban county.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
