<section section-type="section-one" id="HBA51ABAD43694D7E99487DCC255DF1BD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Transit Frontline Workforce Training Act of 2021</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H6A9FF284AB3849BE99CCFA2A5DF6132B"><enum>2.</enum><header>National Transit Frontline Workforce Training Center</header> <subsection id="H8C700510E254419A9B02BE02DF58E18D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5314(b) of title 49, United States Code, is amended— </text> 
<paragraph id="HE810304827D94A44A4E9759EEC4180AD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="H4017872B1E25448796CB3D252039C580"> <paragraph id="HC16F7EC6E9524C83984ECA1617EB02B3"><enum>(2)</enum><header>National Transit Frontline Workforce Training Center</header> <subparagraph id="HDF01FC7504F0415BAB490F7E0D73AA05"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="HCBAE8DC3D5324D46982D6A52FD0B7DDE"><enum>(i)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Transit Administration.</text></clause> <clause id="HA29B172FD2F341A4AE7A36A1C1327405"><enum>(ii)</enum><header>Center</header><text>The term <term>Center</term> means the National Transit Frontline Workforce Training Center established under subparagraph (B).</text></clause> 
<clause id="H66A6BC9EDC8548FBB22567BC269FF026"><enum>(iii)</enum><header>Human capital</header><text>The term <term>human capital</term> means any knowledge, talent, skill, ability, experience, intelligence, training, judgment, or wisdom possessed, individually or collectively, by the transit frontline workforce (including operations, maintenance, and administrative personnel).</text></clause></subparagraph> <subparagraph id="H7945BB0B8E2146E79CF35A3041B328C1"><enum>(B)</enum><header>Establishment</header><text>The Secretary shall—</text> 
<clause id="H3D59BCF56B8146A6ABC36E0D5AF7AB80"><enum>(i)</enum><text>establish a center, to be known as the <quote>National Transit Frontline Workforce Training Center</quote>, to meet the needs of the rural and urban transit system frontline workforce through standards-based training relating to relevant maintenance and operations occupations; and</text></clause> <clause id="HC4C543FC134F46D5A0DED55A287C81D2"><enum>(ii)</enum><text>evaluate, and provide a grant to, a nonprofit organization with demonstrated capacity to develop and provide transit career ladder programs through labor-management partnerships and apprenticeships, on a nationwide basis, to carry out the duties of the Center described in subparagraph (C).</text></clause></subparagraph> 
<subparagraph id="H5B8A5276DCF54079B16AEA191A30DAF5"><enum>(C)</enum><header>Duties</header> 
<clause id="HC901FFDF7F7D4CFFA68723B82A09DBD0"><enum>(i)</enum><header>In general</header><text>The Center, in cooperation with the Administrator, transit authorities, and other appropriate individuals and entities, shall develop and carry out training and educational programs for public transportation employees serving in the frontline workforce.</text></clause> <clause id="HB4E56FEA044647E1B55E8D939195FA27"><enum>(ii)</enum><header>Training and educational program inclusions</header><text>The training and educational programs developed under clause (i) may include courses in recent developments, techniques, and procedures relating to—</text> 
<subclause id="HE8FC0D0EAB8441CA826D8E40EE90889B"><enum>(I)</enum><text>developing consensus national training standards, in partnership with industry stakeholders, for key frontline occupations with demonstrated skill gaps;</text></subclause> <subclause id="H789F31DBBE9345A1A7C5F1E113078657"><enum>(II)</enum><text>developing national systems of qualification and apprenticeship for transit maintenance and operations occupations;</text></subclause> 
<subclause id="H20D016B226B440DEB5ACC2F3D0CCFE77"><enum>(III)</enum><text>establishing local, regional, and statewide transit training partnerships—</text> <item id="HF8034665B7D34442B4111FDFE5488C97"><enum>(aa)</enum><text>to identify and address workforce skill gaps; and</text></item> 
<item id="H7CB41024E9D240979D969E9C24E11CBA"><enum>(bb)</enum><text>to develop skills needed for—</text> <subitem id="HA111B0B483574BB0B24A910116F7A869"><enum>(AA)</enum><text>delivering quality transit service; and</text></subitem> 
<subitem id="H0BD6AC76AF0D4E3E9DB9A48F5DF8998C"><enum>(BB)</enum><text>supporting employee career advancement;</text></subitem></item></subclause> <subclause id="H071E1F5CD26E4243807874B553214B82"><enum>(IV)</enum><text display-inline="yes-display-inline">developing programs for the training of the frontline workforce, instructors, mentors, and labor-management partnership representatives, in the form of classroom, hands-on, on-the-job, and internet web-based training, to be delivered—</text> 
<item id="H96A072A1805E4ABD9883BDBFC0C5A0BC" commented="no"><enum>(aa)</enum><text display-inline="yes-display-inline">at a national center;</text></item> <item id="H62E5D7914EA847E3AABF1C8086C8720F" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">regionally; or</text></item> 
<item id="H428789BCEAB44838B0182C0B28026913" commented="no"><enum>(cc)</enum><text display-inline="yes-display-inline">at an individual transit agency;</text></item></subclause> <subclause id="H2300AA3E2A394D30ADF4F70F72976576"><enum>(V)</enum><text>developing training programs for skills relating to existing and emerging transit technologies, such as zero-emission buses;</text></subclause> 
<subclause id="H0152582BD0464B5A9F3F9C21724A5BCC"><enum>(VI)</enum><text>developing improved capacity for safety, security, and emergency preparedness in local transit systems and the industry as a whole through—</text> <item id="H603E98AE73E94AABB18747FABB3911F3"><enum>(aa)</enum><text>developing the role of the frontline workforce in establishing and sustaining safety culture and safety systems in—</text> 
<subitem id="H7D579546A5C441B895EBD84F38F791E5"><enum>(AA)</enum><text>the industry; and</text></subitem> <subitem id="H940BE0A08CB1492AB29ED5DFFB5A61D2"><enum>(BB)</enum><text>individual public transportation systems; and</text></subitem></item> 
<item id="H09103096CFD44407B027378A740BDB48"><enum>(bb)</enum><text>training to address frontline workforce roles in promoting health and safety for transit workers and the riding public;</text></item></subclause> <subclause id="H2AA25C6FFD2D459197EE71EB78B4D26B"><enum>(VII)</enum><text>developing local transit capacity for career pathway partnerships with schools and other community organizations for recruiting and training underrepresented populations as successful transit employees who can develop careers in the transit industry; and</text></subclause> 
<subclause id="HC48063A696274129944778B415E70669"><enum>(VIII)</enum><text display-inline="yes-display-inline">in collaboration with the Administrator, conducting and disseminating research—</text> <item id="HD96ED930C15F47A6B4158FA1C82D2824"><enum>(aa)</enum><text>to provide transit workforce job projections and identify training needs and gaps;</text></item> 
<item id="H4730C366E3FC41589736840EDAA6BFC9"><enum>(bb)</enum><text>to determine the most cost-effective methods for transit workforce training and development, including return-on-investment analysis;</text></item> <item id="H20FC6168604249EABB46CA74B47489D0"><enum>(cc)</enum><text>to identify the most effective methods for implementing successful safety systems and a positive safety culture;</text></item> 
<item id="HE6022EB0CD0144859142561A91E7803F"><enum>(dd)</enum><text>to promote transit workforce best practices for achieving cost-effective, quality, safe, and reliable public transportation services; and</text></item> <item id="HC52FFFDCCD1B40208252F4CC1F5AC9D6"><enum>(ee)</enum><text>to provide culturally competent training and education programs to all participants, regardless of gender, sexual orientation, or gender identity, including participants with limited English proficiency, diverse cultural and ethnic backgrounds, and disabilities.</text></item></subclause></clause></subparagraph> 
<subparagraph id="H4C5C3CE7410146EFAAA3F448449315E7"><enum>(D)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate the activities of the Center under this paragraph, to the maximum extent practicable, with—</text> <clause id="HBB0EBC73A6FC4303A0E3F426861B2B6B"><enum>(i)</enum><text display-inline="yes-display-inline">the Office of Career, Technical, and Adult Education of the Department of Education; and</text></clause> 
<clause id="HB1461A4A23F742DEBA805155B8E10B6F"><enum>(ii)</enum><text display-inline="yes-display-inline">the Office of Apprenticeship of the Department of Labor.</text></clause></subparagraph> <subparagraph id="H82E889977D514EF7BF8905A583D89129"><enum>(E)</enum><header>National Transit Database</header><text>For the purposes of carrying out this section, the Secretary shall require the collection, through the National Transit Database, on an annual basis, of additional data relating to human capital, in accordance with such requirements relating to the collection and definition of those data as the Secretary may establish, in coordination with relevant transportation sector individuals and entities.</text></subparagraph> 
<subparagraph id="H12E0DFAEED1B4C7A83B2D4D5FB20B107"><enum>(F)</enum><header>Use of other grant amounts for Center-related activities</header> 
<clause id="H4B51BF67368C4CA2BAE39E4A4E1D9098"><enum>(i)</enum><header>In general</header><text>Of the amounts made available to the recipient of a grant under section 5307, 5337, or 5339, the recipient may use not more than 0.5 percent, with the approval of the Secretary, to pay an amount equal to not more than 80 percent of the cost of an activity described in subparagraph (C).</text></clause> <clause id="H0F6C228724E8460597067B7D63285531"><enum>(ii)</enum><header>Existing programs</header><text>A recipient referred to in clause (i) may use the amounts described in that clause to carry out an existing local education or training program for public transportation employees supported by—</text> 
<subclause id="H2A06B49D51E24FB8BC8287920AFC6F03"><enum>(I)</enum><text>the Secretary;</text></subclause> <subclause id="HE6584BF3B781466E82C452D9176870A1"><enum>(II)</enum><text>the Department of Labor; or</text></subclause> 
<subclause id="H41DB3D7CB86C40FFA67743CB44A64AA8"><enum>(III)</enum><text>the Department of Education.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H5DE7E33824194919B9089750424F1772"><enum>(2)</enum><text>in paragraph (3), by striking <quote>or (2)</quote>; and</text></paragraph> 
<paragraph id="HC5D7B13E788349EC9FE90E1624E9156E"><enum>(3)</enum><text>by striking paragraph (4).</text></paragraph></subsection> <subsection id="H0F150D94D50F471FAEF113197DB96B84"><enum>(b)</enum><header>Data required To be reported in National Transit Database</header><text display-inline="yes-display-inline">Section 5335(c) of title 49, United States Code, is amended by inserting <quote>relating to human capital (as defined in section 5314(b)(2)(A)) or physical capital</quote> before the period at the end.</text></subsection> 
<subsection id="H73D1A39487554CDD8D12CC039E9B053D"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 5338(c) of title 49, United States Code, is amended—</text> <paragraph id="H3B59C6BD0BB54CC48F8CE3924FF9D730"><enum>(1)</enum><text>by striking <quote>There are</quote> and inserting the following:</text>

<paragraph id="H7A76FFE275174FD68E8248CB8C2075B0"><enum>(2)</enum><header>National Transit Frontline Workforce Training Center</header><text>There is authorized to be appropriated to carry out section 5314(b)(2) $12,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
