R. 2128</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210323">March 23, 2021</action-date><action-desc><sponsor name-id="B001304">Mr. Brown</sponsor> (for himself, <cosponsor name-id="D000627">Mrs. Demings</cosponsor>, <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>, <cosponsor name-id="S000522">Mr. Smith of New Jersey</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, and <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to improve transit safety.</official-title></form><legis-body id="H1BFA0C04D6B24B3880D60CFB778CE86D" style="OLC"><section id="H9F1B5177F1DD4590A64E13322CD8A31C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Transit Safety Improvement Act of 2021</short-title></quote>.</text></section><section id="H0243977CC9ED4E519E5B647D1BC57059"><enum>2.</enum><header>Public transportation safety program</header><text display-inline="no-display-inline">Section 5329 of title 49, United States Code, is amended—</text><paragraph id="H58F68644C2F344549F552FC7ED2E2BFE"><enum>(1)</enum><text>in subsection (d)(1)—</text><subparagraph id="H929C6F1804E545C18B9A7CFED83E2461"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A) by inserting <quote>the safety committee established under paragraph (4), and subsequently,</quote> before <quote>the board of directors</quote>;</text></subparagraph><subparagraph id="HC32A468167D3446EBDB9D60F5CEC54C7"><enum>(B)</enum><text>in subparagraph (G) by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H266F42E63D3E43CD8D8C2A07D59535E9"><enum>(C)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAFADBAED061443098E57C36B628C8E2E"><subparagraph id="H0368CD4C83784B91BCC9A784BC6C716A"><enum>(H) </enum><text display-inline="yes-display-inline">a requirement that the safety committee only approve a safety plan under subparagraph (A) if such plan stays within such recipient’s fiscal budget</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H53BCDEC4D07E4EF2A6D1CF1E46310113"><enum>(2)</enum><text>by adding at the end of subsection (d) the following:</text><quoted-block style="OLC" id="H90A3F55D3F8B4783BAD39DBD1C1CC200" display-inline="no-display-inline"><paragraph id="H246F79815C4D4C059648366C0187DC8D"><enum>(4)</enum><header>Safety Committee</header><text display-inline="yes-display-inline">For purposes of the approval process of an agency safety plan under paragraph (1), the safety committee shall be convened by a joint labor-management process and consist of an equal number of—</text><subparagraph id="H6A6F2D37D22C4FFAB78D83F4BA6ADF17"><enum>(A)</enum><text>frontline employee representatives, selected by the labor organization representing the plurality of the frontline workforce employed by the recipient or if applicable a contractor to the recipient; and </text></subparagraph><subparagraph id="HB48D8C9B44154244801E5289B0437C10"><enum>(B)</enum><text>employer or State representatives.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
