<section id="H026C382403094A09A189F87A683A06A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Michael Lecik Military Firefighters Protection Act</short-title></quote>.</text></section> <section id="HB85DFE790FE94C3B961C0E2A61007259" section-type="subsequent-section"><enum>2.</enum><header>Presumptions of service connection for diseases associated with firefighting</header> <subsection id="H3909DAFB638B434AA546D712DC06BF7F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="H4BC0461BC71647609C3EA39D9BFF20C5"><enum>1119.</enum><header>Presumptions of service connection for diseases associated with firefighting</header>
<subsection display-inline="no-display-inline" id="H25E60B99B802464BBB0B52BD619EA02A"><enum>(a)</enum><header>Service connection</header><text display-inline="yes-display-inline">For the purposes of section 1110 of this title, and subject to section 1113 of this title, a disease specified in subsection (b) becoming manifest in a veteran described in subsection (c) to a degree of disability specified in subsection (d) and within the period specified in subsection (e) shall be considered to have been incurred in or aggravated during active military, naval, or air service, notwithstanding that there is no record of evidence of such disease during a period of such service.</text></subsection> <subsection commented="no" id="HE539D8CAF0E643A1A902B0AE772DE7B7"><enum>(b)</enum><header>Specified diseases</header><text display-inline="yes-display-inline">The diseases specified in this subsection are the following:</text>
<paragraph id="HB98F76953EBA4976B5A82237250D83FC"><enum>(1)</enum><text>Heart disease.</text></paragraph> <paragraph id="H403F8137E1184BB8AD74420489B2E1AD"><enum>(2)</enum><text>Lung disease.</text></paragraph>
<paragraph display-inline="no-display-inline" id="H12391DA606C94116BEE212B6A22529A8"><enum>(3)</enum><text>Brain cancer.</text></paragraph> <paragraph id="H186C5FA2EC11441BB62CC0385EBC50E2"><enum>(4)</enum><text>Cancer of the blood or lymphatic systems.</text></paragraph>
<paragraph id="HE1FBCCCE7B114926ADEB17FDEA4AF1ED"><enum>(5)</enum><text>Leukemia.</text></paragraph> <paragraph id="H0ADB1BC0926D479DA31FA335B5201A7F"><enum>(6)</enum><text>Lymphoma (except Hodgkin’s disease).</text></paragraph>
<paragraph id="H16DB971FDB694EC3BD62619C15CF91DD"><enum>(7)</enum><text>Multiple myeloma.</text></paragraph> <paragraph id="H0073AF2B28F04E44914435CC7B78E4C1"><enum>(8)</enum><text>Bladder cancer.</text></paragraph>
<paragraph id="H4A6A55751BFA4473B24F10F5AF1CFB9E"><enum>(9)</enum><text>Kidney cancer.</text></paragraph> <paragraph id="H1D4E9001567343998BFF1F24533E08A3"><enum>(10)</enum><text>Cancer of the reproductive system (including testicular cancer).</text></paragraph>
<paragraph id="H97DD4F4C13C949E4BB00E184210A3CB4"><enum>(11)</enum><text>Cancer of the digestive system.</text></paragraph> <paragraph id="H1A2AF8C4B9F545C9A3ACEA803B15346D"><enum>(12)</enum><text>Colon cancer.</text></paragraph>
<paragraph id="HDC8C4F0168014598A4E9E062D5160327"><enum>(13)</enum><text>Liver cancer.</text></paragraph> <paragraph id="H79EC717BB6C342619D576A70A62D2C60"><enum>(14)</enum><text>Skin cancer.</text></paragraph>
<paragraph id="H7734CB640E514F3D8AC1A5DB6AB391C3"><enum>(15)</enum><text>Lung cancer.</text></paragraph> <paragraph id="H75D7ECBF5ECD4B4FB56B11F7E4D6989E"><enum>(16)</enum><text>Breast cancer.</text></paragraph>
<paragraph id="HEED2602F06A6498E931A48CA64EDCF27"><enum>(17)</enum><text display-inline="yes-display-inline">Each additional disease (if any) that the Secretary determines in regulations prescribed under this section—</text> <subparagraph id="H57CAFE1280AB4B5BB320F5F2301D91A1"><enum>(A)</enum><text>warrants a presumption of service connection by reason of having positive association with firefighting; and</text></subparagraph>
<subparagraph id="H9F606293A915446FB89DFF17895773F6"><enum>(B)</enum><text display-inline="yes-display-inline">becomes manifest within the period (if any) prescribed in such regulations in a veteran described in subsection (c), not­with­stand­ing subsection (e).</text></subparagraph></paragraph></subsection> <subsection id="H3D6ECB0F40344768942B8F31DFFA54A8"><enum>(c)</enum><header>Covered veterans</header><text display-inline="yes-display-inline">A veteran described in this subsection is a veteran who—</text>
<paragraph id="H850D819C17F04101AB972D63064053B5"><enum>(1)</enum><text>is trained in fire suppression; and</text></paragraph> <paragraph id="H4E6CB19E23D246D9BBA126C45810C202"><enum>(2)</enum><text>served on active duty in a military occupational specialty or career field with a primary responsibility for firefighting or damage control for at least five years in the aggregate.</text></paragraph></subsection>
<subsection id="H754CF21001BD437FA891713F47D5DBBC"><enum>(d)</enum><header>Degree of disability</header><text display-inline="yes-display-inline">The degree of disability specified in this subsection is 10 percent or more.</text></subsection> <subsection id="H7C4D39993B94498DBAD802E27FEC4677"><enum>(e)</enum><header>Period</header><text display-inline="yes-display-inline">The period specified in this subsection is within 15 years of the date on which the veteran separated from active military, naval, or air service.</text></subsection>
<subsection id="HC903EC5B1B8B4EECB5E5278ABDDC5144"><enum>(f)</enum><header>Effective date of award</header><text display-inline="yes-display-inline">The effective date of an award under this section shall be determined in accordance with section 5110 of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA988D71DA6E342C3BFDBC22546E1F3FD"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1118 the following new item:</text>
