which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Environmental Protection Agency to award grants for projects that are consistent with zero-waste practices, and for other purposes.</official-title></form><legis-body id="H827CD5AA72A54F9BB014F7340B3970A4" style="OLC"><section id="HBB19D7C435C443C4ABB75F11512F4A38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zeroing Excess, Reducing Organic Waste, And Sustaining Technical Expertise Act</short-title></quote> or the <quote><short-title>ZERO WASTE Act</short-title></quote>.</text></section><section id="H313F60BDD55E49B9B4399E5CA917178D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise provided, in this Act:</text><paragraph id="H0AEE9D177595492984400F873789BE38"><enum>(1)</enum><header>Adaptive management practice</header><text display-inline="yes-display-inline">The term <term>adaptive management practice</term> means, with respect to use of a grant under this Act, the integration of project design, management, and monitoring to identify the impacts and outcomes of such use of a grant as they arise for purposes of adjusting behaviors to improve outcomes.</text></paragraph><paragraph id="H3B0DA83CF6A14FA9B6D28D7CCDB44684"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H4134D7278E9E4706B6C62266EDB980D8"><enum>(3)</enum><header>Domestically owned and operated</header><text>The term <term>domestically owned and operated</term> means, with respect to a business—</text><subparagraph id="HBDEEABBA077E443CA1189EEE06DA5392"><enum>(A)</enum><text>the headquarters of such a business is located within the United States; and</text></subparagraph><subparagraph id="H576E9C89A2D5409DAD6E035817ABA83D"><enum>(B)</enum><text>the primary operations of such a business are carried out in the United States.</text></subparagraph></paragraph><paragraph id="H09D28837A0FA4EAF9F5214B385F3363A"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H1747AD00FF2846F8812FF7F6DBC51638"><enum>(A)</enum><text>a single unit of State, local, or Tribal government;</text></subparagraph><subparagraph id="HFEEBB54AF41441E8AC42C073A36E9696"><enum>(B)</enum><text>a partnership of multiple units of State, local, or Tribal government;</text></subparagraph><subparagraph id="HF6E2A816246B43048DD70FFE5F10E6DC"><enum>(C)</enum><text>one or more units of State, local, or Tribal government in coordination with for-profit or nonprofit organizations; or</text></subparagraph><subparagraph id="H67ABA0247C0244CABF0303DDC96E6C7A"><enum>(D)</enum><text>one or more nonprofit organizations.</text></subparagraph></paragraph><paragraph id="HBFD95D98183345E4AA21DD78AC28DE03"><enum>(5)</enum><header>Embodied energy</header><text>The term <term>embodied energy</term> means energy that was used to create a product or material.</text></paragraph><paragraph id="HD4F7DC92F25A40DE98FF4EEF7653F2EA" commented="no"><enum>(6)</enum><header>Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> has the meaning given that term in section 601.</text></paragraph><paragraph id="H042835C940A94DD09092437F2A8597B8"><enum>(7)</enum><header>Living wage</header><text>The term <term>living wage</term> means the minimum income necessary to allow a person working 40 hours per week to afford the cost of housing, food, and other material necessities.</text></paragraph><paragraph id="HE46C1427C73F4F77818355D5E392EB03"><enum>(8)</enum><header>Organics recycling</header><text>The term <term>organics recycling</term> means the biological process by which organic material—</text><subparagraph id="H84678ED9D31947ECB5B1ECFAB764B81B"><enum>(A)</enum><text>is biologically converted to compost that is not harmful to humans, plants, or animals; and</text></subparagraph><subparagraph id="HB5DADE004E004880945DB5B55C2D012F"><enum>(B)</enum><text display-inline="yes-display-inline">is treated in a specialized facility designed to recycle organic material.</text></subparagraph></paragraph><paragraph id="H0DC9EA7F66A84E60926E10C5240D65D3" commented="no"><enum>(9)</enum><header>Recycle; recycling</header><text display-inline="yes-display-inline">The terms <term>recycle</term> and <term>recycling</term> have the meanings given those terms in section 12001 of the Solid Waste Disposal Act (as added by this title).</text></paragraph><paragraph id="H349C572F53E140A9A88BF93CEE7776E1" commented="no"><enum>(10)</enum><header>Reuse</header><text display-inline="yes-display-inline">The term <term>reuse</term>—</text><subparagraph id="H7B53783032BA482FBD5884C00F5AFF19" commented="no"><enum>(A)</enum><text>means—</text><clause id="H203D0BBD215948C1B33087B20F506598" commented="no"><enum>(i)</enum><text>using a product, packaging, or material more than once for the same or a new function without requiring additional processing;</text></clause><clause id="H8C6250D293A24F75B371823828120BFC" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">repairing a product, packaging, or material in such a way that extends its useful lifetime;</text></clause><clause id="HE712EA4783F34DCD9112934B2CCFCE40" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">sharing or renting a product, packaging, or material in such a way that extends its useful lifetime; or</text></clause><clause id="HEBFE020ED8ED497B92B46504B70F2BEA" commented="no"><enum>(iv)</enum><text>selling or donating a product, packaging, or material in such a way that extends its useful lifetime; and</text></clause></subparagraph><subparagraph id="HAC5CFF59BE604B7B97E4717C87DAF40E" commented="no"><enum>(B)</enum><text>does not include incineration.</text></subparagraph></paragraph><paragraph id="H5D09833915E84384A3578F53639B6DD7" display-inline="no-display-inline"><enum>(11)</enum><header>Single-use product</header><text display-inline="yes-display-inline">The term <term>single-use product</term>—</text><subparagraph id="HE869FF3F73314966A1B84172E554A26A"><enum>(A)</enum><text>means a consumer product that is designed to be disposed of, recycled, or otherwise discarded after a single use; and</text></subparagraph><subparagraph id="HA904E5212706413F989D03316B6CE0C1"><enum>(B)</enum><text>does not include—</text><clause id="H6446C16AF3C84151A0E7E9FF4D4E0706"><enum>(i)</enum><text display-inline="yes-display-inline">medical equipment, devices, or other products determined by the Secretary of Health and Human Services to necessarily be made of plastic for the protection of public health;</text></clause><clause id="H3FFA6CB40AEA465DBCDE81031344F637"><enum>(ii)</enum><text>a personal hygiene product that, due to the intended use of the product, could become unsafe or unsanitary to recycle, such as a diaper; and</text></clause><clause id="H35B7523BCA434AFCA28FB55AA89E489E"><enum>(iii)</enum><text>packaging that is—</text><subclause id="HDA340AA4CDDC4B5E94CD14383533FAFF"><enum>(I)</enum><text>for any product described in subparagraph (A); or</text></subclause><subclause id="H17293552A7064B3DB8D1650FC0F896B9"><enum>(II)</enum><text>used for the shipment of hazardous materials that is prohibited from being composed of used materials under section 178.509 or 178.522 of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subclause></clause></subparagraph></paragraph><paragraph id="H2329FFF6945F40A4ABD1845945AA1E34" commented="no"><enum>(12)</enum><header>Source reduction</header><subparagraph id="H5FF7AF822D24443480F373154C28771A" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>source reduction</term> means an activity or process that reduces the generation of waste at its source, before it can enter into commerce or the environment.</text></subparagraph><subparagraph id="HE77A195498874C90A23D35E3B6E48764" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The term <term>source reduction</term> includes—</text><clause id="HB6B052F2A48846F09985986FB333C562" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the redesign of products or materials such that they can be reused, rather than disposed of;</text></clause><clause id="HD6A144439CE64C41A8045816FA0F65A1" commented="no"><enum>(ii)</enum><text>the design and manufacture of products or materials with minimal packaging intended for disposal;</text></clause><clause id="HFED7BFDA4AA44738A39F57532FCA26D8" commented="no"><enum>(iii)</enum><text>an activity or process that reduces the amount of waste generated during a manufacturing process;</text></clause><clause id="HC61A2151063342EC9E67CD8BFF9FF95F" commented="no"><enum>(iv)</enum><text>an activity or process that reduces or eliminates the use of materials that are not able to be recycled without degrading the quality of the material; and</text></clause><clause id="H23EAE839BA99482AB644AD3CA2C86245" commented="no"><enum>(v)</enum><text>any other activity or process that reduces the weight, volume, or toxicity of products or materials.</text></clause></subparagraph><subparagraph id="H0D2003EBBF424A7F9A1ECB3A74076225" commented="no"><enum>(C)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>source reduction</term> does not include an activity or process used after a product or material has become waste, such as incineration.</text></subparagraph></paragraph><paragraph id="H4C50CD2975DD421CB1A7F1E5A10DDDEE" commented="no"><enum>(13)</enum><header>Source separation</header><text>The term <term>source separation</term>—</text><subparagraph id="HCCD9DC2ED25A4631B0DDA59FB5CD36FF" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">means the separation of solid waste by material or commodity type prior to collection, such as separation into recyclable and non-recyclable materials or by recyclable commodity; and</text></subparagraph><subparagraph id="H171229CC268743BBB2FEFC6FD41690B1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">does not require the use of technologies that sort mixed municipal solid waste into recyclable and non-recyclable materials.</text></subparagraph></paragraph><paragraph id="HB1F0283869AE48AD9575F53DC9DE4308"><enum>(14)</enum><header>Waste prevention</header><text>The term <term>waste prevention</term> means any method to reduce the amount of materials disposed of in landfills or incinerated, including reuse and recycling.</text></paragraph><paragraph id="H5D492AAF232646CE8E4CBD59920DE9D7"><enum>(15)</enum><header>Zero-emissions vehicle</header><text>The term <term>zero-emissions vehicle</term> means a vehicle that produces zero emissions of—</text><subparagraph id="H32EA8958DEAA4A49A1C20FC2AF58C9F7" commented="no"><enum>(A)</enum><text>greenhouse gases;</text></subparagraph><subparagraph id="HD5476971363641F0B382A9BC25285080" commented="no"><enum>(B)</enum><text>criteria pollutants; and</text></subparagraph><subparagraph id="H819260873AF84D6AA99C4F6ADB934E87" commented="no"><enum>(C)</enum><text>hazardous air pollutants.</text></subparagraph></paragraph><paragraph id="H965BDF635B2D4D108DAFE8A39FF0D8C5"><enum>(16)</enum><header>Zero-waste</header><text>The term <term>zero-waste</term> means the conservation of all resources by means of responsible production, consumption, reuse, and recovery of products, packaging, and materials without—</text><subparagraph id="H4A3FE38A13514225BAF087AEB5E762D5"><enum>(A)</enum><text>burning or otherwise destroying embodied energy; and</text></subparagraph><subparagraph id="H4D4EBD3B87EA45439C703012AE7BB3BC"><enum>(B)</enum><text display-inline="yes-display-inline">a discharge to land, water, or air that results in adverse human health or environmental effects.</text></subparagraph></paragraph><paragraph id="H26A375C95E3048D2A7CF607E1929F313"><enum>(17)</enum><header>Zero-waste practice</header><text>The term <term>zero-waste practice</term> means a practice used to help achieve zero-waste, including the use of source reduction.</text></paragraph></section><section id="H0D0B35D4E185449C9BE3C4086DAC0103"><enum>3.</enum><header>Grants for zero-waste projects</header><subsection id="H5E1715F3F26C48DA890314678B630AE3"><enum>(a)</enum><header>In general</header><text>The Administrator shall establish and carry out a program to award grants, on a competitive basis, to eligible entities to carry out projects described in subsection (b).</text></subsection><subsection id="H815B1012E73F4D9684676E61EDA941C0"><enum>(b)</enum><header>Grant use</header><paragraph id="H9CB2BBF2920F47BEBF0BC84DA6B8E691"><enum>(1)</enum><header>Organics recycling infrastructure</header><subparagraph id="H237006EDEC52440B9824D473A6E8EE88"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to carry out a project to construct, expand, or modernize infrastructure required for organics recycling, including any facility, machinery, or equipment required for the collection and processing of organic material on a city-wide or county-wide scale.</text></subparagraph><subparagraph id="HDE978FE4222A406899C2144A9AD15B62"><enum>(B)</enum><header>Requirements</header><text>Each project carried out under this paragraph shall result in increased capacity—</text><clause id="HF5FD066EA64542A99DC921F4D3A01E68" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to collect and process residential and commercial organic material, including through source separation of organic material; and</text></clause><clause id="HC5356F95FA134EABAF6541366E3B4A09"><enum>(ii)</enum><text display-inline="yes-display-inline">to generate environmentally beneficial byproducts, such as compost with added nutritional content.</text></clause></subparagraph><subparagraph id="HFCCE054188334B2FAB3B3DE6B53EC6E5"><enum>(C)</enum><header>Mixed-waste composting</header><text display-inline="yes-display-inline">A grant received under this paragraph may not be used to support the collection or processing of mixed-waste composting.</text></subparagraph></paragraph><paragraph id="H0A5ABED003704AD09D9EEC27A2514F08"><enum>(2)</enum><header>Electronic waste recycling</header><subparagraph id="H01A93BD37E3946B6913EE5A294631263" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to carry out a project that enables the recycling or reuse of electronic devices at the end of their useful lifetime, including—</text><clause id="H24B6630FED374F3E94E2F07A4A01478B" commented="no"><enum>(i)</enum><text>constructing, expanding, or modernizing infrastructure and technology;</text></clause><clause id="H10EF547B6D854F98A623378616E576D6" commented="no"><enum>(ii)</enum><text>research and development; and</text></clause><clause id="H97DFCD92353B46A398DBCA7515DB7AD1" commented="no"><enum>(iii)</enum><text>product refurbishment.</text></clause></subparagraph><subparagraph id="HCFA7E7EF8A894940897A62006735BEA7"><enum>(B)</enum><header>Requirements</header><text>A project carried out under this paragraph—</text><clause id="H5F38FE2E12844215B9ED013908D19C68"><enum>(i)</enum><text>may not include an electronic waste buy-back program—</text><subclause id="H3E520447D7BC48669DD508A19395DDC0"><enum>(I)</enum><text>that provides compensation for used electronics; and</text></subclause><subclause id="H47959D255898458095707FC91D31E4E6"><enum>(II)</enum><text>under which such compensation may be applied as a credit toward the purchase of new electronics; and</text></subclause></clause><clause id="H22324F271E8D478198B25AB5011EC5D3" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be carried out by an eligible entity that is certified to recycle electronics by an organization that is accredited by—</text><subclause id="HEA390265BD534934A1CC5EC65590B081" commented="no"><enum>(I)</enum><text>the National Accreditation Board of the American National Standards Institute; </text></subclause><subclause id="H1F9FBCBB4E80418AAAE331AE00F03817" commented="no"><enum>(II)</enum><text>the American Society of Quality; or</text></subclause><subclause id="H3DEC3D794A3348328B47357AF1DA805A" commented="no"><enum>(III)</enum><text>another accrediting body determined appropriate by the Administrator.</text></subclause></clause></subparagraph></paragraph><paragraph id="H350E4C2CB4E64A9D833888D2CED1DB70"><enum>(3)</enum><header>Source reduction</header><subparagraph id="H102379A11958426A810DD692166DE17E"><enum>(A)</enum><header>In general</header><text>An eligible entity receiving a grant under this section may use such grant to carry out a project relating to source reduction, which such project may include, in accordance with subparagraph (B), carrying out product or manufacturing redesign or redevelopment to reduce byproducts, packaging, and other outputs.</text></subparagraph><subparagraph id="H6191A1AA00B44FCFAD2291338447C7F0"><enum>(B)</enum><header>Redesign and redevelopment</header><text display-inline="yes-display-inline">An eligible entity may only carry out a project described in subparagraph (A)(ii) if—</text><clause id="H1F2AB7E0E1EB48C2AFB3430F9C988A64"><enum>(i)</enum><text display-inline="yes-display-inline">the applicable manufacturer—</text><subclause id="HE910786604A54E08A96266BAB155D5BA"><enum>(I)</enum><text>is domestically owned and operated; and</text></subclause><subclause id="HF8B539DE68544A48ADA180B587D09580"><enum>(II)</enum><text>pays a living wage; and</text></subclause></clause><clause id="H6F72B1061E5C4D5A9D95F69FF2077D88"><enum>(ii)</enum><text>the redesign or redevelopment does not result in—</text><subclause id="HDD0BB3F950AE4643A5724DE2EE9C3D79"><enum>(I)</enum><text>higher toxicity of the product or byproducts;</text></subclause><subclause id="H71EEA825FF744994A506A8F31E0D22C2"><enum>(II)</enum><text>more complicated recyclability of the product or byproducts; or</text></subclause><subclause id="HFF025825AAE34319B956AB326F625205"><enum>(III)</enum><text>increased volume of byproducts compared with the original practice.</text></subclause></clause></subparagraph></paragraph><paragraph id="H6708093329A2497794B289808D1F79AB"><enum>(4)</enum><header>Market development</header><subparagraph id="H5DE2EF8B5367475F880655D8282CC0A6" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to carry out a project that—</text><clause id="HCFA56C3DE8EC4E2E8419F7D806186695" commented="no"><enum>(i)</enum><text>creates market demand for source reduction, sorted recyclable commodities, goods made of sorted recyclable commodities, or refurbished goods; and</text></clause><clause id="H2886C0AD775B486D8B087BABCDA75494" commented="no"><enum>(ii)</enum><text>as applicable, encourages or enables investment in domestically owned and operated manufacturing capacity with respect to the list in clause (i).</text></clause></subparagraph><subparagraph id="H6A9B0DDF42B0477EA1F38BF512357276"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each project carried out under this section—</text><clause id="H1094A5D4F17E45BAA9FBDC2B6442B1F1"><enum>(i)</enum><text>shall target easily or commonly recycled materials which are disproportionately disposed of in landfills or incinerated;</text></clause><clause id="H863B63FC71114DC3971EC59C36318FF9"><enum>(ii)</enum><text>shall reduce the volume, weight, or toxicity of waste and waste byproducts; and</text></clause><clause id="H9F3AA6A541284449BCB4EF5ABF2947B1"><enum>(iii)</enum><text>may not conflict with—</text><subclause id="H7DEBCA01647E416EA83AC5ACF110BC90"><enum>(I)</enum><text>minimum-content laws, such as post-consumer recycled content requirements;</text></subclause><subclause id="HEC3AD9C9CE0E468086F993675F0C839C"><enum>(II)</enum><text>beverage container deposits;</text></subclause><subclause id="H8CBAF0DBA5CA4833AF36E91B0D514DBF"><enum>(III)</enum><text>programs funded through retail fees for specific products or classes of products that use such fees to collect, treat, or recycle such products; or</text></subclause><subclause id="H7384EB5CBFFE476AA86029347633089E"><enum>(IV)</enum><text>any applicable recycled product procurement laws and expanded sustainable government purchasing requirements, as identified by the Administrator.</text></subclause></clause></subparagraph></paragraph><paragraph id="H7E161E17C7ED410692B8D54231FD1415"><enum>(5)</enum><header>Zero-emissions collection vehicles</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to carry out a project to purchase, operate, and maintain zero-emissions vehicles used to collect material for recycling or organics recycling.</text></paragraph></subsection></section><section id="HB607ACEB947E48DFB03B8C31C0D8BA29"><enum>4.</enum><header>Grants for landfill diversion</header><subsection id="H2E4B32C557F44B53A27ABE421BA66D3F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish and carry out a program to award grants, on a competitive basis, to eligible entities to develop and implement new requirements, as described in subsection (b), that reduce the amount of waste disposed of in landfills.</text></subsection><subsection id="H504BA0DA375D4EDCA542D4C077C26424"><enum>(b)</enum><header>Grant use</header><paragraph id="HB6F6117B7E4C4AFF9179B7BF85D4BFA0"><enum>(1)</enum><header>Tipping fees</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to develop and implement zero-waste practices that are accompanied by permanent increases in tipping, gate, or disposal fees imposed on the disposal of waste at landfills.</text></paragraph><paragraph id="HD6759EF159044DE0B7A06454F42CF857"><enum>(2)</enum><header>Curbside composting collection</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section may use such grant to support the implementation of State programs that mandate the availability of curbside collection of material for organics recycling for all single-family and multifamily residential households.</text></paragraph><paragraph id="H32F24C8A6ED94D35BBFDCD2380D012FF"><enum>(3)</enum><header>Landfill diversion</header><text>An eligible entity receiving a grant under this section may use such grant to support the implementation of statewide requirements that prohibit organic waste from being sent to landfills.</text></paragraph></subsection><subsection id="HDA0125C9B64E4BFF9E1F0DB1A28B8A77"><enum>(c)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means a single unit of State government or a relevant State agency.</text></subsection></section><section id="HAC91E6F41CF74ED0A330EA01520293C5"><enum>5.</enum><header>Grant applications</header><subsection id="H139AC907114647FDB0421F426D13C8B4"><enum>(a)</enum><header>Application</header><paragraph id="HC53CE074CA51492E951FDD54E6E1B420"><enum>(1)</enum><header>Criteria for all applicants</header><text>To be eligible to receive a grant under this Act, an eligible entity shall submit to the Administrator an application at such time and in such form as the Administrator requires, which shall include demonstrating that the eligible entity—</text><subparagraph id="HCDA697747F9041B98BF935F54C0277B5"><enum>(A)</enum><text>has set specific source reduction or waste prevention targets; and</text></subparagraph><subparagraph id="HF92E13D8135C4915BF3C60590C919E45"><enum>(B)</enum><text>will carry out a project that meets the applicable project requirements under section 3(b) or 4(b).</text></subparagraph></paragraph><paragraph id="HE1CB1071D9224E2886895B3AA2841C8F"><enum>(2)</enum><header>Additional application criteria for nonprofit organization</header><text>In the case of an application from an eligible entity that is a nonprofit organization, the application shall include—</text><subparagraph id="H1DBA561C7A0041549562282CF0C779B8"><enum>(A)</enum><text>a letter of support for the proposed project from—</text><clause id="H2207FF4FEBD64317BC6020439E86EA53"><enum>(i)</enum><text>a local unit of government; or</text></clause><clause id="HF2FDD1B185A3445D924789C366189444"><enum>(ii)</enum><text>another nonprofit organization that—</text><subclause id="H319FD763912948189039CF471EBC9208"><enum>(I)</enum><text>has a demonstrated history of undertaking work in the geographic region where the proposed project is to take place; and</text></subclause><subclause id="HA4A589F8CB374CF0A28C721AA2BA569F"><enum>(II)</enum><text>is not involved in the project being proposed; and</text></subclause></clause></subparagraph><subparagraph id="H02F22953320748FCB60950757325A377"><enum>(B)</enum><text>any other information the Administrator may require.</text></subparagraph></paragraph></subsection><subsection id="HE3542DBECFEC4E6E8E2C8391270980AA"><enum>(b)</enum><header>Priority factors</header><text>In awarding grants under this Act, the Administrator shall give priority to any eligible entity that—</text><paragraph id="H3C3BAA108D864E758EC5D9B2DD9C20B0"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to an eligible entity that is a State or unit of local government, has statutorily committed to implementing one or more zero-waste practices;</text></paragraph><paragraph id="HF415E6BA8FC04A038DB12492C0E2272F"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrates how use of such grant could lead to the creation of new jobs that pay a living wage and are, to the greatest extent practicable, offered to individuals who experience barriers to employment, as determined by the Administrator;</text></paragraph><paragraph id="H45B343EECECE43BD83DC51B8A72CD141"><enum>(3)</enum><text>will use such grant to carry out source reduction or waste prevention in schools;</text></paragraph><paragraph id="HF6942599E58044E5B211960C6C672835"><enum>(4)</enum><text>will use such grant to employ an adaptive management practice to identify, prevent, or address any negative environmental consequences of a project proposed to be carried out with a grant under this Act;</text></paragraph><paragraph id="H870E1398793248E9910F41A146A96202"><enum>(5)</enum><text>has a demonstrated need for additional investment in infrastructure or other resources to achieve source reduction and waste prevention targets set by the local unit of government that is responsible for waste management and recycling in the geographic area;</text></paragraph><paragraph id="H5E9D2F57FBB347F5AA691DCE116336AD"><enum>(6)</enum><text>will use such grant to develop an innovative or new technology or strategy for source reduction and waste prevention;</text></paragraph><paragraph id="H2BF7ADB41CFD4510AC88966F2F96C8F8"><enum>(7)</enum><text>demonstrates how receiving the grant will encourage further investment in source reduction and waste prevention activities; or</text></paragraph><paragraph id="HDC41084E62E246A9BA76579EBAA3E7FD"><enum>(8)</enum><text>will incorporate multi-stakeholder involvement, including nonprofit, commercial, and public sector partners, in carrying out a project using such grant.</text></paragraph></subsection><subsection id="H9835230A61E744A5B18C453747F1FF58" commented="no"><enum>(c)</enum><header>Requirement</header><text display-inline="yes-display-inline">Of the amount made available pursuant to section 8(a), not less than 75 percent shall be allocated to projects that serve, or are located in, environmental justice communities.</text></subsection></section><section id="H2B6782F05C5D4E66A48DED761F63C061"><enum>6.</enum><header>Reporting</header><text display-inline="no-display-inline">Each eligible entity that receives a grant under this Act shall submit to the Administrator a report, at such time and in such form as the Administrator may require, on the results of the project carried out with such grant, and such report shall include any relevant data requested by the Administrator for purposes of tracking the effectiveness of the programs established under section 3(a) and 4(b).</text></section><section id="H7A4E22EAAE7B4C30872974E40B7D72C7"><enum>7.</enum><header>Annual conference</header><text display-inline="no-display-inline">In each of calendar years 2022 through 2030, the Administrator shall convene an annual conference to provide an opportunity for eligible entities and other relevant stakeholders to share their experience and expertise in implementing zero-waste practices.</text></section><section id="HFF7911C92AD2426D9690D89193B28B8A"><enum>8.</enum><header>Authorization of appropriations</header><subsection id="HCDECD5D1780542E5A1440A9966686D42"><enum>(a)</enum><header>Grants for zero-Waste projects</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out section 3 $150,000,000 for each of fiscal years 2022 through 2031, to remain available until expended.</text></subsection><subsection id="HAB71C79B07234B679C66C80C82C1FC43"><enum>(b)</enum><header>Grants for landfill diversion</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out section 4 $250,000,000 for the period of fiscal years 2022 through 2031, to remain available until expended.</text></subsection></section></legis-body></bill>
