R. 2084</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210319">March 19, 2021</action-date><action-desc><sponsor name-id="C001104">Mr. Cawthorn</sponsor> (for himself and <cosponsor name-id="G000576">Mr. Grothman</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To collect and consolidate citizenship status information for the population of the United States, and for other purposes.</official-title></form><legis-body id="HCC03333E6D9E4AD0B13A1BBAE30FCBE3" style="OLC"><section id="H49ED31D0D45046A284F8ADE114538483" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Common-Sense Census Act of 2021</short-title></quote>.</text></section><section id="H4AFE9DF63A88499DA6A090CE689CA5D9"><enum>2.</enum><header>Citizenship status statistics</header><subsection id="H296D8DB5A2D040B1B4A2F5A119205103"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/3">Chapter 3</external-xref> of title 13, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HD49102BD8376443DA6A2DDE1CF7518AF" display-inline="no-display-inline"><section id="H553FAB152A8F4C39AF61094715A64395"><enum>104.</enum><header>Citizenship status</header><text display-inline="no-display-inline">The Secretary shall collect statistics on the citizenship status of persons permanently residing in the United States.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE692E06B37704C64A0E9EE2E26ACFABA"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/3">chapter 3</external-xref> of title 13, United States Code, is amended by inserting after the item related to section 103 the following new item:</text><quoted-block style="USC" id="HB20361F1FF854621B1DD0C1C3556D3DC" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">104. Citizenship status.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H88394EC874694351AA142CD89777F37C"><enum>(c)</enum><header>Citizenship status on census questionnaires</header><text>Section 141 of title 13, United States Code, is amended—</text><paragraph id="H9156C63586B84622B614E9CF951AC40E"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text></paragraph><paragraph id="H1FF0F0A78F42494BB688880D684749CF"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (f) the following:</text><quoted-block style="USC" id="HB58B86D96F184133B16B1ECFAA731182" display-inline="no-display-inline"><subsection id="H085AFE2972464782A7F2E66AB5FDCBCA"><enum>(g)</enum><text display-inline="yes-display-inline">In conducting the 2030 decennial census and each decennial census thereafter, the Secretary shall include in any questionnaire distributed or otherwise used for the purpose of determining the total population by States a checkbox or other similar option for the respondent to indicate, for the respondent and for each of the members of the household of the respondent, whether such individual is a citizen or national of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H863AE70DD0B74E9C9E69C84A2D9A238B"><enum>3.</enum><header>Citizenship data interagency working group</header><subsection id="H3A0920B4E0A64E5CBE356BEF3E3364A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Secretary of Commerce shall establish the Citizenship Data Interagency Working Group (hereinafter referred to as the <quote>Working Group</quote>).</text></subsection><subsection id="H123C4C0595124B03817D422D90CB93E4"><enum>(b)</enum><header>Duties</header><text>The Working Group shall develop and submit to the Secretary recommendations to increase to the maximum extent practicable the percentage of the population of the United States with respect to which the Department of Commerce has information about citizenship status, including recommendations for improving the access of the Department of Commerce to records containing such information that are held by Federal agencies or State or local governments.</text></subsection><subsection id="H7C7E7921ED074F0CA9432B0A0DBF1535"><enum>(c)</enum><header>Membership</header><paragraph id="H632E28970AAE441BA9D8BC6C072DB154"><enum>(1)</enum><header>Members</header><subparagraph id="HDDCC6FAF95D74CA9832B2520BF16BCAE"><enum>(A)</enum><header>In general</header><text>The Working Group shall consist of the Director of the Census Bureau, who shall serve as the chair, and the individuals appointed under subparagraph (B).</text></subparagraph><subparagraph id="H559ED2E69CCA462A9CA783DE97DAFEEE"><enum>(B)</enum><header>Agency appointments</header><clause id="H62835507880348B98BDB74DF5925EBE6"><enum>(i)</enum><header>In general</header><text>At the request of the chair of the Working Group to a Federal agency, the head of such Federal agency shall, not later than 1 month after the date on which such request is made, appoint one individual employed by such Federal agency to serve as a member of the Working Group representing such Federal agency. </text></clause><clause id="HDA906DADE21746DB8D06EE137FF66CCB"><enum>(ii)</enum><header>Initial requests</header><text>Not later than 3 months after the date of the enactment of this Act, the chair of the Working Group shall make the request described in clause (i) to each Federal agency from which an initial member of the Working Group shall be appointed under such clause.</text></clause></subparagraph></paragraph><paragraph id="HC9199C8A8B1A4738B6F20359A012B39F"><enum>(2)</enum><header>Terms</header><text>A member of the Working Group appointed under paragraph (1)(B) shall be appointed for a term of 2 years.</text></paragraph><paragraph id="H1933277387BF4193B11BC047F82C06A0"><enum>(3)</enum><header>Quorum</header><text>A quorum shall be 2 members of the Working Group.</text></paragraph><paragraph id="HA2B3ED970A584B10A0927D8C65ECFA16" commented="no"><enum>(4)</enum><header>Vacancies</header><subparagraph id="HCB1B4E3637F24A4C82527D4D8041CA89"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this paragraph, any vacancy occurring in the membership of the Working Group shall be filled in the same manner as the original appointment for the position being vacated.</text></subparagraph><subparagraph id="HAFCC6C385D784CB4AFFC8B48801CD1B2"><enum>(B)</enum><header>Agency appointments</header><text>With respect to filling a vacancy for which the original appointment was made under paragraph (1)(B), a head of a Federal agency shall fill such vacancy without a request from the chair of the Working Group.</text></subparagraph><subparagraph id="H9281546F36DF464697C63CFA6BC4F59D"><enum>(C)</enum><header>Agency participation ending</header><text>A vacancy resulting from the expiration of the term of a member appointed under paragraph (1)(B) shall not be filled if the chair has provided notice to the Federal agency which such member represented that such participation by such Federal agency in the Working Group is no longer required.</text></subparagraph><subparagraph id="H4041CCAE77F0464A8ABB1A8AC3D3ADD9"><enum>(D)</enum><header>Term continued</header><text display-inline="yes-display-inline">The term of a member appointed to fill a vacancy, other than a vacancy resulting from the expiration of the term of a member, shall be the remainder of the term of the former member who vacated the position.</text></subparagraph><subparagraph id="H1E64D0DEE51B4AE3A446F7BEB78F7357"><enum>(E)</enum><header>Vacancy effects</header><text>A vacancy shall not affect the power of the remaining members to execute the duties of the Working Group except to the extent that such vacancy results in less than a quorum.</text></subparagraph></paragraph><paragraph id="H67FF282D8E044B28BBEBBBD4548522AC" commented="no"><enum>(5)</enum><header>Compensation</header><text>Members of the Working Group who are full-time officers or employees of the United States or Members of Congress may not receive additional pay, allowances, or benefits by reason of their service on the Working Group.</text></paragraph></subsection><subsection id="HFB7D3FA0F46A409789D1595E2D8B09F2" commented="no"><enum>(d)</enum><header>Administrative and technical support</header><text display-inline="yes-display-inline">The Secretary shall provide the Working Group with such administrative support, staff, and technical assistance as the Secretary determines necessary for the Working Group to carry out it duties.</text></subsection><subsection id="HD271DD9C5F6A4EF1B3810BDB50C5AEEC"><enum>(e)</enum><header>Detail of federal employees</header><text display-inline="yes-display-inline">Any Federal employee may be detailed to the Commission without reimbursement from the Commission, and such detailee shall retain the rights, status, and privileges of his or her regular employment without interruption.</text></subsection><subsection id="H4F99B9F7D83943D79F4153F4856B371F" commented="no"><enum>(f)</enum><header>Federal advisory committee act</header><text>The provisions of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply with respect to the Working Group.</text></subsection><subsection id="H7503D8B5D3374767AEEB83B0DB31E787"><enum>(g)</enum><header>Definitions</header><text>In this section: </text><paragraph id="HAF5AEE02605B4B1C8CC0D2A67D1AABED"><enum>(1)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means any agency as that term is defined in section 551(1). </text></paragraph><paragraph id="HEE716313E4EE40FBB9AD845F41CD8490"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="HF443AF121BE54C88888CE0541816E2D5"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States. </text></paragraph></subsection></section><section id="H1EFBA7E1009447E8B4AA768BBCD45BEC"><enum>4.</enum><header>Citizenship-based reapportionment</header><text display-inline="no-display-inline">Section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), is amended to read as follows:</text><quoted-block style="USC" id="H74F4A29E34554D0692BFA2B0CE448D2D" display-inline="no-display-inline"><subsection id="HD7DE93E2B96340B3AE42A91185FFFDB0"><enum>(a)</enum><text display-inline="yes-display-inline">On the first day, or within one week thereafter, of the first regular session of the One Hundred Twenty-second Congress and of each fifth Congress thereafter, the President shall transmit to the Congress a statement showing the whole number of persons in each State, excluding Indians not taxed, as ascertained under the seventeenth and each subsequent decennial census of the population, and the number of Representatives to which each State would be entitled under an apportionment of the then existing number of Representatives by the method known as the method of equal proportions under which only citizens of the United States shall be considered in determining such apportionment, no State to receive less than one Member.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
