which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to provide for certain protections for aliens granted temporary protected status or deferred enforced departure, and for other purposes.</official-title></form><legis-body id="H97F5BE61B230417588C52CED51B2D095" style="OLC"><section id="H109305F28FFD44958E2288AFF093749A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TPS and DED Protection Act of 2021</short-title></quote>.</text></section><section id="H5342F5EB3C5A46D58768BCC676E607F0"><enum>2.</enum><header>Adjustment of status for certain non-immigrant nationals granted temporary protected status or deferred enforced departure</header><text display-inline="no-display-inline">Title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) is amended by inserting after section 244 the following (and amending the table of contents accordingly):</text><quoted-block display-inline="no-display-inline" id="H7D1EC05AF8E4462AA3EE807523A18E4D" style="OLC"><section id="H803891C15AD04C5D9126BC5B179ADF81"><enum>244A.</enum><header>Adjustment of status for certain nationals in receipt of temporary protected status or deferred enforced departure</header><subsection id="H9E94F144D03046BEABB2BFB47F613202"><enum>(a)</enum><header>In general</header><text>The status of any alien described in subsection (c) shall be adjusted by the Secretary of Homeland Security to that of an alien lawfully admitted for permanent residence, if the alien—</text><paragraph id="HE1020853F63A4BC5BA44CCA9033AC263"><enum>(1)</enum><text>applies for such adjustment within 3 years after the date of enactment of this section;</text></paragraph><paragraph id="H8176D495220D44A9ADD4CC86703F8D56"><enum>(2)</enum><text>is determined to be admissible to the United States for permanent residence; and</text></paragraph><paragraph id="HF0B7CCAFA00D42FF9FE751269278A617"><enum>(3)</enum><text>meets the criteria established under subsection (c).</text></paragraph></subsection><subsection id="HA7F9D90896A74A72B01515F81F3E59AE"><enum>(b)</enum><header>Certain grounds for inadmissibility inapplicable</header><paragraph id="H1299FF0A372E4293880A8D82BA2B2C7C"><enum>(1)</enum><header>In general</header><text>For purposes of determining admissibility under subsection (a)(2), the grounds for inadmissibility specified in paragraphs (4), (5), (6)(A), and (7)(A) of section 212(a) of the Immigration and Nationality Act shall not apply.</text></paragraph><paragraph id="HA47A338A09704420B70370FD41F57EA3"><enum>(2)</enum><header>Additional waiver for individual aliens</header><text>The Secretary may waive any other provision of section 212(a) in the case of an individual alien for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest.</text></paragraph></subsection><subsection id="HC09BCDC5E7A74217B2270A90893B7B6E"><enum>(c)</enum><header>Aliens eligible for adjustment of status</header><paragraph id="HA251C5996558422681B3B0B6F4993FC2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An alien shall be eligible for adjustment of status if—</text><subparagraph id="H6D75254AD643426BBF1C67D2746496B5"><enum>(A)</enum><text>the alien is a national of a country (or part of a country) with a designation under 244(b) of the Immigration and Nationality Act during the period specified in section 244(b)(2) and who was granted temporary protected status, or was otherwise eligible for temporary protected status, on or before October 1, 2017, or has been granted Deferred Enforced Departure (hereinafter in this section referred to as <quote>DED</quote>) on or before October 1, 2017; and</text></subparagraph><subparagraph id="HE6ABFB01EAFE43769687976C026C504C"><enum>(B)</enum><text>the alien has been continuously physically present in the United States for a period of not less than 3 years before the date of the enactment of this section.</text></subparagraph></paragraph><paragraph id="H7FBB982AA8F44A9CB2249B568F33BC82"><enum>(2)</enum><header>TPS aliens previously removed or departed</header><text>An alien shall be eligible for adjustment of status if the alien was removed or voluntarily departed from the United States on or after September 25, 2016, if the alien—</text><subparagraph id="H59ADFCA05AB548CF91F624F4607A0D04"><enum>(A)</enum><text>applies from abroad;</text></subparagraph><subparagraph id="H29F4216C146C4B62A15CB5E6242E869C"><enum>(B)</enum><text>was continuously physically present in the United States for a period of not less than 3 years before the date of removal or departure;</text></subparagraph><subparagraph id="HE09E8326FA0B48A08C4CBB602885E73A"><enum>(C)</enum><text>had temporary protected status on such date, or was otherwise eligible, on such date, for temporary protected status notwithstanding subsections (c)(1)(A)(iv) and (c)(3)(C) of section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>); and</text></subparagraph><subparagraph id="HCB5768B6D5964D05830321763C6D8AE7"><enum>(D)</enum><text>the sole reason for the alien’s removal or departure was—</text><clause id="H95185E4981DA4C82A3F61BCA34CB934E"><enum>(i)</enum><text>that the alien was present in the United States after the expiration of the designation of that foreign state (or part thereof) under section 244(b)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(b)(3)(B)</external-xref>); or</text></clause><clause id="HCEEDA859FB304F96B13E5D150120ECD7"><enum>(ii)</enum><text>in the case of a voluntary departure, the alien did so on the basis of the Secretary’s determination to terminate such designation.</text></clause></subparagraph></paragraph><paragraph id="H85121DDE0165418BBB1017EC5AC010E9"><enum>(3)</enum><header>DED aliens previously removed or departed</header><text>An alien shall be eligible for adjustment of status if the alien was removed or voluntarily departed from the United States on or after September 28, 2016, if the alien—</text><subparagraph id="H16337D5414A7436F969FB19C6BA8397A"><enum>(A)</enum><text>applies from abroad;</text></subparagraph><subparagraph id="HDA341FD17BBC40C798AD6BBD786F5664"><enum>(B)</enum><text>is under a grant of Deferred Enforced Departure as of September 28, 2016;</text></subparagraph><subparagraph id="H45566300DE6A48C09C9F0BDB08716DFD"><enum>(C)</enum><text>was continuously physically present in the United States for a period of not less than 3 years before the date of removal or departure; and</text></subparagraph><subparagraph id="HE2AF3A38A484426E834E75453BB31112"><enum>(D)</enum><text>the sole reason for the alien’s removal or departure—</text><clause id="HC7FB9B702DD845A49761E132B2005BAC"><enum>(i)</enum><text>was that the alien was present in the United States after the expiration of the deferral of enforced departure directed in the Presidential Memorandum on Deferred Enforced Departure for Liberians issued on September 28, 2016, or any subsequent extension of such deferral; or</text></clause><clause id="H09D830C060C248C38513EB12531DDF12"><enum>(ii)</enum><text>in the case of a voluntary departure, the alien did so on the basis of the President’s determination to terminate such presidential memorandum or extension.</text></clause></subparagraph></paragraph></subsection><subsection id="H550BBC3F0E1841568F18E83FDB0AA683"><enum>(d)</enum><header>Waiver authorized</header><text>Notwithstanding any provision of the Immigration and Nationality Act, an alien who fails to meet the continuous physical presence requirement under paragraph (2) of subsection (c) shall be considered eligible for status adjustment as provided in this section if the Attorney General or the Secretary determines that the removal of the alien from the United States would result in extreme hardship to the alien, their spouse, their children, their parents, or their domestic partner.</text></subsection><subsection id="HD541DCB1FE854CC8849EA0272DA6DD70"><enum>(e)</enum><header>Effect of application on certain orders</header><text>An alien present in the United States who has been ordered removed or has been granted voluntary departure from the United States may, notwithstanding such order, apply for adjustment of status under this section. Such alien shall not be required to file a separate motion to reopen, reconsider, or vacate the order of removal. If the Secretary approves the application, the Secretary shall cancel the order of removal. If the Secretary renders a final administrative decision to deny the application, the order of removal shall be effective and enforceable to the same extent as if the application had not been made.</text></subsection><subsection id="HC53234AA24DD4743AC3E86D97580C0E4"><enum>(f)</enum><header>Work authorization</header><text>The Secretary shall authorize an alien who has applied for adjustment of status under this section to engage in employment in the United States during the pendency of such application and shall provide the alien with an appropriate document signifying authorization of employment.</text></subsection><subsection id="H35BD73B45C5E460791AEFA4B40ECB954"><enum>(g)</enum><header>Adjustment of status for certain family members</header><paragraph id="H696214B5B2164C5C84B3C5CF2F47ABBA"><enum>(1)</enum><header>In general</header><text>The status of an alien shall be adjusted by the Secretary to that of an alien lawfully admitted for permanent residence if the alien—</text><subparagraph id="HFAAE29B3CCAB4C369F5288A0D1E460AD"><enum>(A)</enum><text>is the spouse, parent, or unmarried son or daughter of an alien whose status is adjusted under this section;</text></subparagraph><subparagraph id="HBC78A195A37B4951B9701F1C02AF1A25"><enum>(B)</enum><text>applies for adjustment under this section within 3 years after the date of enactment of this Act; and</text></subparagraph><subparagraph id="HF9807AD9DB494BC8B97F8C15E188C48E"><enum>(C)</enum><text>is determined to be admissible to the United States for permanent residence.</text></subparagraph></paragraph><paragraph id="H6E4A6FFECED040239EF59587407962F2"><enum>(2)</enum><header>Certain grounds for inadmissibility inapplicable</header><text>For purposes of determining admissibility under subsection (g)(1)(C), the grounds for inadmissibility specified in paragraphs (4), (5), (6)(A), and (7)(A) of section 212(a) shall not apply.</text></paragraph></subsection><subsection id="HCE82D4AC320B44E2BF7743936B758224"><enum>(h)</enum><header>Availability of administrative review</header><text>The Secretary shall provide to aliens applying for adjustment of status under this section the same right to, and procedures for, administrative review as are provided to—</text><paragraph id="H4528B1F0A85448818AB353B08E41DAA4"><enum>(1)</enum><text>applicants for adjustment of status under section 245; or</text></paragraph><paragraph id="HED754EAFD66646EC9887F433340C1AAA"><enum>(2)</enum><text>aliens subject to removal proceedings under section 240.</text></paragraph></subsection><subsection id="H410DDB5FA3DE49419939156A2976B931"><enum>(i)</enum><header>No offset in number of visas available</header><text>The granting of adjustment of status under this section shall not reduce the number of immigrant visas authorized to be issued under any provision of the Immigration and Nationality Act.</text></subsection><subsection id="H0E64BE19B8234923820FAF87CE16BB23"><enum>(j)</enum><header>Treatment of brief, casual, and innocent departures and certain other absences</header><text>An alien who has failed to maintain the 3-year continuous physical presence requirement under subsection (c) because of brief, casual, and innocent departures or, emergency travel, or extenuating circumstances outside of the control of the alien, shall not be considered to have failed to maintain continuous physical presence in the United States.</text></subsection><subsection id="H885F8C32DD23460E827F58EACE04E93A"><enum>(k)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to include aliens (as a class or individual basis) from previously designated countries that no longer have valid temporary protected status designation under section 244(b), or aliens who no longer have a valid deferred enforced departure status, unless such designated status or previously deferred enforced departure expires on or after January 1, 2017.</text></subsection><subsection id="H03D7070DE15D41248ABC06957D009D94"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF0C7E39DC51F49E0A6D9A4DB5AFD8144"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>domestic partner</term> means an adult of at least 18 years of age in a committed relationship with the alien applying for adjustment. A committed relationship is one in which the employee and the domestic partner of the employee are each other’s sole domestic partner (and are not married to or domestic partners with anyone else) and share responsibility for a significant measure of each other’s common welfare and financial obligations. This includes, but is not limited to, any relationship between two individuals of the same or opposite sex that is granted legal recognition by a State or by the District of Columbia as a marriage or analogous relationship (including, but not limited to, a civil union).</text></paragraph><paragraph id="HCF907DDE1AA74ECA9BBCDC8612F881DD"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>provide for its repatriated citizens</term> means a country’s ability to provide safety, and social safety net services, including preventive healthcare services, and housing.</text></paragraph><paragraph id="HE91D6FDC61AA49A49A6E0623EB48B6EE"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>Deferred Enforced Departure</term> or <term>DED</term> refers to the presidential directive issued on September 28, 2016.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE78D6C23A9114EC4A5C1999E1230601F"><enum>3.</enum><header>Reporting requirements regarding future discontinued eligibility of aliens from countries currently listed under temporary protected status</header><subsection id="HB6B4CA10C47840A89DB4C4F23FDF1D97"><enum>(a)</enum><header>Additional reporting requirements</header><text>Section 244(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(b)(3)</external-xref>) is amended by adding at the end, the following:</text><quoted-block display-inline="no-display-inline" id="H43B957179F444B1BB9F5EDFB75CCA534" style="OLC"><subparagraph id="H50600F2CC52C46B59B4F63945A9F5706"><enum>(D)</enum><header>Report on terminations</header><text display-inline="yes-display-inline">Within 3 days after the Attorney General’s announcement, including by notice in the Federal Register, of a country’s designation being terminated from Temporary Protected Status, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the House Judiciary Committee a report that includes—</text><clause id="H2CD818D192AC4D269DB8C0425DBDF654"><enum>(i)</enum><text display-inline="yes-display-inline">an explanation of the event or events that initially prompted a country’s designation under temporary protected status;</text></clause><clause id="HFAAD072D8F6F45869C43D4C1C1022A19"><enum>(ii)</enum><text>the progress the country has made in remedying the designation specified in clause (i), including any significant challenges or shortcomings that have not been addressed since the initial designation; and</text></clause><clause id="H9E745FE920FC43B78FE698884FF28CD4"><enum>(iii)</enum><text>an analysis, with applicable and relevant metrics as determined by the Secretary, of the country’s ability to repatriate its nationals, including—</text><subclause id="HB5C9A977B2D046528482C6B3BD559E82"><enum>(I)</enum><text display-inline="yes-display-inline">the country’s financial ability to provide for its repatriated citizens;</text></subclause><subclause id="H5C613A51C8BB40B4BC2872834E63385C"><enum>(II)</enum><text>the country’s financial ability to address the initial designation specified in clause (i) without foreign assistance;</text></subclause><subclause id="H1D8B4129DD8A4D57A5487D5E78D93378"><enum>(III)</enum><text>the country’s gross domestic product, gross domestic product per capita, and an analysis of the country’s ability to be economically self-sufficient without foreign assistance;</text></subclause><subclause id="H52EBCEE834BF458C9F5A44FC3C931BC3"><enum>(IV)</enum><text>the economic and social impact repatriation of nationals in possession of temporary protected status would have on the recipient country; and</text></subclause><subclause id="H334CBF8993D4483C899D1D711BF5CE4D"><enum>(V)</enum><text>any additional metrics the Secretary deems necessary.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H09910F0A24214869881CEC128500AF6C"><enum>4.</enum><header>Adjustment of relation of period of temporary protected status to cancellation of removal</header><text display-inline="no-display-inline">Section 244(e) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(e)</external-xref>) is amended—</text><paragraph id="H4CA1F83A03064B2386B5F3AA1AEC299D"><enum>(1)</enum><text>by striking <quote>With respect to an alien</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H166389C775FF42278A76D76728676F37" style="OLC"><paragraph id="H83D6244F6A674E66BDF155CA18A49CE5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to an alien</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HB45B659DE61A4C44A8005CC8DA2C0A71"><enum>(2)</enum><text>by adding at the end, the following:</text><quoted-block id="HB87F80AE0B054212ABC5DE0B86D5D0D1" style="OLC"><paragraph id="H0254C143D6264C028600BD4FE0DD1FA4"><enum>(2)</enum><header>Waiver for certain temporary protected status holders</header><text>The provisions in subsection (e) shall not apply to an alien who is eligible for adjustment of status pursuant to section 244A of the Immigration and Nationality Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3FB3004147844C1FBAAB59E65B87656C"><enum>5.</enum><header>Eligibility for naturalization</header><subsection id="HBBA6FDA9E40740F1BF56D3AA27D0C1DD"><enum>(a)</enum><header>In general</header><text>Notwithstanding sections 319(b), 328, and 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1430">8 U.S.C. 1430(b)</external-xref>, 1439, and 1440), an alien whose status is adjusted under section 244A of the Immigration and Nationality Act to that of an alien lawfully admitted for permanent residence may apply for naturalization under chapter 2 of title III of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1421">8 U.S.C. 1421</external-xref> et seq.) not earlier than 5 years after such adjustment of status.</text></subsection><subsection id="H0A780F37C2E94D928F4593A91B79A796"><enum>(b)</enum><header>Language requirement waiver</header><text>Section 312(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1423">8 U.S.C. 1423(b)(2)</external-xref>) is amended—</text><paragraph id="H6F3F88575BF24AF483BB554101E5C4F5"><enum>(1)</enum><text>in subparagraph (A), by adding <quote>or</quote> at the end;</text></paragraph><paragraph id="H4EA9E2827B4848EC99ED43D611B1FFBF"><enum>(2)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H1585C949E961436FB594DDDF833AE712"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H03D4C3C71764446285E5380A17A74B0A" style="OLC"><subparagraph id="H753B387060844456863549E579D715AE"><enum>(C)</enum><text display-inline="yes-display-inline">is an alien in receipt of status adjustment under section 244A of the Immigration and Nationality Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H81FA14659B62432492EFAEB71C856791"><enum>6.</enum><header>Designation for purposes of granting temporary protected status</header><subsection id="H59BD594A4A604CF399126B7F51BDC485"><enum>(a)</enum><header>Designation</header><paragraph id="HFBA35E3396CC486E813315378D3AE582"><enum>(1)</enum><header>In general</header><text>For purposes of section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>), Venezuela and Eritrea shall be treated as if each had been designated under subsection (b)(1)(C) of that section, subject to the provisions of this section.</text></paragraph><paragraph id="H3E582690F0C445FAAF4DA9209B3879DF"><enum>(2)</enum><header>Period of designation</header><text>The initial period of the designation referred to in paragraph (1) shall be for the 18-month period beginning on the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H39FF37C824B64C67BBB20E846BE749B4"><enum>(b)</enum><header>Aliens eligible</header><text>As a result of the designation made under subsection (a), an alien who is a national of Venezuela or Eritrea is deemed to satisfy the requirements under paragraph (1) of section 244(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)</external-xref>), subject to paragraph (3) of such section, if the alien—</text><paragraph id="H4741500AE4124DE7B5E798CF0C1F09B9"><enum>(1)</enum><text>has been continuously physically present in the United States since the date of the enactment of this Act;</text></paragraph><paragraph id="H0F2596D3408047B9B786FB5B1B0AB53B"><enum>(2)</enum><text>is admissible as an immigrant, except as otherwise provided in paragraph (2)(A) of such section, and is not ineligible for temporary protected status under paragraph (2)(B) of such section; and</text></paragraph><paragraph id="H41A3BB77007E4BEA829D2316C0B6EE2C"><enum>(3)</enum><text>registers for temporary protected status in a manner established by the Secretary of Homeland Security.</text></paragraph></subsection><subsection id="H83545A546111485B85898D8DC404FD8A"><enum>(c)</enum><header>Consent To travel abroad</header><paragraph id="H246BFC0F8A184343B7FC9F06DB2A7E0C"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall give prior consent to travel abroad, in accordance with section 244(f)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(f)(3)</external-xref>), to an alien who is granted temporary protected status pursuant to the designation made under subsection (a) if the alien establishes to the satisfaction of the Secretary of Homeland Security that emergency and extenuating circumstances beyond the control of the alien require the alien to depart for a brief, temporary trip abroad.</text></paragraph><paragraph id="HC6A9123CC46D4790B0CFA326B0C79CC7"><enum>(2)</enum><header>Treatment upon return</header><text>An alien returning to the United States in accordance with an authorization described in paragraph (1) shall be treated as any other returning alien provided temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
