which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To accelerate rural broadband deployment.</official-title></form><legis-body id="H9A2C96B6E2BA443EAD85E28C902C0E13" style="OLC"><section id="H3363E4F9A4464165A964C23219B95274" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Broadband Connectivity Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="HB1E34566A49C437D98754C06F1D6F14B"><enum>2.</enum><header>Accelerating broadband connectivity</header><subsection id="HECA5D948C22F4018ACE8708C5E1BA878"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H6CD6E250E07E4AC7A0999837D7E0415E"><enum>(1)</enum><text>the term <term>Commission</term> means the Federal Communications Commission;</text></paragraph><paragraph id="HB9BD95A6DA34423DB0AB377726E4A47F"><enum>(2)</enum><text>the terms <term>Phase I</term> and <term>Phase II</term> mean Phase I and Phase II, respectively, of the Rural Digital Opportunity Fund auction provided for in the Report and Order in the matter of Rural Digital Opportunity Fund and Connect America Fund adopted by the Commission on January 30, 2020 (FCC 20–5);</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HE5D1E8D572FB4A8B8D51BB1CFA20E107"><enum>(3)</enum><text>the term <term>qualified carrier</term> means a terrestrial telecommunications carrier that receives support from the Rural Digital Opportunity Fund under subpart J of part 54 of title 47, Code of Federal Regulations, or any successor regulations; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H317FD0EBD03A4D4E849350AD3B5F9B6A"><enum>(4)</enum><text>the term <term>Rural Digital Opportunity Fund support</term> means support from the Rural Digital Opportunity Fund under subpart J of part 54 of title 47, Code of Federal Regulations, or any successor regulations.</text></paragraph></subsection><subsection id="HE3F10D2F62BF45BB90ECEBE414A7E6CE"><enum>(b)</enum><header>Accelerating Broadband Connectivity Fund</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Accelerating Broadband Connectivity Fund</quote>.</text></subsection><subsection id="HAB29EBF31C4944F99E6E886D622EDE13"><enum>(c)</enum><header>Availability of funds</header><text>The Commission may use amounts in the Accelerating Broadband Connectivity Fund to provide support to qualified carriers in accordance with subsection (d).</text></subsection><subsection id="HD2477FC885EC44DC8E6E64FDA3299F01"><enum>(d)</enum><header>Amount and use of funds</header><paragraph id="H6754E7120F7E42EAABF149873043F8C4"><enum>(1)</enum><header>In general</header><subparagraph id="H17DB34602C764C139D097B739A9E1965"><enum>(A)</enum><header>Phase I support recipients</header><text>The Commission shall make one-time funding offers to qualified carriers that receive Rural Digital Opportunity Fund support during Phase I, and that commit to meeting the conditions under paragraph (2), to accelerate the broadband deployment obligations assumed by those carriers with respect to that support.</text></subparagraph><subparagraph id="H9601B6B62AEA42CCA77555DF5F95E624"><enum>(B)</enum><header>Phase II support recipients</header><text>The Commission shall use any amounts in the Accelerating Broadband Connectivity Fund that are not otherwise committed under subparagraph (A) to make one-time funding offers to qualified carriers that receive Rural Digital Opportunity Fund support during Phase II, and that commit to meeting the conditions under paragraph (2), to accelerate the broadband deployment obligations assumed by those carriers with respect to that support.</text></subparagraph></paragraph><paragraph id="H5AD385C3B3D54407A082234F081DB250"><enum>(2)</enum><header>Conditions</header><subparagraph id="HA52C10D3A278475485EAC22BCF119E7A"><enum>(A)</enum><header>In general</header><text>A qualified carrier that receives amounts under paragraph (1) shall—</text><clause id="H604FC89C82FA4C468F84232B7E8BBA0E"><enum>(i)</enum><text>begin construction of the broadband network for which the amounts are awarded not later than 180 days after the date on which the award under paragraph (1) is authorized;</text></clause><clause id="H851CA221CE264BCD953A3B9A1DEB5306"><enum>(ii)</enum><text>begin to make broadband service available from the broadband network deployed using Rural Digital Opportunity Fund support not later than 1 year after the date on which the award under paragraph (1) is authorized; and</text></clause><clause id="H1A3E00F2BD9742979A7A183D408202EC"><enum>(iii)</enum><text>meet all buildout obligations from the Rural Digital Opportunity Fund support not later than 3 years after the date on which the award under paragraph (1) is authorized.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5EED541AE8584F1CB22F7C064D8970D5"><enum>(B)</enum><header>Force majeure</header><text>The Commission shall adopt rules under subsection (f)(1) to provide for the extension of a deadline under subparagraph (A) of this paragraph if an event outside the control of a qualified carrier prevents the qualified carrier from meeting the deadline.</text></subparagraph></paragraph><paragraph id="HF9AB3B0D4E4743208324F32B1719013C" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Amount of award</header><text>The amount awarded to a qualified carrier under paragraph (1) shall be proportional to the amount of Rural Digital Opportunity Fund support received by the qualified carrier.</text></paragraph></subsection><subsection id="H37DBA0B45A45471999E788BC804BCB00"><enum>(e)</enum><header>Documentation required</header><text>A qualified carrier that receives amounts under this section shall—</text><paragraph id="HAA4DCDABA4784BB7AA69D71831B053DB"><enum>(1)</enum><text>maintain appropriate documentation demonstrating the use of the amounts; and</text></paragraph><paragraph id="H53A856F2074C4941B2757D7BFF793FFB"><enum>(2)</enum><text>make the documentation described in paragraph (1) available upon request as prescribed by the Commission.</text></paragraph></subsection><subsection id="H36E07C6BF96C47E0A89A3A9C6D2D3262"><enum>(f)</enum><header>Expedited rulemaking</header><paragraph id="HFE4E4C65BFED46B9804AFBB7E9CC8490"><enum>(1)</enum><header>In general</header><text>The Commission shall adopt rules to carry out this section as needed on an expedited basis.</text></paragraph><paragraph id="H8D8AE25699E3421AAFC5F1AB64756CCC"><enum>(2)</enum><header>Use of existing rules authorized</header><text>To the extent the Commission determines necessary in the public interest, the Commission may rely on the rules under part 54 of title 47, Code of Federal Regulations, and funding distribution mechanisms established under those rules in administering funds made available under this section.</text></paragraph><paragraph id="H6F5A5A68665A4333AD33C9BDB4A8CBAB"><enum>(3)</enum><header>Administrative Procedure Act exemption</header><text>The Commission shall adopt rules under paragraph (1) without regard to the notice and comment requirements under section 553 of title 5, United States Code.</text></paragraph><paragraph id="H659A60F54BE94C37B1CFA3F9E945C1F2"><enum>(4)</enum><header>Paperwork Reduction Act exemption</header><text>A collection of information conducted or sponsored under this section shall not constitute a collection of information for the purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection><subsection id="HD3C8B4430D9D4344AFD1BD44CB8FA037"><enum>(g)</enum><header>Enforcement</header><paragraph id="HE927123FD6984125874FAA6270D6C16C"><enum>(1)</enum><header>In general</header><text>The Commission shall implement and enforce this section as if it were a part of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.).</text></paragraph><paragraph id="H9EC04EBCE59840D8AB217840551D7484"><enum>(2)</enum><header>Unlawful funding application</header><subparagraph id="H63910ED86C12458A8332C6CE9A648850"><enum>(A)</enum><header>Offense</header><text>It shall be unlawful for a person to willfully, knowingly, or recklessly seek funding under this section if doing so would violate—</text><clause id="H3D6EE4F1EBAF4811BE39FF6F5E4D1322"><enum>(i)</enum><text>this section; or</text></clause><clause id="H488CCC35542F43058A09A2BC84D283AE"><enum>(ii)</enum><text>any rules of the Commission.</text></clause></subparagraph><subparagraph id="H3BDA67E6CC704CA3ACD42245EBE495CA"><enum>(B)</enum><header>Forfeitures</header><text>Any person who violates subparagraph (A) shall be subject to a forfeiture in an amount of not more than 3 times the amount of funds made available to the person under this section, in addition to any forfeiture authorized under section 503 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503</external-xref>).</text></subparagraph></paragraph><paragraph id="HA6FA8FE8652F4A058A7BDAE49E1CCDD3"><enum>(3)</enum><header>Audit and inquiry requirements</header><text>The Commission shall adopt requirements, through the expedited rulemaking under subsection (f), to—</text><subparagraph id="H8D199C2367D04D11ACC8B8D470AF2404"><enum>(A)</enum><text>ensure that a qualified carrier that receives amounts under this section complies with the requirements of this section; and</text></subparagraph><subparagraph id="H2E383785B4E341379691CFF8E932DC48"><enum>(B)</enum><text>prevent waste, fraud, and abuse of the amounts distributed under this section.</text></subparagraph></paragraph></subsection><subsection id="H4BDC9C0C28CC40CBB85CB964817FD055"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Accelerating Broadband Connectivity Fund $6,000,000,000 for purposes of this section.</text></subsection></section></legis-body></bill>
