R. 2059</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="S001168">Mr. Sarbanes</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 5542 of title 5, United States Code, to provide that any hours worked by Federal firefighters under a qualified trade-of-time arrangement shall be excluded for purposes of determinations relating to overtime pay.</official-title></form><legis-body id="HDBD21BBE48D14EDF8152302916761B91" style="OLC"><section section-type="section-one" id="HE3D9898A54A94465A0C893F95C66205D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Firefighter Flexibility and Fairness Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H64BF190F8BE547F384AEE96919D44D62"><enum>2.</enum><header>Treatment of hours worked under a qualified trade-of-time arrangement</header><text display-inline="no-display-inline">Section 5542 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H043AD34A8CF74272803301952CB933C8"><subsection id="HE670FFE91EAD428CB5E22AEC6C63804F"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H61C08CC4D93F47A1B03CFC567E238380"><enum>(1)</enum><text>Notwithstanding any other provision of this section, any hours worked by a firefighter under a qualified trade-of-time arrangement shall be disregarded for purposes of any determination relating to eligibility for, or the amount of, any overtime pay under this section.</text></paragraph><paragraph id="HDAF44E2F0174428686792297DE5927BD" indent="up1"><enum>(2)</enum><text>For purposes of this subsection—</text><subparagraph id="H695C18A01FEF4348A09B3BECAD90AF2A"><enum>(A)</enum><text>the term <term>qualified trade-of-time arrangement</term> means an arrangement under which 2 firefighters who are employed by the same agency agree, solely at their option and with the approval of their employing agency, to substitute for one another during scheduled work hours in the performance of work in the same capacity; and</text></subparagraph><subparagraph id="HE210F588AF4B484094A7582285D2A1DA"><enum>(B)</enum><text>the term <term>firefighter</term> means a firefighter as defined by section 8331(21) or 8401(14).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
