<official-title display="yes">To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1986 to provide for certain health coverage of newborns.</official-title>

<section id="H84D8B59C12324D88AB461533C1108C52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Surprise Bills for New Moms Act</short-title></quote>. </text></section> <section id="H599D3FFE04BF4056A322F72E6753057F"><enum>2.</enum><header>Providing for certain health coverage of newborns</header> <subsection id="H5480A62881734857A623DAEF8D418832"><enum>(a)</enum><header>PHSA amendments</header><text display-inline="yes-display-inline">Section 2725 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-25">42 U.S.C. 300gg–25</external-xref>) is amended—</text>
<paragraph id="H78B6EF40E88A447E886ED8FE09A81C76"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through (f) as subsections (e) through (g), respectively;</text></paragraph> <paragraph id="H7B9995663AAB44BCA71EF1642793C298"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="H28EF52A1F7024AEBBFC2D18462541BE1"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>(or, in the case of subsection (d), the parent or newborn child of such parent)</quote> after <quote>mother or her newborn child</quote>; and</text></subparagraph> <subparagraph id="H879BF7685A42430293A91AF061AABAF0"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>(or, in the case of subsection (d), parents)</quote> after each occurrence of <quote>mothers</quote>; </text></subparagraph></paragraph>
<paragraph id="HC3F337FEF5334072A513FE04EF077591"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text> <quoted-block style="OLC" id="H73AEF671D42C44B9A224B07ECEAE630B" display-inline="no-display-inline"> <subsection id="H05F1B9303A974F5CBC26AEAA6BA579C3"><enum>(d)</enum><header>Newborn coverage</header><text display-inline="yes-display-inline">A group health plan, and a health insurance issuer offering group or individual health insurance coverage, shall, in the case of a parent who is a participant or beneficiary in the plan or coverage—</text>
<paragraph id="H47C8440CAABA4F1399A4F748C6E8899D"><enum>(1)</enum><text display-inline="yes-display-inline">provide coverage to a newborn of such parent for a 30-day period after the date of the birth of such newborn for any service for which coverage is otherwise provided under such plan or coverage;</text></paragraph> <paragraph id="H6817DD41389B4A2F924A82E9C7EA0DD6"><enum>(2)</enum><text>provide for a special enrollment period to enroll such newborn in the plan or coverage during at least the 60-day period following the period specified in paragraph (1); and</text></paragraph>
<paragraph id="H13028FE0DD6B40779114061356B84F9A"><enum>(3)</enum><text display-inline="yes-display-inline">in the case that such plan or coverage receives a claim for items and services furnished to such newborn of such participant or beneficiary and such newborn is not enrolled under such plan or coverage, provide immediate notification to the participant or beneficiary that such newborn is not so enrolled.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HC85D381B3752492589D4ED2288F760A5"><enum>(4)</enum><text>in subsection (g)(1), as redesignated by paragraph (1), by inserting <quote>(other than subsection (d))</quote> after <quote>this section</quote>. </text></paragraph></subsection>
<subsection id="HDD27219D40C84AD496DA5F61177D1B46"><enum>(b)</enum><header>ERISA amendments</header><text display-inline="yes-display-inline">Section 711 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185</external-xref>) is amended—</text> <paragraph id="HEA6E4E8F71CF44B4AB3E5B8DDAE85149"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through (f) as subsections (e) through (g), respectively; and </text></paragraph>
<paragraph id="H952E87B7DE4841479EC9BE3AF0C50B3A" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="HFBF24181579A4AEAAE9A3231605F30DC"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>(or, in the case of subsection (d), the parent or newborn child of such parent)</quote> after <quote>mother or her newborn child</quote>; and</text></subparagraph>
<subparagraph id="H92F7BFBCB7F4457186AD35B2EA5BA60B"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>(or, in the case of subsection (d), parents)</quote> after each occurrence of <quote>mothers</quote>; </text></subparagraph></paragraph> <paragraph id="HC4D9631B1D684BEE968A702E07170615"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="H036FD58AF6834ADE97D17D14709AC966"><enum>(d)</enum><header>Newborn coverage</header><text display-inline="yes-display-inline">A group health plan, and a health insurance issuer offering group health insurance coverage, shall, in the case of a parent who is a participant or beneficiary in the plan or coverage—</text> <paragraph id="H7B034A26E1B04B77ABB848C5E3BA61B0"><enum>(1)</enum><text display-inline="yes-display-inline">provide coverage to a newborn of such parent for a 30-day period after the date of the birth of such newborn for any service for which coverage is otherwise provided under such plan or coverage;</text></paragraph>
<paragraph id="H2DE68C48DCE149298736861F584A58F7"><enum>(2)</enum><text>provide for a special enrollment period to enroll such newborn in the plan or coverage during at least the 60-day period following the period specified in paragraph (1); and</text></paragraph> <paragraph id="HA3D3A1ECD4214C6D8EC72F93072E35BE"><enum>(3)</enum><text>in the case that such plan or coverage receives a claim for items and services furnished to such newborn of such participant or beneficiary and such newborn is not enrolled under such plan or coverage, provide immediate notification to the participant or beneficiary that such newborn is not so enrolled.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H43EABDB1E5DC4F089074E2192506437D"><enum>(4)</enum><text>in subsection (g)(1), as redesignated by paragraph (1), by inserting <quote>(other than subsection (d))</quote> after <quote>this section</quote>. </text></paragraph></subsection> <subsection id="HCE28DDB25E5D4D0192A3496C69E503F1"><enum>(c)</enum><header>IRC amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9811">Section 9811</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
<paragraph id="H72D0E7FFDDE947A08A0AD886FED063B1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and </text></paragraph> <paragraph id="HA5D37BF80FE94B4E90974D36F45609AD" display-inline="no-display-inline"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="HE589246737EF46B6AA331AE990DF64D2"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>(or, in the case of subsection (d), the parent or newborn child of such parent)</quote> after <quote>mother or her newborn child</quote>; and</text></subparagraph> <subparagraph id="HEE7BA61760A74E529A2407980ED0C84F"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>(or, in the case of subsection (d), parents)</quote> after each occurrence of <quote>mothers</quote>; </text></subparagraph></paragraph>
<paragraph id="H36AA5596D03049B1ACF16E64878295A2"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text> <quoted-block style="OLC" id="H30FC5D6DFD9F4D8CAFE40EA63DC1802E" display-inline="no-display-inline"> <subsection id="HD0FC19A8FA1A49D88E1C46C5D2F44594"><enum>(d)</enum><header>Newborn coverage</header><text display-inline="yes-display-inline">A group health plan shall, in the case of a parent who is a participant or beneficiary in the plan—</text>
<paragraph id="H91462FB34360450D9EF20A9D381D2323"><enum>(1)</enum><text display-inline="yes-display-inline">provide coverage to a newborn of such parent for a 30-day period after the date of the birth of such newborn for any service for which coverage is otherwise provided under such plan;</text></paragraph> <paragraph id="HD2D4415D27F044EAB22A45A4C02C0C1A"><enum>(2)</enum><text>provide for a special enrollment period to enroll such newborn in the plan during at least the 60-day period following the period specified in paragraph (1); and</text></paragraph>
<paragraph id="H0C1D446FD2EB4B039C07EB64B7E17FEC"><enum>(3)</enum><text display-inline="yes-display-inline">in the case that such plan receives a claim for items and services furnished to such newborn of such participant or beneficiary and such newborn is not enrolled under such plan, provide immediate notification to the participant or beneficiary that such newborn is not so enrolled.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HFAB11D0931A0449D90EFFDDA7B0FE1F9"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (f)(1), as redesignated by paragraph (1), by inserting <quote>(other than subsection (d))</quote> after <quote>this section</quote>.</text></paragraph></subsection>
<subsection id="H67A8A044E84D4DEC98512FA13AF5E4E7"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to plan years beginning on or after the date of the enactment of this Act.</text></subsection></section> </legis-body> </bill>
