Maloney of New York</sponsor> (for herself and <cosponsor name-id="C001078">Mr. Connolly</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to protect Federal employees from retaliation for the lawful use of Federal records, and for other purposes.</official-title></form><legis-body id="H85060D9481EE45E382094DB630DA3DFC" style="OLC"><section id="H3531F3C5DEC5420686C6332631ED2C55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Access to Information Act</short-title></quote>. </text></section><section id="HCB1175BB5D1A45CDB3C2B1663D06D425"><enum>2.</enum><header>Protections against retaliation for lawful use of Federal records by Federal employees</header><subsection id="HDC982A7C8B2A440AB8F0ACA64339B708"><enum>(a)</enum><header>Protection against retaliation</header><text>Section 2302(b)(9) of title 5, United States Code, is amended—</text><paragraph id="H655F77608E404F428414822AEC00C943"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H5A5FC641C0764F929076865079523E07"><enum>(2)</enum><text>in subparagraph (D), by inserting <quote>or</quote> after the semicolon; and</text></paragraph><paragraph id="HCEB07578B0B8431E9DA1841219179D43"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H709166A09B5B49D1B07FC5CDEFBA38CF" display-inline="no-display-inline"><subparagraph id="HE34F03CD7EA84EE490389BCC6E3227A7"><enum>(E)</enum><text display-inline="yes-display-inline">the employee or applicant for employment—</text><clause id="HCD2D8245F5CD469DA948772490A50763"><enum>(i)</enum><text>making a request for information pursuant to section 552 (commonly referred to as the <quote>Freedom of Information Act</quote>) or subsection (d) of section 552a (commonly referred to as the <quote>Privacy Act of 1974</quote>); or</text></clause><clause id="HEF0FC578E8284351BE27BA95BDCE9B6D"><enum>(ii)</enum><text display-inline="yes-display-inline">pursuing any administrative or judicial action with respect to such request, including seeking assistance or to engage in dispute resolution, as described in section 552.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB67824C5BE7748FABFCFCBE0D4CD959F"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H96DA6060D7A941B9BD547B29E28403EB"><enum>(1)</enum><header>Title 5</header><text display-inline="yes-display-inline">Sections 1214, 1215(a)(3)(B), 1221, 2302, and 7703 of title 5, United States Code, are amended by striking <quote>or (D)</quote> in each instance and inserting <quote>(D), or (E)</quote>.</text></paragraph><paragraph id="H070ED2D3CBDE4266A9EF8EE1A5458DE4"><enum>(2)</enum><header>Whistleblower Protection Enhancement Act of 2012</header><text display-inline="yes-display-inline">Section 116(b)(1)(A) of the Whistleblower Protection Enhancement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/199">Public Law 112–199</external-xref>) is amended by striking <quote>or (D)</quote> and inserting <quote>(D), or (E)</quote>.</text></paragraph></subsection></section></legis-body></bill>
