<section section-type="section-one" id="HB51037B2FE414F8C9DEC85756CA817CE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Utilizing Investments to Leverage Development and Generating Renewable Energy to Electrify the Nation's Infrastructure and Jobs Act</short-title></quote> or the <quote><short-title>BUILD GREEN Infrastructure and Jobs Act</short-title></quote>.</text></section> <section id="HC4B6EB8E7A364FFF98FFE21D01D58097"><enum>2.</enum><header>Green transportation infrastructure grant program</header> <subsection id="H77A84AEC0B924E02916A60B80545FE85"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H37B260559D6B46B1A419AA4FFDA6A13F"><enum>(1)</enum><header>Electric vehicle</header><text>The term <term>electric vehicle</term> has the meaning given the term in section 523.2 of title 49, Code of Federal Regulations (or successor regulations). </text></paragraph> <paragraph id="HA6C94A7E8EC74D6F983911CC5A33E46E"><enum>(2)</enum><header>Frontline, vulnerable, and disadvantaged community</header><text>The term <term>frontline, vulnerable, and disadvantaged community</term> means a community—</text>
<subparagraph id="H90484C2B09E249B1AFD40F02EBD1792A"><enum>(A)</enum><text>in an area described in section 301(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3161">42 U.S.C. 3161(a)</external-xref>); and</text></subparagraph> <subparagraph id="H899B2FE58B1D4AE1935E209E7264594E"><enum>(B)</enum><text>in which climate change, pollution, or environmental destruction have exacerbated systemic racial, regional, social, environmental, gender, and economic injustices by disproportionately affecting Black, Brown, and Indigenous peoples, other communities of color, migrant communities, deindustrialized communities, depopulated rural communities, the poor, low-income workers, women, the elderly, the unhoused, people with disabilities, or youth.</text></subparagraph></paragraph>
<paragraph commented="no" id="H005F12CDF6D6461CBF79DF4E1A1DD798"><enum>(3)</enum><header>Global warming potential</header><text>The term <term>global warming potential</term> has the meaning given the term in section 98.6 of title 40, Code of Federal Regulations (or successor regulations). </text></paragraph> <paragraph commented="no" id="H1E4750AA67BF4BBF80A11976D1041632"><enum>(4)</enum><header>Green project</header><text>The term <term>green project</term> means a project that—</text>
<subparagraph commented="no" id="H7B0D1EF7A4C64D81A6EEE6192AD5EAC9"><enum>(A)</enum><text>deeply reduces transportation greenhouse gas emissions and local air pollution; and</text></subparagraph> <subparagraph commented="no" id="HFB49A81859F84B3680EC599B4024495D"><enum>(B)</enum><text>results in a reduction in overall energy use, maximization of energy efficiency, implementation and use of energy recovery, and an offset of the remaining demand for energy with production of energy from renewable energy sources, such that the project produces as much energy or energy savings as the project uses over the course of a year.</text></subparagraph></paragraph>
<paragraph id="HD98B60299C6E416E86DFD50D3E1164ED"><enum>(5)</enum><header>Green space</header>
<subparagraph id="HEF6D384BCE8D48C39906488C2099BDE1"><enum>(A)</enum><header>In general</header><text>The term <term>green space</term> means publicly accessible land or water that—</text> <clause id="H8720EC50B20C4CB6B5372D08C03B4802"><enum>(i)</enum><text>is partly or completely covered with grass, trees, shrubs, or other vegetation; and</text></clause>
<clause id="HD2171BF2B8AC466890858AD1FEF7C2A3"><enum>(ii)</enum><text>provides floodwater alleviation, storm water mitigation, green travel routes, water purification, cooling temperatures, pollution management, public health benefits, enhancements to biodiversity, ecological resilience, or greenhouse gas emissions sequestration. </text></clause></subparagraph> <subparagraph id="H6E9F059694F04A41AFEB4B48A329890D"><enum>(B)</enum><header>Inclusions</header><text>The term <term>green space</term> includes parks, gardens, playing fields, children’s play areas, woods, grassed areas, bodies of water, and trails.</text></subparagraph></paragraph>
<paragraph id="HB3D2D84091834C13A19178F2F5690805"><enum>(6)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means—</text> <subparagraph id="H752DF7D99E43453DAC337F8D8993F4EB"><enum>(A)</enum><text>carbon dioxide;</text></subparagraph>
<subparagraph id="H555849496FEB40ABA283D58743791DC7"><enum>(B)</enum><text>hydrofluorocarbons;</text></subparagraph> <subparagraph id="HA40EF577A3E540A59DE6036C17B981EB"><enum>(C)</enum><text>methane;</text></subparagraph>
<subparagraph id="HF8A208DDDCE5492481E9AC606A1A5C74"><enum>(D)</enum><text>nitrous oxide;</text></subparagraph> <subparagraph id="HB28AA7A9AC4E44D6B93A2A79D0C47DD2"><enum>(E)</enum><text>perfluorocarbons;</text></subparagraph>
<subparagraph id="H0833B5938B054D73B15A11D366004A5C"><enum>(F)</enum><text>sulfur hexafluoride;</text></subparagraph> <subparagraph id="HF6729B09B1914608A588E0D11C68EC61"><enum>(G)</enum><text>nitrogen triflouride;</text></subparagraph>
<subparagraph id="H9C9EDF08C1C24E56A043CC1079E360AA"><enum>(H)</enum><text>chlorofluorocarbons; </text></subparagraph> <subparagraph commented="no" id="HDA566938EDF442869A3802D0A29F1E72"><enum>(I)</enum><text>criteria pollutants for which there are national ambient air quality standards under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>); and </text></subparagraph>
<subparagraph id="HA70D6E861FBE4296998AD05FD5F05D71"><enum>(J)</enum><text>any other anthropogenically emitted gas or particulate that the Administrator of the Environmental Protection Agency determines, after notice and comment—</text> <clause id="H034679C66E4D4981B55639CC378F4F68"><enum>(i)</enum><text>to contribute to climate change; or </text></clause>
<clause id="H2C329CDCC3D34D678949A33433269E13"><enum>(ii)</enum><text>to produce negative effects on human health, biodiversity, or ecological resilience. </text></clause></subparagraph></paragraph> <paragraph id="H70283C75275E4E03A01D05159DD9094C"><enum>(7)</enum><header>Greenhouse gas emissions</header><text>The term <term>greenhouse gas emissions</term> means emissions of greenhouse gas, expressed in terms of metric tons of carbon dioxide equivalent.</text></paragraph>
<paragraph commented="no" id="HCD3487B03BAB4872A7477DD0A8E0ADB6"><enum>(8)</enum><header>New renewable energy</header><text>The term <term>new renewable energy</term> means renewable energy from a source that is not currently producing power.</text></paragraph> <paragraph commented="no" id="HD90213CA7BDC4E65878EB895EA97F993"><enum>(9)</enum><header>Program</header><text>The term <term>program</term> means the green transportation infrastructure grant program established under subsection (b).</text></paragraph>
<paragraph commented="no" id="H6F6B17EA74CE4D9384F007ADABA60032"><enum>(10)</enum><header>Publicly available EVSE</header>
<subparagraph commented="no" id="H5F52375852A74CA6870EC6741523F5D5"><enum>(A)</enum><header>In general</header><text>The term <term>publicly available EVSE</term> means Electric Vehicle Supply Equipment and any associated parking spaces designated by the property owner or lessee to be available to, and accessible by, the public for any period of time, including Electric Vehicle Supply Equipment and associated parking spaces located in parking garages or gated facilities if any member of the public can obtain vehicular access to the facility for free or through payment of a fee.</text></subparagraph> <subparagraph commented="no" id="H58BD41222510446E83AF0C92EE47303C"><enum>(B)</enum><header>Exclusion</header><text>The term <term>publicly available EVSE</term> does not include Electric Vehicle Supply Equipment and any associated parking spaces in a workplace if the Electric Vehicle Supply Equipment and associated parking spaces are clearly marked and operated as available exclusively to employees or contracted drivers.</text></subparagraph></paragraph>
<paragraph id="H425D6E22481348D195917C43011B92E0"><enum>(11)</enum><header>Renewable energy source</header><text>The term <term>renewable energy source</term> means energy generated from renewable sources, including the following:</text> <subparagraph id="HD45E4C1D68A64336A8D1C72AF0EC7A15"><enum>(A)</enum><text>Solar, including electricity.</text></subparagraph>
<subparagraph id="HCBD505B9B52B4463A74D2B3F1B9D865F"><enum>(B)</enum><text>Wind. </text></subparagraph> <subparagraph id="H3698BAE9D5C44EE5B6D4F9B0182D758E"><enum>(C)</enum><text>Ocean, including tidal, wave, current, and thermal.</text></subparagraph>
<subparagraph id="HE0CB4BB06792447DA75511E28D3A1D9E"><enum>(D)</enum><text>Geothermal, including electricity and heat pumps.</text></subparagraph> <subparagraph id="H844DA224313C4631B8EA466928EA26C7"><enum>(E)</enum><text>Hydroelectric generation capacity achieved from increased efficiency or additions of new capacity—</text>
<clause id="H879F33B0D75C458B89E920341CA8D316"><enum>(i)</enum><text>at an existing hydroelectric project; and</text></clause> <clause id="HE36A607D61BA4615A6E6E589051B6CFA"><enum>(ii)</enum><text>that was placed in service on or after January 1, 1999. </text></clause></subparagraph>
<subparagraph id="HFD6A0ABEDB434C4E8CA6BD248BC5CB20"><enum>(F)</enum><text>Hydrogen used in fuel cells or other non-combustion technologies.</text></subparagraph> <subparagraph id="HACBE822AA4144AC1837D0700A8DA7D3C"><enum>(G)</enum><text>Thermal energy generated by any of the sources described in subparagraphs (A) through (F). </text></subparagraph></paragraph>
<paragraph id="HF93248056C584CC290B9609704BD41AA"><enum>(12)</enum><header>Resilient</header><text>The term <term>resilient</term>, with respect to transportation infrastructure projects, means an anticipation of, preparation for, and adaptation of the project to disruptions and changing environmental and security conditions, and the achievement and maintenance by the project of the capability to withstand, respond to, and recover rapidly from disruptions while ensuring the sustainment of operations.</text></paragraph> <paragraph commented="no" id="H9135EBE8103E474E98395C4C3805F0A8"><enum>(13)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area with a population of 200,000 or fewer.</text></paragraph>
<paragraph id="HADC0ADD17A724F2BA260D4903FAAC753"><enum>(14)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph> <paragraph commented="no" id="HA5D097595E034597B779A11ADE8F66FF"><enum>(15)</enum><header>Urbanized area</header><text>The term <term>urbanized area</term> means an area with a population of more than 200,000.</text></paragraph></subsection>
<subsection id="HFA50EB6138CD4BBCAFB3620E640D9A0A"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a green transportation infrastructure grant program to provide grants on a competitive basis to eligible entities for capital investments in electrified surface transportation infrastructure projects that—</text> <paragraph id="H496476BECB364206B19D846952865A61"><enum>(1)</enum><text>will have a significant local or regional impact to improve transportation and reduce greenhouse gas emissions and toxic emissions; and</text></paragraph>
<paragraph id="HDF9CE8E3D89446369671B7D7387C5EDF"><enum>(2)</enum><text>are—</text> <subparagraph id="H9B15D6E87EEB4478A38B08D2E1168936"><enum>(A)</enum><text>sustainable and resilient; and</text></subparagraph>
<subparagraph id="H0663B17E0F004941BB67B0198E58C5D5"><enum>(B)</enum><text>green projects.</text></subparagraph></paragraph></subsection> <subsection id="HF1E81C8234994C3A9294744AA9F6ABC4"><enum>(c)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under the program is—</text>
<paragraph id="H7AFFB84A808C4566AC0452690AFB5CD7"><enum>(1)</enum><text>a State;</text></paragraph> <paragraph id="H21388777036045B4881751CCF4B17DCC"><enum>(2)</enum><text>a unit of local government;</text></paragraph>
<paragraph id="H44A875DDD6ED422E95E97C6A636971E9"><enum>(3)</enum><text>a transit agency;</text></paragraph> <paragraph id="H976ABBE13DDA49EE8D552537976CA108"><enum>(4)</enum><text>a port authority;</text></paragraph>
<paragraph id="HEE3826FF155E4E6781781DD0DF417DA7"><enum>(5)</enum><text>an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); or</text></paragraph> <paragraph id="H8135B0B3CABA4E6EB6DF2D1EF8AF0196"><enum>(6)</enum><text>a group of entities described in paragraphs (1) through (5).</text></paragraph></subsection>
<subsection commented="no" id="HC5D9075F035747F8A0B3A80831A43DCE"><enum>(d)</enum><header>Eligible projects</header><text>A project eligible to be carried out with funds from a grant provided under the program is—</text> <paragraph commented="no" id="HC4CB8238B4C143BCBA2FFBF8D5C6894C"><enum>(1)</enum><text>a highway or bridge project eligible for assistance under title 23, United States Code, that has or installs publicly available EVSE on the highway or on a highway in immediate proximity to the bridge;</text></paragraph>
<paragraph commented="no" id="H9082A4D4062A42AAB01CBA0C701E140D"><enum>(2)</enum><text>a public transportation project eligible for assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, that is powered by electricity; </text></paragraph> <paragraph commented="no" id="H359C5117DE67497388C7BEEDAAF72D11"><enum>(3)</enum><text>a passenger or freight rail project that is powered solely by an external source of electricity or solar power; </text></paragraph>
<paragraph commented="no" id="HD62DC07788CD4E829C2FD63641D6D27D"><enum>(4)</enum><text>a port infrastructure investment, including inland port infrastructure and land ports of entry, that installs publicly available EVSE or converts fossil fuel-powered equipment to electrified equipment; and</text></paragraph> <paragraph commented="no" id="HE33B51BBB90F4BC9A2637AD785FCD498"><enum>(5)</enum><text>any other projects that—</text>
<subparagraph commented="no" id="HFAFC7AFC546B4EF984840DF7F5C02D2B"><enum>(A)</enum><text>the Secretary determines to be appropriate; and</text></subparagraph> <subparagraph commented="no" id="H599B360B84434CB79D0AF3D0413380B5"><enum>(B)</enum><text>clearly demonstrate a contribution to the reduction of greenhouse gas emissions and toxic emissions.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="HB7CD8ABEE1B14BCA9602B818A1460415"><enum>(e)</enum><header>Application</header>
<paragraph commented="no" id="H03F14574DC044F4A84CDD357D7277730"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> <paragraph commented="no" id="HFAC4A5AE38874251AABB278263DF9755"><enum>(2)</enum><header>Deadlines</header><text>The Secretary shall—</text>
<subparagraph commented="no" id="H0200F84A77B649FEB39DD0A7734D4E89"><enum>(A)</enum><text>publish a notice of funding opportunity for the program by not later than 10 days after October 1 of each fiscal year;</text></subparagraph> <subparagraph commented="no" id="HF2CB4BCD33954B43ABB1A8034AAE1975"><enum>(B)</enum><text>require applications for grants under the program to be submitted to the Secretary by not later than 90 days after the date on which the notice of funding opportunity is published; and</text></subparagraph>
<subparagraph commented="no" id="H183D7D2C99774053B31C12EDAD4AAA24"><enum>(C)</enum><text>select eligible projects to receive grants under the program, in accordance with subsection (f), by not later than 270 days after October 1 of each fiscal year.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="HA94EA665A60745C0A7390A93A2021FEC"><enum>(f)</enum><header>Selection</header> <paragraph commented="no" id="H9EC9CF8AC2DE426DB5258AA73F5C449F"><enum>(1)</enum><header>In general</header><text>The Secretary shall select eligible projects to receive a grant under the program based on sustainability criteria, including—</text>
<subparagraph id="HD06FD9D734174CCFA3E4E8B34D24B5DA"><enum>(A)</enum><text>the extent to which the project promotes the electrification of all public transportation, including electric city buses, electric commuter rail, electric vehicle fleets, and electric school buses;</text></subparagraph> <subparagraph commented="no" id="H89EB361BC4AB4CF0A7FFC2837FBE7B88"><enum>(B)</enum><text>criteria in the Infrastructure Voluntary Evaluation Sustainability Tool (INVEST) of the Federal Highway Administration;</text></subparagraph>
<subparagraph commented="no" id="HF26F767FFC5D48C3B0F39101502EB945"><enum>(C)</enum><text>criteria developed by the Secretary to promote electric vehicle charging infrastructure;</text></subparagraph> <subparagraph commented="no" id="HC683C67D77BB4DFFA8C3F6F5267F4E9C"><enum>(D)</enum><text>criteria developed by the Secretary to reduce overall vehicle miles traveled in single occupancy, internal combustion engine vehicles;</text></subparagraph>
<subparagraph commented="no" id="H25BD3EB8547B4059B3370B73C59CEFB9"><enum>(E)</enum><text>criteria developed by the Secretary, in consultation with the Administrator of the Environmental Protection Agency, that consider the extent to which the eligible project contributes to—</text> <clause id="H83168B8A847F41F0A9D951A16903E605"><enum>(i)</enum><text>climate resilience;</text></clause>
<clause id="H583F65144ED6485CB3BE29E5E71CC6D4"><enum>(ii)</enum><text>climate mitigation;</text></clause> <clause id="H40275C9163E24AE79F3F7B0A8A2A12B8"><enum>(iii)</enum><text>air pollution and emissions of hazardous air pollutants (as defined in section 112(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(a)</external-xref>)); and</text></clause>
<clause id="H4E2204FE517A4DE2B4CA284889479AB0"><enum>(iv)</enum><text>greenhouse gas emissions; </text></clause></subparagraph> <subparagraph id="HC1F5AC077CDB47579C146B3020A34790"><enum>(F)</enum><text>criteria developed by the Secretary, in consultation with the Secretary of Energy, that consider the extent to which the eligible project will achieve energy savings and reduced energy usage compared to other eligible projects; and</text></subparagraph>
<subparagraph id="H8F880D94B1EE4952929CA23F43154794"><enum>(G)</enum><text>criteria developed by the Secretary, in consultation with the Secretary of Energy, that consider the extent to which the eligible project will improve pedestrian and nonmotorized vehicle access and safety compared to other eligible projects.</text></subparagraph></paragraph> <paragraph commented="no" id="H1C992B37254A41088591448A299C4EC7"><enum>(2)</enum><header>Exclusion</header><text>In selecting eligible projects to receive a grant under the program, the Secretary shall not use the Federal share percentage or the ability of an applicant to generate non-Federal revenue as a selection criterion.</text></paragraph>
<paragraph commented="no" id="H2DF40C63AF9D401A8BDC3EDA4E83A4B5"><enum>(3)</enum><header>Priority</header><text>In selecting eligible projects to receive a grant under the program, the Secretary shall give priority to an eligible project that—</text> <subparagraph id="H1FA16F367D604367876541A505AFC11D"><enum>(A)</enum><text>is located in—</text>
<clause id="HC0157B212C3743DABE9F505E1EE0C9FC"><enum>(i)</enum><text>a frontline, vulnerable, and disadvantaged community; </text></clause> <clause id="H57B929FB53F64FFDA84CB15D0BDE45D9"><enum>(ii)</enum><text>an area identified as having disproportionately high adverse human health and environmental impacts on minority populations and low-income populations;</text></clause>
<clause id="HFE1CC574E6D0492394017DE6E6103883"><enum>(iii)</enum><text>a community of color;</text></clause> <clause id="HEE2C277A599D45458371E5B4123FB940"><enum>(iv)</enum><text>a low-income community;</text></clause>
<clause id="H8070AE532C064DF2992B330663C6B6E5"><enum>(v)</enum><text>a deindustrialized community; or</text></clause> <clause id="H4C4DD8B30E0A4D0D8F1CDB2A5F7CC35F"><enum>(vi)</enum><text>a community facing environmental injustice. </text></clause></subparagraph>
<subparagraph commented="no" id="HD3361CDBC615434CB212CD4C068F0B39"><enum>(B)</enum><text>requires a contribution of Federal funds in order to complete an overall financing package; or</text></subparagraph> <subparagraph commented="no" id="HE8333DFEB4C4452DBAD38049F34EB779"><enum>(C)</enum><text>includes—</text>
<clause commented="no" id="HE3965E690CD548A98E93EB84B83A1E44"><enum>(i)</enum><text>the addition of—</text> <subclause commented="no" id="H8AF4F1109FDA413380B1DAE9C0AE8E77"><enum>(I)</enum><text>a new green space; or</text></subclause>
<subclause commented="no" id="H8383ECD5002641E7AABEED3507D916F1"><enum>(II)</enum><text>new State or local park system units and recreation areas administered for outdoor recreation purposes; or </text></subclause></clause> <clause commented="no" id="HEBBBDB9B751A446E8DC26A7254E73856"><enum>(ii)</enum><text>an improvement to improve access to an existing green space, State or local park system unit, or recreation area administered for outdoor recreation purposes, including pedestrian and bicycle access.</text></clause></subparagraph></paragraph>
<paragraph id="H357A90B0A2114899B02B1099EF8F1272"><enum>(4)</enum><header>Report</header><text>Not less frequently than once each year, the Secretary shall —</text> <subparagraph id="HB3085B72A9B44FBC85FF494D1F4C118F"><enum>(A)</enum><text>submit a report that contains the criteria for eligible projects developed under paragraph (1) to—</text>
<clause id="HC95ABE4F25A34A7BBD415F5240625EF4"><enum>(i)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></clause> <clause id="H7B03AC763E3948E99FFD8DE5BAB0C217"><enum>(ii)</enum><text>the Committee on Environment and Public Works of the Senate;</text></clause>
<clause id="H9C67BAC5EBF645B1A3E496D58E98F6C3"><enum>(iii)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text></clause> <clause id="H3B75563CB5B5481A9F1E615C9E14DEBA"><enum>(iv)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></clause></subparagraph>
<subparagraph id="H961ECD11F3EF41498C4A9E420F88D2DF"><enum>(B)</enum><text>make the report under subparagraph (A) available to the public.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="H8F416DAE176D4C0F9CC7A1071495F679"><enum>(g)</enum><header>Grant requirements</header> <paragraph commented="no" id="HB4A9A7B3F05C4B11B73C6AFE84B80576"><enum>(1)</enum><header>Environmental standard</header><text>As a condition of receiving a grant under the program, any building or structure that is part of an eligible project, including existing buildings, shall comply with, or, in the case of an existing building, be renovated to comply with, environmental standards determined by the Secretary, that are at least as stringent as the Leadership in Energy and Environmental Design (LEED) standards of the United States Green Building Council.</text></paragraph>
<paragraph commented="no" id="H5866A5C58C4E4610B34E940E970D432C"><enum>(2)</enum><header>Use of renewable energy</header>
<subparagraph commented="no" id="HA431CA0F60B248158F3EB857D91B14DC"><enum>(A)</enum><header>In general</header><text>As a condition of receiving a grant under the program, any eligible project that, after completion of the project, uses electrical energy shall use electrical energy in a manner that does not increase usage of nonrenewable energy sources, in accordance with subparagraph (B).</text></subparagraph> <subparagraph commented="no" id="HE0C8524BA85B43E4AB45E089F8995109"><enum>(B)</enum><header>Methods</header><text>An eligible entity may comply with subparagraph (A) by—</text>
<clause commented="no" id="H53733313AED84D63823C1B0E95156D83"><enum>(i)</enum><text>purchasing new renewable energy or renewable energy credits for the eligible project;</text></clause> <clause commented="no" id="HA9643BAAA9704D82A2A7D883F6983D73"><enum>(ii)</enum><text>generating new renewable energy for the eligible project;</text></clause>
<clause commented="no" id="HD6E30A7996734DADB053A730D48193F3"><enum>(iii)</enum><text>converting to use of renewable energy for another project of the eligible entity in an equivalent quantity of nonrenewable energy used for the eligible project; or</text></clause> <clause commented="no" id="HEA7CE9FF12954B71BB7B67029019FFDE"><enum>(iv)</enum><text>any combination of the methods described in clauses (i) through (iii).</text></clause></subparagraph>
<subparagraph commented="no" id="H18B024192B354F1885A1037125CAA458"><enum>(C)</enum><header>Compliance</header>
<clause commented="no" id="HBBCF0C6EF727441D869D133E5D0F336D"><enum>(i)</enum><header>In general</header><text>If the Secretary determines that an eligible project is not in compliance with subparagraph (A), the Secretary shall promptly notify the eligible entity of the noncompliance.</text></clause> <clause commented="no" id="H45829C5D75CF4ED783A39C13D721E7DF"><enum>(ii)</enum><header>Withholding of funds for noncompliance</header><text>If an eligible entity that receives a notification of noncompliance under clause (i) is not in compliance with subparagraph (A) beginning on the date that is 180 days after the date of the notification under clause (i), the Secretary shall withhold from the State in which the eligible project is located 10 percent of the amount required to be apportioned to the State under section 104(b) of title 23, United States Code, from that State until the eligible project is in compliance with subparagraph (A). </text></clause></subparagraph></paragraph></subsection>
<subsection commented="no" id="H74FFF3CEFC894D5DA27F99B2B75BE2C7"><enum>(h)</enum><header>Distribution of grants</header>
<paragraph commented="no" id="HEDA6411279EB4B5C98B9F2C341F96787"><enum>(1)</enum><header>In general</header><text>For each fiscal year, in carrying out the program, the Secretary shall ensure that grants are provided—</text> <subparagraph commented="no" id="H8D0F73D040024B91B2F4E553FF41E0B2"><enum>(A)</enum><text>on an equitable geographical basis;</text></subparagraph>
<subparagraph commented="no" id="H7EF9886A97CA4C31811205982C403E8F"><enum>(B)</enum><text>in a manner that achieves an appropriate balance in addressing the needs of urbanized areas and rural areas;</text></subparagraph> <subparagraph commented="no" id="HA648D12109E541B2A47EB430A8CD76EE"><enum>(C)</enum><text>in a manner that ensures investment in a variety of electric vehicles; and</text></subparagraph>
<subparagraph commented="no" id="H5C5B9E85636841179852D06A9EB51693"><enum>(D)</enum><text>in a manner that prioritizes eligible projects in areas described in section 301(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3161">42 U.S.C. 3161(a)</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" id="HD2D33278B1FA409BAA7D11D754FF8397"><enum>(2)</enum><header>State amounts</header> <subparagraph commented="no" id="H96FB12E51D33423EBF223F21233DDDE7"><enum>(A)</enum><header>Minimum amount</header><text>For each fiscal year, the total amount awarded to eligible projects in each State shall be not less than the lesser of—</text>
<clause commented="no" id="HCBDB745F5DFA4EBE87212819A59D20BB"><enum>(i)</enum><text>0.8 percent of the amounts made available to carry out the program for that fiscal year; and</text></clause> <clause commented="no" id="H775A236CB2FF4FAB9813210BC7769F98"><enum>(ii)</enum><text>the total amount requested for eligible projects in that State for that fiscal year for which the Secretary has determined meet the selection criteria under the program.</text></clause></subparagraph>
<subparagraph commented="no" id="HF71B91EEAC3F4982A34041F84CC02839"><enum>(B)</enum><header>Maximum amount</header><text>For each fiscal year, the total amount provided under the program for eligible projects in a single State shall not exceed an amount equal to 8 percent of the amounts made available to carry out the program for that fiscal year.</text></subparagraph></paragraph> <paragraph commented="no" id="H0590488E7C5644DE8E606AFA9CBAA431"><enum>(3)</enum><header>Rural areas, urbanized areas, and frontline, vulnerable, and disadvantaged communities</header> <subparagraph commented="no" id="H5BC2E5872D0E4AD880E3E61FFB9E8D3E"><enum>(A)</enum><header>Rural areas</header> <clause commented="no" id="H40F3DC615FDD49C1A4F8241723AAB132"><enum>(i)</enum><header>In general</header><text>Of the amounts made available to carry out the program for each fiscal year, not less than 35 percent and not more than 40 percent shall be used for eligible projects located in rural areas.</text></clause>
<clause commented="no" id="H07B7779967C54D5A94C794455D88DA85"><enum>(ii)</enum><header>Grant amount</header><text>The amount of a grant provided under the program for a project in a rural area shall be not less than $1,000,000.</text></clause> <clause commented="no" id="HB1FE647E2EC542489353DDAAD0C5F163"><enum>(iii)</enum><header>Federal share</header><text>The Federal share of the cost of an eligible project in a rural area carried out with a grant under the program may exceed 85 percent, at the discretion of the Secretary.</text></clause></subparagraph>
<subparagraph commented="no" id="HB8E1548D148E43D68E8ADC9338449151"><enum>(B)</enum><header>Urbanized areas</header>
<clause commented="no" id="H0E30BAF08C2A4554B081778530BD1B58"><enum>(i)</enum><header>In general</header><text>Of the amounts made available to carry out the program for each fiscal year, not less than 60 percent and not more than 65 percent shall be used for eligible projects located in urbanized areas.</text></clause> <clause commented="no" id="H587FA07C5EFA4E21B8A88F155CBC7E90"><enum>(ii)</enum><header>Metropolitan planning area</header><text>Amounts made available under clause (i) may be used for eligible projects in the metropolitan planning area established under section 134 of title 23, United States Code, that encompasses the urbanized area.</text></clause></subparagraph>
<subparagraph commented="no" id="HF4789152041042268842F45AE3E029ED"><enum>(C)</enum><header>Frontline, vulnerable, and disadvantaged communities</header>
<clause id="H40FF6FB50E984E0996AB6930755E26BC"><enum>(i)</enum><header>In general</header><text>Of the total amounts made available to carry out the program for each fiscal year under subparagraphs (A) and (B), not less than 40 percent shall be used for eligible projects located in frontline, vulnerable, and disadvantaged communities.</text></clause> <clause id="H4BC1E39A8B354322BCCC71F1FF32E90B"><enum>(ii)</enum><header>Grant amount</header><text>The amount of a grant provided under the program for a project in a frontline, vulnerable, and disadvantaged community shall be not less than $1,000,000.</text></clause>
<clause id="H2FDA0D134D2C47D0B2E1CB3797B363CD"><enum>(iii)</enum><header>Federal share</header><text>The Federal share of the cost of an eligible project in a frontline, vulnerable, and disadvantaged community carried out with a grant under the program may exceed 85 percent, at the discretion of the Secretary. </text></clause></subparagraph></paragraph></subsection> <subsection commented="no" id="HF2E7D7FD8BD04FFC80F5B7AB253B8835"><enum>(i)</enum><header>Grant amount</header> <paragraph commented="no" id="HDC475D350E0149208BC14F421D1E5ED9"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a grant under the program shall be in an amount that is not less than $2,000,000.</text></paragraph>
<paragraph commented="no" id="H3346B6B68F1D4CA09F8B7A8F47E3AC06"><enum>(2)</enum><header>Planning grants</header><text>A grant under the program for the planning, preparation, or design of an eligible project shall not be subject to a minimum grant amount. </text></paragraph></subsection> <subsection commented="no" id="H7C4A11F56DF944EEB06C761D63A1F2B4"><enum>(j)</enum><header>Federal share</header><text>Except as otherwise provided in this section, the Federal share of the cost of a project carried out with a grant under the program shall be, at the discretion of the eligible entity—</text>
<paragraph commented="no" id="H621C0BB7AC3F438D988F17AEA25A6A16"><enum>(1)</enum><text>not more than 85 percent, for the purpose of planning, design, and construction of the project; and</text></paragraph> <paragraph commented="no" id="H86AFFF2EB31C40C3805A7EAE52F6A839"><enum>(2)</enum><text>not more than 50 percent of the operation and maintenance costs of the project for the first 10 years of the project.</text></paragraph></subsection>
<subsection commented="no" id="HDB87018768C24477AFB5CC50402C89A1"><enum>(k)</enum><header>TIFIA; RRIF</header><text>For each fiscal year, the Secretary may use an amount equal to not more than 20 percent of the amounts made available to carry out the program for that fiscal year to pay the subsidy and administrative costs of projects eligible for Federal credit assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code, or title V of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821</external-xref> et seq.) if the Secretary finds that such use of those amounts would advance the purposes of the program.</text></subsection> <subsection commented="no" id="H516965E3C01842FB86567A25D1FC5988"><enum>(l)</enum><header>Buy America</header><text>No funds may be used for an eligible project under the program unless—</text>
<paragraph commented="no" id="HF6B2F4985B91431C954F0EB609562781"><enum>(1)</enum><text>in the case of an eligible project described in subsection (d)(1), the project complies with section 313 of title 23, United States Code;</text></paragraph> <paragraph commented="no" id="H8FC3270E0026481C97BCF655F7DAB2BD"><enum>(2)</enum><text>in the case of an eligible project described in subsection (d)(2), the project complies with section 5323(j) of title 49, United States Code; </text></paragraph>
<paragraph commented="no" id="HD455324CF9074410B3D6DBF7BE1804A8"><enum>(3)</enum><text>in the case of an eligible project described in subsection (d)(3), the project complies with section 22905(a) of title 49, United States Code; </text></paragraph> <paragraph commented="no" id="HF21A98FA496F49BCA76FADA1A44AD166"><enum>(4)</enum><text>in the case of an eligible project described in subsection (d)(4), the project complies with section 54101(d)(2) of title 46, United States Code; and </text></paragraph>
<paragraph commented="no" id="HA9AAF79C156D4B5A948105B39A4EFF92"><enum>(5)</enum><text>in the case of an eligible project described in subsection (d)(5), the project complies with appropriate domestic content requirements as determined by the Secretary. </text></paragraph></subsection> <subsection id="H471EE81732D4409D93EBAB32F7ACADD1"><enum>(m)</enum><header>Labor provisions</header> <paragraph id="H0E7680E95ACC4F4FBE51DC99430E38B7"><enum>(1)</enum><header>Employee wages and protections</header><text display-inline="yes-display-inline">Each contractor and subcontractor for an eligible project carried out under the program shall comply with the following:</text>
<subparagraph id="H1164C550095A48B689C607CF6E28DD2A"><enum>(A)</enum><header>Minimum wage</header>
<clause id="H21417F1934D041B8964143C244B59E45"><enum>(i)</enum><header>In general</header><text>All employees employed in the performance of the eligible project shall be paid at a rate of not less than—</text> <subclause id="H8407B42C5EA0476D86598EF6EF68F28F"><enum>(I)</enum><text display-inline="yes-display-inline">$15.00 an hour, beginning on the date of enactment of this Act; and</text></subclause>
<subclause id="H1D39E472E40A4F24A22B7BD169360105"><enum>(II)</enum><text display-inline="yes-display-inline">beginning on the date that is 1 year after such date of enactment, and annually thereafter, the amount in effect under this subparagraph for the preceding year, increased by the annual percentage increase, if any, in the median hourly wage of all employees as determined by the Bureau of Labor Statistics and rounded up to the nearest multiple of $0.05.</text></subclause></clause> <clause id="HE6CDAC58ECC4476891586059D053609E"><enum>(ii)</enum><header>Calculation</header><text display-inline="yes-display-inline">In calculating the annual percentage increase in the median hourly wage of all employees for purposes of clause (i)(II), the Secretary of Labor, through the Bureau of Labor Statistics, shall—</text>
<subclause id="H40DDB863A312449E91BA8BCDA1E0322A"><enum>(I)</enum><text display-inline="yes-display-inline">compile data on the hourly wages of all employees to determine such a median hourly wage; and</text></subclause> <subclause id="H67FA8DFAF03B4DAA8685A883A8999930"><enum>(II)</enum><text display-inline="yes-display-inline">compare such median hourly wage for the most recent year for which data are available with the median hourly wage determined for the preceding year.</text></subclause></clause>
<clause id="H5A501CE06AF24CC18D17759854B48CEA"><enum>(iii)</enum><header>Prevailing wages for laborers and mechanics</header>
<subclause id="HEE94E55C26AA407F833F137815ABBD1F"><enum>(I)</enum><header>In general</header><text>All laborers and mechanics employed by contractors or subcontractors in the performance of construction, alteration, or repair work carried out, in whole or in part, with assistance made available under the program shall be paid wages at rates not less than the greater of—</text> <item id="H8F28DE2999564ABFB9673D8DB8310B8D"><enum>(aa)</enum><text>the rates prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code; or</text></item>
<item id="H9B8102DFAF1145A6AC4AE47C6FFB1A3F"><enum>(bb)</enum><text>the rate required under clause (i).</text></item></subclause> <subclause id="H5E0C25B3861449259DF45EDE64CC4DF4"><enum>(II)</enum><header>Authorities</header><text>With respect to the labor standards specified in subclause (I)(aa), the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subclause></clause></subparagraph>
<subparagraph id="H9E7A55865FDF4CF3BC912A5CE85D2C33"><enum>(B)</enum><header>Neutrality toward organized labor</header><text>The contractor or subcontractor shall have—</text> <clause id="HA97D908A36D041DB85F4667828CECAD4"><enum>(i)</enum><text>an explicit policy of neutrality with regard to—</text>
<subclause id="H111825EB70264E4A86B3D18A2245D150"><enum>(I)</enum><text>labor organizing for the employees of the contractor or subcontractor employed in the performance of the eligible project; and</text></subclause> <subclause id="HAE26A6E4D93B4CD988953193FF408B72"><enum>(II)</enum><text>such employees' choice to form and join labor organizations; and</text></subclause></clause>
<clause id="HB6FADE92FF1945D9B76A159B1B2DDC63"><enum>(ii)</enum><text>policies that require—</text> <subclause id="HC1F301B950B641E897D5927968915C47"><enum>(I)</enum><text>the posting and maintenance of notices in the workplace to such employees of their rights under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151</external-xref> et seq.); and</text></subclause>
<subclause id="HB805D310A0334CAEB277D2A67108772B"><enum>(II)</enum><text>that such employees are, at the beginning of their employment in the performance of the eligible project, provided notice and information regarding the employees' rights under such Act.</text></subclause></clause></subparagraph> <subparagraph id="H5D887583E8904526AC9D5BBEFEF63923"><enum>(C)</enum><header>Paid family and medical leave</header><text>The contractor or subcontractor shall have an explicit policy providing all employees employed in the performance of the eligible project not less than 12 workweeks of paid leave in a 12-month period for any purpose described in section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>), in accordance with regulations promulgated by the Secretary of Labor.</text></subparagraph>
<subparagraph id="H408FE01D4754432686A2CE014ABAA1BE"><enum>(D)</enum><header>Fair scheduling</header>
<clause id="H286BF984903645238EDE1F607AAED8B2"><enum>(i)</enum><header>In general</header><text>The contractor or subcontractor shall have an explicit policy for fair scheduling for employees employed in the performance of the eligible project, which shall include—</text> <subclause id="H2E1757BDEBFD4A709A9DEFC82EF96924"><enum>(I)</enum><text>an opportunity for the employee to request—</text>
<item id="HAD312F93DCFA43AE9DC7CB23C6EC337B"><enum>(aa)</enum><text>an adjustment in the number of hours, work location, or times of the employee's work schedule;</text></item> <item id="H751830EB991543649DE7B8653D7A1A8A"><enum>(bb)</enum><text>a change in the amount of notification provided to the employee regarding the work schedule; or</text></item>
<item id="HABADD33CA3264538A396C8FA9EE7BF67"><enum>(cc)</enum><text>the minimizing of fluctuations in the number of hours the employee is scheduled to work on a daily, weekly, or monthly basis; and</text></item></subclause> <subclause id="H3F00A6BE9A014EB5ABC87A4150F04DCC"><enum>(II)</enum><text>a timely, good faith interactive process through which the employer and employee discuss the employee's request under subclause (I) and the employer grants the request or suggests any alternatives that might meet the employee's needs.</text></subclause></clause>
<clause id="H65AD4A135FBA49548011DE2E17F7A82E"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply to any employee covered by a valid collective bargaining agreement if—</text> <subclause id="HE7E9035078A5423E87808D977D63D897"><enum>(I)</enum><text>the terms of the collective bargaining agreement include terms that govern work scheduling practices; and</text></subclause>
<subclause id="H32C0B501BEA24AF0ADF837282F74A948"><enum>(II)</enum><text>the provisions of this Act are expressly waived in such collective bargaining agreement. </text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF1EC123DC06C4C2B922FD09A3C3390D3"><enum>(E)</enum><header display-inline="yes-display-inline">Preference for local hiring</header><text display-inline="yes-display-inline">The contractor or subcontractor shall have explicit policies that provide a preference for local hiring, consistent with applicable Federal law and subject to rules issued by the Secretary of Labor.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD845786796FD494BBE811E5F0E0F0F47"><enum>(F)</enum><header>Contractor requirement regarding subcontractors</header><text>The contractor or subcontractor shall require that each subcontractor of the contractor for an eligible project carried out under the program comply with the requirements of this paragraph with respect to all employees of the subcontractor employed in the performance of the project.</text></subparagraph></paragraph> <paragraph id="H488E9E6519B745C4B1B9F9A4A92F5813"><enum>(2)</enum><header>Disclosure</header><text>A contractor desiring a contract under an eligible project carried out under the program shall disclose to the Secretary in the contract application any administrative merits determination, arbitral award or decision, or civil judgment against the contractor during the previous 5 years for any violation of—</text>
<subparagraph id="H5A8DB222A2514CB4BCF90A0C50B265EB"><enum>(A)</enum><text>the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201</external-xref> et seq.);</text></subparagraph> <subparagraph id="H290EC40138154B8BB484A5E04795C44B"><enum>(B)</enum><text>the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651</external-xref> et seq.);</text></subparagraph>
<subparagraph id="H31F18032703240AB80167216F6BBC941"><enum>(C)</enum><text>the Migrant and Seasonal Agricultural Worker Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1801">29 U.S.C. 1801</external-xref> et seq.);</text></subparagraph> <subparagraph id="H2389C354C0484B13B1EB8C885E633F8E"><enum>(D)</enum><text>the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151</external-xref> et seq.);</text></subparagraph>

<subparagraph id="H738897D58D644E3C88EB4CC69E1DBF3C"><enum>(M)</enum><text>the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/621">29 U.S.C. 621</external-xref> et seq.);</text></subparagraph> <subparagraph id="H4F7104B669734C22849BB855D4FF2459"><enum>(N)</enum><text>Executive Order 13658 (79 Fed. Reg. 9851; relating to establishing a minimum wage for contractors); or</text></subparagraph>
<subparagraph id="H8B70FA0B724C4265A2057BE8B9601724"><enum>(O)</enum><text>any State law equivalent of a law described in subparagraphs (A) through (N), in accordance with guidance issued by the Secretary of Labor.</text></subparagraph></paragraph> <paragraph id="H30F3B6A220664EF797071489F3318C06"><enum>(3)</enum><header>Labor agreements for construction projects</header> <subparagraph id="H97C308ED6ED74476996D97D2E6D1939C"><enum>(A)</enum><header>In general</header><text>A contractor for an eligible project carried out under the program that is a construction project shall be a party to a covered project labor agreement. </text></subparagraph>
<subparagraph id="HF6834AC403324B86BAEBF65F875CA505"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="HFA7E5CDCEC444C309CBF0F9C65448A8B"><enum>(i)</enum><header>Covered project labor agreement</header><text>The term <term>covered project labor agreement</term> means a project labor agreement that—</text>
<subclause id="H77A9255B90664AFC8C78D030486B3DD2"><enum>(I)</enum><text>binds all contractors and subcontractors on the construction project through the inclusion of appropriate specifications in all relevant solicitation provisions and contract documents;</text></subclause> <subclause id="HC3225369F62B48E2AC20B8CF86AD3C72"><enum>(II)</enum><text>allows all contractors and subcontractors to compete for contracts and subcontracts without regard to whether they are otherwise a party to a collective bargaining agreement;</text></subclause>
<subclause id="H90DEC04C30984EBE97C5C49849A170E8"><enum>(III)</enum><text>contains guarantees against strikes, lockouts, and other similar job disruptions;</text></subclause> <subclause id="H5E70408B2FB149B9A1C9AC815E61B8EA"><enum>(IV)</enum><text>sets forth effective, prompt, and mutually binding procedures for resolving labor disputes arising during the covered project labor agreement; and</text></subclause>
<subclause id="HFB6A9F12734D488C998DDEC49476E856"><enum>(V)</enum><text>provides other mechanisms for labor-management cooperation on matters of mutual interest and concern, including productivity, quality of work, safety, and health.</text></subclause></clause> <clause id="H957EA62DDDBC41E686E585A392F37097"><enum>(ii)</enum><header>Project labor agreement</header><text>The term <term>project labor agreement</term> means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is described in section 8(f) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(f)</external-xref>). </text></clause></subparagraph></paragraph></subsection>
<subsection commented="no" id="HC8BCAEBCBEA14A819BC523E26A3341F0"><enum>(n)</enum><header>Funding</header>
<paragraph commented="no" id="H7822286BDB004D38AED54D25AB1E4941"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the program $50,000,000,000 for each of fiscal years 2022 through 2031, of which not less than $15,000,000,000 shall be for grants for the purchase of electric vehicles and electric vehicle supply equipment.</text></paragraph> <paragraph commented="no" id="H5223DD99B9D54E79BD60F97A4CE7D55F"><enum>(2)</enum><header>Availability</header><text>Amounts made available under paragraph (1) shall remain available until January 1, 2042.</text></paragraph></subsection></section>
<section id="HB24F5FDE6C6A4AD8A4271DE26ACC10DF"><enum>3.</enum><header>Federal funding exchange programs</header><text display-inline="no-display-inline">Section 106(g) of title 23, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9E4CF0EC2DA6400B90011CA4789FF88A"> <paragraph id="H29A62C20EA944BEEA591EB6C61E1DAF2"><enum>(6)</enum><header>Federal funding exchange programs</header><text>A State may implement a program under which a subrecipient has the option to exchange Federal funds allocated to the subrecipient in accordance with the requirements of this title for State or local funds if the State certifies to the Secretary that—</text>
<subparagraph id="H90B700F1DA844BC0A99F3BA05334B032"><enum>(A)</enum><text>the State has prevailing wage and domestic content requirements that are comparable to the requirements under sections 113 and 313, respectively; and</text></subparagraph> <subparagraph id="HA7262D751F6E44BA85B906CB52923E7F"><enum>(B)</enum><text>the requirements described in subparagraph (A) shall apply to projects carried out using the State or local funds if the projects would have been subject to the requirements of sections 113 and 313 if the projects were carried out using Federal funds.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
