R. 2036</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="L000593">Mr. Levin of California</sponsor> (for himself and <cosponsor name-id="F000465">Mr. Ferguson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services, in consultation with the Secretary of State, to formulate a strategy for entering into agreements with foreign countries to develop and commercialize new drugs to address pandemics, and for other purposes.</official-title></form><legis-body id="H3F84919FDB4846319925F0272AA3AE12" style="OLC"><section id="H2F846DFE9866455CBBD8916011285312" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving Us from Pandemic Era Resistance by Building a Unified Global Strategy Act of 2021</short-title></quote> or the <quote><short-title>SUPER BUGS Act of 2021</short-title></quote>.</text></section><section id="HB74AAD1FD83043DCBB6EA34138B40AD6"><enum>2.</enum><header>International strategy for development of new drugs to address pandemics</header><subsection id="H5A8B91EE71C5427B961CBCD0BAC489C4"><enum>(a)</enum><header>Strategy</header><paragraph id="H6555B20BFDA545609FD76C4B027FEF85"><enum>(1)</enum><header>In general</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of State, shall—</text><subparagraph id="HA983A4BBB815452C81BE719819559A31"><enum>(A)</enum><text display-inline="yes-display-inline">formulate a strategy for entering into agreements with foreign countries to help to develop and commercialize (including through contracts with the private sector) new drugs to address pandemics, including antimicrobial drugs; and</text></subparagraph><subparagraph id="HE05190576B484B8387849456A5CCD0D4"><enum>(B)</enum><text>submit such strategy to the Congress.</text></subparagraph></paragraph><paragraph id="H28F816F27A0244E88CD485CDB06F99D5"><enum>(2)</enum><header>Contents</header><text>The strategy under paragraph (1) shall—</text><subparagraph id="H56D42BB459B5414A9DE447CDC5C7691A"><enum>(A)</enum><text display-inline="yes-display-inline">provide for the harmonization of agreements and contracts described in paragraph (1)(A);</text></subparagraph><subparagraph id="H3FE160464ACF453086835DEDA9708FEA"><enum>(B)</enum><text>allow such countries to emphasize national or regional issues of importance; and</text></subparagraph><subparagraph id="H7AEF54F3CFBC4A2C9F3E85C9C54015FF"><enum>(C)</enum><text>provide for collaboration among such countries, so as to allocate joint or individual responsibility across such countries for the development and commercialization of particular drugs.</text></subparagraph></paragraph></subsection><subsection id="H7FD9FE223FC24E5293502B1712E5AD15"><enum>(b)</enum><header>Agreements with foreign countries</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in consultation with the Secretary of State, shall seek to enter into agreements with foreign countries to implement the strategy under subsection (a).</text></subsection><subsection id="H098492A8AC084FEA97379AFDA4D6172E"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>antimicrobial drug</term> means—</text><paragraph id="H3F82A7388C6D42879D12E528E2EA640D"><enum>(1)</enum><text>an antibiotic drug, as defined in section 201(jj) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(jj)</external-xref>); or</text></paragraph><paragraph id="H6036311841144CEE935AAB08017ACED6"><enum>(2)</enum><text>a biological product, as defined in section 351(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(i)</external-xref>), that exhibits antimicrobial activity.</text></paragraph></subsection></section></legis-body></bill>
