R. 2025</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="I000056">Mr. Issa</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to increase transparency and oversight of third-party litigation funding in certain actions, and for other purposes.</official-title></form><legis-body id="H8B8FA8EBBC5B469F929F14E30E5DC37A" style="OLC"><section id="HE446A191D8EB49C2A109EA58A62515A4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Litigation Funding Transparency Act of 2021</short-title></quote>.</text></section><section id="H41EBB0A84B8C402CA5D3D9FF74753991"><enum>2.</enum><header>Transparency and oversight of third-party litigation funding in class actions</header><subsection id="H55D318CA432D48D4BA422D360CD2E211"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/114">Chapter 114</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3D4DB7510C514F5B805C59513C988622" style="USC"><section id="H97C75274B950429D826DB5CDCD15D103"><enum>1716.</enum><header>Third-party litigation funding disclosure</header><subsection id="HF79B343294BB4F878C4498E73E5782DB"><enum>(a)</enum><header>In general</header><text>In any class action, class counsel shall—</text><paragraph id="H23D9023E94054443A705308FA7648712"><enum>(1)</enum><text>disclose in writing to the court and all other named parties to the class action the identity of any commercial enterprise, other than a class member or class counsel of record, that has a right to receive payment that is contingent on the receipt of monetary relief in the class action by settlement, judgment, or otherwise; and</text></paragraph><paragraph id="HBCAEDF61071E46BE8D7C8653039FEC5A"><enum>(2)</enum><text>produce for inspection and copying, except as otherwise stipulated or ordered by the court, any agreement creating the contingent right.</text></paragraph></subsection><subsection id="HCB88481D67194D72826683316C1443AA"><enum>(b)</enum><header>Timing</header><text>The disclosure required by subsection (a) shall be made not later than the later of—</text><paragraph id="HF90BC0EE27B4421C8316CC4F2B69ECA8"><enum>(1)</enum><text>10 days after execution of any agreement described in subsection (a)(2); or</text></paragraph><paragraph id="H33BBC8CD53EE40ABAB9FA3545646ABB9"><enum>(2)</enum><text>the time of service of the action.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H224285146F1B4AFBA84E292B13D31BE5"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/114">chapter 114</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block id="HC9381F01A4B64607BA2F72ACEF0E18FD" style="USC"><toc><toc-entry idref="H97C75274B950429D826DB5CDCD15D103" level="section">1716. Third-party litigation funding disclosure.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H52F8E576C7E14BB1AD9D2DA8C6108CEF"><enum>3.</enum><header>Transparency and oversight of third-party litigation funding in multidistrict litigation</header><text display-inline="no-display-inline">Section 1407 of title 28, United States Code, is amended—</text><paragraph id="H039760A12ED24D9EB8E3CE8D57FFF111"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively; and</text></paragraph><paragraph id="H399B9B9C62074971B00E2D6418BA8DF1"><enum>(2)</enum><text>by inserting after subsection (f) the following:</text><quoted-block display-inline="no-display-inline" id="H62440C0320964ED7AAE2CE11B7B8D807" style="OLC"><subsection id="HB70C7CDC24FD4D65A56EC45B18BEA4F8"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4A9CDB194FE544D2945C256D32DBA1EE"><enum>(1)</enum><text>In any coordinated or consolidated pretrial proceedings conducted pursuant to this section, counsel for a party asserting a claim whose civil action is assigned to or directly filed in the proceedings shall—</text><subparagraph id="H2FA171266F38440385E5DEF0ED07E3AD" indent="up1"><enum>(A)</enum><text>disclose in writing to the court and all other parties the identity of any commercial enterprise, other than the named parties or counsel, that has a right to receive payment that is contingent on the receipt of monetary relief in the civil action by settlement, judgment, or otherwise; and</text></subparagraph><subparagraph id="H77D8FECD7E6148819CE5E7150E4875C1" indent="up1"><enum>(B)</enum><text>produce for inspection and copying, except as otherwise stipulated or ordered by the court, any agreement creating the contingent right.</text></subparagraph></paragraph><paragraph id="HC1C0FE549F3348D1BD6450187C9E72A7" indent="up1"><enum>(2)</enum><text>The disclosure required by paragraph (1) shall be made not later than the later of—</text><subparagraph id="H0530D34E4DB74895B2452474B193EA2C"><enum>(A)</enum><text>10 days after execution of any agreement described in paragraph (1)(B); or</text></subparagraph><subparagraph id="H955FB832B4E444649EBC3D639777BBFD"><enum>(B)</enum><text>the time the civil action becomes subject to this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H92CDABFF2EC244F781EDE3C4107F48E4"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any case pending on or commenced after the date of the enactment of this Act.</text></section></legis-body></bill>
