which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to establish a national bridge replacement and improvement program, and for other purposes.</official-title></form><legis-body id="H2EDE273AAA1A43FCA2F316CAF478C68E" style="OLC"><section id="HEE955C5ADDD2428FACED635F1FBC4F84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Bridge Replacement and Improvement Act</short-title></quote>.</text></section><section id="H8A914C94392243CEBE6D4688F5E2C8AA" section-type="subsequent-section"><enum>2.</enum><header>National bridge replacement and improvement program</header><subsection id="HAD3093ACC11D4E84B3F48C40F5F60CCA"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall establish a national bridge replacement and improvement program (in this section referred to as the <quote>Program</quote>) to assist safety improvements for high-risk intersections and interchanges.</text></subsection><subsection id="H8C37D5C8946E4D64A7A12BCB51181381"><enum>(b)</enum><header>Grant authority</header><text display-inline="yes-display-inline">In carrying out the Program, the Secretary may make grants on a competitive basis to covered entities.</text></subsection><subsection id="H4C45D9459CF34C0FA919B29B4D24FA2F"><enum>(c)</enum><header>Project requirements</header><text>The Secretary may only make a grant under the Program to assist a project that—</text><paragraph id="HFE856C3A27C84F379AAEBE3ADA7870CB"><enum>(1)</enum><text>is a bridge on a Federal-aid highway that is eligible for funding under title 23, United States Code; and</text></paragraph><paragraph id="HA568831272E549ACAC0E39E6019404A1"><enum>(2)</enum><text>will—</text><subparagraph id="HE5BBCC694D4D4369A1F2302BEAB311BC"><enum>(A)</enum><text>restore or increase the structural capacity of the bridge;</text></subparagraph><subparagraph id="HA68508AE6D114FB194966B40520BB2CD"><enum>(B)</enum><text>correct a major safety defect of the bridge; or</text></subparagraph><subparagraph id="H1DBA1629AC88442C9F5B8D75CD588664"><enum>(C)</enum><text>replace an existing bridge with a new bridge that—</text><clause id="H93768185CA464F1DB69D81FB2BE2788E"><enum>(i)</enum><text>is in the same general traffic corridor as the bridge being replaced, as determined by the Secretary; and</text></clause><clause id="HFC0323FBA7CE451C8344ACC6407869BA"><enum>(ii)</enum><text>meets the requirements of subparagraph (A) or (B).</text></clause></subparagraph></paragraph></subsection><subsection id="H44A5130C4C634F3AB3583C179942D5FA"><enum>(d)</enum><header>Applications</header><text>To be eligible for a grant under the Program, a covered entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines is appropriate.</text></subsection><subsection id="H6991D0BED3024E3DB3AD07FC7E91B6FD"><enum>(e)</enum><header>Limitation</header><text>The aggregate amount provided to a covered entity in a fiscal year through grants under the Program may not exceed 5 percent of the amount made available for all grants under the Program in that fiscal year.</text></subsection><subsection id="HA5469F8F091F47919A25ADF0E09B66A3"><enum>(f)</enum><header>Congressional review</header><text>At least 90 days before establishing the Program under subsection (a), the Secretary shall submit to Congress a report detailing the selection process the Secretary shall use in making grants under the Program.</text></subsection><subsection id="HB2E80878B0334BEDA2867BC394E311EA"><enum>(g)</enum><header>Covered entity defined</header><text>In this section, the term <quote>covered entity</quote> means any of the following:</text><paragraph id="H67DDDC88CD2545BC9265DF916F7BBBE9"><enum>(1)</enum><text>A State government entity.</text></paragraph><paragraph id="H899B253713624D31830406855A12DE22"><enum>(2)</enum><text>A local government entity.</text></paragraph><paragraph id="H136C90BD7C904BAC81C8B1A05EA4AD73"><enum>(3)</enum><text>A territory of the United States.</text></paragraph><paragraph id="H5903A19C4C9848F78BC72DB9E351F078"><enum>(4)</enum><text>A Tribal government.</text></paragraph><paragraph id="HD08C4B45FC604E349D890D959D9DC5E8"><enum>(5)</enum><text>A metropolitan planning organization.</text></paragraph><paragraph id="H731FBF4A0AFE498482FE699D893DF9EB"><enum>(6)</enum><text>Any entity composed of 2 or more entities described in paragraphs (1) through (5).</text></paragraph></subsection><subsection id="H42224D0C2D3B4214B91F2702F6334856"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="HA793BBE98AAF4EAFA9BB020F8309FB50"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out the Program $1,000,000,000 for each fiscal year.</text></paragraph><paragraph id="HDCC9773FFB8C48888F835A9D7C51781B"><enum>(2)</enum><header>Applicability of title 23, United States Code</header><text>Funds authorized to be appropriated by paragraph (1) shall—</text><subparagraph id="H152E34FB176642E89D88044D4A513FF3"><enum>(A)</enum><text>be available for obligation in the same manner as if those funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that the Federal share of the cost of a project or activity carried out using such funds shall be 80 percent; and</text></subparagraph><subparagraph id="H1004617B7D6D4DF5803EA9D7BA1CA23D"><enum>(B)</enum><text>remain available until expended and not be transferable.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
