this Act:</text><paragraph commented="no" id="HD2395B82CB9B4756A97E76786F16B940"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Climate Change Advisory Commission established by section 101(a).</text></paragraph><paragraph commented="no" id="H20FD6A1EF0D5494CA3D05DEBD2FB1674"><enum>(2)</enum><header>Community of color</header><text>The term <term>community of color</term> means a geographically distinct area in which the population of any of the following categories of individuals is higher than the average populations of that category for the State in which the community is located:</text><subparagraph id="H2FC71A7817E144CDA2FC0AAFBECC400B"><enum>(A)</enum><text>Black.</text></subparagraph><subparagraph id="H4923CAE88E8C4963A7A61856E83C5C99"><enum>(B)</enum><text>African American.</text></subparagraph><subparagraph id="HBB36D3F7C0E24DCD8F963D93662C14A3"><enum>(C)</enum><text>Asian.</text></subparagraph><subparagraph id="H8B1303011D774F3B813711EF0F228A74"><enum>(D)</enum><text>Pacific Islander.</text></subparagraph><subparagraph id="HF30065605D0841FA9FFADDDE7EA949EA"><enum>(E)</enum><text>Other non-White race.</text></subparagraph><subparagraph id="HA9341B68BCE443728EED91961BA8D2F8"><enum>(F)</enum><text>Hispanic.</text></subparagraph><subparagraph id="H7A3EBA3D7FDA46C6BB79241EED8ED619"><enum>(G)</enum><text>Latino.</text></subparagraph><subparagraph id="HD83629BB615D46219E043B0122814644"><enum>(H)</enum><text>Linguistically isolated. </text></subparagraph></paragraph><paragraph id="HC7F78E68B1B04C6585DC80E4D1F97EC1"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> includes—</text><subparagraph id="H475D78B8F2CF4EFE80E4A64BFB0683D8"><enum>(A)</enum><text>a Federal agency;</text></subparagraph><subparagraph id="H092C2357C5674CFDB06068D00E3FF796"><enum>(B)</enum><text>a State or group of States;</text></subparagraph><subparagraph id="HBCCFC5F902B04A07BD6B004EB74D0852"><enum>(C)</enum><text>a unit of local government or a group of local governments;</text></subparagraph><subparagraph id="H62E62AA54C074BC2A4919700CAD735D7"><enum>(D)</enum><text>a utility district;</text></subparagraph><subparagraph id="HBCD45466BC2F4259B7332A2BA223FE35"><enum>(E)</enum><text>a Tribal government or a consortium of Tribal governments;</text></subparagraph><subparagraph id="H6BA2A61492D94C03A10CAA650C84D968"><enum>(F)</enum><text>a State or regional transit agency or a group of State or regional transit agencies;</text></subparagraph><subparagraph id="HB5E511159CC54871B3CD370D36DF79EB"><enum>(G)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph id="H7759B268E3564FEEAC7DF3113F401DBB"><enum>(H)</enum><text>a special purpose district or public authority, including a port authority; and</text></subparagraph><subparagraph id="HDEF8F56CF34645BB9CD78F011752B5C4"><enum>(I)</enum><text>any other entity, as determined by the Secretary. </text></subparagraph></paragraph><paragraph commented="no" id="H519B612C631D478089BE3E0B9C79A3C0"><enum>(4)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and indigenous communities that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects. </text></paragraph><paragraph commented="no" id="H3D460594456144F59932F8DE30345AAC"><enum>(5)</enum><header>Frontline community</header><text>The term <term>frontline community</term> means a low-income community, a community of color, or a Tribal community that is disproportionately impacted or burdened by climate change or a phenomenon associated with climate change, including such a community that was or is at risk of being disproportionately impacted or burdened by climate change or a phenomenon associated with climate change earlier than other such communities.</text></paragraph><paragraph commented="no" id="H13C11D95F20C4893A9919AB5EA778080"><enum>(6)</enum><header>Fund</header><text>The term <term>Fund</term> means the Climate Change Resiliency Fund established by section 201(a)(1).</text></paragraph><paragraph commented="no" id="H596A5525382343D8AF4CEA8600D7FE19"><enum>(7)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with an annual household income equal to, or less than, the greater of—</text><subparagraph id="HC967CF1CD2D44788881079656E1CCF0D"><enum>(A)</enum><text>an amount equal to 80 percent of the median household income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="HE6FEB071743742D9B78C0CAEFCCA5B04"><enum>(B)</enum><text>200 percent of the Federal poverty line. </text></subparagraph></paragraph><paragraph id="H4C6193CB78304EAD9CBF35930D5B61EE"><enum>(8)</enum><header>Project</header><text>The term <term>project</term> means a project for a qualified climate change adaptation purpose performed by an eligible entity under section 201(b). </text></paragraph><paragraph commented="no" id="H27867CB859A04F1795631073F26C5790"><enum>(9)</enum><header>Qualified climate change adaptation purpose</header><subparagraph commented="no" id="H8542E740CE334AF4AACD4C8F4C797810"><enum>(A)</enum><header>In general</header><text>The term <term>qualified climate change adaptation purpose</term> means an objective with a demonstrated intent to reduce the economic, social, and environmental impact of the adverse effects of climate change.</text></subparagraph><subparagraph commented="no" id="H13197FB4E394429EA29BFBB9D6D9394F"><enum>(B)</enum><header>Inclusions</header><text>The term <term>qualified climate change adaptation purpose</term> includes infrastructure resiliency and mitigation, improved disaster response, and ecosystem protection, which may be accomplished through activities or projects with objectives such as—</text><clause commented="no" id="H81CA28BF014D4282B11F6A500729D3E3"><enum>(i)</enum><text>reducing risks or enhancing resilience to sea level rise, extreme weather events, fires, drought, flooding, heat island impacts, or worsened indoor or outdoor air quality;</text></clause><clause commented="no" id="HFEB0885F86DE43B5BF1819DF022AEFC3"><enum>(ii)</enum><text>protecting farms and the food supply from climate impacts;</text></clause><clause commented="no" id="HF4453C492F0E479C96A3C70C00B4471E"><enum>(iii)</enum><text>reducing risks of food insecurity that would otherwise result from climate change;</text></clause><clause commented="no" id="H992EE0CACDFA4B81B09800844F77B530"><enum>(iv)</enum><text>ensuring that disaster and public health plans account for more severe weather;</text></clause><clause commented="no" id="H347B81F5EB014477ABE4B7CBEFCE7214"><enum>(v)</enum><text>reducing risks from geographical change to disease vectors, pathogens, invasive species, and the distribution of pests; and</text></clause><clause commented="no" id="HD89209918C1344789026A3B78F5B8008"><enum>(vi)</enum><text>other projects or activities, as determined to be appropriate by the Commission.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HD0B5B3574B564341B6F8A4D045727C5E"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="H8F5734B015E44FD4BFBC9682771D30A3"><enum>(11)</enum><header>State</header><text>The term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States. </text></paragraph></section><title id="H9AF0891EB4AC4C6198422EF6519EEA58" style="OLC"><enum>I</enum><header>Climate Change Advisory Commission</header><section id="H78092A0655514F098FA93D37172205EB"><enum>101.</enum><header>Establishment of Climate Change Advisory Commission</header><subsection id="H3566954F7621484584A5402402B421BD"><enum>(a)</enum><header>In general</header><text>There is established a commission to be known as the <quote>Climate Change Advisory Commission</quote>.</text></subsection><subsection id="HEDEF31C50C6E45ACBCDDCDF8F57B47EC"><enum>(b)</enum><header>Membership</header><text>The Commission shall be composed of 11 members—</text><paragraph id="H89877AEE77494BF48FBFE70A6C78FF6B"><enum>(1)</enum><text>who shall be selected from the public and private sectors and institutions of higher education; and</text></paragraph><paragraph id="HF239FCA91D13495894DAD2CFBA32318C"><enum>(2)</enum><text>of whom—</text><subparagraph id="HF326B5B5823A46D28772A4929912EAFB"><enum>(A)</enum><text>3 shall be appointed by the President, in consultation with the National Climate Task Force;</text></subparagraph><subparagraph id="HA133E9F7E98744628CA2AD631CF6BBF8"><enum>(B)</enum><text>2 shall be appointed by the Speaker of the House of Representatives;</text></subparagraph><subparagraph id="H00F3A5DD86214343BA768A7072C17AF4"><enum>(C)</enum><text>2 shall be appointed by the minority leader of the House of Representatives;</text></subparagraph><subparagraph id="H50912B5A102F4D66BCC20B62CD425FF7"><enum>(D)</enum><text>2 shall be appointed by the majority leader of the Senate; and</text></subparagraph><subparagraph id="H52EB9A0C4A7E41F5AF76F721B8C07BD2"><enum>(E)</enum><text>2 shall be appointed by the minority leader of the Senate.</text></subparagraph></paragraph></subsection><subsection id="H43CB3D050A5C4165A8EB1D8782426568"><enum>(c)</enum><header>Terms</header><text>Each member of the Commission shall be appointed for the life of the Commission.</text></subsection><subsection id="H237EB31A49F84DF6AC2C3DC55275CBC7"><enum>(d)</enum><header>Initial appointments</header><text>Each member of the Commission shall be appointed not later than 90 days after the date of enactment of this Act.</text></subsection><subsection id="H4EC4612C62A140E7905AD934E4694EE6"><enum>(e)</enum><header>Vacancies</header><text>A vacancy on the Commission—</text><paragraph id="HB59D1709DC604F89AFE7085850E6CF88"><enum>(1)</enum><text>shall not affect the powers of the Commission; and</text></paragraph><paragraph id="HB64D02EF7C54457FBB10698154D56758"><enum>(2)</enum><text>shall be filled in the manner in which the original appointment was made.</text></paragraph></subsection><subsection commented="no" id="H4F8E0C6422FA4BE8AA762CAC37AB5C68"><enum>(f)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold the initial meeting of the Commission.</text></subsection><subsection commented="no" id="HFC1C5FEADA624592B7B442DD539D554A"><enum>(g)</enum><header>Meetings</header><text>The Commission shall meet at the call of the Chairperson.</text></subsection><subsection commented="no" id="HDEC5318D128E4F22B9F4A62233425BA2"><enum>(h)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></subsection><subsection commented="no" id="HE0B1ABAE56DD402E95BB224AC6F5493D"><enum>(i)</enum><header>Chairperson and Vice Chairperson</header><text>The Commission shall select a Chairperson and Vice Chairperson from among the members of the Commission.</text></subsection></section><section id="H848D8BD5386E446A90AFD6E03826793B"><enum>102.</enum><header>Duties</header><text display-inline="no-display-inline">The Commission shall—</text><paragraph id="H7C22DC25C2774696BDFBF302D7578B7E"><enum>(1)</enum><text>establish recommendations, frameworks, and guidelines for a Federal investment program funded by revenue from climate change obligations issued under section 301 for eligible entities that—</text><subparagraph id="H15B12FD0B7B2449992CA2B07CA81FDE4"><enum>(A)</enum><text>improve and adapt energy, transportation, water, and general infrastructure impacted or expected to be impacted due to climate variability; and</text></subparagraph><subparagraph id="H40DDAE69DCC74B33874C805C9333C80C"><enum>(B)</enum><text>integrate best available science, data, standards, models, and trends that improve the resiliency of infrastructure systems described in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="H41E677D57F1440578EBBD64E207FC74C"><enum>(2)</enum><text>in consultation with the Council on Environmental Quality and the White House Environmental Justice Interagency Council, identify categories of the most cost-effective investments and projects that emphasize multiple benefits to human health, commerce, and ecosystems while ensuring that the Commission engages in early and meaningful community stakeholder involvement opportunities during the development of the recommendations, frameworks, and guidelines established under paragraph (1).</text></paragraph></section><section commented="no" id="HBC186DD85D53420D9147E00ADB507A4F"><enum>103.</enum><header>Commission personnel matters</header><subsection commented="no" id="H6D638D6FD918417191BF9D86C47156E4"><enum>(a)</enum><header>Compensation of members</header><paragraph commented="no" id="H8B888B0996214E98BCDD43909CC23882"><enum>(1)</enum><header>Non-federal employees</header><text>A member of the Commission who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Commission.</text></paragraph><paragraph commented="no" id="HB0115AF984F64767AE5DC5488CFAC376"><enum>(2)</enum><header>Federal employees</header><text>A member of the Commission who is an officer or employee of the Federal Government shall serve without compensation in addition to the compensation received for the services of the member as an officer or employee of the Federal Government.</text></paragraph></subsection><subsection commented="no" id="H3EB0CDD97BCF40E785BDD1BF22A0DD59"><enum>(b)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text></subsection><subsection commented="no" id="HC4672CE282074DC497ABB6706689886B"><enum>(c)</enum><header>Staff</header><paragraph commented="no" id="H62912C31629340A5800ADBDEB48DAB8F"><enum>(1)</enum><header>In general</header><text>The Chairperson of the Commission may, without regard to the civil service laws (including regulations), appoint and terminate such personnel as are necessary to enable the Commission to perform the duties of the Commission.</text></paragraph><paragraph commented="no" id="H958AB847360E48BEBB0FF764B26D4BDB"><enum>(2)</enum><header>Compensation</header><subparagraph commented="no" id="H077DA8A4512A497C9674B13227B01A4A"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Chairperson of the Commission may fix the compensation of personnel without regard to the provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates.</text></subparagraph><subparagraph commented="no" id="H2E976CB1686A452FB7CF9CC99BAAA36F"><enum>(B)</enum><header>Maximum rate of pay</header><text>The rate of pay for personnel shall not exceed the rate payable for level V of the Executive Schedule under section 5316 of title 5, United States Code.</text></subparagraph></paragraph></subsection></section><section commented="no" id="H38F3EAFA42A34EEDBD29447D4699580F"><enum>104.</enum><header>Funding</header><text display-inline="no-display-inline">The Commission shall use amounts in the Fund to pay for all administrative expenses of the Commission.</text></section><section commented="no" id="H089A3A690CC04CB6AF20A51C0FE63104"><enum>105.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate on such date as the Commission determines after the Commission carries out the duties of the Commission under section 102.</text></section></title><title id="HAE5DD7E0BB2C475F9DA0A367AB2C4709" style="OLC"><enum>II</enum><header>Climate Change Resiliency Fund</header><section id="HEEC29FEEDE204D45A8C1D8619F47FADB"><enum>201.</enum><header>Climate Change Resiliency Fund</header><subsection commented="no" display-inline="no-display-inline" id="HA61726AEC3914B9E96A49020057CA0D1"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="H9592E925AF7A40E0AD9EFB5739695F20"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States the <quote>Climate Change Resiliency Fund</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD303009F4B5452FAB9CF30A3D272705"><enum>(2)</enum><header>Use of amounts</header><subparagraph commented="no" display-inline="no-display-inline" id="H5A55315602E64E85A24552DB7E6B7F72"><enum>(A)</enum><header>In general</header><text>The Secretary shall use not less than 40 percent of the amounts in the Fund to fund projects that benefit communities that experience disproportionate impacts from climate change, including environmental justice communities, frontline communities, and low-income communities.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE62592A97624E59A826A37BF603EDC2"><enum>(B)</enum><header>Maintenance of effort</header><text display-inline="yes-display-inline">All amounts deposited in the Fund in accordance with section 301(a) shall only be used—</text><clause commented="no" display-inline="no-display-inline" id="H9F69876E0CE84DCCB16D432ADB990541"><enum>(i)</enum><text display-inline="yes-display-inline">to fund new projects in accordance with this section; and</text></clause><clause display-inline="no-display-inline" commented="no" id="HC765A66C31A84235AF518005C5761B13"><enum>(ii)</enum><text>for administrative expenses of the Commission authorized under section 104.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H18E4D1FDCF8A4C478CBFFB2E61C673F2"><enum>(3)</enum><header>Responsibility of Secretary</header><text>The Secretary shall take such action as the Secretary determines necessary to assist in implementing the Fund in accordance with this section.</text></paragraph></subsection><subsection commented="no" id="H681A331519C34CBAAC7D3D0D06733C01"><enum>(b)</enum><header>Climate change adaptation projects</header><text>The Secretary, in consultation with the Commission, shall carry out a program to provide funds to eligible entities to carry out projects for a qualified climate change adaptation purpose.</text></subsection><subsection id="HCE3060C76D834BBBA3231C63EF75AF4B"><enum>(c)</enum><header>Applications</header><paragraph id="H4A481D9169DC45B7821CE60B3B97BE25"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring funds under subsection (b) shall, with respect to a project, submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="HE20523BF973D40BA91433FEFBDDC320E"><enum>(2)</enum><header>Contents</header><text>An application submitted by an eligible entity under this subsection shall include data relating to any benefits the eligible entity expects the project to provide to the community in which the applicable project is performed, such as—</text><subparagraph id="HD46C3795E0224472BF124727AA672A4A"><enum>(A)</enum><text>an economic impact; or</text></subparagraph><subparagraph id="H32D931487D3945F2BB3E3F0C0D77CB6A"><enum>(B)</enum><text>improvements to public health.</text></subparagraph></paragraph><paragraph id="H99F2977C96764E289402DBACB6EBA21D"><enum>(3)</enum><header>Technical assistance</header><text>The Secretary shall offer technical assistance to eligible entities preparing applications under this subsection.</text></paragraph></subsection><subsection id="H171AFF646DAC4AD0A811D5D7067F39FF"><enum>(d)</enum><header>Selection</header><paragraph id="H9DF96B236B8D4558A2582EA986747B20"><enum>(1)</enum><header>In general</header><text>The Secretary shall select eligible entities to receive funds to carry out projects under this section based on criteria and guidelines determined and published by the Commission under section 102.</text></paragraph><paragraph id="H08A267BC533647468DC2AFB031BE113E"><enum>(2)</enum><header>Priority</header><text>In selecting eligible entities under paragraph (1), the Secretary shall give priority to eligible entities planning to perform projects that will serve areas with the greatest need.</text></paragraph></subsection><subsection id="H3C99D26284164C14AF8FC993AB57EAA0"><enum>(e)</enum><header>Non-Federal funding requirement</header><paragraph id="HBB52C28B26BC4DFA8355996A3D93E5B9"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), in order to receive funds under this section, an eligible entity shall provide funds for a project in an amount that is equal to not less than 25 percent of the amount of funds provided under this section.</text></paragraph><paragraph id="HF2DB26B636234916AD523FDD5BD003DA"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive all or part of the matching requirement under paragraph (1) for an eligible entity, especially an eligible entity performing a project benefitting a low-income community or an environmental justice community, if the Secretary determines that—</text><subparagraph id="H258F612968B041D69509C13EC5B32C22"><enum>(A)</enum><text>there are no reasonable means available through which the eligible entity can meet the matching requirement; or</text></subparagraph><subparagraph id="H52A08470A8304D958BED194D1BEA2938"><enum>(B)</enum><text>the probable benefit of the project outweighs the public interest of the matching requirement.</text></subparagraph></paragraph><paragraph id="HDCE1BA9918C546CE8C03B6F6AEE983B1"><enum>(3)</enum><header>No-match projects</header><subparagraph id="HC8D9626895684829950A3EFEE1A69E3A"><enum>(A)</enum><header>In general</header><text>The Secretary shall award not less than 10 percent and not more than 40 percent of the total funds awarded under this section to eligible entities to which the matching requirement under paragraph (1) shall not apply.</text></subparagraph><subparagraph id="HB8B2E90944BA4E4099C700F9F7F5A681"><enum>(B)</enum><header>Priority</header><text>The Secretary shall give priority for funding under subparagraph (A) to an eligible entity performing a project in a community experiencing a disproportionate impact of climate change, including—</text><clause id="H4C999BCE03B140C6876D45A087202456"><enum>(i)</enum><text>an environmental justice community;</text></clause><clause id="H3AAD167E325A420A8BF3BB533DDF197D"><enum>(ii)</enum><text>a low-income community; or</text></clause><clause id="H61279564AD674E458F0078D2C7F22DC9"><enum>(iii)</enum><text>a community of color.</text></clause></subparagraph></paragraph></subsection><subsection id="H6E20C1390F5E48868022E196BB5949BF"><enum>(f)</enum><header>Applicability of Federal law</header><text>Nothing in this Act shall be construed to waive the requirements of any Federal law or regulation that would otherwise apply to a project that receives funds under this section.</text></subsection></section><section id="HEBE807ED8A9A410986D3F71D995F1477"><enum>202.</enum><header>Compliance with Davis-Bacon Act</header><subsection id="H6F054B74536A489C8021A0D74A07C4AC"><enum>(a)</enum><header>In general</header><text>All laborers and mechanics employed by contractors and subcontractors on projects funded directly by, or assisted in whole or in part by and through, the Fund shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of part A of title 40, United States Code.</text></subsection><subsection id="HDB39BFCF8ADB4EFEBE4EE95487AF2E17"><enum>(b)</enum><header>Labor standards</header><text>With respect to the labor standards described in this section, the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subsection></section><section id="H5F2D6571BC044C51ABFDB5742439A740" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header>Funding</header><text display-inline="no-display-inline">To carry out the program under section 201(b), the Secretary, in addition to amounts in the Fund, may use amounts that have been made available to the Secretary and are not otherwise obligated. </text></section></title><title id="H5406B9E9177041B097DB2D2ECE541646" style="OLC"><enum>III</enum><header>Revenue</header><section commented="no" id="HBD1A25CF71E74BBB849CB763903C6528"><enum>301.</enum><header>Climate Change Obligations</header><subsection commented="no" id="H84B209F911C4456F8E58FFE4B32DBE79"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Secretary of the Treasury or the Secretary's delegate (referred to in this title as the <quote>Secretary</quote>) shall issue obligations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/31">chapter 31</external-xref> of title 31, United States Code (referred to in this title as <quote>climate change obligations</quote>), the proceeds from which shall be deposited in the Fund.</text></subsection><subsection commented="no" id="H9B1798E2A3F4443187023AB9FABFB505"><enum>(b)</enum><header>Full faith and credit</header><text>Payment of interest and principal with respect to any climate change obligation issued under this section shall be made from the general fund of the Treasury of the United States and shall be backed by the full faith and credit of the United States.</text></subsection><subsection commented="no" id="H58194CBB475F426A95A876DD31A73BF7"><enum>(c)</enum><header>Exemption from local taxation</header><text>All climate change obligations issued by the Secretary, and the interest on or credits with respect to such obligations, shall not be subject to taxation by any State, county, municipality, or local taxing authority.</text></subsection><subsection commented="no" id="H8FC101188F544A689209F6EC887BFF2C"><enum>(d)</enum><header>Amount of Climate Change Obligations</header><paragraph commented="no" id="HCD82E88164A2491F9ECE136E1EFF60E7"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the aggregate face amount of the climate change obligations issued annually under this section shall be $200,000,000.</text></paragraph><paragraph commented="no" id="H4360B2D904444309803CBFB5DB1408C2"><enum>(2)</enum><header>Additional obligations</header><text>For any calendar year in which all of the obligations issued pursuant to paragraph (1) have been purchased, the Secretary may issue additional climate change obligations during such calendar year, provided that the aggregate face amount of such additional obligations does not exceed $800,000,000.</text></paragraph></subsection><subsection commented="no" id="HB7DCD08F23D44EB982DDD705229042BD"><enum>(e)</enum><header>Funding</header><text>The Secretary shall use funds made available to the Secretary and not otherwise obligated to carry out the purposes of this section.</text></subsection></section><section id="HF4E15FC5C0B344FE8D0F5E403EFCDC0C"><enum>302.</enum><header>Promotion</header><subsection id="HD25BDA04C119469CB9A8212E140CFE0E"><enum>(a)</enum><header>In general</header><text>The Secretary shall promote the purchase of climate change obligations through such means as are determined appropriate by the Secretary, with the amount expended for such promotion not to exceed $10,000,000 for any fiscal year during the period of fiscal years 2022 through 2026.</text></subsection><subsection id="H01ECE97EDC154867978E04DDF8BE0D72"><enum>(b)</enum><header>Donated advertising</header><text>In addition to any advertising paid for with funds made available under subsection (c), the Secretary shall solicit and may accept the donation of advertising relating to the sale of climate change obligations.</text></subsection><subsection id="H7F57B18913AD4A00A5B6C81B392C87DA"><enum>(c)</enum><header>Authorization of appropriations</header><text>For each fiscal year during the period of fiscal years 2022 through 2026, there is authorized to be appropriated $10,000,000 to carry out the purposes of this section.</text></subsection></section></title></legis-body></bill>
