which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Nutrition Act of 1966 to increase the age of eligibility for children to receive benefits under the special supplemental nutrition program for women, infants, and children, and for other purposes.</official-title></form><legis-body id="H05BBE69693154F1A877D2032B33B7E66" style="OLC"><section id="HA3859C7258A94A8399F3C2341CB40C37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wise Investment in Children Act of 2021</short-title></quote> or the <quote><short-title>WIC Act of 2021</short-title></quote>.</text></section><section id="HF64C24B934BB4AEE940DEF18B393527D"><enum>2.</enum><header>Age of eligibility for children under the special supplemental nutrition program</header><subsection id="H5D1B8407316F4E998A989E2651C909DD"><enum>(a)</enum><header>Definition of child</header><text>Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text><paragraph id="H6D9D709660194D7799389C51F92712B3"><enum>(1)</enum><text>in subsection (b), by striking paragraph (2) and inserting the following:</text><quoted-block id="HF5EA074BFFFF4C2DA9B5552D039ACBD8" style="OLC"><paragraph id="H25090699CD594A19876D6A0C20231DE0"><enum>(2)</enum><header>Child</header><text>The term <quote>child</quote> means—</text><subparagraph id="HF93F9BC59BA54F22B92C82F222FB4F01"><enum>(A)</enum><text>a person who has attained their first birthday but has not yet attained their fifth birthday; and</text></subparagraph><subparagraph id="H130A859026134ED89FC4A52C3B89FFE9"><enum>(B)</enum><text>for purposes of subsection (d)(3)(A)(iii)(II), a person who has attained their first birthday but has not yet attained their sixth birthday.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H6D05C254AB674D84A45C112508898996"><enum>(2)</enum><text>in subsection (e)(4)(A), by striking <quote>up to age 5</quote>; and</text></paragraph><paragraph id="H50CAF8A7A661439290113CA56D290C01"><enum>(3)</enum><text>in subsection (f)(7)(D)(i), by striking <quote>under the age of 5</quote>.</text></paragraph></subsection><subsection id="H814F0144332A45D2A0ABD3BABD498067"><enum>(b)</enum><header>Certification</header><text>Section 17(d)(3)(A)(iii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)(iii)</external-xref>) is amended—</text><paragraph id="H872523AE15D743E5B0732B3F5A9F810D"><enum>(1)</enum><text>by striking <quote>A State</quote> and inserting the following:</text><quoted-block id="H0F46656CB6DA4C3D8EBCBBA06FBD6FBA" style="OLC"><subclause id="H7DC434CAD0BB447EB8597080111592B6"><enum>(I)</enum><header>In general</header><text>A State</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE0B5E23B518D4CADBC2579AA7B5E5128"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H06F6CF2D7B914A87A1C18651D7221FDE" style="OLC"><subclause id="H5FF8EE9CFB60458583B815EE05B695DF"><enum>(II)</enum><header>5-year-old children</header><item id="HCB59308BD01348AE98C84637D6742DD8"><enum>(aa)</enum><header>In general</header><text>Subject to a waiver under clause (vi), beginning not later than October 1, 2026, a State shall certify a participant child who has had a fifth birthday but has not yet attained their sixth birthday, during the period that ends on the earlier of—</text><subitem id="HCF96C1C38A7043C9A98DA54E39C5DFCC"><enum>(AA)</enum><text>the sixth birthday of the child; and</text></subitem><subitem id="H92263A28D5864CBA9AAC64CC8E0AE568"><enum>(BB)</enum><text>the first date on which the child attends full day kindergarten.</text></subitem></item><item id="HB2843400DE8E48528930D4788686F242"><enum>(bb)</enum><header>Requirements</header><text>Each State that certifies a child under item (aa) shall—</text><subitem id="H37EB40F24CED46038D984401D7E8605D"><enum>(AA)</enum><text>ensure that the participant child receives required health and nutrition assessments; and</text></subitem><subitem id="H0A0B82EF58E94622A9244ED2FD5F50EA"><enum>(BB)</enum><text>establish a system to determine the first date on which a participant child attends full day kindergarten.</text></subitem></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB717FCB3DC974C9CB5F8E1D983266A21"><enum>(c)</enum><header>Conforming amendment</header><text>Section 1902(a)(53)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(53)(A)</external-xref>) is amended by striking <quote>below the age of 5</quote> and inserting <quote>(as defined in that section)</quote>.</text></subsection></section><section id="H47C8CEA4AB4B4D66B18710828380F0AC"><enum>3.</enum><header>Certification of infants</header><subsection id="H1E29F2D4DFBA46119C1D21838D7A0F7A"><enum>(a)</enum><header>Definition of infant</header><text>Section 17(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(b)</external-xref>) is amended by striking paragraph (5) and inserting the following:</text><quoted-block id="H61D8E615E1C340FAA7333CE2DBF89794" style="OLC"><paragraph id="H1808C1D3A9EA4A5F86C0D3F2AFAD46EE"><enum>(5)</enum><header>Infant</header><text>The term <quote>infant</quote> means—</text><subparagraph id="H8D33EBEEFE93451B8E690BDFC958F776"><enum>(A)</enum><text>a person under 1 year of age; and</text></subparagraph><subparagraph id="HC1564923F8394C37960BED82226E68E4"><enum>(B)</enum><text>for purposes of subsection (d), a person under 2 years of age.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC0D7A83B6B7E42A6BE2186FE2BF6BEAE"><enum>(b)</enum><header>Certification</header><text>Section 17(d)(3)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H2D972CE7981E4111AF70C8B7B2A0D854" style="OLC"><clause id="HAB30AD89AB2046069086C9326F2085D7"><enum>(iv)</enum><header>Infants</header><subclause id="HE7398B14001B42EE9DAA4EC4D334949F"><enum>(I)</enum><header>In general</header><text>Subject to a waiver under clause (vi), beginning not later than October 1, 2026, a State shall certify an infant for a period of not more than 2 years.</text></subclause><subclause id="H448E557DA5094D1A9987AC4C76B8E629"><enum>(II)</enum><header>Assessments</header><text>In certifying an infant under subclause (I), a State shall ensure that the infant receives required health and nutrition assessments.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD4631CB3176C4DBDB8518A5FF090F4CB"><enum>4.</enum><header>Extension of postpartum period</header><subsection id="HB5951E40A3564C25B1F43FBCEEDB97E1"><enum>(a)</enum><header>Breastfeeding women</header><paragraph id="H7E68A386B7C24AFDB7404D5D43565C0B"><enum>(1)</enum><header>Definition of breastfeeding woman</header><text>Section 17(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(b)</external-xref>) is amended by striking paragraph (1) and inserting the following:</text><quoted-block id="H9A1C908CCD9740FC83A67C32147FBB27" style="OLC"><paragraph id="H17FD46AC13DA4311BCC2E8466AF1405C"><enum>(1)</enum><header>Breastfeeding woman</header><text>The term <quote>breastfeeding woman</quote> means—</text><subparagraph id="H11511107BC6A40A5B2F42281F7F988CD"><enum>(A)</enum><text>a woman who is not more than 1 year postpartum and is breastfeeding the infant of the woman; and</text></subparagraph><subparagraph id="HB238F634AA4D44F78ADCFA0FBBDAD3E1"><enum>(B)</enum><text>for purposes of subsection (d), a woman who is not more than 2 years postpartum and is breastfeeding the infant of the woman.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H20A5F35FC8C34432B3D302ACA32123CA"><enum>(2)</enum><header>Certification</header><text>Section 17(d)(3)(A)(ii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)(ii)</external-xref>) is amended by striking <quote>1 year</quote> and all that follows through <quote>earlier</quote> and inserting <quote>not more than 2 years postpartum</quote>.</text></paragraph></subsection><subsection id="HE623F217C9CE4C93B052B2379231D168"><enum>(b)</enum><header>Postpartum women</header><paragraph id="H2D17F0D5306E48CE81C1E56469F5A64B"><enum>(1)</enum><header>Definition of postpartum woman</header><text>Section 17(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(b)</external-xref>) is amended by striking paragraph (10) and inserting the following:</text><quoted-block id="H665412B52A1744A48B81473677D88CF4" style="OLC"><paragraph id="H5552121B9F2343D09B6DD201A2F055C6"><enum>(10)</enum><header>Postpartum woman</header><text>The term <quote>postpartum woman</quote> means—</text><subparagraph id="HD7609540CA2644DDB663F2B862935EEE"><enum>(A)</enum><text>a woman up to 6 months after termination of pregnancy; and</text></subparagraph><subparagraph id="HC9DACD600FD4431C893580AB6A9705E7"><enum>(B)</enum><text>for purposes of subsection (d), a woman up to 2 years after termination of pregnancy.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H99417490681442D193F77569E6BF7ED0"><enum>(2)</enum><header>Certification</header><text>Section 17(d)(3)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)</external-xref>) (as amended by section 3(b)) is amended by adding at the end the following:</text><quoted-block id="H903E95F52E824CB1B3B6033215663272" style="OLC"><subsection id="H2CBCB6B8FF9C4E2F8D61D14B4BCE3494"><enum>(v)</enum><header>Postpartum women</header><text>Subject to a waiver under clause (vi), beginning not later than October 1, 2026, a State shall certify a postpartum woman for a period of up to 2 years after the termination of pregnancy of the postpartum woman.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H833D6F401E5B4807BC59C181E12E8B25"><enum>5.</enum><header>Waiver for certification</header><text display-inline="no-display-inline">Section 17(d)(3)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)</external-xref>) (as amended by section 4(b)(2)) is amended—</text><paragraph id="HC93818EA517C4850A690EC3C0E098256"><enum>(1)</enum><text>in clause (i), by striking <quote>clause (ii)</quote> and inserting <quote>this subparagraph</quote>; and</text></paragraph><paragraph id="H411965B69DF14185A2B6D257BEB7D970"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HC457940F2039486A954A8018A40C92D1" style="OLC"><clause id="HC0D78B80EDB14C5FA658F8B12D1D8CCB"><enum>(vi)</enum><header>Waiver</header><subclause id="HE40501C670C24F16AB1AD8344E87C095"><enum>(I)</enum><header>In general</header><text>The Secretary may grant a waiver to a State agency, on request, that waives the certification deadline requirement described in clause (iii), (iv), or (v).</text></subclause><subclause id="H7C846ED70A77487999DE30A0BC031D7F"><enum>(II)</enum><header>Specific date</header><text>A State agency requesting a waiver under subclause (I) shall specify a date by which the State agency anticipates that it will implement the certification requirement under clause (iii), (iv), or (v) for which it seeks a waiver.</text></subclause><subclause id="H3F84C117FB894B00998805DFE107951B"><enum>(III)</enum><header>Eligibility for waiver</header><text>To be eligible for a waiver under subclause (I), a State agency shall demonstrate to the satisfaction of the Secretary 1 or more of the following:</text><item id="H88A541F10DCD4ADBA077AC84CDAB250E"><enum>(aa)</enum><text>There are unusual technological barriers to implementation.</text></item><item id="H5742D601000343A195B42E15237C8C5A"><enum>(bb)</enum><text>Operational costs are not affordable within the nutrition services and administration grant of the State agency.</text></item><item id="H4E448FC67F1645FCB3C5CB8D0A2E492F"><enum>(cc)</enum><text>It is in the best interest of the program for the Secretary to grant the waiver.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
