which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to establish a national intersection and interchange safety construction program, and for other purposes.</official-title></form><legis-body id="HC06FCB52FAFE4D209BF5CB3595E4C018" style="OLC"><section id="H9EF2FE6788614C93B292034E87CA0305" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Intersection and Interchange Safety Construction Program Act of 2021</short-title></quote>.</text></section><section id="H93C64B1CB03F40CD8666BB62DA698757"><enum>2.</enum><header>National Intersection and Interchange Safety Construction Program</header><subsection id="HFEB7AC5B20F64769B323825B18A5333A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall establish a national intersection and interchange safety construction program (in this section referred to as the <quote>Program</quote>) to assist safety improvements for high-risk intersections and interchanges.</text></subsection><subsection id="HEBE1E00634234351A74EEBF8BB0D83CB"><enum>(b)</enum><header>Grant authority</header><paragraph id="H87D3BD1FF54148CD9CA9604F72B3DAE6"><enum>(1)</enum><header>In general</header><text>In carrying out the Program, the Secretary may make a grant to a covered entity in accordance with this section.</text></paragraph><paragraph id="H4910F152FD2F4883AE9BBEC696B2A983"><enum>(2)</enum><header>Competitive basis</header><text>The Secretary shall award grants under the Program on a competitive basis.</text></paragraph></subsection><subsection id="HFCE64E1401E14B38871EDBD4B920357C"><enum>(c)</enum><header>Project requirements</header><text>The Secretary may only make a grant under the Program to assist a project that—</text><paragraph id="H550049FA3439420BB63B4A35325EC4E2"><enum>(1)</enum><text>is eligible for funding under title 23, United States Code; and</text></paragraph><paragraph id="H023AF7AE149244328C3CA3745316D43C"><enum>(2)</enum><text display-inline="yes-display-inline">will improve the safety of an intersection or interchange that is—</text><subparagraph id="H38436F1C760F4B709401289CF237CED0"><enum>(A)</enum><text>on the National Highway System;</text></subparagraph><subparagraph id="HC19EF66B705D432B85F0CA6FF4A68336"><enum>(B)</enum><text>used by an average of 50,000 vehicles a day; and</text></subparagraph><subparagraph id="HB5D611E29AD3426C93FD727A6C36D631"><enum>(C)</enum><text>in immediate need of improvement with respect to safety.</text></subparagraph></paragraph></subsection><subsection id="H49CAA720B4034442AA6FFDB3853F1F12"><enum>(d)</enum><header>Applications</header><text>To be eligible for a grant under the Program, a covered entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines is appropriate.</text></subsection><subsection id="H6E2F1DD61B084055AF0BD6DFC530D973"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">The aggregate amount provided to a covered entity in a fiscal year through grants under the Program may not exceed 5 percent of the amount made available for all grants under the Program in that fiscal year.</text></subsection><subsection id="H5C1BE6E12316431E880A32178EFB7408"><enum>(f)</enum><header>Congressional review</header><text>At least 90 days before establishing the Program under subsection (a), the Secretary shall submit to Congress a report detailing the selection process the Secretary shall use in making grants under the Program.</text></subsection><subsection commented="no" id="HC4F22A5AE8DB4FCD8838C60BB3F90350"><enum>(g)</enum><header>Covered entity defined</header><text>In this section, the term <term>covered entity</term> means each of the following:</text><paragraph commented="no" id="H50F6C75DE52D4BAFBF828532380A1938"><enum>(1)</enum><text>A State government entity.</text></paragraph><paragraph commented="no" id="H5C2E68380E00496BB4BAFB40195EF56E"><enum>(2)</enum><text>A local government entity.</text></paragraph><paragraph commented="no" id="H28FA306753E1404395A432942D156EE5"><enum>(3)</enum><text>A territory of the United States.</text></paragraph><paragraph commented="no" id="HD007AF56B5CB4FC9B8AB998469F69DE3"><enum>(4)</enum><text display-inline="yes-display-inline">A tribal government.</text></paragraph><paragraph commented="no" id="H8AD4DEE537B140D3851408F4B553DCEF"><enum>(5)</enum><text display-inline="yes-display-inline">A metropolitan planning organization.</text></paragraph><paragraph commented="no" id="H64B2B79BD33742BC8745274258BF2676"><enum>(6)</enum><text>Any entity composed of 2 or more entities described in paragraphs (1) through (5).</text></paragraph></subsection><subsection id="H2ECAEC2316D4450C892EBCA83D5266CA"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph id="HD88BF1BCCC7E458891035FD1E0A2768E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out the Program $250,000,000 each fiscal year.</text></paragraph><paragraph id="H4DFA2D767BCB4EBC84984457289BD49D"><enum>(2)</enum><header>Applicability of title 23, United States Code</header><text display-inline="yes-display-inline">Funds authorized to be appropriated by paragraph (1) shall—</text><subparagraph id="H2E7152DB94864C66B5E888B6E3896D12"><enum>(A)</enum><text>be available for obligation in the same manner as if those funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that the Federal share of the cost of a project or activity carried out using those funds shall be 80 percent; and</text></subparagraph><subparagraph id="HD1D4379EB661411E9122747236C6A075"><enum>(B)</enum><text>remain available until expended and not be transferable.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
