which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of Health and Human Services to award grants to States to expand or maintain a strategic stockpile of products deemed to be essential in the event of a public health emergency, and for other purposes.</official-title></form><legis-body id="H058E4B3E099A41E38D68DE6DD39C0BD8" style="OLC"><section id="H2C08293D9BD34D56A4EA299C8229B114" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Stockpile Readiness Act of 2021</short-title></quote>.</text></section><section id="H4AB24A35094945C5B5F116D6F8F428D1"><enum>2.</enum><header>Grants for State strategic stockpiles</header><text display-inline="no-display-inline">Title III of the Public Health Service Act is amended by inserting after section 319F–4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>) the following new section:</text><quoted-block style="OLC" id="HF89CE81111FD4A8D8F77AA64EB0B758C" display-inline="no-display-inline"><section id="H26E71E4A7A2F429EB18B4B4C7D39A59D"><enum>319F–5.</enum><header>Grants for State strategic stockpiles</header><subsection id="HF19E74E280CE4373A83206190EC6E69A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may establish a pilot program consisting of awarding grants to States to expand or maintain a strategic stockpile of commercially available drugs, medical equipment, personal protective equipment, and other products deemed by the State to be essential in the event of a public health emergency.</text></subsection><subsection id="H65964775FCAC4C16853C440257A727D6"><enum>(b)</enum><header>Allowable use of funds</header><paragraph id="HA13D4340BC114253AAB9DAE46CF926FC"><enum>(1)</enum><header>Uses</header><text>A State receiving a grant under this section may use the grant funds to—</text><subparagraph id="HE666DF1BD480429B9D6111927DDE7426"><enum>(A)</enum><text>acquire commercially available products listed pursuant to paragraph (2) for inclusion in the State’s strategic stockpile;</text></subparagraph><subparagraph id="H9625A07790E44D5788D4420F8F7B3F32"><enum>(B)</enum><text>store, maintain, and distribute products in such stockpile; and</text></subparagraph><subparagraph id="HD7A357DEC8C74FCE81ABE04ABAFF1E4F"><enum>(C)</enum><text display-inline="yes-display-inline">conduct planning in connection with such activities.</text></subparagraph></paragraph><paragraph id="HCE4DF947AFC34AB1951AB5DEBE305E0B"><enum>(2)</enum><header>List</header><text>The Secretary shall develop and publish a list of the products that are eligible, as described in subsection (a), for inclusion in a State’s strategic stockpile using funds received under this section.</text></paragraph><paragraph id="H657EB01958284EDD989BBEF2F7D50774"><enum>(3)</enum><header>Consultation</header><text>In developing the list under paragraph (2) and otherwise determining the allowable uses of grant funds under this section, the Secretary shall consult with States and relevant stakeholders, including public health organizations.</text></paragraph></subsection><subsection id="HEA71A0C0107E45A68EB01FFBB386D4C5"><enum>(c)</enum><header>Funding requirement</header><text display-inline="yes-display-inline">The Secretary may not obligate or expend any funds to award grants or fund any previously awarded grants under this section for a fiscal year unless the total amount made available to carry out section 319F–2 for such fiscal year is equal to or greater than the total amount of funds made available to carry out section 319F–2 for fiscal year 2021.</text></subsection><subsection id="H9A4039E810FE4C809B66AD193D4942B2"><enum>(d)</enum><header>Matching funds</header><paragraph id="HA1653808D4A844738CB35B8CE598F29D"><enum>(1)</enum><header>In general</header><text>With respect to the costs of expanding and maintaining a strategic stockpile through a grant under this section, as a condition on receipt of the grant, a State shall make available (directly) non-Federal contributions in cash toward such costs in an amount that is equal to not less than the amount of Federal funds provided through the grant. </text></paragraph><paragraph id="HC780F1563EC349589A9C5A9494A11F4E"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the requirement of paragraph (1) with respect to a State for the first two years of the State receiving a grant under this section if the Secretary determines that such waiver is needed for the State to establish a strategic stockpile described in subsection (a).</text></paragraph></subsection><subsection id="H6D930669424241AE93CFFBF2D62FF55B"><enum>(e)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to States in establishing, expanding, and maintaining a stockpile described in subsection (a).</text></subsection><subsection id="H16114A9EDD9145E6AF102F2439E36AD1"><enum>(f)</enum><header>Definition</header><text>In this section, the term <term>drug</term> has the meaning given to that term in section 201 of the Federal Food, Drug, and Cosmetic Act.</text></subsection><subsection id="H00A49011A31A4546A0EF18360B085BC5"><enum>(g)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $3,500,000,000 for each of fiscal years 2021 through 2024, to remain available until expended.</text></subsection><subsection id="H125AAAA2A30445858B8EB34B52A500AE"><enum>(h)</enum><header>Sunset</header><text>The authority vested by this section terminates at the end of fiscal year 2024.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
