Definitions.</toc-entry></toc></subsection><subsection id="H44039C7C33554E19A748EBB117FD510B"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to increase public safety by ensuring access to financial services to cannabis-related legitimate businesses and service providers and reducing the amount of cash at such businesses.</text></subsection></section><section id="HB9B62EDAFDD34BFFBEFF7A53D9750C20"><enum>2.</enum><header>Safe harbor for depository institutions</header><subsection id="HC413AAFF3AA7468988347CAAFE84FAED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A Federal banking regulator may not—</text><paragraph id="H93B5BE5C00394352B983FCB00F9A306D" indent="down1"><enum>(1)</enum><text display-inline="yes-display-inline">terminate or limit the deposit insurance or share insurance of a depository institution under the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811</external-xref> et seq.), the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1751">12 U.S.C. 1751</external-xref> et seq.), or take any other adverse action against a depository institution under section 8 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1818">12 U.S.C. 1818</external-xref>) solely because the depository institution provides or has provided financial services to a cannabis-related legitimate business or service provider;</text></paragraph><paragraph id="HB24C4376BC0E4394B6391F2F39A030E2" indent="down1"><enum>(2)</enum><text display-inline="yes-display-inline">prohibit, penalize, or otherwise discourage a depository institution from providing financial services to a cannabis-related legitimate business or service provider or to a State, political subdivision of a State, or Indian Tribe that exercises jurisdiction over cannabis-related legitimate businesses;</text></paragraph><paragraph id="H65E9FC9310C44F2FA755154E3268221C" indent="down1"><enum>(3)</enum><text display-inline="yes-display-inline">recommend, incentivize, or encourage a depository institution not to offer financial services to an account holder, or to downgrade or cancel the financial services offered to an account holder solely because—</text><subparagraph id="H3FBFEE5CF98E4CAEAE0F16AB3C607CA5"><enum>(A)</enum><text display-inline="yes-display-inline">the account holder is a cannabis-related legitimate business or service provider, or is an employee, owner, or operator of a cannabis-related legitimate business or service provider;</text></subparagraph><subparagraph id="H26406F30F95C43A8909E47A2999E61E9"><enum>(B)</enum><text display-inline="yes-display-inline">the account holder later becomes an employee, owner, or operator of a cannabis-related legitimate business or service provider; or</text></subparagraph><subparagraph id="H942229F2A1534F01B636EBD3BCFBEE1C"><enum>(C)</enum><text display-inline="yes-display-inline">the depository institution was not aware that the account holder is an employee, owner, or operator of a cannabis-related legitimate business or service provider;</text></subparagraph></paragraph><paragraph id="H1F365AB03A844E9494DFC95F62F52744" indent="down1"><enum>(4)</enum><text display-inline="yes-display-inline">take any adverse or corrective supervisory action on a loan made to—</text><subparagraph id="H1C1FEC3CE06745EBBC656BC3E787B006"><enum>(A)</enum><text display-inline="yes-display-inline">a cannabis-related legitimate business or service provider, solely because the business is a cannabis-related legitimate business or service provider;</text></subparagraph><subparagraph id="HFB739EAFC53F4A6D99ABC203DFCB2036"><enum>(B)</enum><text>an employee, owner, or operator of a cannabis-related legitimate business or service provider, solely because the employee, owner, or operator is employed by, owns, or operates a cannabis-related legitimate business or service provider, as applicable; or</text></subparagraph><subparagraph id="HF12A41172D824F47BE63A93DC1E7E307"><enum>(C)</enum><text display-inline="yes-display-inline">an owner or operator of real estate or equipment that is leased to a cannabis-related legitimate business or service provider, solely because the owner or operator of the real estate or equipment leased the equipment or real estate to a cannabis-related legitimate business or service provider, as applicable; or</text></subparagraph></paragraph><paragraph id="HED807AB26F6A4539BF8643586434A787" indent="down1"><enum>(5)</enum><text display-inline="yes-display-inline">prohibit or penalize a depository institution (or entity performing a financial service for or in association with a depository institution) for, or otherwise discourage a depository institution (or entity performing a financial service for or in association with a depository institution) from, engaging in a financial service for a cannabis-related legitimate business or service provider.</text></paragraph></subsection><subsection id="HA0A86C181A504C98A565BD6586D9DB1E"><enum>(b)</enum><header>Safe harbor applicable to de novo institutions</header><text display-inline="yes-display-inline">Subsection (a) shall apply to an institution applying for a depository institution charter to the same extent as such subsection applies to a depository institution.</text></subsection></section><section id="HDAA75A509AAE488C9D244C60145FEC55"><enum>3.</enum><header>Protections for ancillary businesses</header><text display-inline="no-display-inline">For the purposes of sections 1956 and 1957 of title 18, United States Code, and all other provisions of Federal law, the proceeds from a transaction involving activities of a cannabis-related legitimate business or service provider shall not be considered proceeds from an unlawful activity solely because—</text><paragraph id="HBB9EE980344D4434B4D316127082D29B"><enum>(1)</enum><text>the transaction involves proceeds from a cannabis-related legitimate business or service provider; or</text></paragraph><paragraph id="H0DF687CFE8C74806989A47F391F88269"><enum>(2)</enum><text>the transaction involves proceeds from—</text><subparagraph id="HE7845E499E134F1889AAF005B4629894"><enum>(A)</enum><text>cannabis-related activities described in section 14(4)(B) conducted by a cannabis-related legitimate business; or</text></subparagraph><subparagraph id="H69E7874E47274B19B6EB697CC4520684"><enum>(B)</enum><text>activities described in section 14(13)(A) conducted by a service provider.</text></subparagraph></paragraph></section><section id="H99BDAEBB9A3C4C8D868511CFA28FED02"><enum>4.</enum><header>Protections under Federal law</header><subsection id="H2003505AF60246ACB228881129BBA1F9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to providing a financial service to a cannabis-related legitimate business (where such cannabis-related legitimate business operates within a State, political subdivision of a State, or Indian country that allows the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of cannabis pursuant to a law or regulation of such State, political subdivision, or Indian Tribe that has jurisdiction over the Indian country, as applicable) or a service provider (wherever located), a depository institution, entity performing a financial service for or in association with a depository institution, or insurer that provides a financial service to a cannabis-related legitimate business or service provider, and the officers, directors, and employees of that depository institution, entity, or insurer may not be held liable pursuant to any Federal law or regulation—</text><paragraph id="HE3587A81E8F649E3B722088F094BB37E"><enum>(1)</enum><text display-inline="yes-display-inline">solely for providing such a financial service; or</text></paragraph><paragraph id="HF7D256CF44B54FF5AC2AB7B6226A4AD1"><enum>(2)</enum><text display-inline="yes-display-inline">for further investing any income derived from such a financial service.</text></paragraph></subsection><subsection id="H5AEE3F4FF8A64D1C8C2D7DA033133AA3"><enum>(b)</enum><header>Protections for Federal reserve banks and Federal Home Loan Banks</header><text display-inline="yes-display-inline">With respect to providing a service to a depository institution that provides a financial service to a cannabis-related legitimate business (where such cannabis-related legitimate business operates within a State, political subdivision of a State, or Indian country that allows the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of cannabis pursuant to a law or regulation of such State, political subdivision, or Indian Tribe that has jurisdiction over the Indian country, as applicable) or service provider (wherever located), a Federal reserve bank or Federal Home Loan Bank, and the officers, directors, and employees of the Federal reserve bank or Federal Home Loan Bank, may not be held liable pursuant to any Federal law or regulation—</text><paragraph id="H49586A9EC78047038B969509B7638A27"><enum>(1)</enum><text display-inline="yes-display-inline">solely for providing such a service; or</text></paragraph><paragraph id="H5161B03A753B474D8407D8F5742A98D9"><enum>(2)</enum><text display-inline="yes-display-inline">for further investing any income derived from such a service.</text></paragraph></subsection><subsection id="H64EC63D5B7A841DD9C2831AC24D1EF11"><enum>(c)</enum><header>Protections for insurers</header><text display-inline="yes-display-inline">With respect to engaging in the business of insurance within a State, political subdivision of a State, or Indian country that allows the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of cannabis pursuant to a law or regulation of such State, political subdivision, or Indian Tribe that has jurisdiction over the Indian country, as applicable, an insurer that engages in the business of insurance with a cannabis-related legitimate business or service provider or who otherwise engages with a person in a transaction permissible under State law related to cannabis, and the officers, directors, and employees of that insurer may not be held liable pursuant to any Federal law or regulation—</text><paragraph id="H2283665836594E05B7269C9FCAD8FCFB"><enum>(1)</enum><text display-inline="yes-display-inline">solely for engaging in the business of insurance; or</text></paragraph><paragraph id="H31D21B91DB8542048E2FC32089C7BADD"><enum>(2)</enum><text display-inline="yes-display-inline">for further investing any income derived from the business of insurance.</text></paragraph></subsection><subsection id="H2143F74A3C5C4F08A64064D3733F450D"><enum>(d)</enum><header>Forfeiture</header><paragraph id="H0C8537AE4CF740B6862773CA515A7D72"><enum>(1)</enum><header>Depository institutions</header><text>A depository institution that has a legal interest in the collateral for a loan or another financial service provided to an owner, employee, or operator of a cannabis-related legitimate business or service provider, or to an owner or operator of real estate or equipment that is leased or sold to a cannabis-related legitimate business or service provider, shall not be subject to criminal, civil, or administrative forfeiture of that legal interest pursuant to any Federal law for providing such loan or other financial service.</text></paragraph><paragraph id="HFB8C8936E1444C43890CAA66DA284AAC"><enum>(2)</enum><header>Federal reserve banks and Federal Home Loan Banks</header><text display-inline="yes-display-inline">A Federal reserve bank or Federal Home Loan Bank that has a legal interest in the collateral for a loan or another financial service provided to a depository institution that provides a financial service to a cannabis-related legitimate business or service provider, or to an owner or operator of real estate or equipment that is leased or sold to a cannabis-related legitimate business or service provider, shall not be subject to criminal, civil, or administrative forfeiture of that legal interest pursuant to any Federal law for providing such loan or other financial service.</text></paragraph></subsection></section><section id="H215F2AED6AC84B85A1C5B757ED3FEF72"><enum>5.</enum><header>Rules of construction</header><subsection id="HA8687117F5C044CFA4FAAC506A35A755"><enum>(a)</enum><header>No requirement To provide financial services</header><text display-inline="yes-display-inline">Nothing in this Act shall require a depository institution, entity performing a financial service for or in association with a depository institution, or insurer to provide financial services to a cannabis-related legitimate business, service provider, or any other business.</text></subsection><subsection id="H991CF23438D94D56B80DF36A01FCA116"><enum>(b)</enum><header>General examination, supervisory, and enforcement authority</header><text display-inline="yes-display-inline">Nothing in this Act may be construed in any way as limiting or otherwise restricting the general examination, supervisory, and enforcement authority of the Federal banking regulators, provided that the basis for any supervisory or enforcement action is not the provision of financial services to a cannabis-related legitimate business or service provider.</text></subsection><subsection id="H06E40D9619AE459FBEDD524C90084640"><enum>(c)</enum><header>Business of insurance</header><text display-inline="yes-display-inline">Nothing in this Act shall interfere with the regulation of the business of insurance in accordance with the Act of March 9, 1945 (59 Stat. 33, chapter 20; <external-xref legal-doc="usc" parsable-cite="usc/15/1011">15 U.S.C. 1011</external-xref> et seq.) (commonly known as the <quote>McCarran-Ferguson Act</quote>) and the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5301">12 U.S.C. 5301</external-xref> et seq.).</text></subsection></section><section commented="no" id="HEF194703B4D64AD699CCF72959D6BF1E"><enum>6.</enum><header>Requirements for filing suspicious activity reports</header><text display-inline="no-display-inline">Section 5318(g) of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block id="HDBFF6E5D3ED040CE918B33669F95DB00" style="OLC"><paragraph commented="no" id="HD3366BBA1CAC44E3A745812B198A3C65"><enum>(5)</enum><header>Requirements for cannabis-related legitimate businesses</header><subparagraph id="H389FA7C296BA47D1B0D1D72746F1478E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a financial institution or any director, officer, employee, or agent of a financial institution that reports a suspicious transaction pursuant to this subsection, if the reason for the report relates to a cannabis-related legitimate business or service provider, the report shall comply with appropriate guidance issued by the Financial Crimes Enforcement Network. Not later than the end of the 180-day period beginning on the date of enactment of this paragraph, the Secretary shall update the February 14, 2014, guidance titled <quote>BSA Expectations Regarding Marijuana-Related Businesses</quote> (FIN–2014–G001) to ensure that the guidance is consistent with the purpose and intent of the SAFE Banking Act of 2021 and does not significantly inhibit the provision of financial services to a cannabis-related legitimate business or service provider in a State, political subdivision of a State, or Indian country that has allowed the cultivation, production, manufacture, transportation, display, dispensing, distribution, sale, or purchase of cannabis pursuant to law or regulation of such State, political subdivision, or Indian Tribe that has jurisdiction over the Indian country.</text></subparagraph><subparagraph id="H117A0B9FAC6444D98A0E968B8FADA5EC"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text><clause display-inline="no-display-inline" id="H94D3A48EDCE84518864265D4B0965CF9"><enum>(i)</enum><header>Cannabis</header><text display-inline="yes-display-inline">The term <term>cannabis</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></clause><clause id="HF788E97E6C3D4A898654B6C3F3A4F937"><enum>(ii)</enum><header>Cannabis-related legitimate business</header><text display-inline="yes-display-inline">The term <term>cannabis-related legitimate business</term> has the meaning given that term in section 14 of the SAFE Banking Act of 2021.</text></clause><clause id="HAE684892356542AF9B195FB7DDAB488F"><enum>(iii)</enum><header>Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given that term in section 1151 of title 18.</text></clause><clause id="H7C10968D4DC24BBF8427DC098AE8CC0A"><enum>(iv)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>).</text></clause><clause display-inline="no-display-inline" id="H2A4C10F107124461B9141A78441C1456"><enum>(v)</enum><header>Financial service</header><text display-inline="yes-display-inline">The term <term>financial service</term> has the meaning given that term in section 14 of the SAFE Banking Act of 2021.</text></clause><clause id="HFC25D7A2CC5240EC8748A3FE463FDB7A"><enum>(vi)</enum><header>Service provider</header><text display-inline="yes-display-inline">The term <term>service provider</term> has the meaning given that term in section 14 of the SAFE Banking Act of 2021.</text></clause><clause id="H7A360953818447428B8530CFF768A233"><enum>(vii)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H92B224A3D8024DB5866FB1459078E917"><enum>7.</enum><header>Guidance and examination procedures</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Financial Institutions Examination Council shall develop uniform guidance and examination procedures for depository institutions that provide financial services to cannabis-related legitimate businesses and service providers.</text></section><section display-inline="no-display-inline" id="H475E4573C2DB4A9D9032E8C691277E34"><enum>8.</enum><header>Annual diversity and inclusion report</header><text display-inline="no-display-inline">The Federal banking regulators shall issue an annual report to Congress containing—</text><paragraph id="HD94AE5B279A048908E005886BBEB71B2"><enum>(1)</enum><text display-inline="yes-display-inline">information and data on the availability of access to financial services for minority-owned and women-owned cannabis-related legitimate businesses; and</text></paragraph><paragraph id="H28C155C6AB8B41AFA92F688FD13CE02F"><enum>(2)</enum><text display-inline="yes-display-inline">any regulatory or legislative recommendations for expanding access to financial services for minority-owned and women-owned cannabis-related legitimate businesses.</text></paragraph></section><section display-inline="no-display-inline" id="HB0B7CA5441E649C5B11F0BEB27D722EF" section-type="subsequent-section"><enum>9.</enum><header>GAO study on diversity and inclusion</header><subsection id="H19F6FF66472045638E1EFB36350A2B70"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall carry out a study on the barriers to marketplace entry, including in the licensing process, and the access to financial services for potential and existing minority-owned and women-owned cannabis-related legitimate businesses.</text></subsection><subsection id="H702C1E0EF0504199AF8A83DABE1E2EFF"><enum>(b)</enum><header>Report</header><text>The Comptroller General shall issue a report to the Congress—</text><paragraph id="HC0C2B1A29D444A859C81F4FC1B0D4556"><enum>(1)</enum><text>containing all findings and determinations made in carrying out the study required under subsection (a); and</text></paragraph><paragraph id="HD5849E05A90B48A38CB21DF2CD9E462C"><enum>(2)</enum><text display-inline="yes-display-inline">containing any regulatory or legislative recommendations for removing barriers to marketplace entry, including in the licensing process, and expanding access to financial services for potential and existing minority-owned and women-owned cannabis-related legitimate businesses.</text></paragraph></subsection></section><section id="H1FED96DA7DE74D5A8DD861FA718A1CA2"><enum>10.</enum><header>GAO study on effectiveness of certain reports on finding certain persons</header><text display-inline="no-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall carry out a study on the effectiveness of reports on suspicious transactions filed pursuant to section 5318(g) of title 31, United States Code, at finding individuals or organizations suspected or known to be engaged with transnational criminal organizations and whether any such engagement exists in a State, political subdivision, or Indian Tribe that has jurisdiction over Indian country that allows the cultivation, production, manufacture, sale, transportation, display, dispensing, distribution, or purchase of cannabis. The study shall examine reports on suspicious transactions as follows:</text><paragraph id="HD9A278D2F9CA4C158EE4539305B3A289"><enum>(1)</enum><text display-inline="yes-display-inline">During the period of 2014 until the date of the enactment of this Act, reports relating to marijuana-related businesses.</text></paragraph><paragraph id="HC46243D709DB42E4A8209606B55CC3CF"><enum>(2)</enum><text display-inline="yes-display-inline">During the 1-year period after date of the enactment of this Act, reports relating to cannabis-related legitimate businesses.</text></paragraph></section><section id="HC1B21FE0FCE5492B86B1995BAF8A488B"><enum>11.</enum><header>Application of this Act with respect to hemp-related legitimate businesses and hemp-related service providers</header><subsection id="HCEAAC2A4FA81497D86B8AA6077396B61"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The provisions of this Act (other than sections 6 and 10) shall apply with respect to hemp-related legitimate businesses and hemp-related service providers in the same manner as such provisions apply with respect to cannabis-related legitimate businesses and service providers.</text></subsection><subsection id="HE56D22D89C294DAF8F328DFE779514B1"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC780D5DA53D8486E85AA899FE24CD043"><enum>(1)</enum><header>CBD</header><text display-inline="yes-display-inline">The term <term>CBD</term> means cannabidiol.</text></paragraph><paragraph id="HE41E3486470B4747A61757E7FF1DAEFF"><enum>(2)</enum><header>Hemp</header><text>The term <term>hemp</term> has the meaning given that term under section 297A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>).</text></paragraph><paragraph id="H26726436275240F2A934A0F6CC24F90C"><enum>(3)</enum><header>Hemp-related legitimate business</header><text>The term <term>hemp-related legitimate business</term> means a manufacturer, producer, or any person or company that—</text><subparagraph id="HD6F58CA56E8441B8BAA09DCE3FA36F79"><enum>(A)</enum><text>engages in any activity described in subparagraph (B) in conformity with the Agricultural Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>) and the regulations issued to implement such Act by the Department of Agriculture, where applicable, and the law of a State or political subdivision thereof or Indian Tribe; and</text></subparagraph><subparagraph id="H12A6112BAF784ABDA54DA16CBD5360A6"><enum>(B)</enum><text>participates in any business or organized activity that involves handling hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products, including cultivating, producing, extracting, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products.</text></subparagraph></paragraph><paragraph id="H579EA8AD8B7D4878ADF082EA9B3FB8F6"><enum>(4)</enum><header>Hemp-related service provider</header><text>The term <term>hemp-related service provider</term>—</text><subparagraph id="H6CB3B68DD21242C4A131B6F1E4299FAD"><enum>(A)</enum><text>means a business, organization, or other person that—</text><clause id="H5F6DDAED8DB443CD9A04493492630B7D"><enum>(i)</enum><text>sells goods or services to a hemp-related legitimate business; or</text></clause><clause id="H1E25B85AE495443683B088123CBA7DA8"><enum>(ii)</enum><text>provides any business services, including the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to hemp, hemp-derived CBD products, or other hemp-derived cannabinoid products; and</text></clause></subparagraph><subparagraph id="H3CA822EE4C3E43C6B48FB3E20F5589C7"><enum>(B)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling hemp, hemp-derived CBD products, or other hemp-derived cannabinoid products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing hemp, hemp-derived CBD products, and other hemp-derived cannabinoid products.</text></subparagraph></paragraph></subsection></section><section id="H286F3398CB94418A9A95FD75C64B0165"><enum>12.</enum><header>Banking services for hemp-related legitimate businesses and hemp-related service providers</header><subsection id="H682A298F11474C50AF1A49899FCC3C40"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds that—</text><paragraph id="H8DFB560F391E4483B495948065F2F56C"><enum>(1)</enum><text>the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>) legalized hemp by removing it from the definition of <quote>marihuana</quote> under the Controlled Substances Act;</text></paragraph><paragraph id="HACA2DDAD4B354570A9481C5E6D2B1192"><enum>(2)</enum><text>despite the legalization of hemp, some hemp businesses (including producers, manufacturers, and retailers) continue to have difficulty gaining access to banking products and services; and</text></paragraph><paragraph id="H70554DA81797433F8A88E17D552584B9"><enum>(3)</enum><text>businesses involved in the sale of hemp-derived CBD products are particularly affected, due to confusion about the legal status of such products.</text></paragraph></subsection><subsection id="HA1752B09EAB34557B626145967D98464"><enum>(b)</enum><header>Federal banking regulators’ hemp banking guidance</header><text>Not later than the end of the 90-day period beginning on the date of enactment of this Act, the Federal banking regulators shall update their existing guidance, as applicable, regarding the provision of financial services to hemp-related legitimate businesses and hemp-related service providers to address—</text><paragraph id="H81973D07C7D1412B88722A1E8D827F32"><enum>(1)</enum><text>compliance with financial institutions’ existing obligations under Federal laws and implementing regulations determined relevant by the Federal banking regulators, including subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, and its implementing regulation in conformity with this Act and the Department of Agriculture’s rules regulating domestic hemp production (7 C.F.R. 990); and</text></paragraph><paragraph id="H258E87B464174DA2958F1539F2815ACF"><enum>(2)</enum><text>best practices for financial institutions to follow when providing financial services, including processing payments, to hemp-related legitimate businesses and hemp-related service providers.</text></paragraph></subsection><subsection id="HD9A1650DA9164057BA7DD723BDADEE2E"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H34EDC20BF6074E6CA6FA860B15943CC4"><enum>(1)</enum><header>Financial institution</header><text display-inline="yes-display-inline">The term <term>financial institution</term>—</text><subparagraph id="H3D84C7A71BCA43879D57CAC58D7F398F"><enum>(A)</enum><text>has the meaning given that term under section 5312(a) of title 31, United States Code; and</text></subparagraph><subparagraph id="H884AD2216B874E55AED30024C6C4F90A"><enum>(B)</enum><text display-inline="yes-display-inline">includes a bank holding company, as defined under section 2(a) of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1841">12 U.S.C. 1841(a)</external-xref>).</text></subparagraph></paragraph><paragraph id="H7CB3BF80476B46AAABDC3A7AA6C15BF8"><enum>(2)</enum><header>Hemp terms</header><text>The terms <term>CBD</term>, <term>hemp</term>, <term>hemp-related legitimate business</term>, and <term>hemp-related service provider</term> have the meaning given those terms, respectively, under section 11.</text></paragraph></subsection></section><section id="H7834981513B5447CBD355E3840976979"><enum>13.</enum><header>Requirements for deposit account termination requests and orders</header><subsection id="H18566479F26B4F7DB6C83D11545F2F79"><enum>(a)</enum><header>Termination requests or orders must be valid</header><paragraph id="HAA2FFCB0CA6F4011BD029BFAAB016966"><enum>(1)</enum><header>In general</header><text>An appropriate Federal banking agency may not formally or informally request or order a depository institution to terminate a specific customer account or group of customer accounts or to otherwise restrict or discourage a depository institution from entering into or maintaining a banking relationship with a specific customer or group of customers unless—</text><subparagraph id="HD00AB869854349948CDAF33CAD2C478E"><enum>(A)</enum><text>the agency has a valid reason for such request or order; and</text></subparagraph><subparagraph id="HB684243888524F2AB800AFB825A0B3ED"><enum>(B)</enum><text>such reason is not based solely on reputation risk.</text></subparagraph></paragraph><paragraph id="HF0760F57882B475EB6356B009A1380DC"><enum>(2)</enum><header>Treatment of national security threats</header><text>If an appropriate Federal banking agency believes a specific customer or group of customers is, or is acting as a conduit for, an entity which—</text><subparagraph id="H7CB80C1BAEB2495DB2038199BF618CCA"><enum>(A)</enum><text>poses a threat to national security;</text></subparagraph><subparagraph id="H486864EF8F90412AA9748585ABB0A72A"><enum>(B)</enum><text>is involved in terrorist financing;</text></subparagraph><subparagraph id="HA9E85E539B1840F4BA8985D3A95A9CE1"><enum>(C)</enum><text>is an agency of the Government of Iran, North Korea, Syria, or any country listed from time to time on the State Sponsors of Terrorism list;</text></subparagraph><subparagraph id="HBE078F1415A545E9A931163095EC4AE1"><enum>(D)</enum><text>is located in, or is subject to the jurisdiction of, any country specified in subparagraph (C); or</text></subparagraph><subparagraph id="H9822504B07D04214880FC2D90E42DF80"><enum>(E)</enum><text display-inline="yes-display-inline">does business with any entity described in subparagraph (C) or (D), unless the appropriate Federal banking agency determines that the customer or group of customers has used due diligence to avoid doing business with any entity described in subparagraph (C) or (D),</text></subparagraph><continuation-text continuation-text-level="paragraph">such belief shall satisfy the requirement under paragraph (1). </continuation-text></paragraph></subsection><subsection id="H5E83D94ACF8C40B2B68B3D53CEA604D5"><enum>(b)</enum><header>Notice requirement</header><paragraph id="HCD19B8E79477414FB69D0003639AEBD0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If an appropriate Federal banking agency formally or informally requests or orders a depository institution to terminate a specific customer account or a group of customer accounts, the agency shall—</text><subparagraph id="HC9A6FE5E98794F9BB14EB232764D49FE"><enum>(A)</enum><text>provide such request or order to the institution in writing; and</text></subparagraph><subparagraph id="H9FE93554426C49029DB746E101122BA7"><enum>(B)</enum><text>accompany such request or order with a written justification for why such termination is needed, including any specific laws or regulations the agency believes are being violated by the customer or group of customers, if any.</text></subparagraph></paragraph><paragraph id="HD6921759E65242348B888EE952A65C6B"><enum>(2)</enum><header>Justification requirement</header><text display-inline="yes-display-inline">A justification described under paragraph (1)(B) may not be based solely on the reputation risk to the depository institution.</text></paragraph></subsection><subsection id="H53E52705F09C4DFF94AD7ECE94CF80B5"><enum>(c)</enum><header>Customer notice</header><paragraph commented="no" id="H07BA62CCCED84FDF85D0D18D66703AD2"><enum>(1)</enum><header>Notice required</header><text display-inline="yes-display-inline">Except as provided under paragraph (2) or as otherwise prohibited from being disclosed by law, if an appropriate Federal banking agency orders a depository institution to terminate a specific customer account or a group of customer accounts, the depository institution shall inform the specific customer or group of customers of the justification for the customer’s account termination described under subsection (b).</text></paragraph><paragraph id="HF4A6501702824F5A8D04C89A8610A292"><enum>(2)</enum><header>Notice prohibited</header><subparagraph id="HCCDD8C3591024C8F8DDC723E16BB8B80"><enum>(A)</enum><header>Notice prohibited in cases of national security</header><text>If an appropriate Federal banking agency requests or orders a depository institution to terminate a specific customer account or a group of customer accounts based on a belief that the customer or customers pose a threat to national security, or are otherwise described under subsection (a)(2), neither the depository institution nor the appropriate Federal banking agency may inform the customer or customers of the justification for the customer’s account termination.</text></subparagraph><subparagraph id="H473CF6DC43DD4F91B50F013E498496EB"><enum>(B)</enum><header>Notice prohibited in other cases</header><text display-inline="yes-display-inline">If an appropriate Federal banking agency determines that the notice required under paragraph (1) may interfere with an authorized criminal investigation, neither the depository institution nor the appropriate Federal banking agency may inform the specific customer or group of customers of the justification for the customer’s account termination.</text></subparagraph></paragraph></subsection><subsection id="H8693BC8B2BF54517B4186D496A62BF9E"><enum>(d)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Each appropriate Federal banking agency shall issue an annual report to the Congress stating—</text><paragraph id="HDD3820BA4FF14927A0A8A73E0FFE957F"><enum>(1)</enum><text>the aggregate number of specific customer accounts that the agency requested or ordered a depository institution to terminate during the previous year; and</text></paragraph><paragraph id="H5985DA36BB6C4E82B33E095D9D37E1E4"><enum>(2)</enum><text display-inline="yes-display-inline">the legal authority on which the agency relied in making such requests and orders and the frequency on which the agency relied on each such authority.</text></paragraph></subsection><subsection id="H41F6F0D7D7CD43E98111513C83E07207"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HB0C468DE2088411A9540237598611A9D"><enum>(1)</enum><header>Appropriate Federal banking agency</header><text>The term <term>appropriate Federal banking agency</term> means—</text><subparagraph id="H1E16C854D31346ED9226E62A99CDE26B"><enum>(A)</enum><text>the appropriate Federal banking agency, as defined under section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>); and</text></subparagraph><subparagraph id="H176CC87E63734E32A5EB002E6282C399"><enum>(B)</enum><text>the National Credit Union Administration, in the case of an insured credit union.</text></subparagraph></paragraph><paragraph id="H0619189200E04048A8085BB3FD4E754D"><enum>(2)</enum><header>Depository institution</header><text>The term <term>depository institution</term> means—</text><subparagraph id="HDDA44CE00E5C429EA432DE0423B97339"><enum>(A)</enum><text display-inline="yes-display-inline">a depository institution, as defined under section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>); and</text></subparagraph><subparagraph id="H34A6EE9D1296453590C58CB7A9D28F63"><enum>(B)</enum><text>an insured credit union.</text></subparagraph></paragraph></subsection></section><section id="H416BBDE794DE4BFFBAA8BBAA8DC7A9BD"><enum>14.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph display-inline="no-display-inline" id="HCEF166E99C954AD98D48FE7F05E56846"><enum>(1)</enum><header>Business of insurance</header><text display-inline="yes-display-inline">The term <term>business of insurance</term> has the meaning given such term in section 1002 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>).</text></paragraph><paragraph id="HA9E769C711194319972BEF3CB5204D34"><enum>(2)</enum><header>Cannabis</header><text display-inline="yes-display-inline">The term <term>cannabis</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="H9AF38D1ED389482FB81B1FF1B7B5041D"><enum>(3)</enum><header>Cannabis product</header><text display-inline="yes-display-inline">The term <term>cannabis product</term> means any article which contains cannabis, including an article which is a concentrate, an edible, a tincture, a cannabis-infused product, or a topical.</text></paragraph><paragraph id="H3E31B12BDFD845C1808DE920D140EAB2"><enum>(4)</enum><header>Cannabis-related legitimate business</header><text display-inline="yes-display-inline">The term <term>cannabis-related legitimate business</term> means a manufacturer, producer, or any person or company that—</text><subparagraph id="H96989B38ECC94EF4819F64E77A77CE3D"><enum>(A)</enum><text>engages in any activity described in subparagraph (B) pursuant to a law established by a State or a political subdivision of a State, as determined by such State or political subdivision; and</text></subparagraph><subparagraph id="HBAE55FA064B8499AAECF1FD32D1E16B1"><enum>(B)</enum><text display-inline="yes-display-inline">participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subparagraph></paragraph><paragraph id="H2499BA581B1043E39D3997453E03A3D7"><enum>(5)</enum><header>Depository institution</header><text display-inline="yes-display-inline">The term <term>depository institution</term> means—</text><subparagraph id="H4065573B85C845ABB390DD149E142C3A"><enum>(A)</enum><text>a depository institution as defined in section 3(c) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(c)</external-xref>);</text></subparagraph><subparagraph id="H98B1CB2A646A4C23BA8A3BB1F75D0F85"><enum>(B)</enum><text>a Federal credit union as defined in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>); or</text></subparagraph><subparagraph id="HD5B4BD8634AD4649AABDCD50BB3FBE15"><enum>(C)</enum><text display-inline="yes-display-inline">a State credit union as defined in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>).</text></subparagraph></paragraph><paragraph id="HA3962511CFC240E784B4C20DA6919F65"><enum>(6)</enum><header>Federal banking regulator</header><text>The term <term>Federal banking regulator</term> means each of the Board of Governors of the Federal Reserve System, the Bureau of Consumer Financial Protection, the Federal Deposit Insurance Corporation, the Federal Housing Finance Agency, the Financial Crimes Enforcement Network, the Office of Foreign Asset Control, the Office of the Comptroller of the Currency, the National Credit Union Administration, the Department of the Treasury, or any Federal agency or department that regulates banking or financial services, as determined by the Secretary of the Treasury.</text></paragraph><paragraph id="HCEE7B54945D842C48E0CB7F28704F857"><enum>(7)</enum><header>Financial service</header><text display-inline="yes-display-inline">The term <term>financial service</term>—</text><subparagraph id="HC25CD55A72FB4E2488011C3732CD0AD9" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">means a financial product or service, as defined in section 1002 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>), regardless if the customer receiving the product or service is a consumer or commercial entity;</text></subparagraph><subparagraph id="HCD3FAC25669B4FA1B569428D1388E800"><enum>(B)</enum><text display-inline="yes-display-inline">means a financial product or service, or any combination of products and services, permitted to be provided by—</text><clause id="HA3EAE7338BA6454E9ED4C38AE55AFD9F"><enum>(i)</enum><text>a national bank or a financial subsidiary pursuant to the authority provided under—</text><subclause id="H81053986BA9A4790B32E22F8447661B0"><enum>(I)</enum><text>the provision designated <quote>Seventh</quote> of section 5136 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/24">12 U.S.C. 24</external-xref>); or</text></subclause><subclause id="H30F810C20F9A4EF09E2D38ECCC798A3C"><enum>(II)</enum><text display-inline="yes-display-inline">section 5136A of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/24a">12 U.S.C. 24a</external-xref>); and</text></subclause></clause><clause id="H6672D4A0ED0349D6B789A14F52FBAAFE"><enum>(ii)</enum><text>a Federal credit union, pursuant to the authority provided under the Federal Credit Union Act;</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HF6B4BA1555B449CA95DD036DF976BB9B"><enum>(C)</enum><text display-inline="yes-display-inline">includes the business of insurance;</text></subparagraph><subparagraph id="H2C8F2DDAB3E44BAD94651D0F9050507F"><enum>(D)</enum><text display-inline="yes-display-inline">includes, whether performed directly or indirectly, the authorizing, processing, clearing, settling, billing, transferring for deposit, transmitting, delivering, instructing to be delivered, reconciling, collecting, or otherwise effectuating or facilitating of payments or funds, where such payments or funds are made or transferred by any means, including by the use of credit cards, debit cards, other payment cards, or other access devices, accounts, original or substitute checks, or electronic funds transfers;</text></subparagraph><subparagraph id="H6E4ADF2680374BFAA0BF45B09375B70E"><enum>(E)</enum><text>includes acting as a money transmitting business which directly or indirectly makes use of a depository institution in connection with effectuating or facilitating a payment for a cannabis-related legitimate business or service provider in compliance with section 5330 of title 31, United States Code, and any applicable State law; and</text></subparagraph><subparagraph id="H86AC3CFED1094EA38D68EEB4BB6E6307"><enum>(F)</enum><text>includes acting as an armored car service for processing and depositing with a depository institution or a Federal reserve bank with respect to any monetary instruments (as defined under section 1956(c)(5) of title 18, United States Code.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H25FE38DD6508441C9F5835AD363EC0BA"><enum>(8)</enum><header>Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given that term in section 1151 of title 18.</text></paragraph><paragraph id="H85B06C7269A84964A15102471F2F4B26"><enum>(9)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" id="H417D8DACE8AE4EF392804B666E400CB1"><enum>(10)</enum><header>Insurer</header><text display-inline="yes-display-inline">The term <term>insurer</term> has the meaning given that term under section 313(r) of title 31, United States Code.</text></paragraph><paragraph id="H6B824BD21E1A402E9CE4C95315DB4189"><enum>(11)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means a person who manufactures, compounds, converts, processes, prepares, or packages cannabis or cannabis products.</text></paragraph><paragraph id="HB626EEE406AA4A11AC28D57713AE0BB4"><enum>(12)</enum><header>Producer</header><text display-inline="yes-display-inline">The term <term>producer</term> means a person who plants, cultivates, harvests, or in any way facilitates the natural growth of cannabis.</text></paragraph><paragraph id="H8B2B991AF7FA4EB88C934CE5A60FFE2D"><enum>(13)</enum><header>Service provider</header><text display-inline="yes-display-inline">The term <term>service provider</term>—</text><subparagraph id="HD9442BB058F24E81AA413E70656D2600"><enum>(A)</enum><text>means a business, organization, or other person that—</text><clause id="HE985DC4C48ED4E7294776BCADB8F27AE"><enum>(i)</enum><text>sells goods or services to a cannabis-related legitimate business; or</text></clause><clause id="HFA36FFC27DEC4A9A87BEE039F99BCAD7"><enum>(ii)</enum><text>provides any business services, including the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to cannabis; and</text></clause></subparagraph><subparagraph id="H8571A48AB2FE4B02AC158736D7417696"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a business, organization, or other person that participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subparagraph></paragraph><paragraph id="H463B33DDD03F4ADD9C0C75CD91B2B563"><enum>(14)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></paragraph></section></legis-body></bill>
