R. 1991</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210317">March 17, 2021</action-date><action-desc><sponsor name-id="T000474">Mrs. Torres of California</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Attorney General to conduct studies on child custody and divorce in domestic violence cases, and for other purposes.</official-title></form><legis-body id="H479DEB10FFD4401B8EA66DBF903A5D6D" style="OLC"><section id="H807444D647D2436EBEB66F815417172C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Victims of Domestic Violence Act</short-title></quote>. </text></section><section id="HAB721AC1909E49188B21E8BE38C31255"><enum>2.</enum><header>Study on child custody in domestic violence cases</header><text display-inline="no-display-inline">The Attorney General, in consultation with the Secretary of Health and Human Services, shall conduct a study investigating whether victims who raise evidence of domestic violence are more likely to lose primary custody of children to an abusive partner or to the State, including—</text><paragraph id="H230D4B41236F49858161A7BDE5ADEFA4"><enum>(1)</enum><text>a review of State laws, regulations, and practices on how child neglect and custody situations are handled in domestic violence situations; and</text></paragraph><paragraph id="HDC9C8172E419413F904FECE4AF4311D6"><enum>(2)</enum><text>a list of recommendations on how to restructure State laws, regulations, and practices to better protect victims of domestic violence and their children. </text></paragraph></section><section id="H278EB38A548643E7A1D82054529EB3FE"><enum>3.</enum><header>Study on costs of divorce in domestic violence cases</header><text display-inline="no-display-inline">The Attorney General, in coordination with the Secretary of Health and Human Services, shall—</text><paragraph id="HCC2606657FAE4C70A08DED900288DB18"><enum>(1)</enum><text>conduct a study on the direct and collateral economic costs and risks of divorce from an abusive partner to a victim of domestic violence, including the payment of alimony, legal fees, spousal support, or the division of property, disaggregated on the basis of whether the individual has higher earnings than their partner; and</text></paragraph><paragraph id="H36796260A9A441B09D1E38174F137077"><enum>(2)</enum><text>include recommendations based on the study conducted under paragraph (1). </text></paragraph></section></legis-body></bill>
