which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to modernize Federal nursing home protections and to enhance care quality and transparency for nursing home residents and their families.</official-title></form><legis-body id="HD7BF1CD25279466C98DC131092D94657" style="OLC"><section id="H9615FBC59FE748719FF06249EF2F1421" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nursing Home Reform Modernization Act of 2021</short-title></quote>.</text></section><section id="H0BD1D2174BBC4900A47DECF4FCA6ACF9"><enum>2.</enum><header>Improvements to nursing facilities under the Medicare and Medicaid programs</header><subsection id="HC8B892F345BA43F587036F43123CC411"><enum>(a)</enum><header>Advisory Council on Skilled Nursing Facility Rankings <enum-in-header><header-in-text style="OLC" level="paragraph">under</header-in-text></enum-in-header> Medicare and Nursing Facility Rankings <enum-in-header><header-in-text style="OLC" level="paragraph">under</header-in-text></enum-in-header> Medicaid</header><paragraph id="H66523561948C48B9915546B92233E359"><enum>(1)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall establish the Advisory Council on Skilled Nursing Facility Rankings under Medicare and Nursing Facility Rankings under Medicaid (in this subsection referred to as the <quote>Advisory Council</quote>).</text></paragraph><paragraph id="H015B9604A54C476E8158B5136B73D77C"><enum>(2)</enum><header>Membership</header><text>The Secretary shall ensure that the membership of the Advisory Council includes equal representation from the following:</text><subparagraph id="HF81481DD110547B3AEA67546E9C6D2C7"><enum>(A)</enum><text>Consumers with nursing home experience, including adults age 65 and older, individuals with disabilities, family caregivers, and their advocates.</text></subparagraph><subparagraph id="H26C3E494872A4D828C8C5B4B6E1CF584"><enum>(B)</enum><text>Skilled nursing facilities and nursing facilities, including non-profit facilities.</text></subparagraph><subparagraph id="HD4DBBEA9BEB4428FB11FE2D0CFCD19E7"><enum>(C)</enum><text>Academics with expertise in nursing home oversight.</text></subparagraph><subparagraph id="H1844AD19E05049FABBCC66F71A375B8B"><enum>(D)</enum><text>Health professionals with nursing home experience, such as physicians, nurses, pharmacists, certified nursing assistants, and direct care professionals.</text></subparagraph><subparagraph id="HFCE58F83937A40B797DDE37A8547D5FE"><enum>(E)</enum><text>Professionals with expertise in quality measurement.</text></subparagraph><subparagraph id="HAB4DDB12A50B45D18244A22DF27BF17B"><enum>(F)</enum><text>Professionals with expertise in emergency management.</text></subparagraph><subparagraph id="HC1CC43DCAD684F0E9F91DCA0AF6C45EE"><enum>(G)</enum><text>State surveying agencies.</text></subparagraph><subparagraph id="H03DDB73B4B5146F49675D741E49136B6"><enum>(H)</enum><text>State long-term care ombudsman programs.</text></subparagraph><subparagraph id="H13CC29C3EB4C418394DB5AAD2B980EF0"><enum>(I)</enum><text>The Medicare Payment Advisory Commission.</text></subparagraph><subparagraph id="H605201B7CC7E4BA2A9646BE74C914C32"><enum>(J)</enum><text>The Medicaid and CHIP Payment and Access Commission.</text></subparagraph><subparagraph id="H2A1B10387610414D8ABCC113DC448F05"><enum>(K)</enum><text>The Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="HF50FF9DB843544B2BCD1A59F906E694A"><enum>(L)</enum><text>Other representatives as the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="H4619DCF5EB0E46839DE1CC0B2E2D50C3"><enum>(3)</enum><header>Duties</header><subparagraph id="H7BA1EDB25BEC49FD826A21F4CE20DC87"><enum>(A)</enum><header>Study</header><text>The Advisory Council shall conduct a study of processes for ranking skilled nursing facilities and nursing facilities under paragraph (9) of section 1819(f) of the Social Security Act, as added by subsection (b)(1) and under paragraph (11) of section 1919(f) of such Act, as added by subsection (c)(1). Such study shall include an analysis of— </text><clause commented="no" display-inline="no-display-inline" id="HB5C65DBEAA284F0E8BB39287787032A5"><enum>(i)</enum><text>which available, verifiable data sources and measures are best for appropriately designating facilities in— </text><subclause id="H93FC34AC0DD142F8A80FEADBB32533B7" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>the high-rated facility program under paragraph (10) of such section 1819(f) and under paragraph (12) of such section 1919(f); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H37C8D6C4EC1B43739DE8EDACB6CC8353"><enum>(II)</enum><text>the low-rated facility program under paragraph (8) of such section 1819(f) and under paragraph (10) of such section 1919(f); </text></subclause></clause><clause id="H95BD409A55C942A68EFC446086527B3B"><enum>(ii)</enum><text>the appropriate frequency with which to update the rankings for the high-rated and low-rated facility programs described in clause (i);</text></clause><clause id="H975A8B40A30C46B6A58EF84A738F3ECF"><enum>(iii)</enum><text>how best to ensure that skilled nursing facilities and nursing facilities appropriately report adverse events;</text></clause><clause id="H86487242EBCD4036A2DA4F165B10B25E"><enum>(iv)</enum><text>how surveyors can clearly provide the rationale for giving deficiencies to such skilled nursing facilities and nursing facilities and how this can be done in a timely manner;</text></clause><clause id="H24D84F5064694603812DCE48A0149396"><enum>(v)</enum><text>how to manage suspensions from the high-rated facility program described in clause (i)(I) and the need for additional consumer protections to administer such high-rated facility program;</text></clause><clause id="H2DD86F4590724E6D83C92A650A308DCB"><enum>(vi)</enum><text>the availability or potential development of, or modifications to, measures or verifiable data sources on topics, including avoidable hospital readmissions, emergency room visits, risk-adjusted mortality, discharges to the community, involuntary discharges, situations involving the inappropriate administration of medications by a facility, and emergency management; and</text></clause><clause id="H46DE663F33B744D9B5D0826C57589662"><enum>(vii)</enum><text>the development of, or modifications to, data collection, verifiable data sources, and potential measures to assess the financial stability of a facility. </text></clause></subparagraph><subparagraph commented="no" id="HEB616A73903A428694A0DBBDA459108D"><enum>(B)</enum><header>Findings and recommendations</header><clause commented="no" id="HD0C056D2B4B248A482D0246405ED3A5D"><enum>(i)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Advisory Council shall submit to the Secretary the findings of the Advisory Council under the study conducted under subparagraph (A), together with recommendations for such legislation and administrative action as the Advisory Council determines appropriate. </text></clause><clause id="HAB3389BE65A346AEA4E9B4FF7A3F83B4" commented="no"><enum>(ii)</enum><header>Public availability</header><text>Upon receiving the findings and recommendations under clause (i), the Secretary shall make the findings and recommendations available to the public on the Internet website of the Centers for Medicare &amp; Medicaid Services.</text></clause></subparagraph></paragraph><paragraph id="HDE6EC9EFD8644DB198BFCCC2FA7C0849"><enum>(4)</enum><header>Sunset</header><text>The Advisory Council shall terminate upon the submission of the report to the Secretary under paragraph (3)(B)(i). </text></paragraph></subsection><subsection id="HA5C35F41ED48466DA826CEEBCC93ADAC"><enum>(b)</enum><header>Medicare program revisions</header><paragraph id="HF88B13860D5E45DEBAEE79CBD1CB805B"><enum>(1)</enum><header>Establishment of rankings and high-rated facility program</header><subparagraph id="H6CAEF2F24B8143EE847F603F0E45BF88"><enum>(A)</enum><header>In general</header><text>Section 1819(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)</external-xref>) is amended by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="HFC74B08F566E499FBAE176C15C3083B1" style="OLC"><paragraph id="H5C9B3ECCABD84F198BA00554559AECC5"><enum>(9)</enum><header>Ranking process</header><subparagraph id="H97305FD523BD442B85BFA9EC761C3E4E"><enum>(A)</enum><header>Process</header><clause id="HAB8BCAFD00C14096820683C5DF285DFA"><enum>(i)</enum><header>Establishment</header><text>The Secretary shall establish a process to rank skilled nursing facilities based on compliance with the applicable requirements of this Act.</text></clause><clause id="H6900E15D2A194BB8BC760195633EEB29"><enum>(ii)</enum><header>Data</header><text>The process established under clause (i) shall include the use of at least the preceding 3 years of health inspection data, if appropriate, and other data as determined appropriate by the Secretary.</text></clause><clause id="H9973C0E46B6B433B9574EBD90C25D2DC"><enum>(iii)</enum><header>Findings and recommendations of the Advisory Council on Skilled Nursing Facility Rankings under Medicare and Nursing Facility Rankings under Medicaid</header><text>In establishing the process under clause (i), the Secretary shall take into account the findings and recommendations of the Advisory Council that are submitted to the Secretary under section 2(a)(3)(B)(i) of the <short-title>Nursing Home Reform Modernization Act of 2021</short-title>. </text></clause></subparagraph><subparagraph id="HF40E3C5F4E154395A625468D48A7DB92"><enum>(B)</enum><header>Ranking</header><clause id="H179E3960EEA041E8A8BE69B088F21305"><enum>(i)</enum><header>In general</header><text>Under the process established under subparagraph (A), the Secretary shall use the rankings of skilled nursing facilities to categorize facilities into highest and lowest groups for the purposes specified in clause (ii).</text></clause><clause id="H9F6C1669057F4AD5889BBB4C446F4735"><enum>(ii)</enum><header>Timing and use of rankings</header><text>Not later than 2 years after the date the Secretary receives the findings and recommendations described in subparagraph (A)(iii), the Secretary shall use the rankings under clause (i) for purposes of carrying out—</text><subclause id="H808B15C01EE74682B9BBDF5EDF930C33"><enum>(I)</enum><text>the high-rated facility program under paragraph (10); and</text></subclause><subclause id="H1EF216869FA9415091787A9842165BC8"><enum>(II)</enum><text>the low-rated facility program under paragraph (8).</text></subclause></clause></subparagraph></paragraph><paragraph id="HF9A6021C3D96461CBB440547459E03AC"><enum>(10)</enum><header>High-rated facility program</header><subparagraph id="H03F447189F6A4EEEAB2449C62E70A228"><enum>(A)</enum><header>Establishment</header><clause id="HA735F34E0DF9420FBF811F6ADFC9D3A8"><enum>(i)</enum><header>In general</header><text>Not later than 2 years after the date the Secretary receives the findings and recommendations described in paragraph (9)(A)(iii), the Secretary shall establish and implement a high-rated facility program to encourage and reward compliance with the requirements of this Act.</text></clause><clause id="H1BE7972B5B38460289A4A16DEF9E38DB"><enum>(ii)</enum><header>Report</header><text>In establishing the high-rated facility program, the Secretary shall take into account the findings and recommendations described in paragraph (9)(A)(iii).</text></clause><clause id="H3189283392D34398B259BEA567DDCE42" commented="no"><enum>(iii)</enum><header>Regulations</header><text>The Secretary shall establish the high-rated facility program under clause (i) through notice and comment rulemaking.</text></clause></subparagraph><subparagraph id="HC39353D20AE94BB493856269DBDC59E9"><enum>(B)</enum><header>Designation</header><text>Under the high-rated facility program, subject to subparagraph (D), the Secretary shall designate the highest rated skilled nursing facilities under the rankings under paragraph (9)(B) as high-rated skilled nursing facilities.</text></subparagraph><subparagraph commented="no" id="H5CFD7B9E20B347F9AF962B2367219CA6"><enum>(C)</enum><header>Distinction on Nursing Home Compare website</header><text>A skilled nursing facility that is designated as a high-rated skilled nursing facility under subparagraph (B) shall receive a high-rated distinction on the official Internet website of the Federal Government for comparing nursing homes pursuant to subsection (i)(1)(C). </text></subparagraph><subparagraph id="HE60D988D94E443B8B52A64C395CBB004"><enum>(D)</enum><header>Suspension of high-rated status</header><clause id="H11183D38053F403291B04E7A369280D3"><enum>(i)</enum><header>In general</header><text>The Secretary shall suspend a skilled nursing facility’s designation under subparagraph (B) if the Secretary determines that there are circumstances warranting such suspension. </text></clause><clause id="H1874F3602A1E4239BDAB59BD83A0E197"><enum>(ii)</enum><header>Circumstances</header><text>In establishing the circumstances under clause (i), the Secretary shall take into account—</text><subclause id="HA714CDE0B16248E991B76D48B51B58C1"><enum>(I)</enum><text>findings from Federal surveys and investigations;</text></subclause><subclause id="H832DD18B74AA4A579069A8B52CC09CD0"><enum>(II)</enum><text>findings from State surveys conducted under subsection (g)(2)(A);</text></subclause><subclause id="H8526152ACED94FB7A539BFF85DA32B1A"><enum>(III)</enum><text>findings from State investigations and surveys conducted under subsection (g)(4), including a high number of substantiated complaints, the frequency and severity of substantiated complaints, and how the complaints are handled by the facility;</text></subclause><subclause id="H22C96D42B6B546EE99DC37CD4F3AE978" commented="no"><enum>(IV)</enum><text>situations involving changes of ownership, administration, or management of a skilled nursing facility, or the director of nursing; </text></subclause><subclause id="H8D59C3C17CA7454EB8C99F92546093DC"><enum>(V)</enum><text>situations involving the inappropriate administration of medications by a facility;</text></subclause><subclause id="H0DC897662E31482C89B70F2C557D0232"><enum>(VI)</enum><text>situations involving involuntary discharges of residents; and</text></subclause><subclause id="HF402E0DED1AF4FC6937C0C93CD378B96"><enum>(VII)</enum><text>other factors determined appropriate by the Secretary.</text></subclause></clause><clause id="HF757806FDF594765A1B71E2DCE8C9720"><enum>(iii)</enum><header>No reinstatement prior to next standard survey</header><text>If a skilled nursing facility’s designation is suspended under clause (i), such designation shall not be reinstated prior to a subsequent survey as specified under subsection (g)(2)(A)(iii).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAEBDDEF39D4F4C7EAC8C6F5C50EE6647"><enum>(B)</enum><header>Assessment of high-rated designation in special surveys</header><text>Section 1819(g)(2)(A)(iii)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)(2)(A)(iii)(II)</external-xref>) is amended—</text><clause id="H1E8A151F5E6B42D7A7A93EB949E6F256"><enum>(i)</enum><text>by inserting <quote>(or, in the case of a facility that is designated as a high-rated skilled nursing facility under subsection (f)(10), shall be conducted)</quote> after <quote>may be conducted</quote>; and</text></clause><clause id="H99FFEEA50DB14337922A880D0FC5A837"><enum>(ii)</enum><text>by adding at the end the following new sentence: <quote>On and after the date the Secretary implements the high-rated facility program under subsection (f)(10), any survey conducted, pursuant to the preceding sentence, of a facility that is designated as a high-rated skilled nursing facility under such subsection shall include an assessment of whether such designation should continue or be suspended under subparagraph (D) of such subsection.</quote>. </text></clause></subparagraph></paragraph><paragraph id="H3C0C70938C2040DB8F3D69C70B8F3DEB"><enum>(2)</enum><header>Improvements to the special focus facility program</header><subparagraph id="HAEF8888C72294D068707A577C14C6D86"><enum>(A)</enum><header>Appropriate participation</header><text>Section 1819(f)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(8)</external-xref>) is amended—</text><clause id="H2B09CA94172D4BB5B9F316A2AA89049E"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>The Secretary</quote> and inserting <quote>Subject to the succeeding provisions of this subsection, the Secretary</quote>; and</text></clause><clause id="H4AEB27769D0648E8B991D28EFC59A033"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF41439A6FE9D40DFA2E5AB163A52578F"><subparagraph id="H4F0181CE0EB4427599FE6C5C8E35BE96"><enum>(C)</enum><header>Appropriate participation</header><text>Not later than 1 year after the date of enactment of the <short-title>Nursing Home Reform Modernization Act of 2021</short-title>, the Secretary shall ensure that the number of facilities participating in the special focus facility program is not less than 3.5 percent of all skilled nursing facilities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE5F5ED5394D541BBB67A7BC4E48B25E3"><enum>(B)</enum><header>Conversion of the special focus facility program to the low-rated facility program and additional requirements</header><text>Section 1819(f)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(8)</external-xref>), as amended by subparagraph (A), is amended—</text><clause id="H9F7F082B265B46F8BA50BF7B832A7009"><enum>(i)</enum><text>in subparagraph (B), by inserting the following before the period at the end: <quote>(or, on and after the date the Secretary makes the conversion described in subparagraph (D), at a frequency determined appropriate by the Secretary (but in no case less than once every 6 months))</quote>; and</text></clause><clause id="H7B35E1BCFC524E8EAB1F564B5912EBF9"><enum>(ii)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEE0ED6AE27E5487092CB5046AFB6F9EF"><subparagraph id="HCDE4D974914F48FA83342BF3FEA7D68B"><enum>(D)</enum><header>Conversion to the low-rated facility program</header><clause id="HAD7409D6AF49438F9B0A6E6BC90EE808"><enum>(i)</enum><header>In general</header><text>On the same date that the Secretary implements the high-rated facility program under paragraph (10), the Secretary shall convert the special focus facility program under this subsection to the low-rated facility program. </text></clause><clause id="H58811CA950564BDEB9DF92D72D4C87F6" commented="no"><enum>(ii)</enum><header>Regulations</header><text>The Secretary shall carry out the conversion under clause (i) through notice and comment rulemaking. </text></clause><clause id="HF68CAA6B4C6543E99E5638EF0A24DE2B"><enum>(iii)</enum><header>Additional requirements for the low-rated facility program</header><text>In addition to the provisions that apply to the low-rated facility program through the conversion from the special focus facility program, the succeeding provisions of this subsection shall also apply to the low-rated facility program.</text></clause></subparagraph><subparagraph id="H5A98FA2925BC47ADB392FD0C1A6D0749"><enum>(E)</enum><header>Participation</header><text>Subject to the minimum participation requirement under subparagraph (C), the Secretary shall designate the lowest rated skilled nursing facilities under the rankings under paragraph (9)(B) for participation in the low-rated facility program.</text></subparagraph><subparagraph id="HB615B26BA38B4EDDBDF0B7A252FBD762"><enum>(F)</enum><header>Progressive enforcement actions</header><text>The Secretary, in consultation with States, shall utilize progressive enforcement actions, of increasing severity, to ensure facilities participating in the low-rated facility program meet the applicable requirements under this Act.</text></subparagraph><subparagraph commented="no" id="H2CD6DA7316C843BB8D771894950F24B7"><enum>(G)</enum><header>Enforcement for patterns of deficiency</header><text>The Secretary may utilize enforcement actions specified in subsection (h)(2) to remedy patterns of deficiencies cited across multiple surveys. </text></subparagraph><subparagraph commented="no" id="H2E40F32AE98E492ABE6A9568AC68FE41"><enum>(H)</enum><header>Compliance assistance programs</header><clause commented="no" id="HEE7CA8F9A2EE4DFEB6BA337A5DC40CF5"><enum>(i)</enum><header>On-site consultation and educational programming</header><subclause commented="no" id="H2C4AC1D07E234B9B8485FC72DD5FC883"><enum>(I)</enum><header>In general</header><text>The Secretary shall establish on-site consultation and educational programming for skilled nursing facilities participating in the low-rated facility program with respect to compliance with the applicable requirements under this Act.</text></subclause><subclause commented="no" id="H4A1DFDE53BB3475C9980ECB1E2EAF7C2"><enum>(II)</enum><header>Entity</header><text>The on-site consultation and educational programming described in subclause (I) shall be carried out by quality improvement organizations under part B of title XI or other independent organizations of a similar type that do not have conflicts of interest and are deemed appropriate by the Secretary.</text></subclause><subclause commented="no" id="H69212D462B1D4B3686DCDC7AB41570C6"><enum>(III)</enum><header>Required participation</header><text>A skilled nursing facility participating in the low-rated facility program shall participate in any consultations and educational programming described in subclause (I) conducted at the facility.</text></subclause></clause><clause commented="no" id="HB3EBFD82AF9940AE920172F27E79E6DA"><enum>(ii)</enum><header>Consultation independent of enforcement</header><subclause commented="no" id="HDC2B7246800744A5A85386A9FE7ADE3A"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), on-site consultations and educational programming described in clause (i) shall be conducted independently of any enforcement activity.</text></subclause><subclause commented="no" id="HEBA2E0C045694FE392072B4FF96F6AC4"><enum>(II)</enum><header>Exception</header><text>Subclause (I) shall not apply in the case where a triggering event at the skilled nursing facility is observed in the course of providing on-site consultations and educational programming described in clause (i). In establishing such on-site consultations and educational programming, the Secretary shall determine the triggering events for which the use of necessary enforcement actions is permitted notwithstanding the limitation under subclause (I). Such triggering events shall include events that are required to be reported under State and Federal law and a pattern of deficiencies or problems that the quality improvement organization or other organization has identified for correction but which are consistently not corrected.</text></subclause></clause></subparagraph><subparagraph id="H43C07C3A19E840E2928D42EB9C44ED6C"><enum>(I)</enum><header>Public availability</header><clause id="H3A5CAD4C82814B72A5D0A680F380196D"><enum>(i)</enum><header>In general</header><text>The Secretary shall ensure that a skilled nursing facility’s participation in the low-rated facility program is publicly announced, including to—</text><subclause id="HEC789AB40E364B3094F760A7B9D5D25C"><enum>(I)</enum><text>resident family councils; </text></subclause><subclause id="HE08600DBF3B04A238EE96B0E2E56D85C"><enum>(II)</enum><text>resident attending physicians; </text></subclause><subclause id="HC6CF14C9AB284BEFB0F1B05C34173BE3"><enum>(III)</enum><text>the State board responsible for the licensing of the skilled nursing facility administrator at the facility;</text></subclause><subclause id="H402EECC246FD472289EDA5601223B9E4"><enum>(IV)</enum><text>State Long-Term Care Ombudsman programs (as described in section 712(a)(1) of the Older Americans Act of 1965); and</text></subclause><subclause id="H4B721B068A7F45DFB17C6B2C231E57D1"><enum>(V)</enum><text>the community at large. </text></subclause></clause><clause id="H1B961C1560B24534925F38A7F8F20CE0"><enum>(ii)</enum><header>Written notification</header><text>The Secretary shall ensure that, in the case of a skilled nursing facility that is participating in the low-rated facility program, residents of such facility and family or legal representatives are furnished with individualized written notice of such participation. Such notice shall be provided to current residents and to new residents prior to admission. </text></clause></subparagraph><subparagraph id="HFBC96F3B860143E8B2EA458A35F78EE2"><enum>(J)</enum><header>Requirement for removal</header><text>The Secretary shall require that a skilled nursing facility show improvement prior to removal from the low-rated facility program.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H9F482809BAF44012873BB41B3F0DA595"><enum>(C)</enum><header>Use of civil money penalties</header><text>Section 1819(h)(2)(B)(ii)(IV)(ff) of the Social Security Act (42 U.S.C. 1395i–3(h)(2)(B)(ii)(IV)(ff)) is amended—</text><clause id="H88960050169C4DC4B1A0C511DB93649D"><enum>(i)</enum><text>by striking <quote>and facility improvement initiatives</quote> and inserting <quote>facility improvement initiatives</quote>; and</text></clause><clause id="H76A97B81C2F443D281BBC63766C1A03E"><enum>(ii)</enum><text>by inserting the following before the period at the end: <quote>, and, on and after the date the Secretary makes the conversion described in subsection (f)(8)(D), consultation, education, and other activities to foster improvement and remedy root causes contributing to deficiencies cited across multiple surveys among facilities in the low-rated facility program under subsection (f)(8)</quote>. </text></clause></subparagraph></paragraph><paragraph id="H38F5D56BE962430DBB97FC8BBD891CB2"><enum>(3)</enum><header>Information on high-rated and low-rated facilities on Nursing Home Compare Medicare website</header><text>Section 1819(i)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(i)(1)</external-xref>) is amended—</text><subparagraph id="H1395D9B7648F40E3B8759E7E58CA1506"><enum>(A)</enum><text>in subparagraph (A), by adding at the end the following new clause: </text><quoted-block display-inline="no-display-inline" id="H2FEAC40AB90643CBB336EF68CEE98C58" style="OLC"><clause id="H4BBC3077817546CE8AC3A75C6991587E"><enum>(vi)</enum><text>On and after the date the Secretary implements the high-rated facility program under subsection (f)(10) and makes the conversion under subsection (f)(8)(D), consistent with subparagraph (C)—</text><subclause id="HB3CA64F6F81F4A62A42AAA8C463639AE"><enum>(I)</enum><text>for each skilled nursing facility that is designated as a high-rated skilled nursing facility under subsection (f)(10), the date the facility was so designated; and</text></subclause><subclause id="HC7E5B2868B5B49C9AE2A5A33EB616E30"><enum>(II)</enum><text>for each skilled nursing facility participating in the low-rated facility program under subsection (f)(8), the date the facility was identified for inclusion in such program.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF24A2AA418B745EF9EDA3D5A0A00016C"><enum>(B)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block display-inline="no-display-inline" id="H2FF8BE55A0FB4A02BD4527E682D4ADD5" style="OLC"><subparagraph id="H58BA55BFFF1049618FF5A8EF84E44110" commented="no"><enum>(C)</enum><header>Distinctions for high-rated and low-rated facilities</header><text>On and after the date the Secretary implements the high-rated facility program under subsection (f)(10) and makes the conversion under subsection (f)(8)(D), the Secretary shall ensure that graphics, including an appropriate explanation of such graphics, are prominently displayed on the website described in subparagraph (A) in order to distinguish each of the following: </text><clause id="H1C60BA1AD8B24EB786471D0BAB243404" commented="no"><enum>(i)</enum><text>Skilled nursing facilities that are designated as high-rated skilled nursing facilities under subsection (f)(10).</text></clause><clause id="H1885D9D53DC5419F8CFD687B56FF82F1" commented="no"><enum>(ii)</enum><text>Skilled nursing facilities that are participating in the low-rated facility program under subsection (f)(8), with information on facilities that have been placed in such program more than one time over the course of the last 10 years (including the number of times such skilled nursing facilities have been placed in the program).</text></clause></subparagraph><subparagraph id="HD2411E3B58F74286A2790F8E20F8016E"><enum>(D)</enum><header>Focus groups and consumer testing</header><text>In order to help limit confusion, particularly among older adults, individuals with disabilities, and family caregivers, the Secretary shall utilize focus groups and other consumer testing methods prior to including the additional information under subparagraph (A)(vi) and implementing the distinctions under subparagraph (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H0CF887FFA0554690A31D2F503DA1F82B"><enum>(c)</enum><header>Medicaid program revisions</header><paragraph id="H14C233AA3A914B5F8F2A206BEFA69C21"><enum>(1)</enum><header>Establishment of rankings and high-rated facility program</header><subparagraph id="H736FC6F272554D78A285777A46BD5346"><enum>(A)</enum><header>In general</header><text>Section 1919(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(f)</external-xref>) is amended by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H87E3203098BA4DB2AA72D2813151D152" style="OLC"><paragraph id="H584C978D058A4E83836E2DC3831197A1"><enum>(11)</enum><header>Ranking process</header><subparagraph id="H34754D3DFE9D4F95B4B625270C5DD31A"><enum>(A)</enum><header>Process</header><clause id="H1071D048A6594FC3BF4B4A299210D61B"><enum>(i)</enum><header>Establishment</header><text>The Secretary shall establish a process to rank nursing facilities based on compliance with the applicable requirements of this Act.</text></clause><clause id="H472DEAA2D91546BBB11A514625E77587"><enum>(ii)</enum><header>Data</header><text>The process established under clause (i) shall include the use of at least the preceding 3 years of health inspection data, if appropriate, and other data as determined appropriate by the Secretary.</text></clause><clause id="HF930427BB4924547BAAB45E2C5A804F6"><enum>(iii)</enum><header>Findings and recommendations of the Advisory Council on Skilled Nursing Facility Rankings under Medicare and Nursing Facility Rankings under Medicaid</header><text>In establishing the process under clause (i), the Secretary shall take into account the findings and recommendations of the Advisory Council that are submitted to the Secretary under section 2(a)(3)(B)(i) of the <short-title>Nursing Home Reform Modernization Act of 2021</short-title>. </text></clause></subparagraph><subparagraph id="H994A39FCD6504F46B0711474BA1D1CF6"><enum>(B)</enum><header>Ranking</header><clause id="H96399681026A4265A047678345D1E909"><enum>(i)</enum><header>In general</header><text>Under the process established under subparagraph (A), the Secretary shall use the rankings of nursing facilities to categorize facilities into highest and lowest groups for the purposes specified in clause (ii).</text></clause><clause id="H07D708F7331147048264E81026C500BF"><enum>(ii)</enum><header>Timing and use of rankings</header><text>Not later than 2 years after the date the Secretary receives the findings and recommendations described in subparagraph (A)(iii), the Secretary shall use the rankings under clause (i) for purposes of carrying out—</text><subclause id="HE0D6DC980007474CA35FDF2522056F1A"><enum>(I)</enum><text>the high-rated facility program under paragraph (12); and</text></subclause><subclause id="HB6FC4D78DD1C453695FEE63CD805A1F6"><enum>(II)</enum><text>the low-rated facility program under paragraph (10).</text></subclause></clause></subparagraph></paragraph><paragraph id="H270900D0FBED45429ED0BE2D5A0C979A"><enum>(12)</enum><header>High-rated facility program</header><subparagraph id="H5A5770ECE7244C7F8379F81A49B1A44E"><enum>(A)</enum><header>Establishment</header><clause id="H2190BE9F3250489181EDF427F6267399"><enum>(i)</enum><header>In general</header><text>Not later than 2 years after the date the Secretary receives the findings and recommendations described in paragraph (11)(A)(iii), the Secretary shall establish and implement a high-rated facility program to encourage and reward compliance with the requirements of this Act.</text></clause><clause id="H48475BB7B82642049952C1F47A025817"><enum>(ii)</enum><header>Report</header><text>In establishing the high-rated facility program, the Secretary shall take into account the findings and recommendations described in paragraph (11)(A)(iii).</text></clause><clause id="HBECD70CC08D748DA98B4A7C2BE6E9AF1" commented="no"><enum>(iii)</enum><header>Regulations</header><text>The Secretary shall establish the high-rated facility program under clause (i) through notice and comment rulemaking.</text></clause></subparagraph><subparagraph id="H2846CF8D3BC4409C9FDC1E8C43C59FA7"><enum>(B)</enum><header>Designation</header><text>Under the high-rated facility program, subject to subparagraph (D), the Secretary shall designate the highest rated nursing facilities under the rankings under paragraph (11)(B) as high-rated nursing facilities.</text></subparagraph><subparagraph commented="no" id="H5246AE27162D477189E1669C6AA57EDA"><enum>(C)</enum><header>Distinction on Nursing Home Compare website</header><text>A nursing facility that is designated as a high-rated nursing facility under subparagraph (B) shall receive a high-rated distinction on the official Internet website of the Federal Government for comparing nursing homes pursuant to subsection (i)(1)(C). </text></subparagraph><subparagraph id="H2361B7A9D04A4BC2834DA16BAF8720DD"><enum>(D)</enum><header>Suspension of high-rated status</header><clause id="HF8502D45CEB34EF69AC737968CFBEC7A"><enum>(i)</enum><header>In general</header><text>The Secretary shall suspend a nursing facility’s designation under subparagraph (B) if the Secretary determines that there are circumstances warranting such suspension. </text></clause><clause id="H9739BF5F262E41B6B49FB4BA8C2BA3B5"><enum>(ii)</enum><header>Circumstances</header><text>In establishing the circumstances under clause (i), the Secretary shall take into account—</text><subclause id="H1933D64FDAAE4E779795C895014BB57D"><enum>(I)</enum><text>findings from Federal surveys and investigations;</text></subclause><subclause id="H06A870DC096C489592BFA9316526652D"><enum>(II)</enum><text>findings from State surveys conducted under subsection (g)(2)(A);</text></subclause><subclause id="HF39091D35BB64DE3B1722F533405B86A"><enum>(III)</enum><text>findings from State investigations and surveys conducted under subsection (g)(4), including a high number of substantiated complaints, the frequency and severity of substantiated complaints, and how the complaints are handled by the facility;</text></subclause><subclause id="H8EF47165878D41C6A9A315B5A6268DCF" commented="no"><enum>(IV)</enum><text>situations involving changes of ownership, administration, or management of a nursing facility, or the director of nursing; </text></subclause><subclause id="H186941E168754CE7BE65DFF80CC91E9E"><enum>(V)</enum><text>situations involving the inappropriate administration of medications by a facility;</text></subclause><subclause id="H3882EA6E355543FDBAB39F7270C76620"><enum>(VI)</enum><text>situations involving involuntary discharges of residents; and</text></subclause><subclause id="HA39FCE4C235E47C2AA1EE7F2B4441826"><enum>(VII)</enum><text>other factors determined appropriate by the Secretary.</text></subclause></clause><clause id="H5991DCFE788B420E90BCCD3155494BB9"><enum>(iii)</enum><header>No reinstatement prior to next standard survey</header><text>If a nursing facility’s designation is suspended under clause (i), such designation shall not be reinstated prior to a subsequent survey as specified under subsection (g)(2)(A)(iii).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA302F818852A422188980D7FBB996B34"><enum>(B)</enum><header>Assessment of high-rated designation in special surveys</header><text>Section 1919(g)(2)(A)(iii)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(g)(2)(A)(iii)(II)</external-xref>) is amended—</text><clause id="H6C6B117E283646DEBEF1ACDAF5ABEF8C"><enum>(i)</enum><text>by inserting <quote>(or, in the case of a facility that is designated as a high-rated nursing facility under subsection (f)(12), shall be conducted)</quote> after <quote>may be conducted</quote>; and</text></clause><clause id="HA6A0EB5175B24164A9F8DA2AA0868570"><enum>(ii)</enum><text>by adding at the end the following new sentence: <quote>On and after the date the Secretary implements the high-rated facility program under subsection (f)(12), any survey conducted, pursuant to the preceding sentence, of a facility that is designated as a high-rated nursing facility under such subsection shall include an assessment of whether such designation should continue or be suspended under subparagraph (D) of such subsection.</quote>. </text></clause></subparagraph></paragraph><paragraph id="HC507F447D03245ACA34CF6FCBFA45110"><enum>(2)</enum><header>Improvements to the special focus facility program</header><subparagraph id="H5D79028C0EC44C1F883BB0333F73B63A"><enum>(A)</enum><header>Appropriate participation</header><text>Section 1919(f)(10) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(f)(10)</external-xref>) is amended—</text><clause id="H07EF0DABDD8F4822BE628CA9A22D9C7B"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>The Secretary</quote> and inserting <quote>Subject to the succeeding provisions of this subsection, the Secretary</quote>; and</text></clause><clause id="H5C049DAFAF614D5698A6A4DC67159AF1"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9250381D7B684649BBBC83C64415584B"><subparagraph id="HB78B6C86C84D4DACB11A4F9E7A5830A3"><enum>(C)</enum><header>Appropriate participation</header><text>Not later than 1 year after the date of enactment of the <short-title>Nursing Home Reform Modernization Act of 2021</short-title>, the Secretary shall ensure that the number of facilities participating in the special focus facility program is not less than 3.5 percent of all nursing facilities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HEC4242F71CE44B0C8C8FAEC5F4CBF483"><enum>(B)</enum><header>Conversion of the special focus facility program to the low-rated facility program and additional requirements</header><text>Section 1919(f)(10) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(10)</external-xref>), as amended by subparagraph (A), is amended—</text><clause id="HE48C9D9F7E4F4AF7839A49FFE45E2CDB"><enum>(i)</enum><text>in subparagraph (B), by inserting the following before the period at the end: <quote>(or, on and after the date the Secretary makes the conversion described in subparagraph (D), at a frequency determined appropriate by the Secretary (but in no case less than once every 6 months))</quote>; and</text></clause><clause id="H880C12749F0D42ABA44BEFE39047FBAF"><enum>(ii)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA4FB0282A68746E1A9C15CB42EF6DDF0"><subparagraph id="H1AD6885F8F824756832392416D8BA275"><enum>(D)</enum><header>Conversion to the low-rated facility program</header><clause id="HAC98FE5A986D482E8CADFD3F8B7245C7"><enum>(i)</enum><header>In general</header><text>On the same date that the Secretary implements the high-rated facility program under paragraph (12), the Secretary shall convert the special focus facility program under this subsection to the low-rated facility program. </text></clause><clause id="HDE07048BE40249FE936EEB12CAFEF333" commented="no"><enum>(ii)</enum><header>Regulations</header><text>The Secretary shall carry out the conversion under clause (i) through notice and comment rulemaking. </text></clause><clause id="HD983730EF3D94D049D7E02C571BDF1FA"><enum>(iii)</enum><header>Additional requirements for the low-rated facility program</header><text>In addition to the provisions that apply to the low-rated facility program through the conversion from the special focus facility program, the succeeding provisions of this subsection shall also apply to the low-rated facility program.</text></clause></subparagraph><subparagraph id="H03192258C9464B43BD97219846B9BE24"><enum>(E)</enum><header>Participation</header><text>Subject to the minimum participation requirement under subparagraph (C), the Secretary shall designate the lowest rated nursing facilities under the rankings under paragraph (11)(B) for participation in the low-rated facility program.</text></subparagraph><subparagraph id="H626AAEC86F4A4C4CA75C3B1B5FCE5788"><enum>(F)</enum><header>Progressive enforcement actions</header><text>The Secretary, in consultation with States, shall utilize progressive enforcement actions, of increasing severity, to ensure facilities participating in the low-rated facility program meet the applicable requirements under this Act.</text></subparagraph><subparagraph commented="no" id="H4F517C5A084542C7B78BA75CF5E61297"><enum>(G)</enum><header>Enforcement for patterns of deficiency</header><text>The Secretary may utilize enforcement actions specified in subsection (h)(2) to remedy patterns of deficiencies cited across multiple surveys. </text></subparagraph><subparagraph commented="no" id="H2639AFD45C6F4E69AE39F7C747B3FA61"><enum>(H)</enum><header>Compliance assistance programs</header><clause commented="no" id="HCE53CF95BE574BB1812F8DA92E262644"><enum>(i)</enum><header>On-site consultation and educational programming</header><subclause commented="no" id="H528C46A22538464AB82A50E62A3ECDFA"><enum>(I)</enum><header>In general</header><text>The Secretary shall establish on-site consultation and educational programming for nursing facilities participating in the low-rated facility program with respect to compliance with the applicable requirements under this Act.</text></subclause><subclause commented="no" id="HEC8004511ABF4811A65017D8C75F94F3"><enum>(II)</enum><header>Entity</header><text>The on-site consultation and educational programming described in subclause (I) shall be carried out by quality improvement organizations under part B of title XI or other independent organizations of a similar type that do not have conflicts of interest and are deemed appropriate by the Secretary.</text></subclause><subclause commented="no" id="H5521E1A073454B67A11A205F1416BA18"><enum>(III)</enum><header>Required participation</header><text>A nursing facility participating in the low-rated facility program shall participate in any consultations and educational programming described in subclause (I) conducted at the facility.</text></subclause></clause><clause commented="no" id="HF67F56BBAE244340B57A7002944C98D6"><enum>(ii)</enum><header>Consultation independent of enforcement</header><subclause commented="no" id="H9A03C427BAED4ED4869F37837FC97D6C"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), on-site consultations and educational programming described in clause (i) shall be conducted independently of any enforcement activity.</text></subclause><subclause commented="no" id="H1C7C1E3422E34BBD8409B903435550FE"><enum>(II)</enum><header>Exception</header><text>Subclause (I) shall not apply in the case where a triggering event at the nursing facility is observed in the course of providing on-site consultations and educational programming described in clause (i). In establishing such on-site consultations and educational programming, the Secretary shall determine the triggering events for which the use of necessary enforcement actions is permitted notwithstanding the limitation under subclause (I). Such triggering events shall include events that are required to be reported under State and Federal law and a pattern of deficiencies or problems that the quality improvement organization or other organization has identified for correction but which are consistently not corrected.</text></subclause></clause></subparagraph><subparagraph id="HE5102E9D68E74B679646E59A31080A85"><enum>(I)</enum><header>Public availability</header><clause id="HFBC13A11E8E2418DB64AE48EB1ECF01B"><enum>(i)</enum><header>In general</header><text>The Secretary shall ensure that a nursing facility’s participation in the low-rated facility program is publicly announced, including to—</text><subclause id="HEC0ED8020DFD43A3A3AC15F63FA44365"><enum>(I)</enum><text>resident family councils; </text></subclause><subclause id="H6BF609D66AB04ACBBBC4B0ABF43822C9"><enum>(II)</enum><text>resident attending physicians; </text></subclause><subclause id="HEDFD1DE062EA43E1A581D37886D4C7CB"><enum>(III)</enum><text>the State board responsible for the licensing of the nursing facility administrator at the facility;</text></subclause><subclause id="H43EF5E8972F143509620B4BE41AB6E8D"><enum>(IV)</enum><text>State Long-Term Care Ombudsman programs (as described in section 712(a)(1) of the Older Americans Act of 1965); and</text></subclause><subclause id="HDF893F0C437845F98BFEBD070309F87E"><enum>(V)</enum><text>the community at large. </text></subclause></clause><clause id="H2C5FF7156A834603A6B021778DC8BF39"><enum>(ii)</enum><header>Written notification</header><text>The Secretary shall ensure that, in the case of a nursing facility that is participating in the low-rated facility program, residents of such facility and family or legal representatives are furnished with individualized written notice of such participation. and</text></clause><clause id="HCB9868478B844C5D96A8215B21FA7B8D"><enum>(ii)</enum><text>by inserting the following before the period at the end: <quote>, and, on and after the date the Secretary makes the conversion described in subsection (f)(10)(D), consultation, education, and other activities to foster improvement and remedy root causes contributing to deficiencies cited across multiple surveys among facilities in the low-rated facility program under subsection (f)(10)</quote>. </text></clause></subparagraph></paragraph><paragraph id="H69455B4D1BBD44499D292942983FCCC2"><enum>(3)</enum><header>Information on high-rated and low-rated facilities on Nursing Home Compare Medicare website</header><text>Section 1919(i)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(i)(1)</external-xref>) is amended—</text><subparagraph id="HB4BEED77C8724FDBA230CF976FCC78B5"><enum>(A)</enum><text>in subparagraph (A), by adding at the end the following new clause: </text><quoted-block display-inline="no-display-inline" id="HF004AECBE85B48F1B63F2D6BBD24C2A8" style="OLC"><clause id="HDD147EEB8EE945E7B3705D21D2439F1D"><enum>(vi)</enum><text>On and after the date the Secretary implements the high-rated facility program under subsection (f)(12) and makes the conversion under subsection (f)(10)(D), consistent with subparagraph (C)—</text><subclause id="HAD26B4A5F2C94C558C340F5F39FB3012"><enum>(I)</enum><text>for each nursing facility that is designated as a high-rated nursing facility under subsection (f)(12), the date the facility was so designated; and</text></subclause><subclause id="HA8DACFDA3CD841F7889AEDFAD788BD42"><enum>(II)</enum><text>for each nursing facility participating in the low-rated facility program under subsection (f)(10), the date the facility was identified for inclusion in such program.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5D48A9840AC44F088023911DB0CABAA7"><enum>(B)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block id="HA7608EF98EE64ED298FE65492297801F" display-inline="no-display-inline" style="OLC"><subparagraph id="HE1F8A35648C84B0EB5EE1665AD98DF88" commented="no"><enum>(C)</enum><header>Distinctions for high-rated and low-rated facilities</header><text>On and after the date the Secretary implements the high-rated facility program under subsection (f)(12) and makes the conversion under subsection (f)(10)(D), the Secretary shall ensure that graphics, including an appropriate explanation of such graphics, are prominently displayed on the website described in subparagraph (A) in order to distinguish each of the following: </text><clause id="HC6730AEED92C4215A80D01FFD8B698D9" commented="no"><enum>(i)</enum><text>Nursing facilities that are designated as high-rated nursing facilities under subsection (f)(12).</text></clause><clause id="HECB67ACD6D2A4942B412637BB886F568" commented="no"><enum>(ii)</enum><text>Nursing facilities that are participating in the low-rated facility program under subsection (f)(10), with information on facilities that have been placed in such program more than one time over the course of the last 10 years (including the number of times such nursing facilities have been placed in the program).</text></clause></subparagraph><subparagraph id="HF918A45833D24AE897C2A2C1430623DE" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Focus groups and consumer testing</header><text>In order to help limit confusion, particularly among older adults, individuals with disabilities, and family caregivers, the Secretary shall utilize focus groups and other consumer testing methods prior to including the additional information under subparagraph (A)(vi) and implementing the distinctions under subparagraph (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H50539A4584F441BBBAF51FF5EDF69675"><enum>(d)</enum><header>GAO study and report</header><paragraph id="H42BBAC6AAD4B493E8BEADAD24438F7E8"><enum>(1)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study on the quality of items and services furnished by skilled nursing facilities under title XVIII of the Social Security Act and nursing facilities under title XIX of such Act, and such facilities' compliance with the applicable requirements under such titles. Such study shall include analysis of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="HAEFC482B97AD40DE913BE30A0B21F909"><enum>(A)</enum><text display-inline="yes-display-inline">The effectiveness of the low-rated facility program established under paragraph (8) of section 1819(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)</external-xref>), as amended by subsection (b)(2), and under paragraph (10) of section 1919(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(f)</external-xref>), as amended by subsection (c)(2).</text></subparagraph><subparagraph id="HA4C9FE5F6FD942B1BA41EAEE694E16A3"><enum>(B)</enum><text>Other areas determined appropriate by the Comptroller General.</text></subparagraph></paragraph><paragraph id="HBA9ACFDDEB214A9EB90B0655C0B03502"><enum>(2)</enum><header>Report</header><text>Not later than 6 years after the date of enactment of this Act, the Comptroller General shall submit to the appropriate Committees of Congress a report containing the results of the study conducted under paragraph (1), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="HCE9181131CEC49B484F3AE021BCBD554"><enum>(e)</enum><header>Rules of construction</header><paragraph id="HA56EFEB72C7A4465A01F5016C9E69C9E" commented="no"><enum>(1)</enum><header>Surveys</header><text>Nothing in the provisions of, or the amendments made by, this section shall be construed to allow the Secretary to modify or deviate from—</text><subparagraph id="HC5CBE4F014D54BA493C29483990E77D3"><enum>(A)</enum><text>a survey schedule that requires unannounced and unanticipated surveying of skilled nursing facilities under subsection (g)(2)(A)(i) of section 1819 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)</external-xref>) or under subsection (g)(2)(A)(i) of section 1919 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(g)</external-xref>); </text></subparagraph><subparagraph commented="no" id="H3914256DAEC94CAEABD2472137B61A16"><enum>(B)</enum><text>the surveying frequency specified under subsection (g)(2)(A)(iii) of such section 1819 or under subsection (g)(2)(A)(iii) of such section 1919; or</text></subparagraph><subparagraph commented="no" id="H368222A0C15A45BFA548A68962AF0FB3"><enum>(C)</enum><text>surveys and investigations as required under subsection (g)(4) of such section 1819 or under subsection (g)(4) of such section 1919.</text></subparagraph></paragraph><paragraph id="H39A54CEF92FA4F2AABD21311CE086445" commented="no"><enum>(2)</enum><header>Accountability and State law</header><text>Nothing in the provisions of, or the amendments made by, this section shall be construed to impact the ability of a resident, the family of a resident, or a successor in interest to hold a skilled nursing facility or nursing facility accountable or change protections granted under State law. </text></paragraph></subsection></section><section display-inline="no-display-inline" commented="no" id="H5DF3200603744C4DAC72E9D9DC792045"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HA95BCAEAFE504B489C89741807BD09B0"><enum>(1)</enum><header>Appropriate Committees of Congress</header><text>The term <term>appropriate Committee of Congress</term> means—</text><subparagraph commented="no" id="H807377DD268C418D972CC9B52D22EEFD"><enum>(A)</enum><text>the Committee on Finance of the Senate;</text></subparagraph><subparagraph commented="no" id="HCA8F7C7A0D0045CABFB44E62A3057ECB"><enum>(B)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph><subparagraph commented="no" id="HFB6F9A33E3164828AC0F30DFFE1D9536"><enum>(C)</enum><text>the Special Committee on Aging of the Senate; </text></subparagraph><subparagraph commented="no" id="H6812797B82664D3D8C159456B4490612"><enum>(D)</enum><text>the Committee on Ways and Means of the House of Representatives; and</text></subparagraph><subparagraph id="HB9FF47E509AE4E96B28D134C83E0308C" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>the Committee on Energy and Commerce of the House of Representatives. </text></subparagraph></paragraph><paragraph id="H49C7D071BC7A4569AF97953A8D15AC61"><enum>(2)</enum><header>Nursing facility</header><text>The term <term>nursing facility</term> has the meaning given that term in section 1919(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(a)</external-xref>). </text></paragraph><paragraph id="HBF1CAE57A0754AEBB92DD9123C83F579"><enum>(3)</enum><header>Skilled nursing facility</header><text>The term <term>skilled nursing facility</term> has the meaning given that term in section 1819(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(a)</external-xref>). </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H18BC8FECB5BF43A2A71A9FB4993A65E6"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Health and Human Services.</text></paragraph></section></legis-body></bill>
