BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide a credit for owning certain disaster resilient property.</official-title></form><legis-body id="H5688B0DC791A4E6B987FC49A68AC0A2A" style="OLC"><section id="H06032CBF360A4A3CB8E8D09899C4339C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Savings and Resilient Construction Act of 2021</short-title></quote>.</text></section><section id="H04445377A1964A4A97EF4DC71077FDA8"><enum>2.</enum><header>Disaster resilient property tax credit</header><subsection id="H352F9527B3A248C5AF6A68AAE8B46724"><enum>(a)</enum><header>In general</header><text>Subpart B of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 30D the following new section:</text><quoted-block style="OLC" id="H4C3E5CFF07C34A5CB94DF52D5E45EBC9" display-inline="no-display-inline"><section id="H11B995DE0BCC4F28B75D47D1FF74BD71"><enum>30E.</enum><header>Disaster resilient property</header><subsection id="H488B6B0EAE7B4E41B9C0FE44F8E50D16"><enum>(a)</enum><header>General rule</header><text display-inline="yes-display-inline">There shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to the applicable amount for each qualified building placed in service during the taxable year.</text></subsection><subsection id="HE6E8A8BDCBDB4C62BB6842856423B698"><enum>(b)</enum><header>Applicable amount</header><text>For purposes of subsection (a)—</text><paragraph id="H61D91799198842BC8F11AE199B48B09B"><enum>(1)</enum><header>Commercial property</header><text display-inline="yes-display-inline">ln the case of a qualified commercial property, the applicable amount is the lesser of—</text><subparagraph id="H4FED7EF50E044CB38A3588BCB64F1A3E"><enum>(A)</enum><text display-inline="yes-display-inline">1 percent of the cost of the building, or </text></subparagraph><subparagraph id="H1346ED9B51BF428C8D3F51ACA5D3CFEB"><enum>(B)</enum><text>$25,000 per building.</text></subparagraph></paragraph><paragraph id="H6AEBA8B46CED4127AF89BF34D71078E6"><enum>(2)</enum><header>Residential property</header><text display-inline="yes-display-inline">ln the case of a qualified residential property, the applicable amount is the lesser of—</text><subparagraph id="HAD298CA2CF754FAF90EB07CAD4DB7AD0"><enum>(A)</enum><text>1 percent of the cost of the property, or </text></subparagraph><subparagraph id="H95158BDBA44E4E2F8AAD2A10BC644541"><enum>(B)</enum><text>$3,000 per property.</text></subparagraph></paragraph></subsection><subsection id="H992C6F7E7F004A8D8A54CC99A5ECAE19"><enum>(c)</enum><header>Qualified Building</header><text display-inline="yes-display-inline">For purposes of subsection (a)—</text><paragraph id="HDFFCCB2F501C4E78990C1A001D37236A"><enum>(1)</enum><header>In general</header><text>The term <term>qualified building</term> means a building—</text><subparagraph id="HC97FB77087804626A66132B44F105C49"><enum>(A)</enum><text>owned by the taxpayer in a disaster area determined as a result of a federally declared major disaster, </text></subparagraph><subparagraph id="H06E931CB500043B3966B51CC83B43C05"><enum>(B)</enum><text>the construction of which began after the date of such disaster in that area,</text></subparagraph><subparagraph id="HDF4D4F19FAE44461BA177783C6F841A1"><enum>(C)</enum><text>which—</text><clause id="HE57092F7E3E34E85A5481E218975F9F2"><enum>(i)</enum><text>is qualified commercial property placed in service for commercial purposes, or </text></clause><clause id="HCDDB0A59C5FD4C3D8C779F4DF281F563"><enum>(ii)</enum><text>is qualified residential property placed in service for residential purposes, and </text></clause></subparagraph><subparagraph id="H08ED6841F4174B04AD8B0525353F74F9"><enum>(D)</enum><text>for which a certificate of occupancy is issued before the end of the 3-year period beginning on the date of such disaster declaration in that area.</text></subparagraph></paragraph><paragraph id="HD59A7691DB4F4A659FDF4062985E9FA0"><enum>(2)</enum><header>Qualified commercial property</header><text>The term <term>qualified commercial property</term> means a building that is—</text><subparagraph id="H30A8183C6D8C443FB504C85FA5BC3810"><enum>(A)</enum><text>located in the United States,</text></subparagraph><subparagraph id="HDFB82ADB827C423DA1A2F7B25D27454D"><enum>(B)</enum><text>defined in the scope of the most recent International Building Code published by the International Code Council, and</text></subparagraph><subparagraph id="H39BAA13618F74233969F7E6EED353615"><enum>(C)</enum><text>designed and constructed to meet resilient construction requirements.</text></subparagraph></paragraph><paragraph id="HAC579631F7B54F33A103F8927EF1DCC3"><enum>(3)</enum><header>Qualified residential property</header><text>The term <term>qualified residential property</term> means a building that is—</text><subparagraph id="H6820E20A9A244205AC9C9A0C275B6267"><enum>(A)</enum><text>located in the United States,</text></subparagraph><subparagraph id="H88350ED29C5349EC8A585D59E4784F26"><enum>(B)</enum><text>defined in the scope of the most recent International Residential Code published by the International Code Council, and</text></subparagraph><subparagraph id="HC9D516081FF346AA958AE2FF919D4E65"><enum>(C)</enum><text>designed and constructed to meet resilient construction requirements.</text></subparagraph></paragraph></subsection><subsection id="H8DBBBC4BF6374019A309279CC767C52A"><enum>(d)</enum><header>Resilient Construction Requirements</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="H7485583CA7C7403B8C1FC15075FEA666"><enum>(1)</enum><header>In general</header><text>The resilient construction requirements with respect to a property are that the property is designed and constructed to—</text><subparagraph id="HBDB04469096D415FB54D17560E834E93"><enum>(A)</enum><text>resist hazards brought on by a major disaster and continues to provide its primary functions after a major disaster, </text></subparagraph><subparagraph id="H6923F05E337145928DC9C2B27B01761C"><enum>(B)</enum><text>reduce the magnitude or duration of a disruptive event, and</text></subparagraph><subparagraph id="H6ECCD7DF260743B880DCC145C7EF6F04"><enum>(C)</enum><text>have the absorptive capacity, adaptive capacity, and recoverability to withstand a potentially disruptive event. </text></subparagraph></paragraph><paragraph id="HCCB388FB4D654AE8994B176D8D8C507F"><enum>(2)</enum><header>Treated as meeting resiliency requirements</header><text>For purposes of paragraph (1)—</text><subparagraph id="H39716BD3E3164890A76CA37803F68FE4"><enum>(A)</enum><text>in the case of a qualified commercial property, the property shall be treated as meeting the requirements specified in paragraph (1) if the property is a building which—</text><clause id="H4E61188E2D064622B08964A156EC73EA"><enum>(i)</enum><text>was designed to meet the requirements of the most recent International Building Code published by the International Code Council and meets the FORTIFIED Commercial Wind Standard published by the Insurance Institute for Business and Home Safety, or the most recent International Wildland Urban Interface Code published by the International Code Council, </text></clause><clause id="HB04F9E72FD6C406CA85890A08589F13A"><enum>(ii)</enum><text>in the case of a substantial renovation, such renovation meets the requirements of—</text><subclause id="H9066D8292B48494592F439DC11126790"><enum>(I)</enum><text>the most recent International Building Code published by the International Code Council and the FORTIFIED Commercial Wind Standard published by the Insurance Institute for Business and Home Safety, or</text></subclause><subclause id="H240E1BC0E42C444CBC50588F44EFF260"><enum>(II)</enum><text>the most recent International Wildland Urban Interface Code published by the International Code Council, or </text></subclause></clause><clause id="HE8644AC8E27A4018ADCA101815271E3A"><enum>(iii)</enum><text>in the case of a qualified commercial property in a high seismic hazard zone, was designed and built to achieve a reduction in the earthquake risks relative to code-designed buildings by minimizing building damage and promoting contingency planning for utility disruption and other threats to functional recovery that are described in the U.S. Resiliency Council Rating System with specific design criteria achieving the Platinum or Gold rating, and </text></clause></subparagraph><subparagraph id="H3691EEB001F8421DB054A8B8F5EC1288"><enum>(B)</enum><text>in the case of a qualified residential property, the property shall be treated as meeting the requirements specified in paragraph (1) if—</text><clause id="HB72C8C2B610C4C11AF846510219B8134"><enum>(i)</enum><text display-inline="yes-display-inline">the property is a building which—</text><subclause id="H55D244BF857749DAB60728E7DB809C57"><enum>(I)</enum><text>was designed to meet the requirements of the most recent International Residential Code published by the International Code Council, and received a FORTIFIED Roof, FORTIFIED Silver, or FORTIFIED Gold designation from the Insurance Institute for Business and Home Safety, or</text></subclause><subclause id="H8AE53353571F4BCE95310F4085D39807"><enum>(II)</enum><text>was designed to meet or exceed the requirements of the most recent Standard for Residential Construction in High-Wind Regions or International Wildland Urban Interface Code published by the International Code Council, or</text></subclause></clause><clause id="H426D4443006E44DD9964C75A51AA31DB"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a substantial renovation, such renovation meets—</text><subclause id="H41C5D7B0D9194D10B8BE2DB43349741B"><enum>(I)</enum><text>the requirements of the most recent International Residential Code published by the International Code Council and the requirements of the FORTIFIED Roof Standards published by the Insurance Institute for Business and Home Safety, or</text></subclause><subclause id="HD4A31ED6D08F4E34AE5638D7FFDDDD4D"><enum>(II)</enum><text>the requirements of the most recent Standard for Residential Construction in High-Wind Regions or International Wildland Urban Interface Code published by the International Code Council.</text></subclause></clause></subparagraph></paragraph><paragraph id="H421EF4ABFE5146718ACF24BDD27EBF00"><enum>(3)</enum><header>Absorptive capacity</header><text>The term <term>absorptive capacity</term> means the ability of the construction to endure a disruption without significant deviation from normal operating performance. </text></paragraph><paragraph id="HE2839F52352A4E3E8627CF9B9926BAEB"><enum>(4)</enum><header>Adaptive capacity</header><text>The term <term>adaptive capacity</term> means the ability of the construction to adapt to a drastic change in normal operating conditions. </text></paragraph><paragraph id="H55FA22056C774EA59E89CB84D9B515E1"><enum>(5)</enum><header>Recoverability</header><text>The term <term>re­cov­er­a­bil­ity</term> means the ability of the construction to recover quickly, and at low cost, from potentially disruptive events.</text></paragraph></subsection><subsection id="H3CDFF3F5DC294CE59FCE4AC58F03550A"><enum>(e)</enum><header>Other Definitions</header><text display-inline="yes-display-inline">For purposes of this section: </text><paragraph id="HAB52D3F95F8B4D6A8FA1AEF0CC6D9F54"><enum>(1)</enum><header>Construction</header><text>The term <term>construction</term> includes new construction and reconstruction and rehabilitation that meets resilient construction requirements.</text></paragraph><paragraph id="HC638022EAC4D4E0C9BDC5E9F9EABE66C"><enum>(2)</enum><header>Federally declared major disaster</header><text>The term <term>federally declared major disaster</term> means a disaster subsequently determined by the President to be a <quote>major disaster</quote> that warrants assistance by the Federal Government under the Robert T. Stafford Disaster Relief and Emergency Assistance Act. </text></paragraph><paragraph id="HFE678269ADE24812BD96EB9987BD4A39"><enum>(3)</enum><header>Disaster area</header><text>The term <term>disaster area</term> means the area so determined to warrant such assistance.</text></paragraph><paragraph id="H9A5D9290ED99426A9E9C6838346CDD4A"><enum>(4)</enum><header>Most recent editions</header><text display-inline="yes-display-inline">The term <quote>most recent</quote> means, with respect to relevant national consensus-based codes, and specifications and standards referenced therein, either of the two most recent published editions, including, if any, amendments made by State, local, tribal, or territorial governments during the adoption process, that incorporate the latest natural hazard-resistant designs and establish criteria for the design, construction, and maintenance of structures and facilities that may be eligible for assistance under this section for the purposes of protecting the health, safety, and general welfare of a building’s users against disasters.</text></paragraph></subsection><subsection id="H2BB3E23CF5894A819D2FC8DF188532E0"><enum>(f)</enum><header>Application With Other Credits</header><paragraph id="HEC661C7980424FE4A8EF9D8B8E201B53"><enum>(1)</enum><header>Business credit treated as part of general business credit</header><text display-inline="yes-display-inline">So much of the credit which would be allowed under subsection (a) for any taxable year (determined without regard to this subsection) that is attributable to property of a character subject to an allowance for depreciation shall be treated as a credit listed in section 38(b) for such taxable year (and not allowed under subsection (a)). </text></paragraph><paragraph id="H5F597504F1064C9F9981B4F2C3CE71EA"><enum>(2)</enum><header>Personal credit</header><text>For purposes of this title, the credit allowed under subsection (a) for any taxable year (determined after application of paragraph (1)) shall be treated as a credit allowable under subpart A for such taxable year. </text></paragraph></subsection><subsection id="H551CA34101394407BE2D4DEA953B6A44"><enum>(g)</enum><header>Basis Reduction</header><text>For purposes of this subtitle, the basis of any property for which a credit is allowable under subsection (a) shall be reduced by the amount of such credit so allowed.</text></subsection><subsection id="H57EEEC4FF7B04F7482B9F39A1E6AD95B"><enum>(h)</enum><header>Termination</header><text>This section shall not apply to any property for which a certificate for occupancy is issued after December 31, 2023.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H2132FB2605CB4B1996EE7852B2802988" commented="no"><enum>(b)</enum><header>Credit Made Part of General Business Credit</header><text>Section 38(b) of such Code is amended by striking <quote>plus</quote> at the end of paragraph (32), by striking the period at the end of paragraph (33) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H17B061619E40486A93A28D91082CFE5E" display-inline="no-display-inline"><paragraph id="HCFE2B8EEF47349DF861A5D3285274E7C" commented="no"><enum>(34)</enum><text display-inline="yes-display-inline">the portion of the disaster resilient property credit described in section 30E(f)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H62FAA20C75164374B38E8A850B682864" commented="no"><enum>(c)</enum><header>Basis adjustment</header><text display-inline="yes-display-inline">Section 1016(a) of such Code is amended by striking <quote>and</quote> at the end of paragraph (37), by striking the period at the end of paragraph (38) and inserting <quote>, and</quote>, and by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HF7FBD1D5E84242E79D549F0F5DB63093" display-inline="no-display-inline"><paragraph id="H7576F817071448E885EE08CB61BB1E46" commented="no"><enum>(39)</enum><text display-inline="yes-display-inline">to the extent provided in section 30E(g), in the case of amounts with respect to which a credit has been allowed under section 30E.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H373643E7731D4CFB977826AA9BD8EF00"><enum>(d)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections for subpart B of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 30D the following new item:</text><quoted-block style="OLC" id="H32458CF94A16420398D2464AC806D25D" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H4C3E5CFF07C34A5CB94DF52D5E45EBC9" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H11B995DE0BCC4F28B75D47D1FF74BD71" level="section">Sec. 30E. Disaster resilient property.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7913FB9C0C1F4AD2A21C43AAB82AEDAA"><enum>(e)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to property for which a certificate of occupancy is issued after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
