committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To take certain land located in San Diego County, California, into trust for the benefit of the Pala Band of Mission Indians, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H7F3C0EC1295845C09CB6FE0E235566E3" style="OLC"><section id="HDF04D8359FC848B1A0B0E7611BCCC3C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pala Band of Mission Indians Land Transfer Act of 2021</short-title></quote>.</text></section><section id="HB93206D5BE1E4FC9BFEB9C5555D75C72"><enum>2.</enum><header>Transfer of land in trust for the Pala Band of Mission Indians</header><subsection id="H760428F382844EE08656020088439363"><enum>(a)</enum><header>Transfer and administration</header><paragraph id="H86D9BC3BB2864C1DA124F9C82882DF4A"><enum>(1)</enum><header>Transfer of lands into trust</header><text>If, not later than 180 days after the date of the enactment of this Act, the Tribe transfers title to the land referred to in subsection (b) to the United States, the Secretary, not later than 180 days after such transfer, shall take that land into trust for the benefit of the Tribe.</text></paragraph><paragraph id="H738016FB54E84143816F78EF5D19FCE3"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">The land transferred under paragraph (1) shall be part of the Pala Indian Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for an Indian Tribe.</text></paragraph></subsection><subsection id="H489DA9A97E17432CA80622D7058000AE"><enum>(b)</enum><header>Land description</header><text display-inline="yes-display-inline">The land referred to in subsection (a)(1) is the approximately 721.12 acres of land located in San Diego County, California, generally depicted as <quote>Gregory Canyon Property Boundary</quote> on the map titled <quote>Pala Gregory Canyon Property Boundary and Parcels</quote>.</text></subsection><subsection id="H68BD242E20A9475AB61E41C1FEE72E49"><enum>(c)</enum><header>Rules of construction</header><text>Nothing in this Act shall—</text><paragraph id="HA6D46A0DC21B433D81A118A33992F815"><enum>(1)</enum><text>enlarge, impair, or otherwise affect any right or claim of the Tribe to any land or interest in land that is in existence before the date of the enactment of this Act;</text></paragraph><paragraph id="H111C2283EE6B46E78A49FB96AA6DBDCE"><enum>(2)</enum><text>affect any water right of the Tribe in existence before the date of the enactment of this Act; or</text></paragraph><paragraph id="H5E767066EBEC4E94ABEE5483D2B1DE5A"><enum>(3)</enum><text>terminate or limit any access in any way to any right-of-way or right-of-use issued, granted, or permitted before the date of the enactment of this Act.</text></paragraph></subsection><subsection id="HDE3FFDE9E4DF4FBAB91FB5ACFE444E1F"><enum>(d)</enum><header>Restricted use of transferred lands</header><text>The Tribe may not conduct, on the land taken into trust for the Tribe pursuant to this Act, gaming activities—</text><paragraph id="H9DD4416BF56D40A4B343DB7320102215"><enum>(1)</enum><text>as a matter of claimed inherent authority; or</text></paragraph><paragraph id="H4778BB08FE25404B9F174900C644E22C"><enum>(2)</enum><text>under any Federal law, including the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>) and regulations promulgated by the Secretary or the National Indian Gaming Commission under that Act.</text></paragraph></subsection><subsection id="H160690B1C1C24D4AA520A80472EDE423"><enum>(e)</enum><header>Definitions</header><text>For the purposes of this section:</text><paragraph id="HA12BEB9D2E3D4C5C9F2A646A4AE41356"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HE140504FC8EB40309212AAE988264285"><enum>(2)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Pala Band of Mission Indians.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>November 1, 2021</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
