which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the establishment of a national standard for incorporating a passive identification ability into all firearms sold in the United States, and to require the reporting of lost or stolen firearms to the appropriate law enforcement authorities.</official-title></form><legis-body id="H021DC3B9215D47BEA9475CE3C8F9FC7D" style="OLC"><section id="H0ADAC969A7E440CBA1605A6A54C5820B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping the Iron Pipeline Act of 2021</short-title></quote>.</text></section><section id="HFC8BD67180C144C386DA7C62F526B725"><enum>2.</enum><header>Passive capability to identify lost and stolen firearms</header><subsection id="HF084253A600B40FE89FEA915CB0FA2AB"><enum>(a)</enum><header>Establishment of national standard</header><paragraph id="HDD725034DE544A2893CC98A7C56D59D1"><enum>(1)</enum><header>In general</header><text>The Attorney General shall, in consultation with the National Institute for Standards and Technology, establish in regulations a national standard for the incorporation of a passive identification capability into all firearms sold in the United States.</text></paragraph><paragraph id="HCC1A03C1C94748EBB134D44FA2899E3A"><enum>(2)</enum><header>Passive identification capability defined</header><text display-inline="yes-display-inline">In this section, the term <term>passive identification capability</term> means a technology that—</text><subparagraph id="HF9B3B88D48B84C0C9DBD929B141DCC69"><enum>(A)</enum><text>enables a firearm to be identified by a mobile or fixed reading device; and</text></subparagraph><subparagraph id="H1DCC47396CBA4996A82F99138B8C1B8D"><enum>(B)</enum><text>does not emit or broadcast an electronic signal or other information that would enable the firearm or its owner to be monitored or tracked.</text></subparagraph></paragraph><paragraph id="H064D55D1387C47769796C241B986378A"><enum>(3)</enum><header>Considerations</header><text>In developing the standard, the Attorney General shall give equal priority to the following:</text><subparagraph id="H1A1C74CA1D1E4BECB8F047F9013676AF"><enum>(A)</enum><text display-inline="yes-display-inline">The right of firearm owners to maintain their full right to privacy under the 4th Amendment and their right to legally own firearms under the 2nd Amendment.</text></subparagraph><subparagraph id="H894C09723BE84CEDB261D9C56518BB7F"><enum>(B)</enum><text>The ability of law enforcement authorities to use the capability to track lost and stolen guns.</text></subparagraph><subparagraph id="H63A77885EB8B4D8686CB28853973F588"><enum>(C)</enum><text>The ability of manufacturers to incorporate the capability using existing firearm manufacturing processes.</text></subparagraph><subparagraph id="HBB1BD0DC706B4EEA9B6675E6A4845115"><enum>(D)</enum><text display-inline="yes-display-inline">The resistance to tampering and destruction of the technology used to incorporate the capability.</text></subparagraph></paragraph></subsection><subsection id="H7D10B8894B9D4DA085DF728320D02B1E"><enum>(b)</enum><header>Prohibition; penalty</header><paragraph id="H0EB58F5524884954B12B06D81E295520"><enum>(1)</enum><header>Prohibition</header><text>It shall be unlawful for a person, in or affecting interstate or foreign commerce, to manufacture a firearm that does not have a passive identification capability that meets the national standard established under subsection (a).</text></paragraph><paragraph id="HC680B1BC7C8241B3B007A3CA61738355"><enum>(2)</enum><header>Civil penalty</header><text>After notice and opportunity for hearing, the Attorney General shall impose on a person who violates paragraph (1) a civil money penalty in such amount, not exceeding $2,500 per firearm, as the Attorney General shall prescribe in regulations.</text></paragraph><paragraph id="H911AD12642B9447D919B2B90E557D770"><enum>(3)</enum><header>Effective date</header><text>This subsection shall take effect on such date as the Attorney General shall prescribe in regulations that is not later than 3 years after the establishment of the national standard under subsection (a).</text></paragraph></subsection></section><section display-inline="no-display-inline" id="H48C921C07FF14B9FB0F90643889A0EEE" section-type="subsequent-section"><enum>3.</enum><header>Reporting of lost or stolen firearms to local law enforcement authorities</header><subsection id="HC162A7F3EA174568A8B8100D8B9F86AC"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H23B283A088D04E0F91D92042323D393A" style="OLC"><subsection id="H2B782CF482684B62A7AEBD83C0E370AD"><enum>(aa)</enum><text display-inline="yes-display-inline">Within 48 hours after a person who owns a firearm that has been shipped or transported in, or has been possessed in or affecting, interstate or foreign commerce, discovers or should have discovered the theft or loss of the firearm, the person shall report the theft or loss to local law enforcement authorities. To the best of the person’s ability, the person shall provide the following information, if known:</text><paragraph id="HC05666E0D14347C487400F5EF11EAD7E"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the firearm, including the make, model, manufacturer, caliber, and serial number of the firearm, and any other distinguishing number or identification mark on the firearm.</text></paragraph><paragraph id="H4A0CB2899D754706AAB5ECA2CFCFCFF9"><enum>(2)</enum><text>Whether the firearm is being reported lost or stolen.</text></paragraph><paragraph id="H94736E3F5F984126846903EEBC2E1D3B"><enum>(3)</enum><text>The date of the loss or theft.</text></paragraph><paragraph id="HF80EF0DBCF33438B8870091515C076FF"><enum>(4)</enum><text>The person’s name and address.</text></paragraph><paragraph id="H7C10971C73F146FA90EA9E22318A7AA1"><enum>(5)</enum><text>The location from which the firearm was lost or stolen.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H116ACF8C0B31438288E2D1D885FFAC38"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 924 of such title is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4713BE6CA73B4602BABE903A3DBFF1E6" style="OLC"><subsection id="H8D07CDABF38A44E9B369B850C930950B"><enum>(q)</enum><header>Penalties for failure To report loss or theft of firearm</header><text display-inline="yes-display-inline">Whoever violates section 922(aa) shall be fined $10,000, imprisoned not more than 1 year, or both, with respect to each firearm involved in the violation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H58E10E223D6C43AD9B0E1430CBFD7893"><enum>(c)</enum><header>Requirement that local law enforcement authorities report lost or stolen firearms to the national crime information center</header><text display-inline="yes-display-inline">Within 7 days after a local law enforcement authority receives a report that a firearm is lost or stolen, the authority shall transmit the report to the National Crime Information Center maintained by the Federal Bureau of Investigation.</text></subsection></section></legis-body></bill>
