R. 1950</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to provide for the temporary halt in pension payments for Members of Congress sentenced for certain offenses, and for other purposes.</official-title></form><legis-body id="HAB3948BCAE214166875FFC59B40F5D41" style="OLC"><section id="H06F2257ACE6045CD8A76BE2801D14A43" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Pensions for Corrupt Politicians Act of 2021</short-title></quote>.</text></section><section id="H9F5437B1BF00494B8CDA74D1DFD631C1"><enum>2.</enum><header>Forfeiture of pension</header><subsection id="H5F699CDDE769489F85541878B2CC61DE"><enum>(a)</enum><header>CSRS</header><text display-inline="yes-display-inline">Section 8332(o) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H49AFE3385B574F8C970A311B7A505807" style="USC"><paragraph id="HBAC8573E9C2B4C6A93A8C228861E01DC" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDA834A2901104B60AADEDE3CE6E584FB"><enum>(A)</enum><text display-inline="yes-display-inline">Subject to subparagraph (B), an individual convicted of an offense described in paragraph (2) shall not, between the date of sentencing and the date of final conviction for such offense, be eligible to receive any payment of an annuity pursuant to the retirement system under this subchapter, except that this sentence applies only to such payments based on service rendered as a Member (irrespective of when rendered).</text></subparagraph><subparagraph id="H68D37025CA244CF68FBDBCA9B82A9E27" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If the conviction of an individual described in subparagraph (A) is held to be invalid, such individual shall receive payments that such individual would have received but for application of subparagraph (A).</text></subparagraph><subparagraph id="H0E6757C3D1CC4E17B3E7418356406228" indent="up1"><enum>(C)</enum><text>The provisions of this paragraph only apply to a conviction that occurs after the date of enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H15D8079F4DB5464BA97D8C0C0FC77786"><enum>(b)</enum><header>FERS</header><text display-inline="yes-display-inline">Section 8411(l) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="HAC30FEF8B42748C4BAA6A2EB7BC4F699" display-inline="no-display-inline"><paragraph id="H298539FE6164433DA5C542AFD78D06B6"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDAD7A3050D384B56A49B95A101F7AF46"><enum>(A)</enum><text>Subject to subparagraph (B), an individual convicted of an offense described in paragraph (2) shall not, between the date of sentencing and the date of final conviction for such offense, be eligible to receive any payment of an annuity pursuant to the retirement system under this chapter, except that this sentence applies only to such payments based on service rendered as a Member (irrespective of when rendered).</text></subparagraph><subparagraph id="H16DE9A3391454E2883C0AB558DE0204D" indent="up1"><enum>(B)</enum><text>If the conviction of an individual described in subparagraph (A) is held to be invalid, such individual shall receive payments that such individual would have received but for application of subparagraph (A).</text></subparagraph><subparagraph id="H112B057D7AA84CEABC08843DBE10F6F5" indent="up1"><enum>(C)</enum><text>The provisions of this paragraph only apply to a conviction that occurs after the date of enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
