R. 1942</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="R000597">Mr. Rice of South Carolina</sponsor> (for himself and <cosponsor name-id="M000194">Ms. Mace</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To extend Federal recognition to the Waccamaw Indian People of Conway, South Carolina, and for other purposes.</official-title></form><legis-body id="H83A9681E54384DC599C71F1A4CD1E76A" style="OLC"><section id="HD2A12BF09A6540498452EDB219B1C310" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Waccamaw Indian Acknowledgement Act</short-title></quote>.</text></section><section id="H2C42BE5DF82049018175EF725B1DCDFE" section-type="subsequent-section"><enum>2.</enum><header>Federal recognition</header><subsection id="H1FE501205426427ABA4F65579A0B63A8"><enum>(a)</enum><header>Federal recognition</header><text>Federal recognition is extended to the Waccamaw Indian People of Conway, South Carolina.</text></subsection><subsection id="HCAD5E098CB6D401BA74151FA36E863BE"><enum>(b)</enum><header>Applicability of laws</header><text>All laws (including regulations) of the United States of general applicability to Indians or Nations, Indian Tribes, or bands of Indians (including the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461</external-xref> et seq.)) shall be applicable to the Waccamaw Indian People of Conway, South Carolina, and members of that Tribe.</text></subsection></section><section id="HBEF2C8B271DD4474A8AABD5F1EFBE0CB"><enum>3.</enum><header>Federal services and benefits</header><subsection id="H2E6EB959AB32425EA4C9463E61806E8C"><enum>(a)</enum><header>In general</header><text>Beginning on the date of the enactment of this Act, the Tribe and each member shall be eligible for all services and benefits provided by the United States to Indians and federally recognized Indian tribes, without regard to—</text><paragraph id="HDDFACFB6DAB54DC0A8D2AF24DB661CC9"><enum>(1)</enum><text>the existence of a reservation for the Tribe; or</text></paragraph><paragraph id="HD47DD3776E5B40E88C477FE31DB04DD9"><enum>(2)</enum><text>the location of the residence of any member on or near an Indian reservation.</text></paragraph></subsection><subsection id="H48CD7E03BCC84BF28C13F30271F2C59A"><enum>(b)</enum><header>Service area</header><text display-inline="yes-display-inline">For purposes of the delivery of services and benefits to members, the service area of the Tribe shall be considered to be the area comprised of Horry County in the State of South Carolina.</text></subsection></section><section id="HDC97D33B74574C0DB2B7750B0E4A2A79"><enum>4.</enum><header>Membership roll</header><subsection id="H585A057523D64D5890D99B1CE9BF840B"><enum>(a)</enum><header>In general</header><text>As a condition of receiving recognition, services, and benefits pursuant to this Act, the Tribe shall submit to the Secretary, by not later than 18 months after the date of the enactment of this Act, a membership roll consisting of the name of each individual enrolled as a member of the Tribe.</text></subsection><subsection id="H6CF575AD7AF6403093640858152D5AF8"><enum>(b)</enum><header>Determination of membership</header><text display-inline="yes-display-inline">The qualifications for inclusion on the membership roll of the Tribe shall be determined in accordance with section A of article IV of the proposed constitution of the Tribe dated September 8, 2016 (including amendments to the constitution).</text></subsection><subsection id="H34F6C9EF307E43118D0990AF13DEC611"><enum>(c)</enum><header>Maintenance of roll</header><text>The Tribe shall maintain the membership roll under this section.</text></subsection></section><section id="HAF00935D46F24357949090D409F3D95F"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text><paragraph id="HA275A71490EE424D8EEECDF5A65D064E"><enum>(1)</enum><header>Member</header><text>The term <term>member</term> means an individual duly enrolled in the roll of the Tribe described in section 4.</text></paragraph><paragraph id="HB533BD7109B04B66AC0CD260A5D7C508"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H62B692109B9D4148B7A6EA780EA39E23"><enum>(3)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Waccamaw Indian People of South Carolina.</text></paragraph></section></legis-body></bill>
