App.) is amended—</text><paragraph id="H33B43445BC3044A2BB3AB077D72E2967"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text>MEMBERSHIP;</header-in-text></quote> after <quote><header-in-text>ADVISORY COMMITTEES;</header-in-text></quote>;</text></paragraph><paragraph id="HB2B8BFB7A36F4FE6884B35E0E62EBE36"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (e) and (f), respectively; and</text></paragraph><paragraph id="HD305C194E3AC481AB462F739E2B4F66E"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block id="H7942F856DED84CF8832969F6D3FB39EF" style="OLC"><subsection id="HE9C1D0173D454820A6585A4638D883F3"><enum>(b)</enum><header>Appointments made without regard to political affiliation or activity</header><text>All appointments to advisory committees shall be made without regard to political affiliation or political campaign activity, unless required by Federal statute.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBE7E0BF81F164400BA39F6E6FD4AE05F"><enum>(b)</enum><header>Minimizing conflicts of interest</header><text>Section 9 of the Federal Advisory Committee Act (5 U.S.C. App.), as amended by subsection (a) of this section, is further amended by inserting after subsection (b) (as added by such subsection (a)) the following:</text><quoted-block id="H4B10BDDE327D4CC38ABB1DFF398EE241" style="OLC"><subsection commented="no" id="H5EEA129D86834D2E92685992935CC540"><enum>(c)</enum><header>Public nominations of committee members</header><paragraph commented="no" id="HA9D9698DC7554DA6ABB4C8D17ECB74D2"><enum>(1)</enum><text>Before making an appointment to an advisory committee, the head of an agency shall—</text><subparagraph commented="no" id="H18DBEEFE986940A19FED3F242E76B1C4"><enum>(A)</enum><text>solicit nominations for potential committee members;</text></subparagraph><subparagraph commented="no" id="H3FE04499F0EF4577B9A39193BDBBBDF9"><enum>(B)</enum><text>if the head of the agency is required to publish a notice under subsection (a)(2), include in the notice a solicitation for nominations of potential committee members; and</text></subparagraph><subparagraph commented="no" id="HC69E221A8006455FBAC86870BD3052DF"><enum>(C)</enum><text>provide in the notice under subparagraph (B) a mechanism for interested persons to comment through a publicly available website of the agency.</text></subparagraph></paragraph><paragraph commented="no" id="H4336E10F71CA4F6489178205153635C4"><enum>(2)</enum><text>The head of an agency shall consider any comments submitted in accordance with paragraph (1)(C) in appointing the members of an advisory committee.</text></paragraph><paragraph commented="no" id="H42333E93E2694FD08346E6609A7D6DBA"><enum>(3)</enum><text>The head of an agency shall solicit nominations under paragraph (1) not less frequently than once every 2 years.</text></paragraph><paragraph commented="no" id="H8BBC47C31B204C1CB12B92FE8550EAEF"><enum>(4)</enum><text>Notwithstanding paragraph (1), if a vacancy in an advisory committee occurs before the next scheduled solicitation for nominations under this subsection, an agency may appoint a member from among individuals that were previously nominated to be a member of the advisory committee.</text></paragraph></subsection><subsection id="H3109D0538CC54A6499790E46CE99898A"><enum>(d)</enum><header>Designation of committee members</header><paragraph id="HC8884D18D4F84099B31B2F3008AE6B1F"><enum>(1)</enum><text>An individual appointed to an advisory committee who is not a full-time or permanent part-time officer or employee of the Federal Government shall be designated as—</text><subparagraph id="H715318F84BBD4C7C9CF647F6852930AD"><enum>(A)</enum><text>a special Government employee, if the individual is providing advice based on the individual’s expertise or experience; or</text></subparagraph><subparagraph id="HC95B1B2E95DE4BA5951D58F0C87E9070"><enum>(B)</enum><text>a representative, if the individual is representing the views of an entity or entities outside of the Federal Government.</text></subparagraph></paragraph><paragraph id="H3C79845283C74F7190AAD46B86880A30"><enum>(2)</enum><text>An agency may not designate committee members as representatives to avoid subjecting them to Federal ethics rules and requirements.</text></paragraph><paragraph id="H4EE9ACF26BCD49A0BC4FAB7D93A0AA78"><enum>(3)</enum><text>The designated agency ethics official for each agency shall review the members of each advisory committee that reports to the agency to determine whether each member’s designation is appropriate, and to redesignate members if appropriate. The designated agency ethics official shall certify to the head of the agency that such review has been made—</text><subparagraph id="H6BCFDE74EC794D0AB530830994ECD441"><enum>(A)</enum><text>following the initial appointment of members; and</text></subparagraph><subparagraph id="HF370181F424B4762A163E8A58588AEF1"><enum>(B)</enum><text>at the time a committee’s charter is renewed, or, in the case of a committee with an indefinite charter, every 2 years.</text></subparagraph></paragraph><paragraph id="HC6084DAB9EFC4264953BF3ADCF44AD27"><enum>(4)</enum><text>The head of each agency shall inform each individual who is not a full-time or permanent part-time officer or employee of the Federal Government appointed to an advisory committee that reports to the agency whether the individual is appointed as a special Government employee or as a representative. The agency head shall provide each committee member with an explanation of the differences between special Government employees and representatives and a summary of applicable ethics requirements. The agency head, acting through the designated agency ethics official, shall obtain signed and dated written confirmation from each committee member that the member received and reviewed the information required by this paragraph.</text></paragraph><paragraph id="HDE1221561A7A41EEB613148FE709D7DF"><enum>(5)</enum><text>The Director of the Office of Government Ethics shall provide guidance to agencies on what to include in the summary of ethics requirements required by paragraph (4).</text></paragraph><paragraph id="H555F3E57704B467E81E4031E206178DD"><enum>(6)</enum><text>The head of each agency shall, to the extent practicable, develop and implement strategies to minimize the need for written determinations under section 208(b)(3) of title 18, United States Code. Strategies may include such efforts as improving outreach efforts to potential committee members and seeking public input on potential committee members.</text></paragraph><paragraph id="HAE6D30BAFEF441639850A0A42A2E1BE8"><enum>(7)</enum><text>Nothing in this subsection shall be construed to supersede the inapplicability of this Act with respect to peer review groups appointed under paragraph (16) of section 402(b) of the Public Health Service Act, as described in the flush text following paragraph (25)(B) of such section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H95FD689994544E0BB16A7FC4E0F7BFCF"><enum>(c)</enum><header>Regulations implementing FACA</header><text>Section 7(c) of the Federal Advisory Committee Act (5 U.S.C. App.) is amended by inserting <quote>promulgate regulations and</quote> after <quote>The Administrator shall</quote>.</text></subsection><subsection id="HCDC70F4AD4A647599992BEAF0A8C5C08"><enum>(d)</enum><header>Ensuring independent advice and recommendations</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) is amended—</text><paragraph id="HA73AD71B52864B85AA4FB3EBDBAC2731"><enum>(1)</enum><text>in section 8—</text><subparagraph id="H184D272F394942D0A0707A3131AFF526"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text>INDEPENDENT ADVICE AND RECOMMENDATIONS;</header-in-text></quote> after <quote><header-in-text>RESPONSIBILITIES OF AGENCY HEADS;</header-in-text></quote>;</text></subparagraph><subparagraph id="H4A9220BC0F9B42E4A408BDB21EA6D7D2"><enum>(B)</enum><text>by redesignating subsection (b) as subsection (c); and</text></subparagraph><subparagraph id="H7E8B131516434C9584CB2B32E15F2A8A"><enum>(C)</enum><text>by inserting after subsection (a) the following:</text><quoted-block id="HD6B9579A11A848D7BF8C2F3C7BDE7687" style="OLC"><subsection id="H230B34497F884C7187E701A08B7A87F5"><enum>(b)</enum><text>The head of each agency shall ensure that the agency does not interfere with the free and independent participation, expression of views, and deliberation by committee members. Each advisory committee shall include a statement describing the process used by the advisory committee in formulating the advice and recommendations when they are transmitted to the agency.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFAB7037423F74F0386EBC9D2B0C85694"><enum>(2)</enum><text>in section 10—</text><subparagraph id="H1D0704AD79204699964F349B356216B2"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text>; CHAIR</header-in-text></quote> after <quote><header-in-text>ATTENDANCE</header-in-text></quote>; and</text></subparagraph><subparagraph id="HC58C5181225F41C0AE485943702B0E86"><enum>(B)</enum><text>by inserting after subsection (f) the following new subsection:</text><quoted-block id="HD9702B1F75FF484C9E143AD2648BFD8D" style="OLC"><subsection id="H782F1A4227BB45E19ECEDE52D2597D4A"><enum>(g)</enum><text>The chair shall not be an employee of the agency to which the advisory committee reports, unless—</text><paragraph id="H5E98212FBF8A4C8CA0477A74FA981A50"><enum>(1)</enum><text>a statute specifically authorizes selection of such an employee as the chair; or</text></paragraph><paragraph id="H7F5C0772939847D291A9E4447607028C"><enum>(2)</enum><text>the head of the agency directs an employee to serve as the chair.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="H3EF01062F1C344728B03A221BD30E7FC"><enum>3.</enum><header>Preventing efforts to circumvent the Federal Advisory Committee Act and public disclosure</header><subsection id="HFB6D947A80634E78B9554FD9D60F5537"><enum>(a)</enum><header>Subcommittees</header><text>Section 4 of the Federal Advisory Committee Act (5 U.S.C. App.) is amended by striking subsection (a) and inserting the following:</text><quoted-block id="H6D5F65D3A33742DEB23159596322F8E9" style="OLC"><subsection id="H21F094E9D8554DC29130348599A58292"><enum>(a)</enum><header>Application</header><text>The provisions of this Act or of any rule, order, or regulation promulgated under this Act shall apply to each advisory committee, including any subcommittee or subgroup thereof, except to the extent that any Act of Congress establishing any such advisory committee specifically provides otherwise. Any subcommittee or subgroup that reports to a parent committee established under section 9(a) is not required to comply with section 9(f).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7A9232E0DA864CF5A73F9381979C1489"><enum>(b)</enum><header>Committees created under contract</header><text>Section 3(2) of the Federal Advisory Committee Act (5 U.S.C. App.) is amended in the matter following subparagraph (C) by adding at the end the following: <quote>An advisory committee is considered to be established by an agency, agencies, or the President if it is formed, created, or organized under contract, other transactional authority, cooperative agreement, grant, or otherwise at the request or direction of an agency, agencies, or the President.</quote>.</text></subsection><subsection id="H94DF8FA511224DB0858A9E20CE7ABCA4"><enum>(c)</enum><header>Advisory committees containing special government employees</header><text>Section 4 of the Federal Advisory Committee Act (5 U.S.C. App.), as amended by subsections (a) and (b) of this section, is further amended by adding at the end the following new subsection:</text><quoted-block id="H1B7EF2BC5A3248628E194787D39DADC7" style="OLC"><subsection id="H917A904EF7D645AC83081A16FC7EA44E"><enum>(d)</enum><header>Special government employees</header><text>Committee members appointed as special Government employees shall not be considered full-time or permanent part-time officers or employees of the Federal Government for purposes of determining the applicability of this Act under section 3(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7FF37215D4C94F9B80FB3AD589D8EF9F"><enum>4.</enum><header>Increasing transparency of advisory committees</header><subsection id="HB922A05CBD5043DC8E9A5DE3C29ABE4A"><enum>(a)</enum><header>Information requirement</header><text>Section 11 of the Federal Advisory Committee Act (5 U.S.C. App.) is amended to read as follows:</text><quoted-block id="H63F3336A88944DB3A9446FE59B2786C7" style="OLC"><section id="HD4351535E635418BBAAE3018D0C898A6"><enum>11.</enum><header>Disclosure of information</header><subsection id="H4B4E162975CE47958386EF0AE8619061"><enum>(a)</enum><header>In general</header><text>With respect to each advisory committee, the head of the agency to which the advisory committee reports shall make publicly available in accordance with subsection (b) the following information:</text><paragraph id="HF773EDB626F442F69416567D6892A69A"><enum>(1)</enum><text>The charter of the advisory committee.</text></paragraph><paragraph id="H0F3D7E180F764CD4AE67951143810648"><enum>(2)</enum><text>A description of the process used to establish and appoint the members of the advisory committee, including the following:</text><subparagraph id="H558C7B6C15B644339A554945A93CBAE7"><enum>(A)</enum><text>The process for identifying prospective members.</text></subparagraph><subparagraph id="HAA1A85ABC2ED41CDABA9BA7BFECC8B7D"><enum>(B)</enum><text>The process of selecting members for balance of viewpoints or expertise.</text></subparagraph><subparagraph id="HDFC7C012F1F341EA92085657FDE8F005"><enum>(C)</enum><text>The reason each member was appointed to the committee.</text></subparagraph><subparagraph id="H24FFC83E6269449286D57E5CEEB8FEC7"><enum>(D)</enum><text>A justification of the need for representative members, if any.</text></subparagraph></paragraph><paragraph id="H66068B26DDF341CDA9C83290CD063A03"><enum>(3)</enum><text>A list of all current members, including, for each member, the following:</text><subparagraph id="HA2944284DCD3415A88A02ED6466A28C1"><enum>(A)</enum><text>The name of any person or entity that nominated the member.</text></subparagraph><subparagraph id="HB9741164EEF443CAA8CA5E26BABF9972"><enum>(B)</enum><text>Whether the member is—</text><clause id="H8AABBC401BD84D38979BA515EB30C8D1"><enum>(i)</enum><text>designated as a special Government employee;</text></clause><clause id="HCFF8F3D1545749A1B6AC65B6926AB3A7"><enum>(ii)</enum><text>a representative; or</text></clause><clause id="HC6F3FBBF75524E929FE023A9B67490A8"><enum>(iii)</enum><text>a full-time or permanent part-time officer or employee of the Federal Government.</text></clause></subparagraph><subparagraph id="H792DB52346874F5690584BCC41CB015E"><enum>(C)</enum><text>In the case of a representative, the individuals or entity whose viewpoint the member represents.</text></subparagraph></paragraph><paragraph id="HE23005EDC6704365AA25E61D74431FD5"><enum>(4)</enum><text>A list of all members designated as special Government employees for whom written certifications were made under section 208(b) of title 18, United States Code, a copy of each such certification, a summary description of the conflict necessitating the certification, and the reason for granting the certification.</text></paragraph><paragraph id="HE67F190D3B62415F8BB27F4D1F17D159"><enum>(5)</enum><text>Any recusal agreement made by a member or any recusal known to the agency that occurs during the course of a meeting or other work of the committee.</text></paragraph><paragraph id="H95860415D5784E858C7A6CD34BB5C0A8"><enum>(6)</enum><text>A summary of the process used by the advisory committee for making decisions.</text></paragraph><paragraph id="HCEF8C37F085B4DD68B596852E5650215"><enum>(7)</enum><text>Detailed minutes of all meetings of the committee and a description of committee efforts to make meetings accessible to the public using online technologies (such as video recordings) or other techniques (such as audio recordings).</text></paragraph><paragraph id="H011BBF6D5ED447F788E61F7108E0B53A"><enum>(8)</enum><text>Any written determination by the President or the head of the agency to which the advisory committee reports, pursuant to section 10(d), to close a meeting or any portion of a meeting and the reasons for such determination.</text></paragraph><paragraph id="HFC497ADEA85A4DE39933F1F1659BD90E"><enum>(9)</enum><text>Notices of future meetings of the committee.</text></paragraph><paragraph id="H66D9CF2940AA4B39AF0D0009019AEAA1"><enum>(10)</enum><text>Any additional information considered relevant by the head of the agency to which the advisory committee reports.</text></paragraph></subsection><subsection id="H1E3899DCD383498989B6602AE796071F"><enum>(b)</enum><header>Manner of disclosure</header><paragraph id="H9A7E3BE12DD84C1EBD1AFF455F0076E5"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the head of an agency shall make the information required to be disclosed under subsection (a) available electronically on a publicly available website of the agency and to the Administrator at least 15 calendar days before each meeting of an advisory committee. If the head of the agency determines that such timing is not practicable for any required information, such head shall make the information available as soon as practicable but no later than 48 hours before the next meeting of the committee. An agency may withhold from disclosure any information that would be exempt from disclosure under section 552 of title 5, United States Code.</text></paragraph><paragraph id="H60DBA161F4394A71B04A5A63B70780AD"><enum>(2)</enum><header>Website availability</header><text>The head of an agency shall make available electronically, on a publicly available website of the agency, detailed minutes and, to the extent available, a transcript or audio or video recording of each advisory committee meeting not later than 45 calendar days after such meeting.</text></paragraph><paragraph id="H0FDD2A76BA07497F9EDB1580B3783A37"><enum>(3)</enum><header>Grant reviews</header><text>In the case of grant reviews, disclosure of information required by subsection (a)(3) may be provided in the aggregate rather than by individual grant.</text></paragraph></subsection><subsection id="H976102015F244A3E803C56BB40F4C29D"><enum>(c)</enum><header>Provision of information by administrator of general services</header><text>The Administrator of General Services shall provide, on a publicly available website of the General Services Administration, electronic access to the information made available by each agency under this section.</text></subsection><subsection id="H22ACAACBAA4D442E9B8D329817C53414"><enum>(d)</enum><header>Availability of meeting materials</header><paragraph id="HCF39BC8CD12C42FD89962832D7A3F39B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) and where prohibited by contractual agreements entered into prior to the effective date of the Federal Advisory Committee Act Amendments of 2021, agencies and advisory committees shall make available to any person, at actual cost of duplication, copies of advisory committee meeting materials.</text></paragraph><paragraph id="H93382889882947FA96CC5894E8ECB2EE"><enum>(2)</enum><header>Applicability</header><text>Nothing in this subsection shall be construed to require the disclosure of information that is protected from mandatory disclosure by statute.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAF1AC41C881447C8B5ACA0678FC22ED4"><enum>(b)</enum><header>Charter filing</header><text>Subsection (f) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /9">section 9</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.), as redesignated by section 2(a) of this Act, is amended to read as follows:</text><quoted-block id="H220DAC3C7AD643598111C674C20CC48D" style="OLC"><subsection id="H3A5F10B14726461E88CA6EA84A978CA9"><enum>(f)</enum><text>No advisory committee shall meet or take any action until an advisory committee charter has been filed with the Administrator, the head of the agency to whom any advisory committee reports, and the standing committees of the Senate and of the House of Representatives having legislative jurisdiction of such agency. Such charter shall contain the following information in the following order:</text><paragraph id="HD581192E00014093A048C6FE3C3D40BA"><enum>(1)</enum><text>The committee’s official designation.</text></paragraph><paragraph id="H87CF591DBA7840948F45E3876506C3CB"><enum>(2)</enum><text>The authority under which the committee is established.</text></paragraph><paragraph id="HF93DDD015BDA479EA12F2BDA36A0B3BC"><enum>(3)</enum><text>The committee’s objectives and the scope of its activity.</text></paragraph><paragraph id="H8CF93388FDEC4D9599FA1ADE58AB7B5B"><enum>(4)</enum><text>A description of the duties for which the committee is responsible, and, if such duties are not solely advisory, a specification of the authority for such functions.</text></paragraph><paragraph id="H0166EE6E4FB248B891BA45E59B262E40"><enum>(5)</enum><text>The agency or official to whom the committee reports.</text></paragraph><paragraph id="HBFBE0499F0C544E4AA69A1990E1DEBB5"><enum>(6)</enum><text>The agency responsible for providing the necessary support for the committee.</text></paragraph><paragraph id="HC0D8812DCA204B89B19B4470667215B4"><enum>(7)</enum><text>The responsibilities of the officer or employee of the Federal Government designated under section 10(e).</text></paragraph><paragraph id="H8F66599A83914D2094F1CBBBB0F2619D"><enum>(8)</enum><text>The estimated number and frequency of committee meetings.</text></paragraph><paragraph id="HD4718A7DE365476E974ACDB508D98FDB"><enum>(9)</enum><text>The period of time necessary for the committee to carry out its purposes.</text></paragraph><paragraph id="HD79A58C62EB44E1F8088EAB7D942F51A"><enum>(10)</enum><text>The committee’s termination date, if less than 2 years from the date of the committee’s establishment.</text></paragraph><paragraph id="HE9975F92C1CC4716B91F60CD9B43429A"><enum>(11)</enum><text>The estimated number of members and a description of the expertise needed to carry out the objectives of the committee.</text></paragraph><paragraph id="H0AFC0FB935B7455AAEF9978CA5EF7935"><enum>(12)</enum><text>A description of whether the committee will be composed of full- or part-time Government employees, special Government employees, representatives, or a combination of categories.</text></paragraph><paragraph id="H201AC8BC877B413B8215823853F2B089"><enum>(13)</enum><text>Whether the agency intends to create subcommittees and if so, the agency official authorized to exercise such authority.</text></paragraph><paragraph id="HB04F7A73792145298A6DF0509DF83E5B"><enum>(14)</enum><text>The estimated annual operating costs in dollars and full-time equivalent positions for such committee.</text></paragraph><paragraph id="H8A1DD0A6994E4059A978F047393C68D3"><enum>(15)</enum><text>The recordkeeping requirements of the committee.</text></paragraph><paragraph id="H57DC48EAE6E24F23B50E17CBEA9CE9BA"><enum>(16)</enum><text>The date the charter is filed.</text></paragraph><continuation-text continuation-text-level="subsection">A copy of any such charter shall also be furnished to the Library of Congress.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H966DE005549F4764A26B39D18DA61057"><enum>5.</enum><header>Managing Federal advisory committees</header><subsection id="HF408942F68B841809BA13A5C91AE609F"><enum>(a)</enum><header>Committee management officers</header><text>Subsection (c) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /8">section 8</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.), as redesignated by section 2(d) of this Act, is amended to read as follows:</text><quoted-block id="H2D7A36D75349472DB721AF5D5060F20E" style="OLC"><subsection id="HE420753C68224C61B72482B9F195A654"><enum>(c)</enum><text>The head of each agency that has an advisory committee shall designate an Advisory Committee Management Officer who shall—</text><paragraph id="H55F6E6E0D9704510BE7A1AFAA20D5AE6"><enum>(1)</enum><text>be a senior official who is—</text><subparagraph id="H3F66DF6B689A4580900148E07A9532FA"><enum>(A)</enum><text>an expert in implementing the requirements of this Act and regulations promulgated pursuant to this Act; and</text></subparagraph><subparagraph id="H1143E0CCD95540DEB798058E7C6581F4"><enum>(B)</enum><text>the primary point of contact for the General Services Administration;</text></subparagraph></paragraph><paragraph id="H1C34906F39BE46A4B78D6A7A2110FDDB"><enum>(2)</enum><text>ensure the establishment, management, and supervision of the advisory committees of the agency, including establishing procedures, performance measures, and outcomes for such committees;</text></paragraph><paragraph id="HC867C2FF5B5A46D7A17D1E493F4302A9"><enum>(3)</enum><text>ensure the assembly and maintenance of the reports, records, and other papers (including advisory committee meeting materials) of any such committee during its existence;</text></paragraph><paragraph id="H19A86124B83440B1A0C4F6AC465828DE"><enum>(4)</enum><text>ensure any such committee and corresponding agency staff adhere to the provisions of this Act and any regulations promulgated pursuant to this Act;</text></paragraph><paragraph id="HC88D6A53EEB74FE985EB4CD03B4E22C7"><enum>(5)</enum><text>ensure the maintenance of records on each employee of any such committee and completion of training required for any such employee;</text></paragraph><paragraph id="H4B9F6A2E89F847FCB706D4DB16EA9C1B"><enum>(6)</enum><text>be responsible for providing the information required in section 7(b) of this Act to the Administrator; and</text></paragraph><paragraph id="H4373FA28F70E4CCE87DF894DC6BDA406"><enum>(7)</enum><text>carry out, on behalf of that agency, the provisions of section 552 of title 5, United States Code, with respect to the reports, records, and other papers described in paragraph (3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2CC245D83EFE4612995725AF7D06EF0A"><enum>6.</enum><header>Comptroller General review and reports</header><subsection id="HC9A66EA914FA4006869A9B99815FA09E"><enum>(a)</enum><header>Review</header><text>The Comptroller General of the United States shall review compliance by agencies with the Federal Advisory Committee Act, as amended by this Act, including whether agencies are appropriately appointing advisory committee members who are not full-time or permanent part-time officers or employees of the Federal Government as either special Government employees or representatives.</text></subsection><subsection id="HF42D8CE3E0F94579BB2D99F9A5143498"><enum>(b)</enum><header>Report</header><text>The Comptroller General shall submit to the committees described in subsection (c) two reports on the results of the review, as follows:</text><paragraph id="HA1CEE404571D4D4B9B16358DCA98752B"><enum>(1)</enum><text>The first report shall be submitted not later than 1 year after the date of promulgation of regulations under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /7">section 7(c)</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.), as amended by section 2(c).</text></paragraph><paragraph id="H73E009FB7A4F4F8E9D033E97E2EC7C8C"><enum>(2)</enum><text>The second report shall be submitted not later than 5 years after such date of promulgation of regulations.</text></paragraph></subsection><subsection id="H22AE5B0663B44232B63AD860BB159D98"><enum>(c)</enum><header>Committees</header><text>The committees described in this subsection are the Committee on Oversight and Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subsection></section><section id="HDD5E5AF210E74EE586B787B3A36E9F31"><enum>7.</enum><header>Application of Federal Advisory Committee Act to trade advisory committees</header><text display-inline="no-display-inline">Section 135(f)(2)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155(f)(2)(A)</external-xref>) is amended by striking <quote>subsections (a) and (b) of sections 10 and 11 of the Federal Advisory Committee Act</quote> and inserting <quote>subsections (a) and (b) of section 10 and subsections (a)(7), (a)(8), (a)(9), (b)(2), and (d) of section 11 of the Federal Advisory Committee Act</quote>.</text></section><section id="HF81E77AC3AD74487AECC52D1BE85BA50"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Federal Advisory Committee Act (5 U.S.C. App.) is amended by adding at the end the following new paragraph:</text><quoted-block id="HCD3EB07757294ED590CC9B98071E2B8E" style="OLC"><paragraph id="H170D96ECC27445D09A916DC4776BDF1D"><enum>(5)</enum><text>The term <term>special Government employee</term> has the meaning given that term in section 202(a) of title 18, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCFC7CBBCC802411DA2E9BE380DC2FCD3"><enum>9.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">Section 7(d)(1) of the Federal Advisory Committee Act (5 U.S.C. App.) is amended—</text><paragraph id="H766839B6DC0046A3BF73AE6E2C836CA1"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>the rate specified for GS–18 of the General Schedule under section 5332</quote> and inserting <quote>the rate for level IV of the Executive Schedule under section 5315</quote>; and</text></paragraph><paragraph id="HA2A131DB7C0E4660AA1D922D8C11CC11"><enum>(2)</enum><text>in subparagraph (C)(i), by striking <quote>handicapped individuals (within the meaning of section 501 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>))</quote> and inserting <quote>individuals with disabilities (as defined in section 7(20) of the Rehabilitation Act of 1973)</quote>.</text></paragraph></section><section id="H100A9ABF47D44C27BB89A6051953052A"><enum>10.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect 30 days after the date of the enactment of this Act.</text></section><section id="HF002BCE687564987AB7EB89C3622E0E8"><enum>11.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to carry out the requirements of this Act and the amendments made by this Act. Such requirements shall be carried out using amounts otherwise authorized.</text></section><section commented="no" id="H9B34BB975FE840B7BE61C71FBB53733E"><enum>12.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
