R. 1928</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="L000582">Mr. Lieu</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to protect students from sexual abuse, and for other purposes.</official-title></form><legis-body id="H2260A025015D49DCA7CADCBBDBA7970F" style="OLC"><section id="H1CFC57733620418A99BF90E556B88999" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Preventing Sexual Abuse of K–12 Students Act of 2021</short-title></quote>.</text></section><section id="H7F0A185237D14532828AC8421DEFCFF7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H9DA2D9E788804FF0AFB03205B5140BED"><enum>(1)</enum><text display-inline="yes-display-inline">Child sexual abuse victims are at greater risk of experiencing feelings of guilt and shame, suffering from low self-esteem, and developing substance abuse symptoms, depression, and post-traumatic stress disorder.</text></paragraph><paragraph id="H407E1871F02241ADA7F8414827C98189"><enum>(2)</enum><text>A 2004 study by the Department of Education indicated that 9.6 percent of students in secondary schools reported that they had been subjected to sexual misconduct by school personnel.</text></paragraph><paragraph id="HDC80F995B228437C9C09291F23DFD3E6"><enum>(3)</enum><text>A 2014 report by the Government Accountability Office revealed that only 42 States had codes of conduct for school personnel of which only 22 dealt with appropriate relationships between personnel and students.</text></paragraph><paragraph id="H7C5BB8DE763149AEA71CD4FDD3847EE4"><enum>(4)</enum><text>Such 2014 report by GAO also revealed that only 18 States mandated that school districts provide sexual abuse and misconduct awareness and prevention training.</text></paragraph><paragraph id="HFBA48370E92B463F931063828D4B3811"><enum>(5)</enum><text>Title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681</external-xref> et seq.), which prohibits sex discrimination in education programs or activities receiving federal funds, requires elementary and secondary schools to protect students from sexual abuse and misconduct.</text></paragraph><paragraph id="H79FEEB1968784404A165F111A95096F5"><enum>(6)</enum><text display-inline="yes-display-inline">Educators are dedicated and tireless individuals serving our communities and they make invaluable contributions to our country by preparing students for the future. They work to provide children with safe and secure environments in which to learn and these safe environments should be strengthened by including the resources and training necessary to help prevent the sexual abuse of students.</text></paragraph><paragraph id="H5A7489BB948C44AAAF97D56816D0FD09"><enum>(7)</enum><text>It is in the interest of the United States to protect students in elementary and secondary schools from sexual abuse and misconduct.</text></paragraph></section><section id="HE8AE7D03598A49B2876EF8D01FCF57C1"><enum>3.</enum><header>Sexual abuse awareness training</header><subsection id="H47FEFDDE66FC4AF8860DD0FDC162755A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9F64447371AD490DAD5AC56E07A0305F" style="OLC"><section id="H8AC104CABB844EEDB75D06588527A284"><enum>8549D.</enum><header>Sexual abuse awareness training</header><text display-inline="no-display-inline">Each State receiving funds under this Act shall establish and implement a statewide policy requiring each local educational agency to—</text><paragraph id="H829FB1120CF04A96AC1DBB19D3F583A3"><enum>(1)</enum><text>develop codes of conduct to prevent sexual abuse of students by identifying acceptable and unacceptable behavior for—</text><subparagraph id="HC4ECCD84270A489B9FBB53A2D28D15D8"><enum>(A)</enum><text>school personnel with respect to relationships with students; and</text></subparagraph><subparagraph id="HABE1DB5A88F24090A25B6E49D4B0E5BC"><enum>(B)</enum><text>students with respect to relationships with other students; and</text></subparagraph></paragraph><paragraph id="HABFCB96B1AC442E29E42E4F7CA8508B6"><enum>(2)</enum><text>ensure that school personnel receive training on—</text><subparagraph id="HE87A7E0CF14F4E1090A9538DBEA6F772"><enum>(A)</enum><text>the codes of conduct described in paragraph (1);</text></subparagraph><subparagraph commented="no" id="HE9CE438FC0004D4BAEA949522C435A62"><enum>(B)</enum><text>Federal and State requirements with respect to reporting child abuse;</text></subparagraph><subparagraph id="H29AA5BD92D184948A717A0DDE9AC860C"><enum>(C)</enum><text display-inline="yes-display-inline">the requirements under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681</external-xref> et seq.) with respect to the protecting students in elementary and secondary schools from sexual abuse and misconduct; and</text></subparagraph><subparagraph id="H4C4D7D4CA9C242E0BCABFA3056821C8C"><enum>(D)</enum><text>sexual abuse and misconduct awareness and prevention.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7964AC1A73734FE4B188FF42E44EBA6C"><enum>(b)</enum><header>Funding</header><paragraph id="HB224D9D896144E469F48D0510227A9DC"><enum>(1)</enum><header>Grants for State assessments</header><text display-inline="yes-display-inline">Section 1201(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6361">20 U.S.C. 6361(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7924A2D625F14DBC95366823F4E1E949" style="OLC"><paragraph id="HC2CF0597791C4AAF85F4AF5A9A10771F"><enum>(3)</enum><text display-inline="yes-display-inline">To carry out sexual abuse awareness training under section 8549D.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H0CFD8BB69B1F48C0B448A054E807E62E"><enum>(2)</enum><header>Types of State activities</header><text display-inline="yes-display-inline">Section 2101(c)(4)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611(c)(4)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5B64AA4F563E4CAB8B12A11106A9C3F2" style="OLC"><clause id="H0E37EDFD2D12456D924BAA1C34571BC5"><enum>(xxii)</enum><text display-inline="yes-display-inline">To carry out sexual abuse awareness training under section 8549D.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBE8305FA13C840A0A1E3FB426FF0D93D"><enum>(3)</enum><header>Local uses of funds</header><text display-inline="yes-display-inline">Section 2103(b)(3)(L) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613(b)(3)(L)</external-xref>) is amended by inserting <quote>and carry out sexual abuse awareness training under section 8549D</quote> before the semicolon.</text></paragraph><paragraph id="HD1ACE90980794C568146D457C4C9E394"><enum>(4)</enum><header>Student support and academic enrichment grants</header><text display-inline="yes-display-inline">Section 4108(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7118">20 U.S.C. 7118(5)</external-xref>) is amended—</text><subparagraph id="HD9A100BDDF7A4C9CBF18023A9518B2F9"><enum>(A)</enum><text>in subparagraph (H)(iii), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HD8F0E6D1A36A47E5A84A77AD588D296F"><enum>(B)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HD813D9A8E67A46BA9D6DBDFCEB6FE558"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5106610821D245E6848A7B6E1B1E2F58" style="OLC"><subparagraph id="id1C9F7181978345E9AC4D51724EFBE37C" indent="up1"><enum>(J)</enum><text display-inline="yes-display-inline">to carry out sexual abuse awareness training under section 8549D.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HDA8D3FC046B64DD8A8C3BE0DBFE5A68A"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 2 years after the date of the enactment of this Act.</text></subsection></section><section commented="no" id="H18554F45C80A41B1B7970CA618E0D47F"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Education shall conduct a study and submit a report to Congress that includes—</text><paragraph id="HDC99957BC1CD487A85410C54029B8234"><enum>(1)</enum><text>the incidence of sexual abuse of elementary and secondary school students by—</text><subparagraph id="HE490389CE16F45DF8D6C2EC924AF972C"><enum>(A)</enum><text>other students; and</text></subparagraph><subparagraph id="H9910F55894EF4FE281C03C60EB4D8149"><enum>(B)</enum><text>school personnel; and</text></subparagraph></paragraph><paragraph id="H2DA2B78547C04706BED3DC766EDB3DD0"><enum>(2)</enum><text>recommendations with respect to preventing the sexual abuse described in paragraph (1).</text></paragraph></section></legis-body></bill>
