Amendments to Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017.</toc-entry></toc></subsection></section><section id="HDEB56453B3F947068E9EEDEA38B6C429"><enum>2.</enum><header>Reauthorize appropriations for Merit Systems Protection Board</header><subsection id="H4ACB1F98AB6545A89995E2883C3F2E4F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 8(a) of the Whistleblower Protection Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/12">Public Law 101–12</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/5/5509">5 U.S.C. 5509</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H8BD8B9DEAAB54A42BC4502489625B3E5" style="OLC"><paragraph commented="no" id="H9C51E2EAAB9147739E89E1DE5E901A15"><enum>(1)</enum><text display-inline="yes-display-inline">for each of fiscal years 2022, 2023, 2024, 2025, and 2026—</text><subparagraph id="HEBBE3154263448ABBDB3983AF6CD0E5A"><enum>(A)</enum><text>$44,490,000 to carry out subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/12">chapter 12</external-xref> of title 5, United States Code (as amended by this Act); and</text></subparagraph><subparagraph id="H0143DDE6C6D14E718E0A65A0DBB77370"><enum>(B)</enum><text>not to exceed $2,345,000, to be transferred from the Civil Service Retirement and Disability Fund in amounts determined by the Merit Systems Protection Board, for administrative expenses to adjudicate retirement appeals; and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEFEB36170538497EAFE8E482A92E707E"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on October 1, 2021.</text></subsection></section><section id="HE0BDFC10D4B847889DF4CFB020645148"><enum>3.</enum><header>Filing fee for Merit Systems Protection Board claims and appeals</header><subsection id="H035074EF7D654B74987C23F5940084F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1204 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H904F05994A05413F806D1C3C884EC23E" style="USC"><subsection id="H9AA3BFA5D37C45039833960BF6F53A6B"><enum>(o)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB85D85113A1749F2BD6A1B4D6FBD6300"><enum>(1)</enum><text>The Board shall establish and collect a filing fee to be paid by any individual filing a claim or appeal with the Board under this title, or under any other law, rule, or regulation, consistent with the requirements of this subsection.</text></paragraph><paragraph id="HAE28253F764B4BEE9E719FF3943CA839" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The filing fee established under paragraph (1) may—</text><subparagraph id="HEECBF83692E04824A546916561DC6EBE"><enum>(A)</enum><text display-inline="yes-display-inline">not exceed the amount that is 50 percent of the fee required for filing a civil action in a United States district court;</text></subparagraph><subparagraph id="H1A2C65D07D664EA398DA5F3E6E86D682"><enum>(B)</enum><text>be adjusted from time to time as the Board considers appropriate; and</text></subparagraph><subparagraph commented="no" id="HE6C5C368021B4F2588D39A986DB2F7D4"><enum>(C)</enum><text display-inline="yes-display-inline">upon request of the individual filing the claim or appeal, be waived by the Board if the Board determines the fee would create undue hardship.</text></subparagraph></paragraph><paragraph id="H8953B428EA6B49A2981B94D43126BF22" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A filing fee shall not be required with respect to any action—</text><subparagraph id="H3575D60457CD4EED9FA1A21AA28F71B0"><enum>(A)</enum><text display-inline="yes-display-inline">brought by the Special Counsel under section 1214, 1215, or 1216; or</text></subparagraph><subparagraph id="HB938B4421279425EB2FA33E8B96321D1"><enum>(B)</enum><text display-inline="yes-display-inline">taken against an administrative law judge under section 7521.</text></subparagraph></paragraph><paragraph commented="no" id="HBD19B20BD3FB410ABBB2862B6CF3658C" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">A filing fee paid by an individual for an appeal or claim before the Board shall cover any subsequent filing by the individual with the Board during the litigation of that appeal or claim. Such fee shall be returned to the individual if the individual is the prevailing party.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection commented="no" id="HB1889F04DC4A48A5BE4130E50731A370"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Merit Systems Protection Board shall establish and collect the filing fee required under subsection (o) of section 1204 of title 5, United States Code, as added by subsection (a), not later than 1 year after the date of the enactment of this Act.</text></subsection><subsection id="HA689D28A60244359AB3D5732531DCCEC"><enum>(c)</enum><header>Application</header><text>The fee required under such subsection (o) shall apply to any claim or appeal filed with the Merit Systems Protection Board after the date the fee is established pursuant to subsection (b).</text></subsection></section><section id="H045D40FCE8DD4B31B04692E375964C91"><enum>4.</enum><header>Modification to procedures and authority of the Merit Systems Protection Board</header><subsection id="H7202E789BF764ED9A691F0F85C33A471"><enum>(a)</enum><header>Summary judgment</header><text display-inline="yes-display-inline">Section 7701 of title 5, United States Code, is amended—</text><paragraph id="HBBB75B0DF0D942AA8BE8EA049D4133E7"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>, except as provided in subsection (b)</quote> after <quote>kept</quote>; and</text></paragraph><paragraph id="H5203E1A4007945A98E5AB55C2711160E"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="H042533E05E5C4BC3A9F4BCE47CEC5A59"><enum>(A)</enum><text>by striking <quote>The Board may</quote> and inserting <quote>(A) The Board may</quote>;</text></subparagraph><subparagraph id="H37E061F6B90C4641BA6D4939F7EED02C"><enum>(B)</enum><text>by striking the second and third sentences; and</text></subparagraph><subparagraph id="HB336753CDDC9421AB30F9697ED3C78E7"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3B1759F0D3A74E448BAF3F0C5A64EBF6" style="USC"><subparagraph id="HA397468188B44BD7A78192128E9CE3A3" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The Board, an administrative law judge appointed by the Board under section 3105, and any officer or employee of the Board designated by the Board (as the case may be) shall make a decision after receipt of the written representations of the parties to the appeal and after opportunity for a hearing under subsection (a)(1) of this section, except as provided under subparagraph (C).</text></subparagraph><subparagraph id="HA875906DCA0C4B6E9951F157726EA71C" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Board, an administrative law judge appointed by the Board under section 3105, and any officer or employee of the Board designated by the Board (as the case may be) may, with respect to any party, grant a motion for summary judgment. Any hearing under subsection (a)(1) of this section shall be limited to the issues remaining in the case, or, if applicable, a decision may be issued without holding a hearing.</text></subparagraph><subparagraph id="H24A50E371D424EAABD020F5212C87057" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">A copy of the decision under subparagraph (B) or (C) shall be furnished to each party to the appeal and to the Office of Personnel Management.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HAF056FF559D14D939D79E74A2B006E40"><enum>(b)</enum><header>Limit on mitigation</header><text>Paragraph (3) of section 7701(b) of title 5, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HA8989C68391D4FEAA2159B8CBCFF6225" style="USC"><paragraph id="HE5C2DEA118EC44CEB73D861FEE24E7AE" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">With respect to an appeal from a performance or conduct-based adverse action under subchapter II or V of chapter 75, the Board may not mitigate the personnel action involved unless the action is so disproportionate as to be wholly without justification.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC75883E3BD274A38AFDE6ED1EF4671FC"><enum>(c)</enum><header>Evidentiary burden</header><text display-inline="yes-display-inline">Paragraph (1) of section 7701(c) of title 5, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HAC098B4CF19244BDB3E938A81A4695EF" style="USC"><paragraph id="HBFF0D8BA58484D0E896DF61887642C46" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), the decision of the agency shall be sustained under subsection (b) only if the agency’s decision is supported by substantial evidence.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H514D0F24BE0A4659AAB1C4D2963CCCDA"><enum>(d)</enum><header>Effective date; application</header><paragraph id="HC3229BD2ADAE4EE792E6D9B008A7495F"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></paragraph><paragraph commented="no" id="H97088E073796427B975E0E1CB08BA549"><enum>(2)</enum><header>Application</header><text>The amendments made by this section shall apply with respect to any appeal filed under section 7701 of title 5, United States Code, on or after the effective date in paragraph (1).</text></paragraph></subsection></section><section id="HDC5E174D229D42D1918696AAB5A83382"><enum>5.</enum><header>Limitation on furlough appeals to the Merit Systems Protection Board</header><subsection id="H73E48CFAE8C74386B71CDE21A02AC3B3"><enum>(a)</enum><header>In general</header><text>Section 3595a of title 5, United States Code, is amended—</text><paragraph id="H2041680F1F8C4E3F8EE3DFA8888B09CE"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HF73103D78BD544B98C3E9D81F5F8B7F0" style="USC"><subsection id="HDE0F371302E34500AA7DDF932C5DD189"><enum>(a)</enum><text display-inline="yes-display-inline">For the purposes of this section—</text><paragraph id="H0E3CCF7BE2DE4D7BAE455407818E56BF"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>furlough</quote> means the placement of a senior executive in a temporary status in which the senior executive has no duties and is not paid when the placement in such status is by reason of insufficient work or funds or for other nondisciplinary reasons; and</text></paragraph><paragraph id="H44651821AE2941098E85BD33C3DC640B"><enum>(2)</enum><text>the term <quote>emergency furlough</quote> has the meaning given that term in section 7501(3).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF2B1C99B146C469682F2A6AD1C86BB85"><enum>(2)</enum><text>in subsection (b), by adding after the period at the end the following: <quote>Such regulations shall provide for procedures for emergency furloughs for career appointees, consistent with the procedures promulgated by the Office under section 7504(b).</quote>; and</text></paragraph><paragraph id="HA5D0028800A34881898EC82FDD18F82B"><enum>(3)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HB00F11806A2B40DFB9D8F59646A714D3" style="USC"><subsection commented="no" id="H5F363B77816E475E9E50C599D651ECE7"><enum>(c)</enum><text display-inline="yes-display-inline">A career appointee who is furloughed in excess of 14 days is entitled to appeal to the Merit Systems Protection Board under section 7701. The previous sentence shall not apply to any emergency furlough.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H64180960FC1A4C469790017037EEE7FA"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to any furlough occurring on or after the date that is 90 days after the date of the enactment of this Act.</text></subsection></section><section id="H18D6C7EDA5404B9EA47132A2E52B7171"><enum>6.</enum><header>Reappointment of Merit Systems Protection Board members</header><text display-inline="no-display-inline">Subsection (c) of section 1202 of title 5, United States Code, is amended—</text><paragraph id="H5F110D8D3D6B4B19A75A9F6FE617CF41"><enum>(1)</enum><text>by striking <quote>may not be reappointed to any following term but</quote>; and</text></paragraph><paragraph id="H49987219949A4D7A9081D74E3B063CDA"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>, unless the member is reappointed</quote>.</text></paragraph></section><section commented="no" id="HDF49AC433005449FB12B35E74319EF9F"><enum>7.</enum><header>Amendments to Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017</header><subsection commented="no" id="HEB2B8BF9B15F410CB6B0DC634CB699CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 714 of title 38, United States Code, is amended—</text><paragraph commented="no" id="H04A503BE2676463FB813747C3C7AEC63"><enum>(1)</enum><text>in subsection (c)(4)(A), by striking <quote>, which shall refer such appeal to an administrative judge pursuant to section 7701(b)(1) of title 5</quote>; and</text></paragraph><paragraph commented="no" id="H11CFF30C12B844F99A4C35B4A83A61AF"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="H238E2EC23D564BA68D114C771010C64F"><enum>(A)</enum><text>by striking <quote>the administrative judge</quote> in each place it appears and inserting <quote>the Merit Systems Protection Board</quote>;</text></subparagraph><subparagraph commented="no" id="H8938011D355141B2B031F7615D989E98"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (3);</text></subparagraph><subparagraph commented="no" id="HE97EE1D0B84749689F04AE43AEA0B853"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) through (10) as paragraphs (3) through (9), respectively; and</text></subparagraph><subparagraph commented="no" id="H1891908875E64CC2B018C64D8D94AAA3"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (4), as redesignated by subparagraph (C), by striking <quote>paragraph (3)</quote> and inserting <quote>paragraph (1)</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H523FCB9B88F246DF815355CE34E18076"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to any appeal made under section 714(c)(4)(A) of title 38, United States Code, after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
