<legis-type>AN ACT</legis-type> 
<official-title display="yes">To modify eligibility requirements for certain hazard mitigation assistance programs, and for other purposes.</official-title>

<section id="H4B52DC8C2FFC41018756D60E5996E554" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hazard Eligibility and Local Projects Act</short-title></quote>.</text></section> <section id="H1C63EB6039304653AA4A97647C8956B5"><enum>2.</enum><header>Authority to begin implementation of acquisition and demolition assistance projects</header> <subsection id="H10D30C156BF34EBABDD5A3D041C3DE46"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H296C52208F7B48C98DD7CF1494B67B7D"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph> <paragraph id="H4B1B1858749B4C939A55FCD071FC17EE"><enum>(2)</enum><header>Covered project</header><text>The term <term>covered project</term> means a project that—</text>
<subparagraph id="H28AD38ED05F0434FA9E0A745219F9C34"><enum>(A)</enum><text>is an acquisition and demolition project for which an entity began implementation, including planning or construction, before or after requesting assistance for the project under a hazard mitigation assistance program; and</text></subparagraph> <subparagraph id="H4365055FA28A47F790050F9FAFA35FEE"><enum>(B)</enum><text>qualifies for a categorical exclusion under the National Environmental Policy Act of 1969 ( <external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="H60A12E6586644F8993E7D034ECCF528D"><enum>(3)</enum><header>Hazard mitigation assistance program</header><text>The term <term>hazard mitigation assistance program</term> means—</text> <subparagraph id="H82ECF88171974DFB8FBFB9BA71588C1E"><enum>(A)</enum><text>any grant program authorized under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>);</text></subparagraph>
<subparagraph id="HC9E4AC8F24A74E9CB06A4C245688EBD9"><enum>(B)</enum><text>the hazard mitigation grant program authorized under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>); and</text></subparagraph> <subparagraph id="H758146AA21BF4DCCA40629A74A275E93"><enum>(C)</enum><text>the flood mitigation assistance program authorized under section 1366 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="H824D257F08E4439ABE13B977B43A65E6"><enum>(b)</enum><header>Eligibility for assistance for covered projects</header>
<paragraph id="HA5466A0F17AE4D49BF9D941AD8A1F78B"><enum>(1)</enum><header>In general</header><text>An entity seeking assistance under a hazard mitigation assistance program may be eligible to receive that assistance for a covered project if—</text> <subparagraph id="H32078C91CF7D40BFA1EA3895A7EB9491"><enum>(A)</enum><text>the entity—</text>
<clause id="HF49DD8931A524508B0C04DEA6CA8CE10"><enum>(i)</enum><text>complies with all other eligibility requirements of the hazard mitigation assistance program for acquisition or demolition projects, including extinguishing all incompatible encumbrances; and</text></clause> <clause id="H2EFE1ADBBFE84695B20100C4FCA0796D"><enum>(ii)</enum><text>complies with all Federal requirements for the covered project; and</text></clause></subparagraph>
<subparagraph id="H3E5BE871EC3F46FAB4E8B2AC9541B4A4"><enum>(B)</enum><text>the Administrator determines that the covered project—</text> <clause id="HFF77FD1447644D63AAD7A428693EFBCD"><enum>(i)</enum><text>qualifies for a categorical exclusion under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></clause>
<clause id="H43AFE8ACAF424B6C9B413CE534AFD3DD"><enum>(ii)</enum><text>is compliant with applicable floodplain management and protection of wetland regulations and criteria; and</text></clause> <clause id="H56CB20D662E54FF7AF13BC2EC5BCC04E"><enum>(iii)</enum><text>does not require consultation under any other environmental or historic preservation law or regulation or involve any extraordinary circumstances.</text></clause></subparagraph></paragraph>
<paragraph id="HBBF2B40A2A7C4B30AB9A7F34C97ACC3B"><enum>(2)</enum><header>Costs incurred</header><text>An entity seeking assistance under a hazard mitigation assistance program shall be responsible for any project costs incurred by the entity for a covered project if the covered project is not awarded, or is determined to be ineligible for, assistance.</text></paragraph></subsection> <subsection id="H3F8E37E336F84F649848D9FA8828F99A"><enum>(c)</enum><header>Applicability</header><text>This Act shall apply to covered projects started on or after the date of enactment of this Act.</text></subsection>
<subsection id="HA70650841BB8483A87CF43CEAD0A2BFD"><enum>(d)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter for 3 years, the Administrator shall submit to Congress a report on use of the authority under this Act, including—</text> <paragraph id="HD8B497A4699E45BC8AF1E206311F569D"><enum>(1)</enum><text>how many applicants used the authority;</text></paragraph>
<paragraph id="H629B2F785C8740BDBEAAAFBF0E1851C9"><enum>(2)</enum><text>how many applicants using the authority successfully obtained a grant;</text></paragraph> <paragraph id="H4A9F623CE2724944A735BAE21978B475"><enum>(3)</enum><text>how many applicants were not able to successfully obtain a grant;</text></paragraph>
<paragraph id="H76131A62730E4737B138687ECED3565A"><enum>(4)</enum><text>the reasons applicants were not able to obtain a grant; and</text></paragraph> <paragraph id="H56E7EBADE92D4264A7C29D2FCF5A7DD1"><enum>(5)</enum><text>the extent to which applicants using the authority were able to comply with all necessary Federal environmental, historic preservation, and other related laws and regulations.</text></paragraph></subsection>
<subsection id="HB501B657E3674B17911E247623D087C3" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Termination</header><text>The authority provided under this Act shall cease to be effective on the date that is 3 years after the date of enactment of this Act. </text></subsection></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
