section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leave Ethanol Volumes at Existing Levels Act</short-title></quote> or the <quote><short-title>LEVEL Act</short-title></quote>.</text></section><section id="H73C74B1AD7FB4381A47B9D3F55BCAB99"><enum>2.</enum><header>Repeal of expansion of Renewable Fuel Program</header><subsection id="HEF0C675D97804334938C3D15DDA4E453"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H42584F98788543D8BC68ACB51BFB07F0" style="OLC"><paragraph id="HC82BBA52D9054FA8B9DB014EF733F3C1"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><subparagraph id="H4D204CB1F5434FDFAAEFF60BDA438340"><enum>(A)</enum><header>Cellulosic biomass ethanol</header><text>The term <term>cellulosic biomass ethanol</term> means ethanol derived from any lignocellulosic or hemicellulosic matter that is available on a renewable or recurring basis, including—</text><clause id="HD1839E7F7BD0401683CB15343DCC2E05"><enum>(i)</enum><text>dedicated energy crops and trees;</text></clause><clause id="H1F2C64489A5045C08FF0015ADE99A574"><enum>(ii)</enum><text>wood and wood residues;</text></clause><clause id="HD8616F13AC72434499BC41B5132724BC"><enum>(iii)</enum><text>plants;</text></clause><clause id="HB2DD272731464597BF02A28FB668E0F7"><enum>(iv)</enum><text>grasses;</text></clause><clause id="H98261BDCA2F34301924522E22CB8FD89"><enum>(v)</enum><text>agricultural residues;</text></clause><clause id="HE4D4A53A69B14B4FBEE16AE6E25F98E1"><enum>(vi)</enum><text>fibers;</text></clause><clause id="H41F735B299214CD19677F6D8C0B80A90"><enum>(vii)</enum><text>animal wastes and other waste materials; and</text></clause><clause id="H015FB5F854EF47F6821B5003E5F174D0"><enum>(viii)</enum><text>municipal solid waste.</text></clause><continuation-text continuation-text-level="subparagraph">The term also includes any ethanol produced in facilities where animal wastes or other waste materials are digested or otherwise used to displace 90 percent or more of the fossil fuel normally used in the production of ethanol. </continuation-text></subparagraph><subparagraph id="HF765BCA5051E428AB1CE4A48D13A90EC"><enum>(B)</enum><header>Waste derived ethanol</header><text>The term <term>waste derived ethanol</term> means ethanol derived from—</text><clause id="HCFB7C8E4D6124E14A135680C635EEFF9"><enum>(i)</enum><text>animal wastes, including poultry fats and poultry wastes, and other waste materials; or</text></clause><clause id="HB0C800A8E7B24BAD961258E153532685"><enum>(ii)</enum><text>municipal solid waste.</text></clause></subparagraph><subparagraph id="HD71CD6D8E97A465A8F5E805ABDD2C3A6"><enum>(C)</enum><header>Renewable fuel</header><clause id="HEBEB26FBB02246D3933C18E5A30550A8"><enum>(i)</enum><header>In general</header><text>The term <term>renewable fuel</term> means motor vehicle fuel that—</text><subclause id="H9D25E436D5E04A83832554EEA9F4D080"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="H75A01DF59E024C7FB7C793A6BE0DD9FA"><enum>(aa)</enum><text>is produced from grain, starch, oilseeds, vegetable, animal, or fish materials including fats, greases, and oils, sugarcane, sugar beets, sugar components, tobacco, potatoes, or other biomass; or</text></item><item id="HDF0DFA98C82441B98C79BEBEAA471E31" indent="up1"><enum>(bb)</enum><text>is natural gas produced from a biogas source, including a landfill, sewage waste treatment plant, feedlot, or other place where decaying organic material is found; and</text></item></subclause><subclause id="HE1DBE6F0D4A3482E8F39D952323DBBBF"><enum>(II)</enum><text>is used to replace or reduce the quantity of fossil fuel present in a fuel mixture used to operate a motor vehicle.</text></subclause></clause><clause id="H09D25E5A10B84287B9C3EE11936C8D06"><enum>(ii)</enum><header>Inclusion</header><text>The term renewable fuel includes—</text><subclause id="HB051D6FC4716439E87F72066093F20DF"><enum>(I)</enum><text>cellulosic biomass ethanol and waste derived ethanol; and</text></subclause><subclause id="HB01A8F20E4194D67A7A80D210C2E911D"><enum>(II)</enum><text>biodiesel (as defined in section 312(f) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13220">42 U.S.C. 13220(f)</external-xref>)) and any blending components derived from renewable fuel (provided that only the renewable fuel portion of any such blending component shall be considered part of the applicable volume under the renewable fuel program established by this subsection).</text></subclause></clause></subparagraph><subparagraph id="HD1C4ED55332347A4BFCB0B9828422A98"><enum>(D)</enum><header>Small refinery</header><text>The term <term>small refinery</term> means a refinery for which the average aggregate daily crude oil throughput for a calendar year (as determined by dividing the aggregate throughput for the calendar year by the number of days in the calendar year) does not exceed 75,000 barrels.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H632C300C30A14471837A0FB60A652F46"><enum>(b)</enum><header>Renewable fuel program</header><text>Paragraph (2) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(2)</external-xref>) is amended as follows:</text><paragraph id="HBC17A550E1724E5990B431F8C3E05A63"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Clause (i) of subparagraph (A) is amended by striking the last sentence.</text></paragraph><paragraph id="H41F238E4654244D8AC3E140C58ED58FA"><enum>(2)</enum><header>Applicable volumes of renewable fuel</header><text>Subparagraph (B) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H1BF2535403A14B46AD2046F47D82E59B" style="OLC"><subparagraph id="H8382081CAC044F30907F595144180424"><enum>(B)</enum><header>Applicable volume</header><text display-inline="yes-display-inline">For the purpose of subparagraph (A), the applicable volume of renewable fuel for each calendar year shall be 7,500,000,000 gallons.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H90C768D0281A4D88BB40032FB8CD352A"><enum>(c)</enum><header>Applicable percentages</header><text>Paragraph (3) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(3)</external-xref>) is amended as follows:</text><paragraph commented="no" id="H41EBB3CA0D9E48C5961CF823E2874715"><enum>(1)</enum><text>In subparagraph (A), by striking <quote>each of calendar years 2005 through 2021</quote> and inserting <quote>each calendar year</quote>.</text></paragraph><paragraph commented="no" id="HBB1CF9398F434F5BA2F3129D304DDF3E"><enum>(2)</enum><text>In subparagraph (A), by striking <quote>transportation fuel, biomass-based diesel, and cellulosic biofuel</quote> and inserting <quote>gasoline</quote>.</text></paragraph><paragraph commented="no" id="H1B09F55C5B4648E3A1ECE81B70104183"><enum>(3)</enum><text>In subparagraph (B)(i), by striking <quote>each of calendar years 2005 through 2021</quote> and inserting <quote>each calendar year</quote>.</text></paragraph><paragraph commented="no" id="H8963DF843C6D48E6B024A6F248FF0936"><enum>(4)</enum><text>In subparagraph (B), by striking <quote>transportation fuel</quote> and inserting <quote>gasoline</quote> in clause (ii)(II).</text></paragraph></subsection><subsection id="H693CD11BD5194BE9BBF6B7C8D4AD5006"><enum>(d)</enum><header>Cellulosic biomass ethanol or waste derived ethanol</header><text>Paragraph (4) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(4)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HF487FFA112FF47408EBA7F4778753A95" style="OLC"><paragraph id="HD7D36C98D9A8477799E0BB45984682ED"><enum>(4)</enum><header>Cellulosic biomass ethanol or waste derived ethanol</header><text display-inline="yes-display-inline">For the purpose of paragraph (2), 1 gallon of cellulosic biomass ethanol or waste derived ethanol shall be considered to be the equivalent of 2.5 gallons of renewable fuel.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H44B9478225634B78997AC0A88A27815B"><enum>(e)</enum><header>Credit program</header><text display-inline="yes-display-inline">Paragraph (5) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(5)</external-xref>) is amended by striking subparagraph (E).</text></subsection><subsection id="HEB199C7A1DBD4991888886E76981EAD1"><enum>(f)</enum><header>Waivers</header><paragraph id="H2AB0E2B2DE1B4591B2E1006E53023EAA"><enum>(1)</enum><header>In general</header><text>Paragraph (7) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(7)</external-xref>) is amended—</text><subparagraph id="H3CE2029F0B894884B711B5CBC7129167"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>, by any person subject to the requirements of this subsection, or by the Administrator on his own motion</quote>; and</text></subparagraph><subparagraph id="H04ED21C17414496496A37EB186BA5456"><enum>(B)</enum><text>by inserting <quote>State</quote> before <quote>petition for a waiver</quote> in subparagraph (B).</text></subparagraph></paragraph><paragraph id="HB0676603D7DD4E979A06A09373F44822"><enum>(2)</enum><header>Cellulosic biofuel</header><text>Paragraph (7) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(7)</external-xref>) is amended by striking subparagraph (D).</text></paragraph><paragraph id="H8287AD6B976D4A0890384D98C65BB9DB"><enum>(3)</enum><header>Biomass-based diesel</header><text>Paragraph (7) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(7)</external-xref>) is amended by striking subparagraphs (E) and (F).</text></paragraph></subsection><subsection commented="no" id="HF1698B3EB7CF41F78EFE1250FE846600"><enum>(g)</enum><header>Periodic Reviews</header><text display-inline="yes-display-inline">Section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>) is amended by striking paragraph (11).</text></subsection><subsection commented="no" id="H9B7407E5A143415BAEE03C986082F91D"><enum>(h)</enum><header>Savings clause</header><text>Section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>) is amended by striking paragraph (12).</text></subsection><subsection id="H86465C4185BA4DF68E7FC40A1AC8EE56"><enum>(i)</enum><header>Regulations</header><text>Section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) is amended by striking paragraph (2) of subsection (v).</text></subsection><subsection id="H7BE604A1F7664D48A81B9254FF5B01F8"><enum>(j)</enum><header>Other provisions</header><paragraph commented="no" id="HC3430C1C7B1644EB8C87EDE2FAC33566"><enum>(1)</enum><header>Environmental and resource conservation impacts</header><text>Section 204(b) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>) is repealed.</text></paragraph><paragraph commented="no" id="HB99DA661F9F74023A67935D904DF1AF9"><enum>(2)</enum><header>Effective date, savings provision, and transition rules</header><text>Section 210 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>) is repealed.</text></paragraph></subsection><subsection commented="no" id="H63C72DB568C449EBA6CA4352081084F7"><enum>(k)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1 of the first calendar year following the date of enactment of this Act.</text></subsection><subsection id="HF6A08B9660EF4A85B6926551F323E612"><enum>(l)</enum><header>Estimates for first calendar year</header><text display-inline="yes-display-inline">Prior to January 1 of the first calendar year following the date of enactment of this Act—</text><paragraph id="HCEBEA9E3B6FB4DB6A78F7BF3F027452C"><enum>(1)</enum><text>the Administrator of the Energy Information Administration shall provide to the Administrator of the Environmental Protection Agency an estimate, under section 211(o)(3) of the Clean Air Act, as amended by this Act, with respect to such calendar year, of the volumes of gasoline projected to be sold or introduced into commerce in the United States; and</text></paragraph><paragraph id="H623692F391694AE0A878B9328141A0F8"><enum>(2)</enum><text>based on the estimate provided under paragraph (1), the Administrator of the Environmental Protection Agency shall determine and publish in the Federal Register, with respect to such calendar year, the renewable fuel obligation for such calendar year under section 211(o)(3) of the Clean Air Act, as amended by this Act.</text></paragraph></subsection></section><section commented="no" id="H06BA4A7A504143DE96D2670CF651581F"><enum>3.</enum><header>Prohibition of authorization of higher ethanol blends</header><subsection commented="no" id="H585B538D4D5446029DE2807594231E66"><enum>(a)</enum><header>Prohibition</header><text>Notwithstanding any provision of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.), the Administrator of the Environmental Protection Agency may not permit or authorize (including by granting a waiver through the fuels and fuel additives waiver process under section 211(f)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(f)(4)</external-xref>)) the introduction into commerce of gasoline that—</text><paragraph id="H8FED37CD38FF40A3A9383D0C982AB85E"><enum>(1)</enum><text>contains greater than 10-volume-percent ethanol;</text></paragraph><paragraph id="H622792DF733F49E2A2237A7EB4ACE3A6"><enum>(2)</enum><text>is intended for general use in conventional gasoline-powered onroad or nonroad vehicles or engines; and</text></paragraph><paragraph id="HF8528DFCF77A4575B8C4854954C233B7"><enum>(3)</enum><text>is not, on or before the date of enactment of this Act—</text><subparagraph id="HEC44CD9E98E84358983CA2BFF42BA7EB"><enum>(A)</enum><text>registered in accordance with section 211(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(b)</external-xref>); and</text></subparagraph><subparagraph id="HC63FD7AB50F746D59FC709819330E52D"><enum>(B)</enum><text>lawfully sold in the United States.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HF0CA82C344D24538A443F3B26D535F44"><enum>(b)</enum><header>Repeal of existing waivers</header><paragraph id="H9226D390A1DA47C889153089185D2937"><enum>(1)</enum><header>In general</header><text>Any waiver described in paragraph (2) is repealed and shall have no force or effect.</text></paragraph><paragraph id="H4646B925F3654EA98604138A2900D67D"><enum>(2)</enum><header>Waiver</header><text>A waiver described in this paragraph—</text><subparagraph id="HBB1A15A21546401C914F957603E8EFC2"><enum>(A)</enum><text>is a waiver granted pursuant to section 211(f)(4) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(f)(4)</external-xref>) prior to the date of enactment of this Act that permits or authorizes the introduction into commerce of gasoline that contains greater than 10-volume-percent ethanol for general use in conventional gasoline-powered onroad or nonroad vehicles or engines; and</text></subparagraph><subparagraph id="HAE85F0A8735E4192AE7E129F6725D1D3"><enum>(B)</enum><text>includes the following:</text><clause commented="no" id="HD23D7D8FCC774359B2E43717311E7053"><enum>(i)</enum><text><quote>Partial Grant and Partial Denial of Clean Air Act Waiver Application Submitted by Growth Energy To Increase the Allowable Ethanol Content of Gasoline to 15 Percent; Decision of the Administrator</quote> published at 75 Fed. Reg. 68094 (November 4, 2010).</text></clause><clause commented="no" id="HCFD3D032430C4400A36F8224EE168208"><enum>(ii)</enum><text><quote>Partial Grant of Clean Air Act Waiver Application Submitted by Growth Energy To Increase the Allowable Ethanol Content of Gasoline to 15 Percent; Decision of the Administrator</quote> published at 76 Fed. Reg. 4662 (January 26, 2011).</text></clause></subparagraph></paragraph><paragraph id="H9EF92378A6A5489B93380D3CA13DC09D"><enum>(3)</enum><header>Exception</header><text>Paragraph (1) shall not apply with respect to a waiver to the extent such waiver permits or authorizes the introduction into commerce of gasoline—</text><subparagraph id="HFF3E9AA6ADE84462B3E998B267F65B11"><enum>(A)</enum><text>that is described in paragraph (2)(A); and</text></subparagraph><subparagraph id="HFBC397CA3FB746628BFA9F911DE987D8"><enum>(B)</enum><text display-inline="yes-display-inline">that is, on or before the date of enactment of this Act—</text><clause id="HA7753342D4604BF89A813A23F3F09DC9"><enum>(i)</enum><text>registered in accordance with section 211(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(b)</external-xref>); and</text></clause><clause id="H319D388141604E4EBEE2684545C7C751"><enum>(ii)</enum><text>lawfully sold in the United States.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H85D43C492B1446269392044C6585543E"><enum>(c)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall conduct, and submit to Congress the results of, a comprehensive study on—</text><paragraph commented="no" id="HA3174454F2574DD99B2E87CCA3BCC4A9"><enum>(1)</enum><text>the effects of the introduction into commerce of an ethanol-gasoline blend described in subsection (b)(2)(A) on consumer products, including—</text><subparagraph commented="no" id="H78687C45AF6440879430CB2284460944"><enum>(A)</enum><text>onroad and nonroad vehicles;</text></subparagraph><subparagraph commented="no" id="HE67B4FEE5AA649F3BC84223765DD87DD"><enum>(B)</enum><text>nonroad engines (such as lawn mowers); and</text></subparagraph><subparagraph commented="no" id="HA17CA1524752441AA02CCF896A6AF643"><enum>(C)</enum><text>any other applicable gasoline-powered vehicles, engines, and devices;</text></subparagraph></paragraph><paragraph commented="no" id="HAFF12AE20C6441C6ABC2B922342794F6"><enum>(2)</enum><text display-inline="yes-display-inline">the impact of an ethanol-gasoline blend described in subsection (b)(2)(A) on—</text><subparagraph commented="no" id="H3E2D17FC356F4E2BAAB2801D4C4A7F21"><enum>(A)</enum><text>engine performance of conventional gasoline-powered onroad and nonroad vehicles and nonroad engines;</text></subparagraph><subparagraph commented="no" id="H97AE2F5757B54A3B8D8498089F2D02D0"><enum>(B)</enum><text display-inline="yes-display-inline">emissions from the use of the blend; and</text></subparagraph><subparagraph commented="no" id="H1FE564961BCD44FAB1B0A62E59DD8C0F"><enum>(C)</enum><text display-inline="yes-display-inline">materials compatibility and consumer safety issues associated with the use of such blend (including the identification of insufficient data or information for some or all of such vehicles and engines with respect to each of the issues described in this subparagraph and subparagraphs (A) and (B)); and</text></subparagraph></paragraph><paragraph commented="no" id="H1F687B522BC5475AA63FE0DF61175EFA"><enum>(3)</enum><text>the ability of wholesale and retail gasoline distribution infrastructure, including bulk storage, retail storage configurations, and retail equipment (including certification of equipment compatibility by independent organizations), to introduce such an ethanol-gasoline blend into commerce without widespread intentional or unintentional misfueling by consumers.</text></paragraph></subsection></section></legis-body></bill>
