R. 1908</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>March 16, 2022</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To authorize the Secretary of the Interior to conduct a study to assess the suitability and feasibility of designating certain land as the Ka’ena Point National Heritage Area, and for other purposes.</official-title></form><legis-body id="H17F88CB7A72A4A8B8B7E0626D5C3E6E2" style="OLC"><section id="H9704C32EE0B6496B9E2C63B9ABDBA65B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ka‘ena Point National Heritage Area Act</short-title></quote>.</text></section><section id="H30973DE3231B4960A7B25138F66EFF5F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7CE91D69BE374DB58DA207E752DFF6C1"><enum>(1)</enum><header>Heritage area</header><text>The term <term>Heritage Area</term> means the Ka‘ena Point National Heritage Area.</text></paragraph><paragraph id="H30022FD1C0D94B6B98D309DF4857EB08"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H22DA693378104607AB04DBD2BC67E6F3"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of Hawai‘i.</text></paragraph><paragraph id="H1557E85C874E4682B40BED96845BAB93"><enum>(4)</enum><header>Study area</header><text display-inline="yes-display-inline">The term <term>study area</term> means Honolulu County on the island of O‘ahu.</text></paragraph></section><section id="H1AE411B68246440EA37CCB90EE5B62AC"><enum>3.</enum><header>Study</header><subsection id="H66182937E6C84406BBECD2BB096FFF72"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with State and local historic preservation officers, State and local historical societies, State and local tourism offices, and other appropriate organizations and governmental agencies, shall conduct a study to assess the suitability and feasibility of designating the study area as a National Heritage Area, to be known as the <quote>Ka‘ena Point National Heritage Area</quote>.</text></subsection><subsection id="H73291FD1C7AC459CBC98A262C83A3F73"><enum>(b)</enum><header>Requirements</header><text>The study shall include analysis, documentation, and determinations on whether the study area—</text><paragraph id="HAE78B0235429436F9DD22783E672453E"><enum>(1)</enum><text>has an assemblage of natural, historic, and cultural resources that—</text><subparagraph id="H19C5E051FF9240DDBB05CB9DF8780232"><enum>(A)</enum><text>represents distinctive aspects of the heritage of the United States;</text></subparagraph><subparagraph id="H95CEECBA747E4DCC82E47469A90A1E61"><enum>(B)</enum><text>is worthy of recognition, conservation, interpretation, and continuing use; and</text></subparagraph><subparagraph id="H0D8755A42010467FA435ACFE2C13179E"><enum>(C)</enum><text>would be best managed—</text><clause id="H1460CA2CD0844BAD8355632DCC29A9EA"><enum>(i)</enum><text>through partnerships among public and private entities; and</text></clause><clause id="HEFC7F0EA83064A2BA79031EA39761B3F"><enum>(ii)</enum><text>by linking diverse and sometimes noncontiguous resources and active communities;</text></clause></subparagraph></paragraph><paragraph id="HB02F1397104F48CD92A472A63EBF90FC"><enum>(2)</enum><text>reflects traditions, customs, beliefs, and folklife that are a valuable part of the story of the United States;</text></paragraph><paragraph id="H255F58F1275849C2A33B5EB8E97F9F8A"><enum>(3)</enum><text>provides outstanding opportunities—</text><subparagraph id="HDE8025D5F2FA4B7895E4940D326F7B66"><enum>(A)</enum><text>to conserve natural, historic, cultural, or scenic features; and</text></subparagraph><subparagraph id="H6F8EA5D62AF94C8D9F6AFE5C9978C205"><enum>(B)</enum><text>for recreation and education;</text></subparagraph></paragraph><paragraph id="H9899730CC4F74653ADE57D8891803756"><enum>(4)</enum><text>contains resources that—</text><subparagraph id="H25A6F20384534E6AB415C53675C958C3"><enum>(A)</enum><text>are important to any identified themes of the study area; and</text></subparagraph><subparagraph id="HC3ADD76206E64FC09C5E92C8B1FFEFFF"><enum>(B)</enum><text>retain a degree of integrity capable of supporting interpretation;</text></subparagraph></paragraph><paragraph id="HB540FE52770A4D859231DBA7CF46509C"><enum>(5)</enum><text>includes residents, business interests, nonprofit organizations, and State and local governments that—</text><subparagraph id="HC8AB40DF96B645D9873516DE924DD8D4"><enum>(A)</enum><text>are involved in the planning of the Heritage Area;</text></subparagraph><subparagraph id="H6C5E340352C540C7AAFE0570628C1724"><enum>(B)</enum><text>have developed a conceptual financial plan that outlines the roles of all participants in the Heritage Area, including the Federal Government; and</text></subparagraph><subparagraph id="H342E143F111B49A8ACCE0CE7EB8BD46A"><enum>(C)</enum><text>have demonstrated support for the designation of the Heritage Area;</text></subparagraph></paragraph><paragraph id="HF57B7468FDEA4D7EB79FD9B814416494"><enum>(6)</enum><text>has a potential management entity to work in partnership with the individuals and entities described in paragraph (5) to develop the Heritage Area while encouraging State and local economic activity; and</text></paragraph><paragraph id="H00EF594CD6074679983EA4B6D8682C69"><enum>(7)</enum><text>has a conceptual boundary map that is supported by the public.</text></paragraph></subsection></section><section id="HCB56D898CD974403A51F00FCE5F0396A"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 3 years after the date on which funds are first made available to carry out this Act, the Secretary shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that describes—</text><paragraph id="H4697DA33AD1D475FAE327530D22E89A4"><enum>(1)</enum><text>the findings of the study under section 3; and</text></paragraph><paragraph id="H82730B162BB04928802E8E22444BB945"><enum>(2)</enum><text>any conclusions and recommendations of the Secretary.</text></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20220315" chamber="House">Passed the House of Representatives March 15, 2022.</attestation-date><attestor display="yes">Cheryl L.
