which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Environmental Protection Agency to continue to carry out certain programs relating to environmental justice, and for other purposes.</official-title></form><legis-body id="HBFCD19284AC74B128A1833B52476BCD6" style="OLC"><section id="H66A7A70393924F38A6651DD57F934FF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Justice for Coronavirus Affected Communities Act</short-title></quote>. </text></section><section id="H4FB06072E020410196CD989FA76A61D8" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HDAE080A961544723936A32C56F7F41F4"><enum>(1)</enum><text>Communities of color, low-income communities, Tribal and indigenous communities, fossil fuel-dependent communities, and other vulnerable populations, such as persons with disabilities, children, and the elderly, are disproportionately burdened by environmental hazards that include exposure to polluted air, waterways, and landscapes.</text></paragraph><paragraph id="H7CF63D4FFB2B4557AB87C99F3D249515"><enum>(2)</enum><text>Environmental justice disparities are also exhibited through a lack of equitable access to information and data on potential exposure to environmental hazards.</text></paragraph><paragraph id="HC51ABB4CDDC949AF966057BEF8AF1CE7"><enum>(3)</enum><text>Communities experiencing environmental injustice have been subjected to systemic racial, social, and economic injustices and face a disproportionate burden of adverse human health or environmental effects, a higher risk of intentional, unconscious, and structural discrimination, and disproportionate energy burdens.</text></paragraph><paragraph id="H9D4E76F3815146EEA1775F6DD6C50059"><enum>(4)</enum><text>These disproportionate burdens are being exacerbated by the COVID–19 pandemic.</text></paragraph><paragraph id="H9A9AEBF4277044978F2214FD110EB344"><enum>(5)</enum><text>Citizen science will be essential for environmental justice communities to protect themselves during this pandemic.</text></paragraph></section><section id="HF6CC3C3192C644D082C3F9894FE6193C"><enum>3.</enum><header>Environmental justice grant programs</header><subsection id="H2F14F97121724AC6A7D2F716DF8CFCD0"><enum>(a)</enum><header>Environmental Justice grants</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall continue to carry out—</text><paragraph id="H3FB0169FD95546A3A6986534CDB66062"><enum>(1)</enum><text>the Environmental Justice Small Grants Program and the Environmental Justice Collaborative Problem-Solving Cooperative Agreement Program, as those programs are in existence on the date of enactment of this Act; and</text></paragraph><paragraph id="HE482A586FFD24E12A7FEA8C136354A8C"><enum>(2)</enum><text>the Community Action for a Renewed Environment grant programs I and II, as in existence on January 1, 2012.</text></paragraph></subsection><subsection id="HD25FC7D8195D4FC2A225715B392F6946"><enum>(b)</enum><header>Authorization for Grants in Response to COVID–19 Emergency</header><paragraph id="H2D2F8BC4866248AB89AA95DADE505D2E"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for fiscal year 2022—</text><subparagraph id="HDF85EC903A344F038650AD69E2F214E1"><enum>(A)</enum><text>$50,000,000 to carry out the programs described in subsection (a); and</text></subparagraph><subparagraph id="H183BA853B4F049F9994EA9517ADDC7B3"><enum>(B)</enum><text>$50,000,000 for grants and activities authorized under subsections (a) through (c) of section 103 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403</external-xref>) and grants and activities authorized under section 105 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7405">42 U.S.C. 7405</external-xref>).</text></subparagraph></paragraph><paragraph id="H7973C68E7B32437BBDA9E5D6D0E1FDEF"><enum>(2)</enum><header>Priority for funds</header><text display-inline="yes-display-inline">In awarding grants under the programs described in subsection (a) pursuant to this section, the Administrator shall prioritize projects that will— </text><subparagraph id="H91995F236184421E9369E8FB5F210C01"><enum>(A)</enum><text>monitor pollution in or near environmental justice communities; </text></subparagraph><subparagraph id="H921ECAEE6804411BAC52917B3B321FA1"><enum>(B)</enum><text>investigate or address the disproportionate impacts of the COVID–19 pandemic in environmental justice communities; or</text></subparagraph><subparagraph id="HBE909A93B7F745118860F3819342233E"><enum>(C)</enum><text>address disproportionate environmental or public health harms and risks in minority populations or low-income populations under—</text><clause id="HFF8BAB0095C74FDFBC1536ADB897A44B"><enum>(i)</enum><text>section 103(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403(b)</external-xref>);</text></clause><clause id="H0B1B071015E34C30B90453C6A0888140"><enum>(ii)</enum><text>section 1442 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1</external-xref>);</text></clause><clause id="H896FCBBB733142CAB509ECA0296F4693"><enum>(iii)</enum><text>section 104(k)(7)(A) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(7)(A)</external-xref>); and</text></clause><clause id="H4F458ADD1BCD4E69B2244A9C27B3DEBF"><enum>(iv)</enum><text>sections 791 through 797 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16131">42 U.S.C. 16131</external-xref> through 16137).</text></clause></subparagraph></paragraph></subsection><subsection id="H109DF06D175845ED8549C85A47610CC3" commented="no"><enum>(c)</enum><header>Distribution</header><text display-inline="yes-display-inline">Not later than 30 days after amounts are made available pursuant to subsection (b)(1), the Administrator of the Environmental Protection Agency shall make awards of grants under each of the programs described in subsection (a).</text></subsection></section></legis-body></bill>
