R. 1871</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210721">July 21, 2021</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To improve the understanding and clarity of Transportation Security Administration policies, and for other purposes.</official-title></form><legis-body id="HAA1D1726239045CAB32A846BDDBD4639" style="OLC"><section id="HA72926EC87FE46C1B9A048703E542748" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Security Transparency Improvement Act</short-title></quote>.</text></section><section id="H0ABEE0050DD142339AEA0F152F3FB3AB"><enum>2.</enum><header>Sensitive security information; international aviation security</header><subsection id="HC4E29F8DCA264B6391D0EFC2E8B49835"><enum>(a)</enum><header>Sensitive security information</header><paragraph id="HD4477082DE014365AE646BFBB80610C7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration (TSA) shall—</text><subparagraph id="HCB6560FE338B4C1E80D34DB31F4AF4CC"><enum>(A)</enum><text display-inline="yes-display-inline">ensure clear and consistent designation of <quote>Sensitive Security Information</quote>, including reasonable security justifications for such designation;</text></subparagraph><subparagraph id="H2C8F03D0106D4317B862B037287E6AA9"><enum>(B)</enum><text>develop and implement a schedule to regularly review and update, as necessary, TSA Sensitive Security Information Identification guidelines;</text></subparagraph><subparagraph id="H03CE6A0ADA1D4770A55613A6351F0DCC"><enum>(C)</enum><text>develop a tracking mechanism for all Sensitive Security Information redaction and designation challenges;</text></subparagraph><subparagraph id="H0F73A220E26D43B991C03B4242F5BCFD"><enum>(D)</enum><text>document justifications for changes in position regarding Sensitive Security Information redactions and designations, and make such changes accessible to TSA personnel for use with relevant stakeholders, including air carriers, airport operators, surface transportation operators, and State and local law enforcement, as necessary; and</text></subparagraph><subparagraph id="H07FB1F8DABFB4E6D95A2EFECA3FA3E5E"><enum>(E)</enum><text display-inline="yes-display-inline">ensure that TSA personnel are adequately trained on appropriate designation policies.</text></subparagraph></paragraph><paragraph id="H35F1F078CE904A26BE95191B3CE657D3"><enum>(2)</enum><header>Stakeholder outreach</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration (TSA) shall conduct outreach to relevant stakeholders described in paragraph (1)(D) that regularly are granted access to Sensitive Security Information to raise awareness of the TSA’s policies and guidelines governing the designation and use of Sensitive Security Information.</text></paragraph></subsection><subsection id="HF3AC888F4F9548D3B10959C5FD52B97D"><enum>(b)</enum><header>International aviation security</header><paragraph id="H7F1A094E817B4FFB9BDEFBF423000A27"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall develop and implement guidelines with respect to last point of departure airports to—</text><subparagraph id="H9D00FB14E10F4FC3A0B63269B9EC1CA0"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the inclusion, as appropriate, of air carriers and other transportation security stakeholders in the development and implementation of security directives and emergency amendments;</text></subparagraph><subparagraph id="H24C09B7A782344D4BE0AFA03B31B7C10"><enum>(B)</enum><text>document input provided by air carriers and other transportation security stakeholders during the security directive and emergency amendment, development, and implementation processes;</text></subparagraph><subparagraph id="H0D1B8BDFBB5D45DB9DE4DFE451735DF2"><enum>(C)</enum><text display-inline="yes-display-inline">define a process, including time frames, and with the inclusion of feedback from air carriers and other transportation security stakeholders, for cancelling or incorporating security directives and emergency amendments into security programs;</text></subparagraph><subparagraph id="H3353EAC21344444A8FC3326041373908"><enum>(D)</enum><text>conduct engagement with foreign partners on the implementation of security directives and emergency amendments, as appropriate, including recognition if existing security measures at a last point of departure airport are found to provide commensurate security as intended by potential new security directives and emergency amendments; and</text></subparagraph><subparagraph id="H99612F9232E243178E76C993C6F9F8C4"><enum>(E)</enum><text>ensure that new security directives and emergency amendments are focused on defined security outcomes.</text></subparagraph></paragraph><paragraph id="H13B33193E1804C3B815259459F40D91B"><enum>(2)</enum><header>Briefing to Congress</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the guidelines described in paragraph (1).</text></paragraph><paragraph id="HC4A6AD76C4EB4C13B270707239159435"><enum>(3)</enum><header>Decisions not subject to judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any action of the Administrator of the Transportation Security Administration under paragraph (1) is not subject to judicial review.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210720" chamber="House">Passed the House of Representatives July 20, 2021.</attestation-date><attestor display="yes">Cheryl L.
