which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Homeland Security to prioritize strengthening of local transportation security capabilities by assigning certain officers and intelligence analysts to State, local, and regional fusion centers in jurisdictions with a high-risk surface transportation asset and improving the timely sharing of information regarding threats of terrorism and other threats, including targeted violence, and for other purposes.</official-title></form><legis-body id="H17510CCCA9CA44F68A30FD2EB604F989" style="OLC"><section id="H7D57E0D88C4E479594935BF7406EB055" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Local Transportation Security Capabilities Act of 2021</short-title></quote>.</text></section><section id="H341A9244A33D4DDAA5C472F774295EE8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H735F04892E4342619EB4735CECBE3235"><enum>(1)</enum><header>Domestic terrorism</header><text>The term <quote>domestic terrorism</quote> has the meaning given such term in section 2331 of title 18, United States Code.</text></paragraph><paragraph id="H422265541B5E4644BD3AEAC101F9474F"><enum>(2)</enum><header>International terrorism</header><text>The term <quote>international terrorism</quote> has the meaning given such term in section 2331 of title 18, United States Code.</text></paragraph><paragraph id="HA715957E82644B979CCDFEC45B8033A1"><enum>(3)</enum><header>Public and private sector stakeholders</header><text>The term <quote>public and private sector stakeholders</quote> has the meaning given such term in section 114(u)(1)(C) of title 49, United States Code.</text></paragraph><paragraph id="HE8CB7304512A44199D9D7557FD60E607"><enum>(4)</enum><header>Surface transportation asset</header><text>The term <quote>surface transportation asset</quote> includes facilities, equipment, or systems used to provide transportation services by—</text><subparagraph id="H2A98CB048FCF48579890E23241325343"><enum>(A)</enum><text>a public transportation agency (as such term is defined in section 1402(5) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law 110–53</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/1131">6 U.S.C. 1131(5)</external-xref>));</text></subparagraph><subparagraph id="HA1BF058D25DC448FA46E84616DF821B9"><enum>(B)</enum><text>a railroad carrier (as such term is defined in section 20102(3) of title 49, United States Code);</text></subparagraph><subparagraph id="HFCCAE856EDB64CD1A7138A21CCCE8050"><enum>(C)</enum><text>an owner or operator of—</text><clause id="HBC715FD1994341C2934687E157989404"><enum>(i)</enum><text>an entity offering scheduled, fixed-route transportation services by over-the-road bus (as such term is defined in section 1501(4) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/53">Public Law 110–53</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/1151">6 U.S.C. 1151(4)</external-xref>)); or</text></clause><clause id="H274F09E9BBA94BF48C72D9102A2DEE7A"><enum>(ii)</enum><text>a bus terminal; or</text></clause></subparagraph><subparagraph id="HD6E15004C08F408D811824A2E120CAEC"><enum>(D)</enum><text>other transportation facilities, equipment, or systems, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HC14FC43387444278975553B2795DD02E"><enum>(5)</enum><header>Targeted violence</header><text>The term <quote>targeted violence</quote> means an incident of violence in which an attacker selected a particular target in order to inflict mass injury or death with no discernable political or ideological motivation beyond mass injury or death.</text></paragraph><paragraph id="H56AA6D6BBD3C42C88D13CF659E19F6BB"><enum>(6)</enum><header>Terrorism</header><text>The term <quote>terrorism</quote> means domestic terrorism and international terrorism.</text></paragraph></section><section id="H157C0FC4911C4242B10066E66CC41818"><enum>3.</enum><header>Threat information sharing</header><subsection id="HFC66F0201489491499607F1FAF7E7580"><enum>(a)</enum><header>Prioritization</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall prioritize the assignment of officers and intelligence analysts under section 210A of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124h">6 U.S.C. 124h</external-xref>) from the Transportation Security Administration and, as appropriate, from the Office of Intelligence and Analysis of the Department of Homeland Security, to locations with participating State, local, and regional fusion centers in jurisdictions with a high-risk surface transportation asset in order to enhance the security of such assets, including by improving timely sharing of information regarding threats of terrorism and other threats, including targeted violence.</text></subsection><subsection id="H11994242F3914B689DEFEC0566D28578" commented="no"><enum>(b)</enum><header>Intelligence products</header><text display-inline="yes-display-inline">Officers and intelligence analysts assigned to locations with participating State, local, and regional fusion centers under this section shall participate in the generation and dissemination of transportation security intelligence products, with an emphasis on such products that relate to threats of terrorism and other threats, including targeted violence, to surface transportation assets that—</text><paragraph id="HEAF51E1458564EE6BA29909612EF48FC" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">assist State, local, and Tribal law enforcement agencies in deploying their resources, including personnel, most efficiently to help detect, prevent, investigate, apprehend, and respond to such threats;</text></paragraph><paragraph id="H5B6E3CB364CF4D5CAC4C85C5483A6F47" commented="no"><enum>(2)</enum><text>promote more consistent and timely sharing with and among jurisdictions of threat information; and</text></paragraph><paragraph id="H6729D70A646F40E6A12FA6A2CF62F8E4" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">enhance the Department of Homeland Security’s situational awareness of such threats.</text></paragraph></subsection><subsection id="HFAC3595D00A04E0D8F111E8CD303A411"><enum>(c)</enum><header>Clearances</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall make available to appropriate owners and operators of surface transportation assets, and to any other person that the Secretary determines appropriate to foster greater sharing of classified information relating to threats of terrorism and other threats, including targeted violence, to surface transportation assets, the process of application for security clearances under Executive Order No. 13549 (75 Fed. Reg. 162; relating to a classified national security information program) or any successor Executive order.</text></subsection></section><section id="H71E8B091348C467F8318B75E2E4BC287"><enum>4.</enum><header>Local law enforcement security training</header><subsection id="HB3FB4B76C1C7488D9C6E87CB98575167"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with public and private sector stakeholders, may develop, through the Federal Law Enforcement Training Centers, a training program to enhance the protection, preparedness, and response capabilities of law enforcement agencies with respect to threats of terrorism and other threats, including targeted violence, at a surface transportation asset.</text></subsection><subsection id="HC4A5B2B29EE8474EB8E12AA4A6332FB4"><enum>(b)</enum><header>Requirements</header><text>If the Secretary of Homeland Security develops the training program described in subsection (a), such training program shall—</text><paragraph id="H9CB9D3C99CE94C8A9E5F6F3A6355B203"><enum>(1)</enum><text>be informed by current information regarding tactics used by terrorists and others engaging in targeted violence;</text></paragraph><paragraph id="H48C2FDBA58A348DFB45AAEA032F90BCC"><enum>(2)</enum><text>include tactical instruction tailored to the diverse nature of the surface transportation asset operational environment; and</text></paragraph><paragraph id="H3F7FCE7B14264754A2CA93A2194760AC"><enum>(3)</enum><text>prioritize training officers from law enforcement agencies that are eligible for or receive grants under sections 2003 or 2004 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/604">6 U.S.C. 604</external-xref> and 605) and officers employed by railroad carriers that operate passenger service, including interstate passenger service.</text></paragraph></subsection></section></legis-body></bill>
