which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 54, United States Code, to authorize the provision of technical assistance under the Preserve America Program and to direct the Secretary of the Interior to enter into partnerships with communities adjacent to units of the National Park System to leverage local cultural heritage tourism assets.</official-title></form><legis-body id="H685F03E9EA004AC99D3835FF1E375D30" style="OLC"><section id="H691AAD6A7EBD4A8EAFA64791D07D052E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Explore America Act of 2021</short-title></quote>.</text></section><section id="HE83925ADD2CB4D0F84F8581525DE4790"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="HF7750E10BC8A40ECAFF77BCB5200F4C4"><enum>(1)</enum><text>to strengthen economic development across the United States by supporting cultural heritage tourism and historic preservation activities through the Preserve America Program; and</text></paragraph><paragraph id="HF7EAAEE8670F468B9586AEE220B5D9D9"><enum>(2)</enum><text>to encourage the Director of the National Park Service to partner with gateway communities (including Native American communities and National Heritage Areas) to leverage local cultural and historic heritage tourism assets.</text></paragraph></section><section id="HF918DB7207AA4D2086D0E5F5948A922E"><enum>3.</enum><header>Preserve America grant program</header><subsection id="H8839C6D211DD47C8A2751D710251ECF4"><enum>(a)</enum><header>Establishment</header><text>Section 311102 of title 54, United States Code, is amended—</text><paragraph id="H3B0DDAC871C642B889DAF7F32663F030"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="HFBDCBE18D1C74F9B9D51072D94F54A78"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and the Secretary of Commerce</quote> after <quote>Council</quote>; and</text></subparagraph><subparagraph id="HF5D2FA9AD0CD47A5B133B2FF00FF8EBC"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0172EF914E5D464E930DF774B68C85D7" style="OLC"><paragraph id="HB8C3EC7B94D04315B8A20190A2B20849"><enum>(3)</enum><header>Advisory role of Secretary of Commerce</header><text>The Secretary of Commerce shall advise the program with respect to job creation, economic growth, and tourism policy and promotion.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0EE0C56A0678426BA59CB0F0D29C9FBF"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9B8A618AA3D24AC9AF102A7DDC830AC1" style="OLC"><subsection id="HF54EF9329A564BD7B2561A1277DADF85"><enum>(f)</enum><header>Technical assistance</header><paragraph id="H87BDCCA8DEC94DC0A49F42933A82F92D"><enum>(1)</enum><header>In general</header><text>For any fiscal year for which funds are not made available to provide grants under this section, to the extent practicable, the program shall, in lieu of the grants, provide technical assistance to the eligible entities described in subsection (a) for projects that meet the eligibility requirements described in subsection (b), as identified on the list of projects prepared by the Secretary in accordance with subsection (d).</text></paragraph><paragraph id="H487C330635B54F7C944D31BD4BBCA983"><enum>(2)</enum><header>Limitation</header><text>The Secretary may take into account the availability of staff resources at the Department of the Interior, the Council, and the Department of Commerce for purposes of determining the number of projects that are provided technical assistance under this subsection.</text></paragraph><paragraph id="HC989C6DEA07846129DA0D27B28658B6D"><enum>(3)</enum><header>Form</header><text>The form of technical assistance under paragraph (1) may include technical assistance provided by—</text><subparagraph id="HE008CD68A5754AE3811FB32E0E1553E6"><enum>(A)</enum><text>the Director, with respect to—</text><clause id="HB82697825E354A0B9DF23311C07FB80D"><enum>(i)</enum><text>best practices in visitor services;</text></clause><clause id="HBF46959599F740A88A618DF2EC270C78"><enum>(ii)</enum><text>the conduct of research, inventories, and surveys;</text></clause><clause id="H5B7F2379C95643918828061A5F0609EB"><enum>(iii)</enum><text>the documentation of historic resources; and</text></clause><clause id="H83655CC2E4584B3499B94CCBB3C8E1B4"><enum>(iv)</enum><text>the interpretation and promotion of cultural and heritage assets;</text></clause></subparagraph><subparagraph id="H68FE4764BB8648A48F687112EA812CD2"><enum>(B)</enum><text>the Council, with respect to historic preservation initiatives and best practices in stewardship; and</text></subparagraph><subparagraph id="H383F433D4BE74FAB91C599F311658550"><enum>(C)</enum><text>the Secretary of Commerce, with respect to economic development and job creation resources.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H180E17069CA0491693C54474DB152D74"><enum>(b)</enum><header>Program Metrics</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3111">Chapter 3111</external-xref> of title 54, United States Code, is amended—</text><paragraph id="H223AE1594B7C48B28EDBFAF5C81E2E18"><enum>(1)</enum><text>by redesignating section 311105 as section 311106; and</text></paragraph><paragraph id="H01C06CDEED164D27A49D43F60DED6456"><enum>(2)</enum><text>by inserting after section 311104 the following:</text><quoted-block display-inline="no-display-inline" id="H9BB5929F8EDB45C2974B5D72DEFD1FFA" style="USC"><section id="H78A0288B61D241C29006D945C31A6DE1"><enum>311105.</enum><header>Reports</header><subsection id="H8BB66323E31A4FB3BCD0CE05E3C98022"><enum>(a)</enum><header>Metrics</header><text>Not later than 180 days after the date of enactment of the <short-title>Explore America Act of 2021</short-title>, the Secretary, in consultation with the Council and the Secretary of Commerce, shall develop specific metrics to measure the effectiveness of the program, including—</text><paragraph id="H2CAEAE473F9340B296C7CE733865C87B"><enum>(1)</enum><text>the economic impact of the program on local communities (including Native American communities and National Heritage Areas); and</text></paragraph><paragraph id="H7D9820ADD1CC4412ABA3F9C1DCC0E7D2"><enum>(2)</enum><text>the effect of the program on efforts to preserve heritage resources.</text></paragraph></subsection><subsection id="H8981E63C5C0248DF96599A6E24DC466E"><enum>(b)</enum><header>Grantee report</header><text>Not later than 2 years after the date on which a grantee receives a grant or technical assistance under this chapter, the grantee shall submit to the Secretary a report that—</text><paragraph id="HCD042D64412B419E831AD7A9237DD7AD"><enum>(1)</enum><text>describes the outcome of the project that was provided a grant or technical assistance under this chapter; and</text></paragraph><paragraph id="H513A6AC1470C44BBAB9D5DDCAFFAB5C8"><enum>(2)</enum><text>based on the metrics developed under subsection (a), assesses—</text><subparagraph id="HF8C9DCB9680B484AA2E5765678319359"><enum>(A)</enum><text>the accomplishments of the project; and</text></subparagraph><subparagraph id="H153D6D5BBB2043DB9C86DFF5E2C21A11"><enum>(B)</enum><text>the impact of the project on the community in which the project was carried out.</text></subparagraph></paragraph></subsection><subsection id="H7584BE22A4984691864F8B5CCF492CCE"><enum>(c)</enum><header>Annual reports</header><text>The Secretary shall submit an annual report to the appropriate committees of Congress that includes data provided by grantees to demonstrate the economic impact of the program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0E84CCAB43BA4DEAAD8D4D92B7A745A7"><enum>(c)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3111">chapter 3111</external-xref> of title 54, United States Code, is amended by striking the item relating to section 311105 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H365E89267D2B4780A78B7B7F0493C0BE" style="OLC"><toc><toc-entry bold="off" level="section">311105. Reports. </toc-entry><toc-entry bold="off" level="section">311106. Authorization of appropriations.</toc-entry></toc><section id="H532235C9C1CE4456A7DDD1025F75B23F"><enum>309201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="HAE5731029A704098A43DC711A31F3098"><enum>(1)</enum><header>Appropriate congressional committee</header><text>The term <term>appropriate congressional committee</term> means—</text><subparagraph id="HD4881312A50C40959E1EDD8B57F40E57"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="H7DBF1291FE6C47F9BF377B8F4B0D5C7B"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph><subparagraph id="H3BCDFE8772F24CEEB76AB0C789394F81"><enum>(C)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph id="HA16B191345BF4D83A53AD8CE282CB253"><enum>(D)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph id="HA30DFCAF2A1647D9BF0850EA6E1CAB9D"><enum>(E)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph><subparagraph id="HA19282FB13E646A0A51AB8FF54F84F00"><enum>(F)</enum><text>the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H6B0F47146B9B4B738482771B7B3E5614"><enum>(2)</enum><header>Gateway Community</header><text>The term <term>gateway community</term> means a community adjacent to a unit of the System, including a Native American community or a National Heritage Area.</text></paragraph><paragraph id="H8010CAE74BF24D7690B1F65439552B88"><enum>(3)</enum><header>Heritage Tourism</header><text>The term <term>heritage tourism</term> has the meaning given the term in section 311101.</text></paragraph></section><section id="HAAC2AEE78FBC48F499311E9AC88E6CF6"><enum>309202.</enum><header>Partnerships with gateway communities</header><subsection id="H74DBEAF29FAE4ECA83E97378F8F6D1F8"><enum>(a)</enum><header>In general</header><text>The Secretary shall, to the extent practicable, offer to enter into partnerships with gateway communities to leverage heritage tourism assets to strengthen local economies and create jobs in the gateway communities with the goal of establishing a standardized framework for partnerships throughout the System, including through—</text><paragraph id="HB605690A85D74644B323BD6711748E59"><enum>(1)</enum><text>providing financial assistance to gateway communities to support outreach and promotional efforts;</text></paragraph><paragraph id="H39CD2CB638D447D0B22BD757C826E2A9"><enum>(2)</enum><text>providing technical assistance to gateway communities based on Service best practices in tourism development and visitor management, such as—</text><subparagraph id="H98CC556BBA8541AE86E40DB0BC1DDE86"><enum>(A)</enum><text>inventorying tourism resources in the gateway community;</text></subparagraph><subparagraph id="H73FDC8EA3F3E48F6B884EF80757BD33E"><enum>(B)</enum><text>identifying historic heritage and cultural resources;</text></subparagraph><subparagraph id="H2872C9D40AB14542A3C773F3CDF4FE66"><enum>(C)</enum><text>engaging collaborative partners and stakeholders;</text></subparagraph><subparagraph id="HE13FBE799512483B995BDD5C7B2FB1DD"><enum>(D)</enum><text>designing community outreach and participation strategies;</text></subparagraph><subparagraph id="HCEA20F7EB988421A88229560BA209970"><enum>(E)</enum><text>developing concept plans for trails, parks, historic resources, and natural areas;</text></subparagraph><subparagraph id="H41B417CD000B4AE6925D0F7A63A1A4E1"><enum>(F)</enum><text>developing sustainable tourism development frameworks for community planning; and</text></subparagraph><subparagraph id="HB598C54EBF4A43C786C9283310D20BC1"><enum>(G)</enum><text>encouraging regional strategies for tourism development and promotion; and</text></subparagraph></paragraph><paragraph id="H2218B2C78AA74757B850520B37652458"><enum>(3)</enum><text>assisting gateway communities in accessing additional Federal resources available to strengthen tourism assets and support economic development.</text></paragraph></subsection><subsection id="H3F85C84637BE4060B8852CA8FBFDD93D"><enum>(b)</enum><header>Obtaining financial and technical assistance</header><text>The Secretary, in consultation with stakeholders of System units, shall establish a process through which States, units of local government, and Tribal governments may apply for designation as a gateway community to become eligible for financial and technical assistance made available under this section.</text></subsection><subsection id="HB5F8A36A4DE3490FACAA15BDD678467B"><enum>(c)</enum><header>Metrics</header><text>The Secretary, in consultation with gateway communities, shall develop metrics to measure the impact of the financial and technical assistance provided to gateway communities under this section.</text></subsection></section><section id="H50271D7D880B4B14940FC4B9CF4D8AF7"><enum>309203.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the appropriate congressional committees a report that—</text><paragraph id="HD05E0C7D743E4576AEE62CAACD72D3AF"><enum>(1)</enum><text>describes the efforts of the Secretary to partner with gateway communities under this chapter;</text></paragraph><paragraph id="H5B8CC9A9F612474490191B04F57E60BA"><enum>(2)</enum><text>analyzes the results of the financial and technical assistance using the metrics developed under section 309202(c); and</text></paragraph><paragraph id="H299D576A8C174D1094183EC296DBE7E3"><enum>(3)</enum><text>identifies—</text><subparagraph id="H98E589CD063F4665A156191C7A6DF283"><enum>(A)</enum><text>the next steps that should be taken to improve partnerships with gateway communities;
