R. 1858</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210311">March 11, 2021</action-date><action-desc><sponsor name-id="S001195">Mr. Smith of Missouri</sponsor> (for himself, <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>, <cosponsor name-id="M001190">Mr. Mullin</cosponsor>, <cosponsor name-id="B001301">Mr. Bergman</cosponsor>, <cosponsor name-id="A000372">Mr. Allen</cosponsor>, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, <cosponsor name-id="R000597">Mr. Rice of South Carolina</cosponsor>, <cosponsor name-id="B001305">Mr. Budd</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="K000395">Mr. Keller</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="M001156">Mr. McHenry</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="K000392">Mr. Kustoff</cosponsor>, <cosponsor name-id="L000589">Mrs. Lesko</cosponsor>, and <cosponsor name-id="B001291">Mr. Babin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To encourage States to permit members of the Armed Forces who are outside of the State under orders to renew a permit to carry a concealed firearm through the mail, and for other purposes.</official-title></form><legis-body id="HAC92F9EEBBA24A0DAFB518B31F4C19A9" style="OLC"><section id="HBE7168280B5E424EBFEF533DF4FC35E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Military Right To Carry Act</short-title></quote>.</text></section><section id="H395A8F0F720A44A4879999E0AA32F312"><enum>2.</enum><header>Concealed carry renewals by mail for members of the Armed Forces</header><subsection id="HBB437F584DEE4216AB2CE3D908387AEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State that receives funds under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) shall have in place—</text><paragraph id="H5E966FC5CCC84459858EF5785AC6A59F"><enum>(1)</enum><text>a law or policy that permits a member of the Armed Forces who is a resident of the State and who is outside of the State under orders to renew a permit to carry a concealed firearm through the mail; and</text></paragraph><paragraph id="H2F0336CFEF904844823DB77305023B8D"><enum>(2)</enum><text display-inline="yes-display-inline">a law or policy that treats a member of the Armed Forces on active duty in the State as a resident of the State for purposes of issuing a permit to carry a concealed firearm in the State. </text></paragraph></subsection><subsection id="H2FA243A5A886482792D8947F36C703D7"><enum>(b)</enum><header>Reduction in funds</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date of enactment of this Act, the Attorney General shall, with respect to the amount that a State would otherwise receive under the grant program described in subsection (a)—</text><paragraph id="H6EBD176133D24A7798BDD515D027C683"><enum>(1)</enum><text>reduce such amount by 5 percent in the case of a State that fails to comply with the requirement under subsection (a)(1); and</text></paragraph><paragraph id="H38722EAE289B4D88BB591F31CC1392FB"><enum>(2)</enum><text>reduce such amount by 5 percent in the case of a State that fails to comply with the requirement under subsection (a)(2). </text></paragraph></subsection><subsection id="H8157C85AEE054447B0EC44349B377ACA"><enum>(c)</enum><header>Reallocation</header><text>The Attorney General shall reallocate amounts not awarded to a State pursuant to subsection (b) to States that comply with the requirement under subsection (a).</text></subsection></section></legis-body></bill>
