<official-title display="yes">To repeal certain provisions of the Communications Act of 1934, title 17 of the United States Code, and certain regulations, to allow for interim carriage of television broadcast signals, and for other purposes.</official-title>

<section id="HBD9A107F40224516AA7F3016D112A445" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modern Television Act of 2021</short-title></quote>.</text></section> <section id="H4B010E9E64C14258A403F67376F38CF3"><enum>2.</enum><header>Agreements for carriage of broadcast programming</header> <subsection id="HB8F0BCD95DE84EDAB6B90E04C3BFC415"><enum>(a)</enum><header>Agreements for carriage of broadcast programming</header><text>Section 325 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325</external-xref>) is amended—</text> 
<paragraph id="H4510EB6A272A4A21ADBE54692C5A6EC9"><enum>(1)</enum><text>in subsection (b)(3)(C)—</text> <subparagraph id="H3434235E99894518A1CFAEF254F3E488"><enum>(A)</enum><text>by striking clauses (ii), (iii), and (iv); and</text></subparagraph> 
<subparagraph id="H9888AED5191E4BF8AD10AB199BBF5F0E"><enum>(B)</enum><text>by redesignating clauses (v) and (vi) as clauses (ii) and (iii), respectively; and</text></subparagraph></paragraph> <paragraph id="H09AE8A8F7B6B43D1B4BEEC4A934214A7"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H514E3FC368CB48BF98E5A8CFB7F0F80C"><enum>(f)</enum><header>Requirements for marketplace agreements</header> 
<paragraph id="H6160FB7E031843F3955A9910BDF75706"><enum>(1)</enum><header>Negotiation requirements</header> 
<subparagraph id="H4DD9D0F4E488413FB54863915D8CF7A5"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of the Modern Television Act of 2021, the Commission shall, by regulation—</text> <clause id="H3400023C91AA41D180EC6604A64DB832"><enum>(i)</enum><text>require a television broadcast station and multichannel video programming distributor (and any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) to negotiate in good faith in any effort to reach a marketplace agreement; and</text></clause> 
<clause id="HC1DCD51EBE924C0CA22A3BEBD033E587"><enum>(ii)</enum><text>prohibit a television broadcast station from coordinating negotiations or negotiating on a joint basis with another television broadcast station in the same local market in an effort to reach a marketplace agreement with a multichannel video programming distributor, unless such stations are directly or indirectly under common de jure control permitted under the regulations of the Commission.</text></clause></subparagraph> <subparagraph id="HE903F249F7E04B4C924EE59C4510B100"><enum>(B)</enum><header>Good faith requirements</header><text>The regulations promulgated under paragraph (1)(A) shall provide—</text> 
<clause id="H6920B712ABB845DA96C52E3669E94202"><enum>(i)</enum><text>that it is a violation of the requirement under paragraph (1)(A)(i)—</text> <subclause id="H4A7D63B1E5FB40A4B948C75A645865A6"><enum>(I)</enum><text>for a multichannel video programming distributor, a qualified MVPD buying group, a television broadcast station, or a large station group to refuse to declare an impasse for the sole purpose of avoiding binding arbitration under subsection (g), as added by the Modern Television Act of 2021; or</text></subclause> 
<subclause id="H61050933E268472399BD63530563811F"><enum>(II)</enum><text>for a large station group to prohibit a qualified MVPD buying group from permitting a multichannel video programming distributor with which the large station group has an existing marketplace agreement to join a new marketplace agreement negotiated by the large station group and the qualified MVPD buying group upon the expiration of the existing marketplace agreement, if the multichannel video programming distributor was unable to join the new marketplace agreement at the time of the execution of the agreement because of the existing marketplace agreement;</text></subclause></clause> <clause id="H9364A71775804410B1832512E8A91418"><enum>(ii)</enum><text>that is not a violation of the requirement under paragraph (1)(A)(i)—</text> 
<subclause id="H71EC39921FA64C42A9B3474A530CDF04"><enum>(I)</enum><text>for a television broadcast station or large station group to enter into marketplace agreements containing different terms and conditions, including price terms and royalty fees, with different multichannel video programming distributors or with different qualified MVPD buying groups if such different terms and conditions are based on competitive marketplace considerations; or</text></subclause> <subclause id="HB87827CC1E2041C2BE27782AF15195A6"><enum>(II)</enum><text>for a multichannel video programming distributor or a qualified MVPD buying group to enter into marketplace agreements containing different terms and conditions, including price terms and royalty fees, with different television broadcast stations or with different large station groups if such different terms and conditions are based on competitive marketplace considerations;</text></subclause></clause> 
<clause id="HFD311E169E6643D1ACEF0E8ACA47CF0E"><enum>(iii)</enum><text>that a multichannel video programming distributor may satisfy its obligations under paragraph (1)(A)(i) by designating a qualified MVPD buying group to negotiate on its behalf, so long as the qualified MVPD buying group itself negotiates in good faith; and</text></clause> <clause id="HE30A069AD30E4013913590A33328ED9C"><enum>(iv)</enum><text>that a qualified MVPD buying group may satisfy any obligations under paragraph (1)(A)(i) to designate a representative with authority to make binding representations by designating such a representative that can make binding representations on the qualified MVPD buying group’s behalf.</text></clause></subparagraph></paragraph> 
<paragraph id="HC6F6D745279E49BFA23CBA83241F6AED"><enum>(2)</enum><header>Interim carriage</header><text>Not later than 90 days after the date of the enactment of the Modern Television Act of 2021, the Commission shall, by regulation, require a multichannel video programming distributor to retransmit a signal of a television broadcast station and the television broadcast station to permit the retransmission of that signal—</text> <subparagraph id="H259CB5F717E949BC8232F484A5CEF7CF"><enum>(A)</enum><text>for a period not longer than 60 days beginning on the date on which a marketplace agreement entered into by the television broadcast station and the multichannel video programming distributor (or by any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) expires; and</text></subparagraph> 
<subparagraph id="HA24FA7937CEC43FF9DF05AF46CF0DD81"><enum>(B)</enum><text>under the terms and conditions of such expired agreement.</text></subparagraph></paragraph> <paragraph id="HD61596B5255F4224AF75B5E6C9918E42"><enum>(3)</enum><header>Retroactivity of marketplace agreement</header><text>Not later than 90 days after the date of the enactment of the Modern Television Act of 2021, the Commission shall require, by regulation, each marketplace agreement entered into on or after such date of enactment by a television broadcast station and a multichannel video programming distributor (or by any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) to include a clause making the terms of the agreement retroactive to the expiration date of the most recent marketplace agreement entered into by or on behalf of the station and the distributor if the station and the distributor—</text> 
<subparagraph id="H61A92FDBB42C4A99B00A2517240AB119"><enum>(A)</enum><text>had previously entered into a marketplace agreement; and</text></subparagraph> <subparagraph id="H3605F394E8D9492FA3992C412A008D5B"><enum>(B)</enum><text>are required to retransmit a signal or permit the retransmission of a signal, as the case may be, under paragraph (2) or subsection (g), as added by the Modern Television Act of 2021.</text></subparagraph></paragraph> 
<paragraph id="H1498CD5B80BD4945ACE0CB2785945B8C"><enum>(4)</enum><header>Prohibition on requiring certain payments</header><text>Not later than 90 days after the date of the enactment of the Modern Television Act of 2021, the Commission shall, by regulation, prohibit a television broadcast station from requiring payment, either directly or indirectly, from a multichannel video programming distributor for customers of the multichannel video programming distributor who do not receive the signals of the television broadcast station from that distributor.</text></paragraph> <paragraph id="HF052648215A542EA855FD0168D7315F6"><enum>(5)</enum><header>Limitation</header><text>The requirements under this subsection do not apply with respect to mandatory carriage of the signal of a television broadcast station that elects mandatory carriage under section 338, 614, or 615.</text></paragraph> 
<paragraph id="HCFFC41CFE13C41FDB8B9C9ECCD335AF6"><enum>(6)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H36A2956C3AC64336A0E70B9AC084CCA5"><enum>(A)</enum><header>Large station group</header><text>The term <term>large station group</term> means a group of television broadcast stations that—</text> 
<clause id="HCA086251EBDC4B399E6DA2CD7CCC788C"><enum>(i)</enum><text>are directly or indirectly under common de jure control permitted by the regulations of the Commission; </text></clause> <clause id="H9E5A35465A0F4EBCA5BCB392953537BF"><enum>(ii)</enum><text>generally negotiate agreements for retransmission consent under this section as a single entity; and </text></clause> 
<clause id="H200D24A778684A0489E6982B40BC1C1C"><enum>(iii)</enum><text>include only television broadcast stations that collectively have a national audience reach of more than 20 percent.</text></clause></subparagraph> <subparagraph id="HAE04C39A5C084B0F89D2497C35196532"><enum>(B)</enum><header>Local market</header><text>The term <term>local market</term> has the meaning given such term in section 122(j) of title 17, United States Code.</text></subparagraph> 
<subparagraph id="H693B58B0F6FD420AB1AAC1ADFE073478"><enum>(C)</enum><header>Marketplace agreement</header><text>The term <term>marketplace agreement</term> means an agreement, or agreements, for—</text> <clause id="HDB0E2E8299424339B22EEDE3335A045C"><enum>(i)</enum><text>the exclusive right under section 106 of title 17, United States Code, to transmit a performance or display of a work embodied in primary transmission (as defined in section 111(f) of such title) of a television broadcast station and the royalty fee payable; or</text></clause> 
<clause id="H53183F36BFD7475ABA649EA9188275ED"><enum>(ii)</enum><text>retransmission consent under subsection (b), as in effect before the repeal made by the Modern Television Act of 2021.</text></clause></subparagraph> <subparagraph id="H3B6BA14FAC0149DFAEDF590BDBA3C62D"><enum>(D)</enum><header>Multichannel video programming distributor</header><text>The term <term>multichannel video programming distributor</term> has the meaning given such term in section 602.</text></subparagraph> 
<subparagraph id="HD8DEE527439F4C8BB87469CEB1117C82"><enum>(E)</enum><header>Qualified MVPD buying group</header><text>The term <term>qualified MVPD buying group</term> means an entity that, with respect to a negotiation with a large station group for retransmission consent under this section—</text> <clause id="H16233D8051D94FDB8B424FC806647855"><enum>(i)</enum><text>negotiates on behalf of two or more multichannel video programming distributors—</text> 
<subclause id="H04846258B9E54361BA146BA2E9A838D6"><enum>(I)</enum><text>none of which is a multichannel video programming distributor that serves more than 500,000 subscribers nationally; and </text></subclause> <subclause id="H8824BEB33DE74EA5AF9421F3C8996534"><enum>(II)</enum><text>that do not collectively serve more than 25 percent of all households served by multichannel video programming distributors in any single local market in which the applicable large station group operates; and </text></subclause></clause> 
<clause id="H3A7CFD9264CE41918EDEE881AFF1A238"><enum>(ii)</enum><text>negotiates agreements for such retransmission consent—</text> <subclause id="HACC0EF93033145AE9B9DF876797FF651"><enum>(I)</enum><text>that contain standardized contract provisions, including billing structures and technical quality standards, for each multichannel video programming distributor on behalf of which the entity negotiates; and </text></subclause> 
<subclause id="H3D869AD6730C47AEBFB9A598EABEB81B"><enum>(II)</enum><text>under which the entity assumes liability to remit to the applicable large station group all fees received from the multichannel video programming distributors on behalf of which the entity negotiates. </text></subclause></clause></subparagraph> <subparagraph id="H19E64ABE8C0144AE8F82A9605CBAF730"><enum>(F)</enum><header>Television broadcast station</header><text display-inline="yes-display-inline">The term <term>television broadcast station</term> means an over-the-air commercial or noncommercial television broadcast station licensed by the Commission under subpart E of part 73 of title 47, Code of Federal Regulations, except that such term does not include a low-power or translator television station. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H62D023BF12E748A38AE2BA6A574CB337"><enum>(b)</enum><header>Effective date</header><text>This section, and the amendments made by this section, shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></subsection></section> <section id="H302227B2523A4A70B4DC0CF9694EFF31"><enum>3.</enum><header>Repeal of regulatory intervention in the television marketplace under the communications act of 1934</header> <subsection id="HD455801512344FECBA4515C34DC317BF"><enum>(a)</enum><header>Repeal</header><text>The following sections of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) are hereby repealed:</text> 
<paragraph id="H6EE6566DE2ED4B429AA169D30B8F559B"><enum>(1)</enum><text>Section 325(b) (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)</external-xref>).</text></paragraph> <paragraph id="HF7A4D377A3C44133ADA62EF6AC963F24"><enum>(2)</enum><text>Section 325(e) (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(e)</external-xref>).</text></paragraph> 
<paragraph id="HC562E87A0D9547239120A78E5095741F"><enum>(3)</enum><text>Section 339 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339</external-xref>).</text></paragraph> <paragraph id="H5F7191E2CCC24CB5BFF04F6C82CCA66F"><enum>(4)</enum><text>Section 340 (<external-xref legal-doc="usc" parsable-cite="usc/47/340">47 U.S.C. 340</external-xref>).</text></paragraph>

<paragraph id="H6298EE7C65A543F0956874A954639D65"><enum>(1)</enum><header>Section 338</header><text>Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338</external-xref>) is amended—</text> <subparagraph id="H39FFE37657E54C10AF2C470B117EE747"><enum>(A)</enum><text>in subsection (a)—</text>

<paragraph id="HC21DB82DF61A4DC8BC483E4C6170408E"><enum>(5)</enum><header>Nondiscrimination in carriage of high definition signals of noncommercial educational television stations</header><text>If, on or after the date of enactment of the Satellite Television Extension and Localism Act of 2010, an eligible satellite carrier initiates the provision of any secondary transmission in high definition format to subscribers located within the local market of a television broadcast station of a primary transmission made by that station, then such satellite carrier shall carry the signals in high-definition format of all qualified noncommercial educational television stations located within that local market.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H45A6AA6D0F014E0EBA696A420040DB9D"><enum>(B)</enum><text>in subsection (d), by inserting <quote>seeking carriage under subsection (a)(1)</quote> after <quote>signal of a local television broadcast station</quote>;</text></subparagraph> 
<subparagraph id="HBA9CC40BC672460793B57C6E1753ED3F"><enum>(C)</enum><text>by striking subsection (h);</text></subparagraph> <subparagraph id="H93B1206D8CCB4057A1FCDD76A304E0B1"><enum>(D)</enum><text>by redesignating subsections (i), (j), (k), and (l) as subsections (h), (i), (j), and (k), respectively;</text></subparagraph>

<subparagraph id="H054FC45EE9024DBCA43F32BCAC88B26A"><enum>(A)</enum><text>by striking subsections (a), (b), (c), (d), (g), (h), (i), (j), (k), (l), (m), (n), and (o);</text></subparagraph> <subparagraph id="HDCFCC8B50FD94647967BD49F2E29665C"><enum>(B)</enum><text>by redesignating subsections (e) and (f) as subsections (a) and (b), respectively; and</text></subparagraph> 
<subparagraph id="H2AE02E0A8D644B4481FDB423F3BC72A7"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H398CE468D9604C42B46FD0562FBFEBF9" style="OLC"> <subsection id="H4347C66B994F4897935BF3BD58209704"><enum>(c)</enum><header>Regulation of rates and broadcast signal carriage</header><text>No Federal agency, State, or franchising authority may regulate—</text> 
<paragraph id="HF01F159539A645D3B9009F1156F6B878"><enum>(1)</enum><text>the rates for the provision of multichannel video programming services of a multichannel video programming distributor; or</text></paragraph> <paragraph id="H02542AC0B0C745BEB3B299C721E4A2B5"><enum>(2)</enum><text>the retransmission of television broadcast signals by a multichannel video programming distributor except in accordance with the requirements of sections 325, 338, 614, and 615.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>

<clause id="H8CD8B56D25F94876B8496A4D46F54671"><enum>(ii)</enum><text>is owned and operated by a municipality and transmits predominantly noncommercial programs for educational purposes.</text></clause></subparagraph> <subparagraph id="H76503FF86FD34F469B0C27322574C4CC"><enum>(B)</enum><header>Inclusions</header><text>Such term includes—</text> 
<clause id="HBDFC1521C5D445838D8E4CED7B51D810"><enum>(i)</enum><text>the translator of any noncommercial educational television station with five watts or higher power serving the franchise area;</text></clause> <clause id="H361C979A563543BB9E479737C5955852"><enum>(ii)</enum><text>a full-service station or translator if such station or translator is licensed to a channel reserved for noncommercial educational use pursuant to section 73.606 of title 47, Code of Federal Regulations, or any successor regulations thereto; and</text></clause>

<section id="HF2E36EB6B6444DF3BE98569AC55C5F8E"><enum>4.</enum><header>Binding arbitration</header><text display-inline="no-display-inline">Section 325 of the Communications Act of 1934, as amended by sections 2 and 3, is further amended by adding at the end the following:</text> <quoted-block id="H0C98E617E2A145ABAD6887FF33D34CC7" style="OLC"> <subsection id="H5E9ED0AC67B345D2976432FF07CD1299"><enum>(g)</enum><header>Binding arbitration</header> <paragraph id="HC5B6D12A1C2A4D9BBEC4CD28D210889F"><enum>(1)</enum><header>Requirement</header><text>Beginning on the date that is 90 days after the date on which this subsection takes effect, the Commission shall, by regulation—</text> 
<subparagraph id="H0F6C07503A0B43F3ABD97CDA78055F27"><enum>(A)</enum><text>provide that the Commission may require a television broadcast station and multichannel video programming distributor negotiating a marketplace agreement (and any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) to submit to binding arbitration—</text> <clause id="H0AB79A6CB3F84D42AE8167E2F077C5E2"><enum>(i)</enum><text>upon—</text> 
<subclause id="HEBC41177E8BE4FBFAF78A8555F3EE06B"><enum>(I)</enum><text>a declaration of an impasse in negotiations by all parties negotiating the agreement;</text></subclause> <subclause id="HB6BBC370204B4C34AA282C4D7FC9DA36"><enum>(II)</enum><text>a preliminary finding by the Commission of a violation of the good faith requirement under subsection (f)(1)(A)(i); or</text></subclause> 
<subclause id="HBF6D1814EA0B4F32A7839F73E3666099"><enum>(III)</enum><text>the failure of the television broadcast station and multichannel programming distributor (or any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) to reach a marketplace agreement by the date that is 60 days after the date on which a marketplace agreement entered into by the television broadcast station and the multichannel video programming distributor (or by any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) expires; and</text></subclause></clause> <clause id="H36DB1A8E431F4598AC672BAB089B12D6"><enum>(ii)</enum><text>in a form substantially similar to that imposed in Section VII of Appendix A of the Memorandum Opinion and Order in the matter of Applications of Comcast Corporation, General Electric Company and NBC Universal, Inc. For Consent to Assign Licenses and Transfer Control of Licensees that was adopted by the Commission on January 18, 2011 (FCC 11–4); and</text></clause></subparagraph> 
<subparagraph id="H31B56CEB8E4243AB99D58B82852A0B2A"><enum>(B)</enum><text>provide that the Commission may require a multichannel video programming distributor to retransmit a signal of a television broadcast station and the television broadcast station to permit the retransmission of that signal—</text> <clause id="H6ED201D64D2948AEAC67E9AE477615CB"><enum>(i)</enum><text>during any period in which the television broadcast station and the multichannel video programming distributor (or any large station group or qualified MVPD buying group negotiating for a marketplace agreement on behalf of a television broadcast station or multichannel video programming distributor, respectively) are required to submit to binding arbitration under subparagraph (A); and</text></clause> 
<clause id="HF5F04FBCED1241628B25E40CB215EAA2"><enum>(ii)</enum><text>in accordance with the interim carriage provisions imposed in Section VII of Appendix A of the Memorandum Opinion and Order described under subparagraph (A)(ii).</text></clause></subparagraph></paragraph> <paragraph id="HCDB701FE0848414B9BD25B0786299279" commented="no"><enum>(2)</enum><header>Definitions</header><text>In this subsection, the terms <term>large station group</term>, <term>marketplace agreement</term>, <term>multichannel video programming distributor</term>, <term>qualified MVPD buying group</term>, and <term>television broadcast station</term> have the meaning given those terms in subsection (f).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="HA9E09A7CFEF94E14AFF0F4431952F449"><enum>(15)</enum><header>Satellite carrier</header><text>The term <term>satellite carrier</term> means an entity that uses the facilities of a satellite or satellite service licensed by the Federal Communications Commission and operates in the Fixed-Satellite Service or the Direct Broadcast Satellite Service under part 25 of title 47, Code of Federal Regulations, to establish and operate a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to provide such point-to-multipoint distribution, except to the extent that such entity provides such distribution pursuant to tariff under the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.), other than for private home viewing.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HF591AC1768FB440CA3E4FE759DB9EBCC"><enum>(c)</enum><header>Section 122</header><text>Section 122 of title 17, United States Code, is amended—</text>

<paragraph id="H85B834D9CB934CE3B04C1B5065EC85BA"><enum>(1)</enum><text>repeal section 73.658 of the Commission’s rules (47 CFR 73.658);</text></paragraph> <paragraph id="HCB0B02988DAF428DA23812E5539BD3E8"><enum>(2)</enum><text>repeal subpart F of part 76 of the Commission’s rules; and</text></paragraph> 
<paragraph id="H047F948D49A04B05AEE81DBA19AA5F14"><enum>(3)</enum><text>modify subpart S of part 76 of the Commission’s rules by eliminating any requirements relating to network nonduplication and syndicated exclusivity for open video systems.</text></paragraph></section> <section id="HBDD09BBC43874070A2CC3AE3A7B74FAE"><enum>7.</enum><header>Report</header><text display-inline="no-display-inline">Section 13 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/163">47 U.S.C. 163</external-xref>) is amended—</text> 
<paragraph id="H3F7B177D7756499D929AA4BD4157C97B"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H05C5A22B22CF48D99D2917A014C12EDB"><enum>(A)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph>

<subsection id="H6A1C0C8A68DE42F3BB786F2328CFECF7"><enum>(e)</enum><header>Comptroller general study</header> 
<paragraph id="H75163DE708AB4EDA809A22F3467FA47C"><enum>(1)</enum><header>Study</header><text>Not later than 4 years after the date of the enactment of the Modern Television Act of 2021, and every two years thereafter, the Comptroller General of the United States, in consultation with the Commission, shall study the effect of the regime established under such Act, and the amendments made by such Act, by measuring—</text> <subparagraph id="H2F62DBBA508F4E5A81F561939E56AE25"><enum>(A)</enum><text>the price consumers pay for video programming, adjusted to reflect national monetary inflation or deflation;</text></subparagraph> 
<subparagraph id="H2CCF1ABCE4C94B3DA6028D1CC5D5455C"><enum>(B)</enum><text>the satisfaction of consumers with the quality of video programming and the services of multichannel video programming distributors;</text></subparagraph> <subparagraph id="H0E91566DB34746F6AC64F9A5AE3291E2"><enum>(C)</enum><text>the—</text> 
<clause id="HEA8BBF3F735F4574A903F16CF0C6629D"><enum>(i)</enum><text>number of interruptions to the distribution of programming to consumers because of impasses in negotiations between multichannel video programming distributors and television broadcast stations;</text></clause> <clause id="H887D88CBEAF04292B593DDF41BA99329"><enum>(ii)</enum><text>duration of each interruption; and</text></clause> 
<clause id="H8024A02067F94C91B89703F38AE0F183"><enum>(iii)</enum><text>number of consumers impacted by each interruption; and</text></clause></subparagraph> <subparagraph id="H5C225EA1C0AC4C55936484FC9F5DB198"><enum>(D)</enum><text>consumer access to local programming, including news, weather, sports, and public, educational, and governmental programming.</text></subparagraph></paragraph> 
<paragraph id="H85CB46ECD7F4490780CC2FD71E8E863E"><enum>(2)</enum><header>Determination by commission</header><text>The Commission shall determine under the study described in paragraph (1) if the totality of the measurements described in such paragraph present a net positive, net negative, or indeterminate impact to consumers and to the marketplace.</text></paragraph> <paragraph id="H49BFD0A6BA0E45B49029DBD51BD696E0"><enum>(3)</enum><header>Definitions</header><text>In this subsection, the terms <term>video programming</term> and <term>multichannel video programming distributor</term> have the meaning given those terms in section 602.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC7B03B68A4AA4DABADB0D75EF881293E"><enum>8.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or any application of such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of the provisions of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section> <section id="H2A3812F3340E4EF7BCCE5BC51CFCF1CD"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in section 2, this Act, and the amendments made by this Act, shall take effect on the date that is 42 months after the date of the enactment of this Act.</text></section>
