Doyle of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/261">chapter 261</external-xref> of title 49, United States Code, to provide for high-speed rail corridor development, and for other purposes.</official-title></form><legis-body id="H5FC91168DEAA41D59EF5C240842A3B08" style="OLC"><section id="H23F824027BE648D0B15DC023D4B33689" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American High-Speed Rail Act</short-title></quote>.</text></section><section id="H97F0D1249A4A46B79E38B6B9F168A895" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Amendments to certain high-speed rail assistance provisions</header><subsection id="H8DE9ABE3E32C4FE594C6C1D4A99E607F" commented="no"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">Amendments made by this Act, and the applications of such amendments to other persons or circumstances, to chapter 261 shall apply to any Federal assistance provided on or after the date of the enactment of this Act.</text></subsection><subsection id="H54D2BC0777304681B92E3E11E8C59812"><enum>(b)</enum><header>High-Speed rail corridor planning</header><text display-inline="yes-display-inline">Section 26101 of title 49, United States Code, is amended—</text><paragraph id="H80CA7C0ECD684B0BBE4368FA873BEDC9" commented="no"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H2088A1E164274CD0B65D3AD4103F880A" commented="no"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or group of public agencies for corridor planning for up to 50 percent</quote> and inserting <quote>, a group of public agencies, or a consortium composed of a public agency or group of public agencies and a private entity, for corridor planning for up to 100 percent</quote>;</text></subparagraph><subparagraph id="H36BA8AD80FC746178024D2BA84260EEF" commented="no"><enum>(B)</enum><text>in paragraph (2), by striking <quote>No less</quote> and all that follows through the period at the end and inserting <quote>The Secretary shall prioritize providing financial assistance for corridor planning activities with respect to which at least 20 percent of the total costs associated with eligible activities shall be from specified financial sources.</quote>; and</text></subparagraph><subparagraph id="H30EC829020904C29AC167C74167337B9" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H818788BE87B4408C8387E1CB0891552E"><paragraph id="H64640A816BEC4F05B37112F2A725FDEA" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>specified financial source</term> means—</text><subparagraph id="HDE54672F121A4BFE8E866C66C1BD06A2" commented="no"><enum>(A)</enum><text>the Railroad Rehabilitation and Improvement Finance program under chapter V of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821</external-xref> et seq.);</text></subparagraph><subparagraph id="HA48310080D134937A7BE249516511671" commented="no"><enum>(B)</enum><text>the transportation infrastructure finance and innovation program in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23;</text></subparagraph><subparagraph id="HB61FA93312CA411A841AE20F607A788C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">funding provided by the government of a country that is adjacent to the international border of the United States through which the proposed corridor will cross;</text></subparagraph><subparagraph id="H6D5988789EC942279EB95069EB939982"><enum>(D)</enum><text display-inline="yes-display-inline">a State, local, or private source; or</text></subparagraph><subparagraph id="H9ACDE4B8FC9446EE8655F16ADA1D6D0B"><enum>(E)</enum><text>any combination of the sources described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="H9DCDA2CB0BFA4F2B94AE5B6BDCD65351" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">For any funds derived from the programs described in subparagraphs (A) and (B) of paragraph (3) that are used for costs associated with eligible activities, such funds shall be repaid from State, local, or private sources.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H63DAD22E9BEE4ED6ACC8077D8174FACE"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HAB8DA25E733A4881B71B74BD3D978593"><enum>(A)</enum><text>by striking paragraph (2); and</text></subparagraph><subparagraph id="HED7379A8F2BD414B97404849DF9BF02B"><enum>(B)</enum><text>by striking <quote>(1) A corridor</quote> and inserting <quote>A corridor</quote>;</text></subparagraph></paragraph><paragraph id="H0FCE032E52084A7F9004CCA252F67093"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="HDEB1F73CF6804D2BAC836E06283609F8"><enum>(A)</enum><text>in paragraph (13) by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H4EA741B7D55E4B17BA7A9C0EFE533CEC"><enum>(B)</enum><text>by redesignating paragraph (14) as paragraph (16); and</text></subparagraph><subparagraph id="H9726750196904BC5AE9C732124CF9546"><enum>(C)</enum><text>by inserting after paragraph (13) the following:</text><quoted-block style="USC" id="HC7DD736FA3BF4F27B33B952063C75613" display-inline="no-display-inline"><paragraph id="H6F3A4116F088438D8870635D4BA93B74"><enum>(14)</enum><text display-inline="yes-display-inline">impacts associated with equity, resilience, sustainability, economic development, and climate;</text></paragraph><paragraph id="H0E6FF6D9A93141C4ADDCB2A8DBBBC636"><enum>(15)</enum><text>the potential to serve an eligible place, as such term is defined in section 41731; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3ABE5B89202B484A9CF81D9AE692EC67"><enum>(4)</enum><text>by adding at the end the following subsection:</text><quoted-block style="OLC" id="H308BEB5BFA5C421CB784824E8AB6A290" display-inline="no-display-inline"><subsection id="HDBDCF85F319E4043B4C917E5133069F8"><enum>(d)</enum><header>Projects or activities for higher-Speed rail</header><paragraph id="H5BF60CFF3F1C4011B17D27ECB28C8EC2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to grants awarded under this section, the Secretary may award not more than 20 percent of grants under this section for projects or activities for higher-speed rail.</text></paragraph><paragraph id="H27996B254C254C5A81ACD7AF5D32C4A2"><enum>(2)</enum><header>Relevant requirements</header><text>With respect to grants under paragraph (1), the Secretary may apply requirements for high-speed rail to projects or activities for higher-speed rail, where applicable.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA8934FC6B5584A5FA95C1E7331F66A68"><enum>(c)</enum><header>High-Speed rail technology improvements</header><text display-inline="yes-display-inline">Section 26102 of title 49, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="USC" display-inline="no-display-inline" id="H065026A6606D499A9E0E204FBCE8A187"><subsection id="H94758577A006413D9D9D0EDB3BAC2B9A"><enum>(d)</enum><header>Factor To consider</header><text display-inline="yes-display-inline">In providing financial assistance to eligible recipients under subsection (b), the Secretary may consider activities that incorporate the use of technologies that facilitate intermodal connections and connections with other passenger rail systems.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC67E65BAEF3C44179B2E85B711DFC1C8" commented="no"><enum>(d)</enum><header>Safety regulations</header><text display-inline="yes-display-inline">Section 26103 of title 49, United States Code, is amended by striking <quote>such</quote> and all that follows and inserting <quote>comprehensive, performance-based regulations for all high-speed rail projects. Such regulations shall not inhibit interoperability within the high-speed rail network.</quote></text></subsection><subsection id="H647B208A36914B8EB33CAAB63C71DF8D"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 26105 of title 49, United States Code, is amended—</text><paragraph id="H907A7E0C0DD74A9CB63EBAA7A798277E"><enum>(1)</enum><text>in paragraph (2), by striking <quote>of more than 125 miles per hour</quote> and inserting <quote>of 186 miles per hour or more</quote>; and</text></paragraph><paragraph id="H1FCC8336C8D74C2FB7C47CC1D3311D0F" commented="no"><enum>(2)</enum><text>by adding at the end the following paragraph:</text><quoted-block style="USC" id="H400BFD78CA52490187D5342A761EB87F" display-inline="no-display-inline"><paragraph id="H002904D3540644C5B63F49F65112E0E4" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>higher-speed</term>—</text><subparagraph id="H91C4588651634E45B5B56936937647A7"><enum>(A)</enum><text>means all forms of nonhighway ground transportation that run on rails or electromagnetic guideways providing transportation service which is—</text><clause id="H523D297124A442F680E6D5456C138D61" commented="no"><enum>(i)</enum><text>reasonably expected to reach sustained speeds of more than 110 miles per hour but less than 186 miles per hour; and</text></clause><clause id="HDFA90E7F933C42AB9845D3A2E27612AE" commented="no"><enum>(ii)</enum><text>made available to members of the general public as passengers; and</text></clause></subparagraph><subparagraph id="H56027F51DF7549F0AE4D8CF120286E27"><enum>(B)</enum><text>does not include rapid transit operations within an urban area that are not connected to the general rail system of transportation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBD795C8DD591410D91CA7E221622FBA6"><enum>(f)</enum><header>High-Speed rail corridor development</header><text>Section 26106 of title 49, United States Code, is amended—</text><paragraph id="HD027F6144D564DF1BD3974516889C314" commented="no"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>In carrying out the program, the Secretary may designate high-speed rail corridors.</quote>;</text></paragraph><paragraph id="H370FAD37E3B14DE485655E4D065241EA"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HA70D4D89F6854AD8BCE649B26507CDC1"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or Amtrak</quote> and inserting <quote>, Amtrak, or a consortium of a private entity and one or more of any of the entities listed in this paragraph</quote>;</text></subparagraph><subparagraph id="HD0939C87DE6D43C58F769D5522C94AD7" commented="no"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>before the date of the enactment of MAP–21 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>) or a corridor designated by the Secretary under subsection (a).</quote>; and</text></subparagraph><subparagraph id="HDDF467AFF6CB4AEEBF8AF28FCC2614BE" commented="no"><enum>(C)</enum><text>in paragraph (4), by striking <quote>of at least 110 miles per hour</quote> and inserting <quote>of 186 miles per hour or more</quote>;</text></subparagraph></paragraph><paragraph id="HF29D96AF43B343F69A3430D535E7327C"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="HD1E6BD61F681489D90E15BA83841E7CE"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H45F25D22F4884E7F9CCECB64B777369B"><enum>(i)</enum><text>in subparagraph (B)(i)—</text><subclause id="H1D5D15FE607F4FA28E8BB983BCB5E9B2"><enum>(I)</enum><text>in subclause (I), by adding <quote>and</quote> at the end; and</text></subclause><subclause id="H6583633605CC403B93B1D5AEADF36CC5"><enum>(II)</enum><text>in subclause (II), by striking <quote>and</quote> at the end;</text></subclause></clause><clause id="H30E6EB5A44844D54B7A5233B64302F8F"><enum>(ii)</enum><text>in subparagraph (B)(ii)(IV), by inserting <quote>and</quote> at the end; and</text></clause><clause id="H635DD20F339642CEAE47FE226B334F6B"><enum>(iii)</enum><text>in subparagraph (C)(i)—</text><subclause id="H12BE46677050447EB7E6A127C6D72774"><enum>(I)</enum><text>in subclause (II) by inserting <quote>, including where a grant will support the plans of an Interstate Passenger Rail Commission or other entity with the goal of developing a regional passenger rail system involving 2 or more States</quote> before the semicolon; </text></subclause><subclause id="HA261DAE0C9DA4858A7DB597D4EE34DA6"><enum>(II)</enum><text>in subclause (IV), by inserting <quote>electrification or</quote> after <quote>involve</quote>; and</text></subclause><subclause id="H51E2813F385540F0992BD4191D8B8131" commented="no"><enum>(III)</enum><text>in subclause (V), by striking the semicolon and inserting <quote>, including as a result of transit-oriented development, connectivity between areas of high-economic development and areas with a low cost of living, or the agglomeration of effects along a passenger rail corridor.</quote>;</text></subclause><subclause id="H13A9620B91664B62A7B4F69394F1279F"><enum>(IV)</enum><text>in subclause (VI) by striking <quote>and</quote> at the end; </text></subclause><subclause id="H159CD9B17DBA4E8D870507AE481E7CA4"><enum>(V)</enum><text>by redesignating subclause (VII) as subclause (IX); and</text></subclause><subclause id="H7E30C9F29E774C71830E3867520BA04E"><enum>(VI)</enum><text>by inserting after subclause (VI) the following: </text><quoted-block style="USC" id="H6C33966460194F9293F8997A56B93E1B" display-inline="no-display-inline"><subclause id="H4386700E20E34371BC35C8C3CB1EE5B9"><enum>(VII)</enum><text display-inline="yes-display-inline">impacts associated with equity, resilience, sustainability, economic development and climate</text></subclause><subclause id="HBCF989C1C674437481644A3816D7CB55"><enum>(VIII)</enum><text>ability to serve an eligible place, as such term is defined in section 41731; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="H9E19D24B24EB4BAAA0F26DED619CDC18"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="H619F11953B874B6EB15F6EA4411630BE"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>(A) The Secretary</quote>; and</text></clause><clause id="H3F8685C219A34C1886C1DF3AE59D7676"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H33C92633A3A44958A3FC655EED8CD22C" display-inline="no-display-inline"><subparagraph id="H01A6046E080248229E71C07CA6FEE103"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall not establish mandatory spending timelines for costs and activities associated with the project.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HA2FEA2929B064038BC1B15CC8F22F524"><enum>(4)</enum><text>in the heading of subsection (f), by striking <quote><header-in-text level="subsection" style="USC">Federal share</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Funding</header-in-text></quote>;</text></paragraph><paragraph id="HECE93BC2F66C487BBCC89940D6C91413"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (f),</text><subparagraph id="HE34B682761DF45AC83BBDAD4EFD44783" commented="no"><enum>(A)</enum><text>by striking <quote>The Federal share</quote> and all that follows and inserting <quote>(1) <header-in-text level="paragraph" style="USC">Federal share.—</header-in-text>With respect to the net capital cost of a project financed under this section, the Federal share of such cost may be up to 100 percent.</quote>; and</text></subparagraph><subparagraph id="H604ACDD04D7F4774B883D32EAB8B4F65"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="HAA24F7AE915D43418F7B72D2A5F0E927"><paragraph id="HFE8A3B4B60564416AAEC89EAD9DA60CE" commented="no"><enum>(2)</enum><header>Non-Federal share</header><subparagraph id="HE60659FD51B54CD8AB87BD368A465CFE" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall prioritize financing capital projects in high-speed rail corridors with respect to which at least 20 percent of the project net capital cost is funded through specified financial sources.</text></subparagraph><subparagraph id="H653FCF0C13F5480FA074DBE522CEA614"><enum>(B)</enum><text display-inline="yes-display-inline">In this section, the term <term>specified financial source</term> means—</text><clause id="H4C39F69FD1794822B15E9E49FD30E977" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the Railroad Rehabilitation and Improvement Finance program under chapter V of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821</external-xref> et seq.);</text></clause><clause id="H6A4FBF9C5C9B4CEC8698BD4755574E42" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the transportation infrastructure finance and innovation program in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23;</text></clause><clause id="HDDCC123B3D1B4EC881C871CC6DFCA8C2" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">funding provided by the government of a country that is adjacent to the international border of the United States through which the proposed corridor will cross;</text></clause><clause id="HAAB61DDF37DC4F7B9EBF549F40F69FDC"><enum>(iv)</enum><text display-inline="yes-display-inline">a State, local, or private source; or</text></clause><clause id="H4B6EE74B01C34036B001D3E2477AD4E5"><enum>(v)</enum><text>any combination of the sources described in clauses (i) through (v).</text></clause></subparagraph><subparagraph id="H6D7DF7F53A69460EA44621B6A4B39CFF" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">For any funds derived from the programs described in clauses (i) or (ii) of subparagraph (B) that are used to finance costs associated with capital projects in high-speed rail corridors, such funds shall be repaid from State, local, or private sources.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H34FE351B6A2E4FD5BD4AE4A1E6B790AF"><enum>(6)</enum><text>by striking subsection (g) and inserting the following:</text><quoted-block style="USC" id="H60EEEB1268C64143B13BB3FA3A411509" display-inline="no-display-inline"><subsection id="HFB1F6ACAF32A4147B94D3556829CB1CA" commented="no"><enum>(g)</enum><header>Presidential border permits</header><text display-inline="yes-display-inline">With respect to any project that requires construction, connection, operation, or maintenance, at the international boundaries of the United States, the Secretary of State shall provide the applicant of such project with the necessary Presidential permits required for such project, unless the Secretary of State determines that the provision of such permit would not be in the interest of national security.</text></subsection><after-quoted-block>; and</text></subparagraph><subparagraph id="HBC75FEA00A1B4447B29A5D72AAA7E2CE"><enum>(F)</enum><text>will not result in elimination or reduction of benefits or assistance to a displaced person required by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601</external-xref> et seq.) and title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref> et seq.).</text></subparagraph></paragraph></subsection><subsection id="H2758858507C3452885A85EA0AFF5A454"><enum>(c)</enum><header>Environmental reviews</header><paragraph id="H0B625E0AC91143DF895CE8886A8A14F1"><enum>(1)</enum><header>Completion of NEPA review</header><text>Before authorizing Federal funding for an acquisition of a real property interest, the Secretary shall complete all review processes otherwise required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), section 4(f) of the Department of Transportation Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/49/303">49 U.S.C. 303</external-xref>), and section 106 of the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470f">16 U.S.C. 470f</external-xref>) with respect to the acquisition.</text></paragraph><paragraph id="HEE79B5D561BF41A3A090518647087752"><enum>(2)</enum><header>Timing of development acquisition</header><text>A real property interest acquired under subsection (a) may not be developed in anticipation of the proposed project until all required environmental reviews for the project have been completed.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H08979CABF3414110A539D1351146CFA1"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/242">chapter 242</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/24202">section 24202</external-xref> the following:</text><quoted-block style="USC" id="HB2AE29CD965A43BABEE739DC4D85574C" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">24203. trains.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9B071853AAEC40A09DF510EC6C0A9C50" section-type="subsequent-section"><enum>4.</enum><header>Pilot program for transit-oriented development planning</header><text display-inline="no-display-inline">Section 20005(b) of the <short-title>Moving Ahead for Progress in the 21st Century Act</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2E18758FEF8D4F1098A6AD09D127E1CC"><paragraph id="H9683558E900D42C1BEC65072E69420D5"><enum>(4)</enum><header>Special consideration</header><text>With respect to eligible projects involving high-speed rail corridor development, the Secretary shall give greater consideration to communities in which such projects are proposed to occur.</text></paragraph><paragraph id="HB277E924437D4EC49F9B21A54742163E"><enum>(5)</enum><header>Authorizations of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $20,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA0BE8E8051BF43F49714CE133861CF43"><enum>5.</enum><header>Payments of credit risk premiums</header><text display-inline="no-display-inline">Section 502(f) of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4054452B71124F7AA718191412E67D32" display-inline="no-display-inline"><paragraph id="H692A7FC39082469E8658813717554658" commented="no"><enum>(5)</enum><header>Availability of grant amounts</header><text display-inline="yes-display-inline">Amounts provided under the heading <quote>Office of the Secretary—National Infrastructure Investments</quote> in the Department of Transportation Appropriations Act, 2016 (title I of division L of <external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>), the Transportation, Housing and Urban Development, and Related Agencies Appropriations Act, 2018 (title I of division L of <external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>), or any subsequent appropriation Act may be used to pay credit risk premiums under this subsection.</text></paragraph><paragraph id="H1B243AC54D824D6FAB7AA7A5E8F2F504"><enum>(6)</enum><header>Refund of premium</header><text>The Secretary shall repay the credit risk premium required under this subsection not later than 60 days after the date on which all obligations attached to each such loan have been satisfied.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H04EDE601E80F4DF685EF5FE1216572C0"><enum>6.</enum><header>Private activity bonds</header><subsection id="H97CAE9D2D11A42488D61EED40D2ABA6E"><enum>(a)</enum><header>National limitation</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/142">Section 142(m)(2)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$15,000,000,000</quote> and inserting <quote>$30,000,000,000</quote>.</text></subsection><subsection id="H26C36D6A98284D76BDD115DC679361A9"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to allocations made on or after the date of the enactment of this Act.</text></subsection></section><section id="H4EE1CC7D790F40B783BCB31613D07395"><enum>7.</enum><header>Acquiring freight train right of way</header><subsection id="H81B7654EFEB442688C5143AFEE463796"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/261">Chapter 261</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H33FF2D485DD445D9A410B211F478062E" display-inline="no-display-inline"><section id="H803458FF658441B2958E25F2997DD830"><enum>26107.</enum><header>Acquiring freight rail right-of-way</header><subsection id="HA97F102D5FC0451CA8E6377EAB9BE56B"><enum>(a)</enum><header>Sale of property</header><text display-inline="yes-display-inline">A rail carrier may sell, grant an easement on, or lease real property to a recipient of financial assistance under section 26101 or section 26106.</text></subsection><subsection id="HB9A95821916E445BA585CB2F1C110377" commented="no"><enum>(b)</enum><header>Grants for acquisition of additional real property along right-of-Way</header><text>In the case of a rail carrier that sells, grants an easement, or leases property under subsection (a) and that acquires additional real property along the portion of the right-of-way subject to such sale, grant, or lease, the Secretary of Transportation shall make one or more grants to such rail carrier which, in the aggregate, shall not exceed the aggregate amounts received by such rail carrier pursuant to such sale, grant, or lease.</text></subsection><subsection id="H1B589FAE73444D338B45CA5CB86E3A20"><enum>(c)</enum><header>Tax treatment</header><paragraph id="HAE05B9ED229B461CB0D63C175A9C5854"><enum>(1)</enum><header>Exclusion of gain, etc</header><text>Any gain on the sale of any interest in real property described in subsection (a) (including the granting of an easement on such real property), or any payment made under any lease of such real property, shall not be includible in the gross income of such rail carrier for purposes of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HF6C0B3A0CDC442A499222AFCB0387312"><enum>(2)</enum><header>Exclusion of grant amounts</header><text>The amount of grant provided under subsection (b) shall not be includible in the gross income of the recipient of such grant for purposes of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HC0C0470480F340459D0B20E216DE9BED"><enum>(3)</enum><header>Exclusion of certain capital improvements</header><text display-inline="yes-display-inline">Any capital investment or improvement (including turnouts, passing track, signaling, crossings, and barriers) made pursuant to section 26101 or section 26106 by a recipient of financial assistance under such section on any real property owned by the rail carrier referred to in subsection (a) shall not be includible in the gross income of such rail carrier for purposes of the Internal Revenue Code of 1986.</text></paragraph></subsection><subsection id="HBB64D0E22F2E4645AF4B3826749BC3AE"><enum>(d)</enum><header>Applicability of law</header><text>Section 28103 shall apply to property described in subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6A889CA9600844B389FE566BEE2E8D54"><enum>(b)</enum><header>Clerical Acquiring freight rail right-of-way.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H394DCC6731CA4C5394B1BE308556E6F0"><enum>8.</enum><header>Operators deemed rail carriers and employers</header><text display-inline="no-display-inline">Section 22905(b) of title 49, United States Code, is amended—</text><paragraph id="H23F1331990064128B4984BC0301BF4FE"><enum>(1)</enum><text>in the heading by striking <quote><header-in-text level="subsection" style="OLC">Operators</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Covered persons</header-in-text></quote>;</text></paragraph><paragraph id="H1D36C0F30FAE4B929E0832D38A63A324"><enum>(2)</enum><text>by striking <quote>A person that</quote> and all that follows through <quote>chapter</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="OLC">In general.—</header-in-text>A covered person</quote>;</text></paragraph><paragraph id="H80611F808504435F8468A32850E62271"><enum>(3)</enum><text>by striking <quote>as defined in Section 10102(5)</quote> and all that follows through <quote>applies</quote> and inserting <quote>only for the purposes of making it subject to the laws of the United States referred to in section 10501(c)(3)(A) of title 49, United States Code</quote>;</text></paragraph><paragraph id="HB009FA09D0B346A1AFC9B3FABFB300BF"><enum>(4)</enum><text>by redesignating paragraphs (1), (2), and (3) as (i), (ii), and (iii); and</text></paragraph><paragraph id="H8892CBF4859C4026AC5C59A59FB2215D"><enum>(5)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8B11A6810E9F4866A54A6ECA22359ADF"><paragraph id="HB65DA528D7BC424BAA426746714BAC4C"><enum>(2)</enum><header>Covered person defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered person</term>—</text><subparagraph id="HD8350EEB3837427C84F7954757EB7981"><enum>(A)</enum><text>means—</text><clause id="HADCB26C21CAA4F48B399C1E971FB62E9"><enum>(i)</enum><text display-inline="yes-display-inline">a person that conducts passenger rail operations over rail infrastructure constructed or improved with funding provided in whole or in part in a grant made under this chapter; and</text></clause><clause id="H0150BB6B4CC843D6B78313401470FD07"><enum>(ii)</enum><text>a person that performs work for, or in support of, passenger rail operations that is work performed by employees in crafts and classes recognized under section 2 of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/152">45 U.S.C. 152</external-xref>);</text></clause></subparagraph><subparagraph id="H01BDB950C48F4DA4B84D782CE6E548BF"><enum>(B)</enum><text>does not include—</text><clause id="HFF56A3D743B6463284E6EDBFD47ED933"><enum>(i)</enum><text display-inline="yes-display-inline">an employer engaged primarily in the building and construction industry (as such term is used in section 8(f) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(f)</external-xref>)) who is solely performing work as a contractor for a rail carrier;</text></clause><clause id="H0828F78CC7A84B3183C75775E5624085"><enum>(ii)</enum><text display-inline="yes-display-inline">an employer solely performing work as a contractor or subcontractor for—</text><subclause id="H61102E4AC68D4D17849C03C8CB95BD85"><enum>(I)</enum><text>a railroad that owns, uses, or is contracted to perform work on, rail infrastructure constructed or improved with funding provided in whole or in part in a grant made under this chapter; or</text></subclause><subclause id="HB3437292DB2E42E1BBC86A77236E97FE"><enum>(II)</enum><text display-inline="yes-display-inline">an operator that uses such infrastructure,</text></subclause><continuation-text continuation-text-level="clause">consistent with a collective bargaining agreement between the railroad or operator and a union representing employees in a craft or class recognized under section 2 of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/152">45 U.S.C. 152</external-xref>).</continuation-text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
