which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to ensure that publicly owned treatment works monitor for and report sewer overflows, and for other purposes.</official-title></form><legis-body id="H2ABE66EFA431426CBD6C3485724ED498" style="OLC"><section id="H3082B47FBCD144649FDC9AD700FFB11B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sewage Treatment Overflow Prevention through Community Sanitation Outreach Act of 2021</short-title></quote> or the <quote><short-title>STOP CSO Act of 2021</short-title></quote>.</text></section><section id="H745EB42B798A4517A84D5940D443AD54"><enum>2.</enum><header>Monitoring, reporting, and public notification of sewer overflows</header><subsection id="H1E0DD5303C7E4E7FAFD54D12495BAA3E"><enum>(a)</enum><header>Sewer overflow and stormwater reuse municipal grants</header><text display-inline="yes-display-inline">Section 221(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1301">33 U.S.C. 1301(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H36BBAB35659B4396892F0FCB6DD2B200" style="OLC"><paragraph id="H365009750F4F4734A055FE2009623869"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A State may use funding provided by a grant under this subsection for monitoring, reporting, and notification required under section 402(t).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H957F71A6457541EFB26B57AFFCA1C76E"><enum>(b)</enum><header>National pollutant discharge elimination system</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" id="HA9A0AD4CA9C5489BAB40E7B274A0CCC2"><enum>(1)</enum><text>in subsection (b)(2)(B), by inserting <quote>this section and</quote> after <quote>required in</quote>; and</text></paragraph><paragraph id="H0436DFBA12C94419A34461A7AE2B33B5"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H0E0227723BD840679B336FE60B3574CF" style="OLC"><subsection id="H6571C2C314294CFFB7576F0143951C4C"><enum>(t)</enum><header>Sewer Overflow Monitoring, Reporting, and Notifications</header><paragraph id="H12AD8F93021248EE8AA2E1FB7BD008A5"><enum>(1)</enum><header>General requirements</header><text>After the last day of the 180-day period beginning on the date on which regulations are issued under paragraph (4), a permit issued, renewed, or modified under this section by the Administrator (or a State, in the case of a permit program approved by the Administrator) for a publicly owned treatment works shall require the owner or operator of the treatment works to—</text><subparagraph id="H14FBE04D38A24B18952F009BC3E61C8D"><enum>(A)</enum><text>institute and utilize a feasible methodology, technology, or management program for monitoring sewer overflows to alert the owner or operator to the occurrence of a sewer overflow in a timely manner;</text></subparagraph><subparagraph id="HF594286C99FD4C15835612FC3934A3B5"><enum>(B)</enum><text>in the case of a sewer overflow that has the potential to affect human health, notify the public of the overflow as soon as practicable, but in no case more than 4 hours, after the time the owner or operator knows of the overflow;</text></subparagraph><subparagraph id="HE3EA6BF3EA3E4054A0DDB88539C1BAD0"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a sewer overflow that may imminently and substantially endanger human health, notify public health authorities and other affected entities, such as public water systems, of the overflow immediately after the owner or operator knows of the overflow; and</text></subparagraph><subparagraph id="HDBC87C2A76E94407976D35E6D2EE92FB"><enum>(D)</enum><text display-inline="yes-display-inline">report each sewer overflow to the Administrator (or the State), describing—</text><clause id="HA574B57D9FC840959224928145CD2FC6"><enum>(i)</enum><text>the magnitude, duration, and suspected cause of the overflow;</text></clause><clause id="H7E97A4BEB5C04DAEBA41F77C3C739901"><enum>(ii)</enum><text>the steps taken or planned to reduce, eliminate, or prevent a recurrence of the overflow; and</text></clause><clause id="H1D35F9CE7A00493E98C073F59C7AE770"><enum>(iii)</enum><text>the steps taken or planned to mitigate the adverse effects of the overflow.</text></clause></subparagraph></paragraph><paragraph id="H28BBD78E560B47CAAFCA7E03BE04EF3B"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The reporting requirements of paragraph (1)(D) shall not apply to a sewer overflow that is a release of wastewater that occurs in the course of maintenance of a treatment works, is managed consistently with best management practices for treatment works, and is intended to prevent sewer overflows.</text></paragraph><paragraph id="H0987D1030A6E46019762143E81FD56FD"><enum>(3)</enum><header>Annual report</header><text>In the case of a permit program approved by the Administrator, the State shall submit to the Administrator an annual report describing sewer overflows reported to the State under paragraph (1)(D).</text></paragraph><paragraph id="HC302EABEAE774A5F90B40673E79AA832"><enum>(4)</enum><header>Rulemaking</header><text>Not later than one year after the date of enactment of this subsection, the Administrator shall issue regulations to implement this subsection, including regulations to—</text><subparagraph id="HB9262596A3D447DB9367FD06CFB6DFB8"><enum>(A)</enum><text>establish a set of criteria to guide the owner or operator of a publicly owned treatment works in—</text><clause id="H9E932ABE63A04BA1899972961C79C4B5"><enum>(i)</enum><text>assessing whether a sewer overflow has the potential to affect human health or may imminently and substantially endanger human health; and</text></clause><clause id="HFCC2DFFB39104DE2A9B8FA900FE7D776"><enum>(ii)</enum><text>developing communication measures that are sufficient to give notice under paragraphs (1)(B) and (1)(C); and</text></clause></subparagraph><subparagraph id="H28BE1535E9B347CA8C6724D2792857C1"><enum>(B)</enum><text>define the terms <term>feasible</term> and <term>timely</term> as such terms apply to paragraph (1)(A), which definitions shall include consideration of site-specific conditions.</text></subparagraph></paragraph><paragraph id="H380453E38CE444CEA09B2B937E77439B"><enum>(5)</enum><header>Special rules concerning application of notification requirements</header><text>After the last day of the 30-day period beginning on the date on which the Administrator issues regulations under paragraph (4), the requirements of paragraphs (1)(B) and (1)(C) shall apply to the owner or operator of a publicly owned treatment works until such date as a permit is issued, renewed, or modified under this section in accordance with paragraph (1).</text></paragraph><paragraph id="H59509F480899430FA7AD8C794CD2313E"><enum>(6)</enum><header>Statutory Construction</header><text>Nothing in this subsection applies to a wastewater backup that will not result in a discharge into waters of the United States.</text></paragraph><paragraph id="H17FAD49BEFAB4166BA2AAAB37FEB5A28"><enum>(7)</enum><header>Definition of sewer overflow</header><text display-inline="yes-display-inline">In this subsection, the term <term>sewer overflow</term> means a sanitary sewer overflow or a municipal combined sewer overflow.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H6FDBC72AE67540DF98D21661ED9D7F6D"><enum>3.</enum><header>Eligibility for assistance</header><text display-inline="no-display-inline">Section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended—</text><paragraph id="HFEE6ADC8FC124C72B7EA7370CB2C5C67"><enum>(1)</enum><text>in paragraph (11)(B), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="HB9B6F445FA4D486C8EB65603F9899411"><enum>(2)</enum><text>in paragraph (12)(B), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H2AEAAF81BDA24911A17637D6E6CDEFCB"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2B1DAA6877704E15890E3598A51EF7F6" style="OLC"><paragraph id="H14423162631B4E98B3369811821C66B8"><enum>(13)</enum><text display-inline="yes-display-inline">for the implementation of monitoring for sewer overflows required under section 402(t).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
