which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles 23 and 49, United States Code, to streamline the environmental review process for major projects, and for other purposes.</official-title></form><legis-body id="H448D2A1CE25C491AA703CDBD117F35E4" style="OLC"><section id="H97264064AFE748EF837B2931B236ADE4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>One Federal Decision Act of 2021</short-title></quote>. </text></section><section id="H7C5E3B7911184E9DAD5178C3C168608F"><enum>2.</enum><header>Environmental reviews for major projects</header><text display-inline="no-display-inline">Section 139 of title 23, United States Code, is amended—</text><paragraph id="HE276C464919B40E4951E78B75E57649B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H6A06C33C525D4A96997B5D2BA615D0EA"><enum>(A)</enum><text>in paragraph (3)(B), by striking <quote>process for and completion of any environmental permit</quote> and inserting <quote>process and schedule, including a timetable for and completion of any environmental permit</quote>; </text></subparagraph><subparagraph id="H6E2346052E114EDBA2DEBEF953036020"><enum>(B)</enum><text>by redesignating paragraphs (5) through (8) as paragraphs (9) through (11); </text></subparagraph><subparagraph id="HDB52EED8276E489194774C59EDD476CC"><enum>(C)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (4) through (6);</text></subparagraph><subparagraph id="HA928B199000F40A48B50D9BAB4040A6E"><enum>(D)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="USC" id="H3BA664FA783345E29EA39D7E108EA7FA" display-inline="no-display-inline"><paragraph id="H178518966B3343E1949357BD67B9D93B"><enum>(2)</enum><header>Authorization</header><text display-inline="yes-display-inline">The term <term>authorization</term> means any environmental license, permit, approval, finding, or other administrative decision related to an environmental review process that is required under Federal law to site, construct, or reconstruct a project.</text></paragraph><paragraph id="H370BA0088C6F4A78822EB044EB75D888"><enum>(3)</enum><header>Environmental document</header><text display-inline="yes-display-inline">The term <term>environmental document</term> means an environmental assessment, finding of no significant impact, notice of intent, environmental impact statement, or record of decision under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7F15C8162EBA467AB1A64D160A5FA614"><enum>(E)</enum><text>by inserting after paragraph (6), as redesignated, the following:</text><quoted-block style="USC" id="HB4A6B16E2C4946E484A7D9DBDEBFB682" display-inline="no-display-inline"><paragraph id="H2795BE91072144CBB6C0F4F20828BB8D"><enum>(7)</enum><header>Major project</header><text display-inline="yes-display-inline">The term <term>major project</term> means a project for which—</text><subparagraph id="H6DB57E6500FA4615A0871C8337F0653A"><enum>(A)</enum><text>multiple permits, approvals, reviews, or studies are required under a Federal law other than the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text></subparagraph><subparagraph id="H3EEAEE75B4BF450CBF92E2A13035996C"><enum>(B)</enum><text>the project sponsor has identified the reasonable availability of funds sufficient to complete the project;</text></subparagraph><subparagraph id="H9185354ABC7E4E72A3B9BC82D3EE2D10"><enum>(C)</enum><text>the project is not a covered project, as such term is defined in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>); and</text></subparagraph><subparagraph id="HD5CDCC68312E41F385CE365C7F004A09"><enum>(D)</enum><text>the head of the lead agency has determined that—</text><clause id="H9D9F194E0A074BF58BC585211546A2F9"><enum>(i)</enum><text>an environmental impact statement is required; or</text></clause><clause id="HBAA48BA0303B45278F41C4045D38A1A5"><enum>(ii)</enum><text display-inline="yes-display-inline">an environmental assessment is required, and the project sponsor requests that the project be treated as a major project.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H59199AE3ED7A4B21ACDBED84577A7FE1"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="H4D717983A1D94422A92E161A270ED108"><enum>(A)</enum><text>by inserting <quote>, including major projects,</quote> after <quote>all projects</quote>; and</text></subparagraph><subparagraph id="H0AB00BA3F9014843BDFF646BB8A8CC67"><enum>(B)</enum><text>by inserting <quote>, at the request of a project sponsor</quote> after <quote>be applied</quote>; </text></subparagraph></paragraph><paragraph id="H4CB9FBDF217B44BB80BF5D551E1FAB9B"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H13E9EA39878B4ED9A8CB91170777C92F"><enum>(A)</enum><text>in paragraph (6)—</text><clause id="H2588961FF86040F1B203595012C7ACE0"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></clause><clause id="H67B43141051A4D8E924CD8D182A372EB"><enum>(ii)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H9E3E39389879417BA665F49F24259B44"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HA16C7664D03843DFAD9B450B7B167F84" display-inline="no-display-inline"><subparagraph id="H8F9EA7C77FDF484B85AA628FF69597E7"><enum>(D)</enum><text display-inline="yes-display-inline">to calculate annually the average time taken by the lead agency to complete all environmental documents for each project during the previous fiscal year.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HDA0F38DC3D1F466C9E270CCC7D5439AA"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H0DDB6E1B52C34D0183420831BD80567D" display-inline="no-display-inline"><paragraph id="HBCFC339D267646EEB689606F43F06F6D"><enum>(7)</enum><header>Process improvements for projects</header><subparagraph id="H06CB6335B07346238BDCC4DCE3EA6129"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall review existing practices, procedures, programmatic agreements, and applicable laws to identify potential changes that would facilitate an efficient environmental review process for projects.</text></subparagraph><subparagraph id="H057B9E5EBF9045B38465AEC8A891F8EE"><enum>(B)</enum><header>Consultation</header><text>In conducting the review required by subparagraph (A), the Secretary shall consult, as appropriate, with the heads of other Federal agencies that participate in the environmental review process.</text></subparagraph><subparagraph id="HEEAD13E3CFDC4B2A9368A173126C6AC4" commented="no"><enum>(C)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>One Federal Decision Act of 2021</short-title>, Secretary shall submit to the Committee on Environment and Public works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes—</text><clause id="H3A6C9D463A214A5C913350BA955957E7" commented="no"><enum>(i)</enum><text>the results of the review required by subparagraph (A); and</text></clause><clause id="HA5B99B38855E4D6EB573A69C2F47279A" commented="no"><enum>(ii)</enum><text>an analysis of whether additional resources would help the Secretary meet the requirements applicable to the projects under this section.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H326C790E84D344CBBE1A63D9A7464367"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="HAB7658A2AAD7485B8E85CC1058AA02DD"><enum>(A)</enum><text>in paragraph (8)—</text><clause id="HE576EC29BAC84D5CB1E57D9A54E7B112"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="USC">NEPA</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="USC">Environmental</header-in-text></quote>;</text></clause><clause id="H85428FBDF3E74927AB6B7E2AA0E884F3"><enum>(ii)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="USC" id="H8EB523097E0B499FAB4FC7E9528073D0" display-inline="no-display-inline"><subparagraph id="HEED5ECC1591A4C34844976014B0B0E3E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as inconsistent with paragraph (7), and except as provided in subparagraph (D), to the maximum extent practicable and consistent with Federal law, all Federal authorizations and reviews for a project shall rely on a single environmental document for each type of environmental document prepared under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) under the leadership of the lead agency.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HAA5F215931004EE89E8C250E7704F15B"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HAEE6D60BC5CE4FB48FF499A7F63F66D2" display-inline="no-display-inline"><subparagraph id="HED15CDCBDF4D4AA389377684D7E3113B"><enum>(D)</enum><header>Exception</header><text display-inline="yes-display-inline">The lead agency may waive the application of subparagraph (A) with respect to a project if—</text><clause id="H6C0CBD2AD8394055A2D53B7B0E197051"><enum>(i)</enum><text>the project sponsor requests that agencies issue separate environmental documents;</text></clause><clause id="H64972E55F7384839BAC2BB129BB9B23E"><enum>(ii)</enum><text>the obligations of a cooperating agency or participating agency under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) have already been satisfied with respect to such project; or</text></clause><clause id="HD5A4228CCF4F44E38230FA9DBF0F31AF"><enum>(iii)</enum><text>the lead agency determines that such application would not facilitate completion of the environmental review process for such project within the timeline established under paragraph (10).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB2B32B64965544E68070F83413A9A0FF"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H536520EB230343C68B38C1B66443EF16" display-inline="no-display-inline"><paragraph id="H8C09AC4E6910498B829FDCB2C7F1B6DF"><enum>(10)</enum><header>Timely authorizations for major projects</header><subparagraph id="H870B477D52354E05A7C15A2FFBD89BF7"><enum>(A)</enum><header>Deadline</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), notwithstanding any other provision of law, all authorization decisions necessary for the construction of a major project shall be completed by not later than 90 days after the date of the issuance of a record of decision for the major project. </text></subparagraph><subparagraph id="H97D58801E18C485883AED6704698D8EC"><enum>(B)</enum><header>Required level of detail</header><text display-inline="yes-display-inline">The final environmental impact statement for a major project shall include an adequate level of detail to inform decisions necessary for the role of the participating agencies in the environmental review process.</text></subparagraph><subparagraph id="HE740B07ED1784FB9A674331A72332695"><enum>(C)</enum><header>Extension of deadline</header><text>Not later than 180 days after the date of enactment of the <short-title>One Federal Decision Act of 2021</short-title>, the Secretary shall establish procedures for a lead agency to extend a deadline under subparagraph (A) in cases in which—</text><clause id="H1A8181B38E0449E692AF55B473ACFAE9"><enum>(i)</enum><text>Federal law prohibits the lead agency or another agency from issuing an approval or permit within the period described in such subparagraph;</text></clause><clause id="H88EF692028C2417FB10C90BA9E916601"><enum>(ii)</enum><text>such an extension is requested by the project sponsor; or</text></clause><clause id="HB5B22E11FF5749AB9DF67AF75C7AC532"><enum>(iii)</enum><text>such extension would facilitate the completion of the environmental review and authorization process of the major project.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H372F24E4B9B74AABB6671EA1CCAE3FA3"><enum>(5)</enum><text>in subsection (g)—</text><subparagraph id="H4FBFEA8F416C4E18AC7CADA358A31EDB"><enum>(A)</enum><text>in paragraph (1)(B)—</text><clause id="H6DF1D733464D44178149EDBB8B26FD7C"><enum>(i)</enum><text>by amending clause (ii)(IV) to read as follows:</text><quoted-block style="USC" id="H3C19982729AD40249903C1903FEF6AD7" display-inline="no-display-inline"><subclause id="H8637B8C6939240DAA22100FD17BF91C0"><enum>(IV)</enum><text display-inline="yes-display-inline">the overall time required by an agency to conduct an environmental review and make decisions under applicable Federal law relating to a project (including the issuance or denial of a permit or license) and the cost of the project; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HA7D14E4FBEE547CBA7EA23B8E4C3FADA"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H90540929315B485F9336D073FBA5C525" display-inline="no-display-inline"><clause id="H1A7ECF06E2A64C10A4569E6CF610B8FE"><enum>(iii)</enum><header>Major project schedule</header><text display-inline="yes-display-inline">To the maximum extent practicable and consistent with applicable Federal law, in the case of a major project, the lead agency shall develop, in consultation with the project sponsor, a schedule for the major project that is consistent with an agency average of not more than 2 years for the completion of the environmental review process for major projects. The time period measured, as applicable—</text><subclause id="H3F1BBCF8EC7B44A59114E503E4C58CB6"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of a project that requires an environmental impact statement, begins on the date of publication of a notice of intent to prepare an environmental impact statement and ends on the date of publication of a record of decision; or</text></subclause><subclause id="H9D6E0AD037E846B0AE3FCFE952546538"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a project which does not require an environmental impact statement, begins on the date of that the decision is made to prepare an environmental assessment and ends on the date of issuance of a finding of no significant impact.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HC7FEC67D31C24D929F9CD443DDC1CC70"><enum>(B)</enum><text>by redesignating subparagraph (E) as subparagraph (F);</text></subparagraph><subparagraph id="H58B3CD9B8DF84AB5AEA2F2C3ECCDD609"><enum>(C)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="USC" id="H96ABEC273F60492C9262DA5296B43F86" display-inline="no-display-inline"><subparagraph id="H468E91D451C7472DBD552BA42187A1E8"><enum>(E)</enum><header>Failure to meet deadline</header><text display-inline="yes-display-inline">If a Federal cooperating agency fails to meet a deadline established under subparagraph (D)(ii)(I)—</text><clause id="H4F5C9C6B8A6C4965B91100CD39FA9B2D"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 30 days after the date such agency failed to meet such deadline, such agency shall submit to the Secretary a report on why the deadline was not met; and</text></clause><clause id="HBF24B0DC7F624BC5918CDF6C084444CA"><enum>(ii)</enum><text>not later than 30 days after the date on which a report is submitted under clause (i), the Secretary shall—</text><subclause id="H20B9E024FDDD4BB987D5371CEAE77D74"><enum>(I)</enum><text display-inline="yes-display-inline">transmit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a copy of such report; and</text></subclause><subclause id="H5F547AFCAF564D7C8DA0A2876BA85F54"><enum>(II)</enum><text>make such report available to the public on the internet.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFC16C308A65447949A4F8D84FA725424"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H2226A9F7C2D84DC5A07CDFDAC50F531B" display-inline="no-display-inline"><subsection id="H76F41A2B3F3344E999C9F5EF16BE2279"><enum>(p)</enum><header>Accountability and reporting for major projects</header><paragraph id="HAF9DFB327F154C25AB0F47B10FF1E7DE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>One Federal Decision Act of 2021</short-title>, the Secretary shall establish a performance accountability system to track each major project.</text></paragraph><paragraph id="H153706F8282A4FAB999765D003CB7D0B"><enum>(2)</enum><header>Requirements</header><text>The performance accountability system required under paragraph (1) shall, for each major project, track—</text><subparagraph id="H18C0F7AE59124345B567F95465024971"><enum>(A)</enum><text>the environmental review process for such project, including the project schedule required by subsection (g)(1)(B)(iii);</text></subparagraph><subparagraph id="HE03C1C2980A94A6E88B72788251531A9"><enum>(B)</enum><text>whether the lead agency, cooperating agencies, and participating agencies are meeting such schedule; and</text></subparagraph><subparagraph id="H3B99FF8D950C42849D1DFEF2F0B2AD9A"><enum>(C)</enum><text>the time taken to complete the environmental review process.</text></subparagraph></paragraph></subsection><subsection id="H73D0055B85284A3D8CB560BEC8237E19"><enum>(q)</enum><header>Development of categorical exclusions</header><paragraph id="H385F2C275F1445DA9E7D72BE60E60A13"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this subsection, the Secretary shall—</text><subparagraph id="HD3460CE5D7224DF987E5EEEA7BAEB326"><enum>(A)</enum><text display-inline="yes-display-inline">in consultation with the agencies described in paragraph (2), identify the categorical exclusions established by the Federal Highway Administration that would accelerate delivery of a project if such categorical exclusions were available to such agencies;</text></subparagraph><subparagraph id="H9932CAFE8D8541DFB45E7E3F69D8CA20"><enum>(B)</enum><text>collect existing documentation and substantiating information on the categorical exclusions described in subparagraph (A); and</text></subparagraph><subparagraph id="HA08A9A0ED7444F72A3E95457DE4A50E5"><enum>(C)</enum><text>provide to each agency described in paragraph (2) a list of the categorical exclusions identified under subparagraph (A) and the documentation and substantiating information collected under subparagraph (B).</text></subparagraph></paragraph><paragraph id="H14026725892E4F7FB5AADE9661CD58D6"><enum>(2)</enum><header>Agencies described</header><text>The following agencies are described in this paragraph—</text><subparagraph id="HA7CE25969AF7453797DFF4E1A3CE2A40"><enum>(A)</enum><text>The Departments of—</text><clause id="HDED6F117D5C64A0DBECE83D1F70482F9"><enum>(i)</enum><text>the Interior;</text></clause><clause id="H5E555D5DE4FE416AAEE63541EE1B509C"><enum>(ii)</enum><text>Commerce;</text></clause><clause id="H5940BECF66C54913A92C2DF3EEA70E36"><enum>(iii)</enum><text>Agriculture;</text></clause><clause id="HBCC89B334B8D4B2DA82D31FD630E0D69"><enum>(iv)</enum><text>Energy; and</text></clause><clause id="H24CE15BC8FFC4C7087B0BFEFA35518B9"><enum>(v)</enum><text>Defense, including the United States Army Corps of Engineers; and</text></clause></subparagraph><subparagraph id="HFBEC59CAB4F34E55931A551EB0B26C17"><enum>(B)</enum><text>any other Federal agency that has participated in an environmental review process for a major project, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H04AAB5A14D0048F0892450346D80F593"><enum>(3)</enum><header>Adoption of categorical exclusions</header><subparagraph id="HA7D61B86912B4CF7A40AFF73D141E796"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Secretary provides the list under paragraph (1)(C), an agency described in paragraph (2) shall publish a notice of proposed rulemaking to propose any categorical exclusions from the list applicable to the agency, subject to the condition that the categorical exclusion identified under paragraph (1)(A) meets the criteria for a categorical exclusion under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></subparagraph><subparagraph id="HFF5EE7A8231E440C968F61957E67E734"><enum>(B)</enum><header>Public comment</header><text display-inline="yes-display-inline">In a notice of proposed rulemaking under subparagraph (A), the applicable agency shall solicit comments on whether any of the proposed new categorical exclusions meet the criteria for a categorical exclusion under section 1508.4 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE3611AA3AFE4407BBBF0AF9477371D82"><enum>3.</enum><header>Efficient environmental reviews</header><text display-inline="no-display-inline">Section 24201(a)(4) of the title 49, United States Code, is amended by striking <quote>, except that the limitation on claims of 150 days shall be 2 years</quote>. </text></section></legis-body></bill>
