which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of Health and Human Services to establish a grant program to promote comprehensive mental health and suicide prevention efforts in high schools, and for other purposes.</official-title></form><legis-body id="H9A248CC277654338877934065D743F9F" style="OLC"><section id="H038849B8E3824A3E8C5AD879224B6B84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth Mental Health and Suicide Prevention Act of 2021</short-title></quote>.</text></section><section id="H141F4F507F0743DBB56C2A04F8E73910"><enum>2.</enum><header>Coordinated promotion of high school comprehensive mental health and suicide prevention plans</header><subsection id="H22821CC4488E45E2A18EBE78DC2ACFCD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, may carry out a program to award grants, on a competitive basis, to eligible entities to enhance services for high school students with mental health and behavioral health issues that can lead to school failure, including depression, substance abuse, and suicide attempts.</text></subsection><subsection id="H73370CB8D05845FAAFCD1DE9A6286ED9"><enum>(b)</enum><header>Application</header><text>To be eligible for a grant under this section, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including, at a minimum—</text><paragraph id="HAA57D82D54B743DF984911A67D6393C9"><enum>(1)</enum><text display-inline="yes-display-inline">a description of identified mental health and behavioral health needs of high school students served by such eligible entity;</text></paragraph><paragraph id="HF7BB8427ADD541C285191F6D141244C9"><enum>(2)</enum><text display-inline="yes-display-inline">a description of existing Federal, State, local, private, and institutional resources available to address the needs described in paragraph (1);</text></paragraph><paragraph id="HDDBB34063F4444D4B434DEE4F2414C44"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the outreach strategies of such eligible entity to promote access to services, including a proposed plan for mental health equity and assisting students most in need of mental health services;</text></paragraph><paragraph id="H67F784E8A1504750A0BF29009F640777"><enum>(4)</enum><text display-inline="yes-display-inline">a description of how such eligible entity will involve, as appropriate, students and peer representatives in the planning, implementation, and evaluation processes;</text></paragraph><paragraph id="H425AA70ED42747D4924EC2EB92595056"><enum>(5)</enum><text display-inline="yes-display-inline">a description of how such eligible entity will support other students and the school community if a student dies by suicide; </text></paragraph><paragraph id="HBB9D1B1C237541F1A85F1FA1FDF8C0B3"><enum>(6)</enum><text display-inline="yes-display-inline">a plan to—</text><subparagraph id="H93FC812C6D394D92A9A695C55CEC8BFA"><enum>(A)</enum><text>implement the activities described in subsection (c); and</text></subparagraph><subparagraph id="HDDDEB7BCF50745ADAD75A4D76339A2B2"><enum>(B)</enum><text>evaluate the outcomes of such activities; and</text></subparagraph></paragraph><paragraph id="HDC1B86C590EC45EA89BAFAC665F22A38"><enum>(7)</enum><text display-inline="yes-display-inline">an assurance that such eligible entity will submit to the Secretary, for each fiscal year in which grant funds are used, a report with respect to—</text><subparagraph id="H24FF64A0F9C040EA90B393D17E235493"><enum>(A)</enum><text>the activities carried out under subsection (c); and</text></subparagraph><subparagraph id="HEA4D1CFB601A4B4584117D102F77F74B"><enum>(B)</enum><text>the outcomes of such activities.</text></subparagraph></paragraph></subsection><subsection id="HA2274E9BFDA942C1A8188BA1F4FDA28A"><enum>(c)</enum><header>Grant uses</header><text>A grant awarded under this section may only be used, with respect to high school students served by an eligible entity, for—</text><paragraph id="H20CF8873E27444989186FEC67B18F374"><enum>(1)</enum><text display-inline="yes-display-inline">evaluating existing program activities and prevention strategies;</text></paragraph><paragraph id="H288ECDBE6C364F66804F0D2CEDE45758"><enum>(2)</enum><text display-inline="yes-display-inline">educational seminars;</text></paragraph><paragraph id="H8C801FC5B2B4418CB7980D983568B30D"><enum>(3)</enum><text display-inline="yes-display-inline">educational awareness campaign materials for students, families of students, and school staff to increase the awareness of potential mental and behavioral health issues of students;</text></paragraph><paragraph id="HA9567027BEB54E7BA2BB8FBE912B767E"><enum>(4)</enum><text display-inline="yes-display-inline">peer-to-peer program support;</text></paragraph><paragraph id="H8E87BAB21086447B8A5075F4B1B8DA14"><enum>(5)</enum><text display-inline="yes-display-inline">programs that assist schools in adopting a public health approach to mental health; </text></paragraph><paragraph id="HEBF3ABA7F0FD426AB2B904237B270538"><enum>(6)</enum><text display-inline="yes-display-inline">social media applications used for mental and behavioral health purposes, such as suicide risk and mental health screenings;</text></paragraph><paragraph id="H45E998D57CB949309157B84E4BFBD31C"><enum>(7)</enum><text display-inline="yes-display-inline">providing mental health services for students through telehealth;</text></paragraph><paragraph id="H7CDC5997B2C045D4A2095BB1E754C7BF"><enum>(8)</enum><text display-inline="yes-display-inline">training programs for students and high school teachers, school leaders, and other school personnel to learn to respond effectively to students with mental health and behavioral health issues that can lead to school failure, including depression, anxiety, substance abuse, and suicide attempts; and</text></paragraph><paragraph id="H7764173823224BFE82A575FE0F1F44D1"><enum>(9)</enum><text display-inline="yes-display-inline">the creation of an infrastructure to facilitate communication between high schools served by a local educational agency or State educational agency that does not have mental health services, including health care providers who can treat mental health and behavioral health issues.</text></paragraph></subsection><subsection id="HC3E27B85420042ACA8A2877CDD4F70ED"><enum>(d)</enum><header>Matching requirement</header><paragraph id="H348EB46B3BEF4B9AA8BF38770C230697"><enum>(1)</enum><header>In general</header><text>An eligible entity receiving a grant under this section shall provide non-Federal matching funds (including funds from donations from public or private entities) equal to the amount of the grant.</text></paragraph><paragraph id="HB7A78B15909843F0BE03D51C3BF6EDFD"><enum>(2)</enum><header>Determination of amount contributed</header><subparagraph id="HFEF30B94286D47F295822A67F844D751"><enum>(A)</enum><header>In-kind support</header><text>Non-Federal matching funds described in paragraph (1) may include cash or in-kind support.</text></subparagraph><subparagraph id="H2CDBC2B25F8543ED8B55FFA756B37987"><enum>(B)</enum><header>Federal support</header><text>Amounts provided by the Federal Government, or services assisted or subsidized to any significant extent by the Federal Government may not be included when determining the amount of non-Federal matching funds provided.</text></subparagraph></paragraph><paragraph id="HDA1A0FFBC4D146EE8655366E9008F04F"><enum>(3)</enum><header>Waiver</header><text>The Secretary may waive the matching funds requirement of paragraph (1) with respect to a grant made to an eligible entity under this section if the Secretary determines that such eligible entity has demonstrated extraordinary need for such a waiver.</text></paragraph></subsection><subsection id="HC9B240ACC6CD449D92FC09E3F9F5E7DD"><enum>(e)</enum><header>Study and report</header><paragraph id="H58ED7F9351FE49A6B8C7B106CAC47BCC"><enum>(1)</enum><header>Study</header><text>For each fiscal year during which grants are awarded under this section, the Secretary shall conduct a study on the results of the grant program.</text></paragraph><paragraph id="H525C20788EA34DF9B6192F5FEAE0A2FF"><enum>(2)</enum><header>Report</header><text>For each study conducted under paragraph (1), the Secretary shall submit to Congress a report on the results of such study, including—</text><subparagraph id="H89FF5ED7188B4AA58FB6238A4292C7D1"><enum>(A)</enum><text>an evaluation of the outcomes of the grant program, including a summary of activities carried out by eligible entities and the results of such activities; and</text></subparagraph><subparagraph id="H7928918B405443D3A6C247974BBF32F9"><enum>(B)</enum><text>recommendations with respect to improving access to mental health and behavioral heath services at high schools, including efforts to reduce the occurrence of suicide and substance abuse.</text></subparagraph></paragraph></subsection><subsection id="H1BD918D14CCA4A8D9C8ECE73CE520BD9"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB9D115F339F648D7AE5EBFED4A50D9A0"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a local educational agency or State educational agency that serves at least one secondary school.</text></paragraph><paragraph id="H32897D84497D4825AAFD6FF26648D18B"><enum>(2)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>high school</term>, <term>local educational agency</term>, <term>secondary school</term>, and <term>State educational agency</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H18BCEC95C7854F71A656E5FEE2E48CDC"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, in consultation with the Secretary of Education and the heads of other appropriate agencies.</text></paragraph></subsection></section></legis-body></bill>
